My dear fellow exporters,

I am proud to inform you that the Saga of the biggest ever exposition of Indian EngineeringExpertise has been scripted in Hannover Fair 2006 with active support from 343 entrepreneurscomprising large corporates from Public and Private sectors, State Governments, Associationsand SME sector. During the exhibition, a number of joint venture agreements were signedbetween Kingfisher and Airbus, Mann Age and Force Motors, Deutsche Bahn and IndianRailways. Agreements were also signed between Indian Council for Medical Research andHelm Hotz for Research and Cooperation in areas of Bio-Technology and other medical areas.

A series of Business Summit, Conferences, and Seminars were organised highlighting onspecific topics where India and Germany can join hands together for reaping the benefitsin future. Your Council organised two seminars on “Auto Component Sector in India” and“Industrial Sub-Contracting in India” respectively. Both the seminars were well attendedfrom the German side and it was felt that both Auto component as well as Sub-contractingoffer tremendous potential for growth.

Energy was one of the focal areas in the exhibition and a bilateral Indo-German EnergyForum was formed where long term cooperation between the Germans and Indians in areasof solar and other non-conventional energy areas were discussed.

Friends, you will be happy to learn that total business generated during the exhibition wasto the tune of US$ 1.3 billion. Further an initial estimate reveals generation of serious enquiryto the tune of US$ 100 million, which is equivalent to 18% of our present level of engineeringexports to Germany.

On the visitors front, there was a footfall of more than 35,000 to the Indian Pavilion withan average visitor of 50 - 100 in each stall. Around 7000 Indian businessmen attended theexhibition as against 3000 last year.

I am happy to inform you that your Council has signed a Memorandum of Understanding(MOU) with German Engineering Federation (VDMA) for promoting and development oftrade between India and Germany.

Automechanika is the Leading International Trade Fair for the Automotive Industry. Report on Passenger Cars and CommercialVehicles in Indonesia(Continued from previous issue)

Investment barriers

Indonesia’s investment climate is poor. The World EconomicForum’s 2003 competitiveness rankings scored Indonesia 97thof 102 countries. Foreign direct investment (FDI) has declinedsteeply since the 1997-98 financial crisis and in the last few yearsthe numbers have been inflated by the inclusion of state-ownedfirms that were partially privatized. Government approvals forinvestment proposals reached $ 14.6 billion in 2003, $ 9.8billion in 2002, an adjusted $ 9 billion in 2001, and $ 16 billionin 2000. Investment proposals from Asia, North America andEurope - traditionally large investors - declined from 2002. Mostof this investment is never realized.

On January 1, 2001, Indonesia began to implement a large-scaledecentralization of authority and budget from the centralgovernment to the provincial and district-level governments.Differences of opinion between the central and local governmentsabout which has authority on certain issues has added to thelevel of uncertainty facing foreign investors. In many areas, eventhough contrary to law, local governments have institutedrevenue-raising measures (“retribusi”), which are trade-distorting.

Decentralization has complicated government efforts to improveIndonesia’s investment climate and reduce burdensome bureau-cratic procedures and other requirements on foreign investors.Indonesian law provides for both 100 per cent FDI projects andjoint ventures with a minimum Indonesian equity of five percent. Currently, BKPM and other relevant agencies in certainsectors must approve proposed foreign investments, but underthe proposed law, BKPM would be responsible for approvals inall sectors, including licences, tax incentives, and businessregistrations. The Government is considering proposing a revisedinvestment law to Parliament in 2005 that would streamlineforeign investment approval procedures.

Indonesia blocks or restricts foreign investment in some sectorsin addition to those service sectors mentioned above. Theserestricted sectors are described in the “negative list.” The mostrecent version, issued in August 2000, is based on Presidentialdecree 96, which opened some sectors, particularly certainmedical services, to foreign investment. The negative list restrictsforeign investment in industries producing marijuana, certainenvironmentally harmful chemicals, chemical weapons, andalcoholic drinks, and it closes to foreign investment casino andgambling facilities, air traffic and marine vessel certification andclassification systems, and radio frequencies. However, variousinfrastructure, airline, medical services, marine and fisheries,industrial, and other trade sectors are open to investment subjectto joint venture or other conditions.

Customs valuation

Since April 1997, the Customs Directorate of the Ministry ofFinance has operated a post-entry audit system, which reliesprimarily on verification and auditing rather than inspection tomonitor compliance. A paper-less electronic data interchangesystem that links importers, banks, and Customs was also intro-duced and is slowly being adopted. Indonesia is in compliancewith the WTO Customs Valuation Agreement but US companiesoperating in Indonesia have reported problems with Customsprocedures and valuations made by Indonesian Customs. The USgovernment continues to monitor the situation.

Import licences and restrictions

According to the Directorate General of Customs and Excise thefollowing goods are still subject to import restrictions, licensingand/or prohibition : narcotics, psychotropics, explosive materials,firearms and ammunition, fireworks, certain books and printedmaterials, audio and/or visual recording media, telecommu-nications equipment, colour photocopying equipment and partsand equipment thereof, endangered wild fauna and flora andparts thereof, certain species of fish, medicines, unregisteredfood and beverages at the Department of Health, dangerousmaterials, pesticides, ozone-depleting substances and goodscontaining ozone depleting substances, wastes, culturally valuablegoods, and other items.

Import restrictions and special licensing requirements have beenor still are imposed on other goods, such as alcoholic beverages,hand tools, artificial sweeteners, engines and pumps, tractors,rice and lube oil, although such requirements may not be consis-tently applied. The government controls the import of videotapes, laser discs and other entertainment products for bothexhibition and private use. Such goods are subject to review bya censor board.

Export controls

Like Indonesia’s import tariff regime, export controls are in astate of rapid change as the government works to implementreforms associated with the IMF programme. Many of the restric-tions and taxes placed on exports affect agricultural products,including major cash crops like rubber, palm oil, coffee, andcopra. Export restrictions and controls are applied by thegovernment to a number of food commodities, most notablycrude palm oil (CPO) which remains subject to a 5% export tax,in an effort to ensure adequate domestic availability and stableprices of such products, particularly with the weak economy inrecent years.

Import documentation requirements

The government requires the following for most imports : proformainvoice; commercial invoice; certificate of origin; bill of lading;insurance certificate; special certificates. According to the IndonesianCustoms Law that came into effect in April 1997, importers arenow required to notify the Customs Office in the first stage bysubmitting the import documents on a standard form computerdiskette. Customs Inspections of imported goods may be madeafter they are imported in the importer’s warehouse. Typically,the Indonesian importer takes care of the process.

Free Trade Zones and Warehouses/Import Provisions/Temporary Entry

The government encourages foreign investors who export tolocate in bonded or export processing zones (EPZ). There are anumber of EPZs in Indonesia, the most well-known being BatamIsland, located 20 km. south of Singapore. Indonesia also hasseveral bonded zones or areas that are designated as entree portsfor export destined production (EPTE). Companies are encouragedto locate in bonded zones or industrial estates whenever possible.Other free trade zones include a facility near Tanjung Priok, Jakarta’smain port, and a bonded warehouse in Cakung, also near Jakarta.

There is a duty drawback facility (BAPEKSTA) for exportslocated outside the zones. Producers located within the bondedareas are allowed to sell up to 15% of their product into the localmarket. Foreign and domestic investors wishing to establishprojects in a bonded area must apply to the National InvestmentCoordinating.

Labeling and marketing requirements

Food labeling regulations requiring labels in the Indonesianlanguage and expiration date (rather than the standard “best usedby” date) are in place but are not being enforced. A product regis-tration regulation is also in place that requires detailed productprocessing information so as to approach proprietary informa-tion. The registration procedure can also be quite lengthy andexpensive. Indonesian importers and US exporters have expre-ssed concern that these regulations could act as non-tariff barriersto imports of packaged food products. The market for foreignpharmaceuticals has been open since the October 1993 Deregula-tion Package. Previously Indonesia limited pharmaceutical importsto those that incorporated high technology and were the productof their own company’s research. The 1993 package also relaxedthe registration requirements for pharmaceuticals approved inother countries. Foreign pharmaceutical companies report ongoingproblems obtaining timely registration of new products from theMinistry of Health. New regulations issued in July 2000 havehelped reduce some of the backlog in new registrations.

Membership in Free Trade Agreements

As a member of the Association of Southeast Asian Nations(ASEAN), Indonesia is party to the ASEAN Free Trade Agreement(AFTA). Through AFTA, ASEAN members are phasing in a CommonEffective Preferential Tariff (CEPT) scheme, which will becompleted for most traded goods in 2003.

Research and development

Hardly any of Indonesia’s automotive parts and componentsproduction have an R&D department, thus they depend uponparent companies or technical tie-ups for complete support in thedevelopment of export parts. The R&D institutes operated by theAgency for Assessment and Application of Technology (BPPT)and the Indonesian institute of Science (LIPI) have catered mainlyto the needs of state-owned strategic industries. Their internalmanagement and procedures face bureaucratic constraints. Recentefforts to encourage them to carry out research of more relevanceto private firms, with government financial support, have notborne fruit. Due to poor funding and weak management structure,their equipment is outmoded and their staff poorly trained, paidand motivated. They are in no position to provide relevant servicesto manufacturing firms. Indonesia does not have productivitycenters to improve the productivity, product quality, deliveryand manufacturing methods of manufacturing firms.

New Tendering Law in Vietnam

Vietnams’ new Law 61-2005-QH11 on Tendering became effective

on 1 April, 2006, four months after it was passed by the National

Assembly on 29 November 2005. The Tendering Law represents

the sixth update of Vietnam’s tendering regime since 1996.

As under the old tendering regulations, the Tendering Law requires

tendering in respect of the following three types of contract :

- contracts for consulting services, such as project management;

- contracts for procurement of goods;

- contracts for construction and installation.

Like the old tendering regulations, the Tendering Law applies to

joint venture enterprises, business cooperation contracts and

foreign invested shareholding companies in which the Vietnamese

party is a State owned enterprise with a capital contribution of

30% or more. As before, such foreign invested projects are required

to put the above types of contract out to tender in accordance

with Vietnamese tendering rules.

Exemptions from the requirement to conduct tendering are available

(for foreign invested, domestic and State investment projects alike)

in prescribed cases, such as :

- due to events of force majeure and the like;

- where a foreign donor requires direct appointment of a contractor;

- where it is necessary to appoint a contractor to ensure

compatibility of facilities and technology of equipment;

- for tender packages under VND 1 billion in respect of procure-

ment of goods or for construction and installation where the

project is for investment and development; under VND 100

million in respect of procurement of goods for recurrent

procurement; and under VND 500 million in respect of

consultancy, unless tendering is “deemed necessary”.

If an exemption is available, appointment of a preferred contractor

is permissible. However, the selection process must comply with

procedures yet to be stipulated by the Government.

EEPC OFFERSCourses on International Trade and Trade Laws under WTO Framework

In partnership with Institute of International Trade, Center for WTO Studies, EEPC is launching various types ofcourses on International Trade to facilitate trade under the WTO framework from 1st June, 2006, onwards. The objective

of these courses are to enlighten and empower the businessmen engaged in international trade on the Rules of trade and theopportunities available in global markets.

Government of India has entered into various Free Trade Agreements (FTAs) and Comprehensive Economic Co-operationAgreement (CECA) with neighbouring countries in Eastern and South Eastern Asia along with the multilateral agreements

under World Trade Organisation (WTO). EEPC feels that the increased knowledge on the new dynamics of Internationaltrading and financial systems can expand the business horizon and capacity of its members.

The training programme would include various Crash Courses and Refresher Courses for one day to five days dependingon the type of Course and number of modules chosen by the participant. The programme modules are as follows :

The Course would give a background on the global economic environment, investment climate and emerging opportunities

Foreign Trade Policy, 2004-09 and Paragraph 1.1 of Handbook

of Procedures (Vol. I), the Director General of Foreign Trade herebymakes the following amendments in the Handbook of Procedures(Vol. I) :

1. Para 2.32.2 (a) will be amended to read as follows :

“Import will be allowed only from overseas suppliers who areregistered with the Directorate General of Foreign Trade andare listed under Appendix 5-B of the Handbook of Procedures.Registration will be required only for those suppliers thatdirectly contract with importers located in India.”

2. Para 2.32.2 (g) will be amended to read as follows :

“In case of any violation, the overseas supplier would bederegistered. Action will also be taken against the Indian firmwhich is importing the scrap under the Foreign Trade(Development & Regulation) Act, 1992.”

The last date for filing the applications will be 31st May, 2006.Applications can be sent by e-mail, courier, or in person to theDirectorate General of Foreign Trade, H-wing, Udyog Bhawan,Maulana Azad Road, New Delhi - 110 011.

The new system of import from registered sources will come intoeffect from 1st April, 2006. However, in cases where Bill of Ladingis dated 1st August, 2006 and before, imports will be allowed onthe basis of Pre-Shipment Inspection regime in terms of Para 2.32of the Handbook of Procedures (Vol. I), notified vide Public NoticeNo. 1 dated 8th April, 2005 and as amended from time to time.

A number of representations have been received from variousquarters seeking clarification regarding importability ofCompressors filled with non-Ozone Depleting Substances.

2. The matter has been examined by the Ministry of Environment& Forests who have clarified that “as per rule 12 of the OzoneDepleting Substances (Regulation and Control) Rules, 2000,importers of Compressors have to be registered with the competent

The Trade & Industry has represented that Customs authoritiesare insisting upon a specific licence for clearance of second handcapital goods on the premise that remanufactured goods arerestricted for import. In this context it is clarified that the saidrestriction is applicable only to remanufactured goods and not tosecond hand capital goods, which are freely importable withouta specific licence.

3. To facilitate clearance of second hand capital goods under freecategory, a declaration by the importer at the time of clearancethat the capital goods imported are second hand capital goodsand do not fall under the category of remanufactured capital goodsmay be accepted by the Customs authorities.

In exercise of powers conferred by Section 5 of the Foreign Trade(Development and Regulation) Act, 1992 read with paragraph2.1 of the Foreign Trade Policy – 2004-09, the Central Governmenthereby amends Schedule – I (Imports) of the ITC(HS)Classifications of Export and Import Items, 2004-09 as under :

1. The Licensing Note to Chapter – 87 will be amended as follows :

“Para 2(II) (e) The above mentioned provisions will notapply to the import of new vehicles :

(i) For the purpose of certification as per para (c) (i) above;

(ii) For the purpose of defence requirement.

Para 2(II) (f) : The above mentioned provisions will alsonot apply to the import of new vehicles for R&D purpose byvehicle manufacturers and auto component manufacturers.However, the vehicles imported by both these categoriesfor R & D will not be registered under the CMVR Rules inthe country and will not ply on Indian roads. The Customswill make necessary endorsement at the time of clearanceof these vehicles.

Para 2 (II) (g) : In case the country of manufacture is a landlocked country and the shipment takes place from anothercountry, the vehicles would deemed to have been exportedfrom the country of manufacture provided there aresupporting documents to track the vehicles from the countryof manufacture to the Port of Landing and from there, tothe Port of Destination.”

4. The following conditions will be added in Chapter 1A :General Notes regarding Import Policy :

“19. Import of any form of metallic waste and scrap will besubject to the provisions of Para 2.32 of the Hand Book ofProcedures (Vol-I), 2004-09.”

10. The Import Policy for the following items will be amended asfollows :
