On January 24, 2014 at 9 : 1 5PM , I was dispatched to a suicidal person on 340 street. I was advised that thisperson had called Unity Point and stated that if any came he wo uld s hoot them . All available Sac C ountyDeputy were dispatched as well as assistance from the lowa State Patrol.

lowa State Patrol District 4 Commander Lt. Rick Pierce arrived at the staging area which was located at theintersection of HWY 196 & 175. Pierce informed me that he was a trained negotiator and agreed to try andmake contact with Fertig by telep hon e. The plan was to ask Fertig to s tep outside and speak with officers.Chief D eputy B rouwer had three dep uties with him that were going to be the rapid response. They werestationed west ofthe residence.

Pierce made contact by p hone and spoke with Fertig for quite a while. Pierce relayed to me that Fertig soundeddrunk, was hom e alone, and had a shotgun with six rounds in it. Fertig did not want anyone on his prop erty ajust wanted left alone.

It was d ecided that all units wo uld back out and leave Fertig alone. I did make contact with a granddaugh ternamed N ikki. N ikki was told a bout w hat w as going on at the home and told that no one should come out, butsomeone needed to call and check on him in the morning.

On the evening of February 8, 2014 around 5 :17PM, I received a phone call from Deputy Cudaback. Cudabackinformed me that James Fertig was on the phone with dispatchers currently and the threatening to shoot anylaw enforcement officers that came to his prop erty. Cuda back stated that Fertig sounded intoxicated, and thatwe had not attemp ted to make any contact with him prior to the phone call . Fertig also stated that he wouldsho ot at any car driving by the residenc e if he though t it was law enforcem ent. I instructed C udaback that w ewould watch the area, but n ot to go to the residence unless we had to. There were no other calls from Fertigthat night.

It is a violation of lowa Code Section 708A.5 when a person threatens to com mit terrorism or the fear of theimminent comm ission of such an act. Fertig has twice in a two week pe riod threated to shoot law e nforcem ewhile un-provoked . Fertig upon his own admissions has the m eans to shoot law enforcement and admits thathe has a shotgun.

Law enforcement believes that it is in the best interest to both law enforcement and general public if any andfire arms and ammunition in the possession of James Fertig be seized as evidence for the prose cution of thiscase.
