    FADE IN:

EXT. DOWNTOWN OMAHA STREET - DAY

Omaha is a sophisticated place for post-Civil War America.

Buildings, many under construction, reach for the sky, someseven or eight stories high.

    Title: Omaha, Nebraska - 1867

The CAMERA FINDS a STAGECOACH picking its way through thecrowded street, heading toward a sparkling

    TRAIN DEPOT

which is large and new. As the stagecoach pulls up, theCAMERA FINDS the logo of the PINKERTONS on the door: an open

eye, with the slogan below, "The Eye That Never Sleeps."

Six PINKERTON SECURITY PERSONNEL, guns conspicuous, leap outand pull a LOCKBOX from the back. Two men carry it while theothers keep watch.

One Pinkerton in particular, MCELROY, 50, seems to be incharge. He has a lean, wiry frame and a weathered face. Hiseyes scan the street, sharp but calm, like a redtail waitingfor a mouse to show itself.

A railroad executive, MR. BUTTERFIELD, dressed sharply in asuit, climbs out after them and watches them do their work.

McElroy gives him a nod and the men move the box toward thetrain and disappear in a passenger car, followed by Mr.Butterfield.

    INT. TRAIN - DAY

Butterfield and his posse are the only people in thepassenger car. Once the train starts to move, Butterfieldopens the box, which has a seal from the Central PacificRailroad.

Inside reveals stacks of GOVERNMENT BONDS.

    EXT. TRAIN DEPOT - DAY

The train heads west. Butterfields car is the only one forpassengers in a train filled otherwise with rails, woodenties, coal, boxes of supplies...

  • 7/31/2019 310 To Yuma (2004.09.15)

    3/112

...the train blows black smoke into the night, surrounded bythe stars and open plains...

...and we notice, if only gradually, the music turning alittle less festive, a little more ominous as the train moves

further and further into new Americas heart of darkness.

It cuts through North Platte, Nebraska, a town the Eastern *press aptly nicknamed Hell on Wheels.

Butterfield looks out and sees an ARMLESS MAN in a Unionuniform, sitting on the platform, his BUDDY pouring somethingfrom a bottle down his throat.

EXT. EVANSTON, WYOMING TERRITORY - DAY

The train pulls into the EVANSTON TRAIN DEPOT, which consists

of nothing more than a platform and the framing of a stationunder construction.

Beyond the platform, the rails end, and we realize this isthe literal end of the line. For a half mile toward themountains, wooden ties lie flat, waiting for their rails.

Surrounded by the Pinkertons, Mr. Butterfield steps out andlooks around. As each train depot has gotten newer andnewer, each town has gotten worse and worse.

Ahead, Butterfield watches the laying of the rails. A loadof steel is pulled by a horse on the track to the end, where

four IRISH WORKERS pull a rail off and drop it into place.Just then SPIKERS and BOLTERS swing their hammers, nailingthe metal down. This all happens in 30 seconds and is quiteimpressive.

The constant PING of the sledgehammers is everywhere.

Behind Butterfield, the engine of the train is detached andit moves forward onto another track which sits on a CIRCULARPLATFORM. Here, 20 more IRISH WORKERS are waiting, eachstanding in front of a steel bar extruding from the circularplatform.

Once the engine is in place, they all start to push, slowlyrotating the engine on the giant TURNTABLE. Itsbackbreaking work and the train rotates slowly, like the hourhand on a giant clock.

EXT. MAIN STREET - EVANSTON - DUSK

A pair of STAGECOACHES roll up, each driven by a singleDRIVER. But these arent like any stagecoaches weve seen

before. Built onto the back of each is a platform surroundedby a rail about chest high.

McElroy and his Pinkerton men load the box into a coach andthen climb up on to the platforms, two on the back of eachcoach, one with the driver.

McElroy takes a seat by one of the drivers then looks back towatch his men get into position. They lean against the railwith their chests and hold their guns on the outside of it.Now we realize what its for: so they can shoot and hang onat the same time.

Butterfield nods at the driver next to McElroy, BILL MOONS.

    MR. BUTTERFIELD(re: the other driver)

    Bill, whos the new driver?

BILL MOONSMy brother, Edgar. He knows theroute to Contention even betterthan me.

    MR. BUTTERFIELDThen lets go.

With that, Bill and Edgar Moons clap their reins and the twocoaches race west toward the mountains and the setting sun.

    EXT. MOUNTAIN TRAIL - DAWN

Miles from anywhere, the two stagecoaches race down a bumpymountain trail, a desolate valley spreading in front of them. The guards on back are still alert, guns at the ready, eventhough they traveled all night.

The valley is a few miles long, and it is bookended byfoothills. The coaches hit the base of the valley and driveon toward the foothills on the other side.

High on a hill above the trail, watching, are the fiveroughest men youve ever seen. Two white men, CRENSHAW andDARDEN, a Mexican, CAMPOS, and a Chinese man, WU.

And saddled on a horse in the middle of them all is theirleader, BEN WADE.

    3.

  • 7/31/2019 310 To Yuma (2004.09.15)

    5/112

He watches the coaches move along the trail. Unmindful, hepulls a STRAIGHT RAZOR from his belt and scrapes it over hischeek, over and over in the same place, thinking.

Hes a handsome guy, but one youd better approachcautiously, like a dog with a bone.

Crenshaw nods at the other end of the valley...

CRENSHAWWe better not let them get to the *foothills. Theyll be able tohunker in.

The rest of the gang look curiously at the souped-up coaches.

DARDENLook at the gun platforms on back.

    WU(knowing)

    Pinkertons.

Wades eyes survey the situation. The two well-armed coachesare not going to be easy to stop.

Ben scans ahead on the path, where through the rolling hillsbelow he spies a small HERD OF CATTLE.

Carefully, he folds the razor and tucks it into his frontshirt pocket.

    WADEPinkertons bleed red too. Hyah!

And with that, Ben Wades gang is off, thundering down thehill toward the unsuspecting coaches.

    IN THE VALLEY:

The Pinkerton men stare out as the coaches bump along thetrail, kicking up dust behind.

Suddenly, GUNSHOTS ring out and on the second coach, next tothe driver, the guards head explodes!

He topples over, where his legs get tangled up on thesaddlebar, half hanging out of the side of the coach.

McElroy, on the other coach, spins in his seat, trying todraw a bead on whoevers firing the shots.

    4.

  • 7/31/2019 310 To Yuma (2004.09.15)

    6/112

On the back of the coach, the two guards now see the horsesfollowing them through the dust and open fire...

Ben and his gang scatter, weaving in and out of the rollinghills, making for tough targets. Ben races alongside Wu and

Campos, keeping the hills between them and the coaches.

On the back of the rear coach, the Pinkerton men use thesupports for balance, and fire quickly at the bandits.McElroy scans the situation.

    MCELROY(to Moons, the driver)

    Get us into those hills!

The foothills that mark the end of the valley areapproaching, and Moons gives the horses an extra slap.

    MCELROY (contd)(to his men)

    Dont let them flank off!

Ben Wade and his men give chase, but whenever they emerge toget a shot off, the Pinkertons open fire and pin them backdown.

Ben looks around, sees the hills getting closer... as doesMcElroy. Both men know if the coaches can get to those hillsthis will be a very different fight...

Ben spurs his horse, avoiding the gunfire from the

Pinkertons, and breaks off the trail...

    UP AHEAD:

At the base of the foothills, a hundred head of cattle lollabout, lazily looking for grass in this barren parcel of landin northern Utah.

Two boys, WILLIAM, 16, and MATTHEW, 8, ride their horses, trying to herd the cattle together, which are scatteringabout as fast as they can round them up.

While Matthew is excited to be doing a mans work, Williamlooks out at the valley, bored as can be.

Just then, a rancher, DAN EVANS, with intelligent eyes and alot of hard work etched into his face, appears from over thehill.

The look on his face tells us everything: these are roughtimes to be ranching in northern Utah.

    5.

    7/112

    DAN(yells)

William, I thought you were gonnaget this herd back to the pen!Theres nothing here for them to

    eat.

The steer are slowly starving to death; their ribs stick outthrough too-skinny flanks.

    Dan points at the herd.

DAN (contd)Move up around the outside thereand start leading em home.

    WILLIAM(mumbles)

Not like theres anything to eatthere either.

    DANWhats that?

    WILLIAMNothing, sir.

BOOM! A distant blast of dynamite echoes through thevalley...

    DAN

Thats the railroad blastin.Theyre getting closer.

Matthew looks over away from the herd.

    MATTHEWPa!

He nods and his father turns his eyes to follow the boysstare...

About thirty yards away, they see a small, malnourished CALF

trotting over a hill, all by itself.Dan looks over at William.

    DANGo get him, William.

William spurs his horse and trots away.

    6.

  • 7/31/2019 310 To Yuma (2004.09.15)

    8/112

    OVER THE HILL:

The boy crests the hill and spots the calf, loping off.

He steers his colt over and stops in front of the cow, staring into those lifeless dark eyes.

Like a flash, William draws his gun and points it at the cow, which just sniffs at the dirt, looking for something green.William looks bored enough to shoot the cow, just to bringsome excitement into his life...

Finally, William shoves his gun back into his holster.

    WILLIAMCome on you stupid cow.

    BACK TO:

    OVER THE HILL:

Dan and Matthew work their horses around the herd, gatheringthem in a group.

Suddenly the SOUND OF HOOVES startles them both, and theyturn to see Ben Wade racing his horse at them, gun drawn.

    BAM BAM BAM!

Ben fires a few shots that startle the herd, sending themrunning away from Dan and Matthew!

    DANWhat the hell...

But Ben pays no attention to them and races by, scaring theherd more and leading them over the hill where Williamrode...

    CUT TO:

    OVER THE HILL:

William spins as he HEARS THE SOUND OF THUNDERING HORSEHOOVES right on top of him.

He just has a second to look up, because baring down on himare two out-of-control stagecoaches with a gang of banditsflanking it!

    7.

  • 7/31/2019 310 To Yuma (2004.09.15)

    9/112

William jumps his horse out of the way just as the coachesbarrel past him like a meteor and continue down the trail.

Where all of a sudden Dans herd, now spurred on by Ben Wade, appear in the trail in front of the coaches, cutting right

    into their path...

WHAM! Hooves, hides, horns and wood go flying as the leadcoach, Butterfields coach, smashes into the cows and slidesoff its two back wheels, whipping to a stop in the dirt!

The trailing coach manages to just miss the herd and tipscrazily as it tries to continue on, the violent turn knockingthe men on back off balance.

Wu and Campos split from the others to follow the secondcoach, and with a couple of shots from each, they blast thedefenseless guards off the back.

The two outlaws easily catch up to the now unprotected coachand race alongside it.

Wu holds up a thick piece of hickory, which he shoves intothe spinning spokes of the back wheel! With a CRACK thewheel disintegrates and the coach topples, spinning like atop before finally coming to a stop.

    AT THE FIRST COACH:

The coach is destroyed, literally ripped to splinters.

Crenshaw and Darden push their way through the spooked cowsthat survived.

Finally they find the two Pinkerton men from the back of thecoach, both defenseless in the dirt. Without a secondthought, they shoot the two Pinkertons in cold blood.

Bill Moons crawls up through the splintered wood and throwsup his hands, and Crenshaw and Darden remove his pistol belt.

    CRENSHAWTheres one missing.

Darden kicks over a chunk of wood revealing McElroy, dead, asharp splinter of wood protruding from his chest.

Darden gives the chunk of wood a kick, which allows moreblood to seep from McElroys chest.

    DARDENNot anymore. Hes dead.

    8.

    10/112

    AT THE SECOND COACH:

Campos and Wu leap off their horses, and guns drawn, lookthrough the dust and wreckage for the driver, Edgar Moons.

Campos looks under a large chunk of the stagecoach and issurprised to find Edgar there, waiting, a gun drawn.

    EDGAR MOONSDrop that pistol.

Reluctantly, Campos does, just as Wu comes around thewreckage.

    EDGAR MOONS (contd)(to Wu)

    Ill kill him.

    Wu nods calmly.

    EDGAR MOONS (contd)Come on.

    AT THE FIRST COACH:

Wade watches Darden and Crenshaw pull an unhurt but pissedButterfield from the wreckage of the first coach. They standhim by Bill Moons.

    MR. BUTTERFIELD

What the hell do you think youredoing?!

    WADE(ignoring him, to his men)

    Find the box.

They do, and unload that case of government bonds.

    ON THE HILL:

Dan and Matthew make their way toward the wreck. They arejoined by William, all stunned at what they are seeing.

    WILLIAMDad...!

    DANShhhh.

    AT THE STAGECOACHES:

Ben Wade kicks open the box and looks at all those governmentbonds. Crenshaw lets out a low WHISTLE.

MR. BUTTERFIELDThosere government bonds. Theyreworthless paper to you!

WADECrenshaw, whats that bankers namein Kansas City? The one who givesus 95 cents on the dollar?

    CRENSHAWSmith.

    Wade turns to Butterfield.

    WADEThats right. Smith.

(smiles coldly)Now I dont suppose thats his realname, do you?

Butterfield stares back at him, incredulous. Just then, theres a CLICK behind Wade.

The three outlaws turn to see Edgar Moons with a gun toCampos head.

Wade stares him down, calmly, while Moons looks them over, equally steady.

EDGAR MOONSWho the hell are you?

WADEThe last person youll ever see.

Moons is a little taken aback by the strength and confidencein Wades voice.

EDGAR MOONS(to Wade, now a littlenervous)

Tell your men to drop their guns.

    Bill interrupts...

    BILL MOONSWhatre you doing, Edgar?

    10.

    BILL MOONSThis aint our fight.

EDGAR MOONSI said to shut up.

(back to Wade)Do as I say, mister. Have em dropthem belts. Now!

But Wade completely ignores him, still looking at hiscaptured man, his eyes as cold as weve ever seen.

    WADECampos...

Campos face is filled with fear. Like disappointing BenWade is worse than a gun to his head.

With that, Wade whips his revolver out of his belt quick aslightning and FIRES, shooting his own gang member right inthe stomach!

The Mexican doubles over, leaving the driver exposed.

BAM! Ben fires a second shot, blasting Edgar Moons away.Bill Moons recoils, shocked at watching his brother go down.

When the ECHO of the shot is gone...

    WADE (contd)(to his men)

Were only as strong as ourweakest.

The men look at Wade with respect, almost reverence, aseverything is still for a moment, but then the sound of aHORSES WHINNY comes from a hill behind them.

They all turn to see Dan, William, and Matthew watching them.

Wade nods at his gang.WADE (contd)

    Load up the lock-box. *

And then Wade rides over to where Dan stands with his sons.

    WADE (contd)(coldly)

Can I help you with something?

William, Matthew and Dan all dismount to the ground. Wadenods, gathers the reins, and rides back...

    DOWN THE HILL:

...to where his men are strapping the lockbox to Wus horse.

Butterfields face is all red, in a huff, and Wade noticesthat Bill Moons is crying.

    WADEWhats wrong with him?

    MR. BUTTERFIELD(angry)

    You killed his brother.

Wade nods, walks over to Moons.

    WADEWhats your name, cowboy?

    MOONSB-Bill Moons.

    WADEWhere do you live?

    MOONSContention City.

WADEThen bury him there. A man shouldbe buried where he lived.

Wade starts to move off when Butterfield speaks up, in ahuff.

MR. BUTTERFIELDNow, wait a minute, mister...

    WADE

    Whore you?MR. BUTTERFIELD

Names Jim Butterfield. And I haveassurances from the railroad thatany trouble from bandits will bemet with --

Wade looks out over the land, ignoring Butterfield. It maynot be much, but the open country is his.

    WADEThat your railroad blasting?

MR. BUTTERFIELDThats the sound of progress.

Wade shakes his head and spits in the dirt.

    WADEProgress... *

With that, he spurs his horse and he and his gang gallopaway.

    UP THE HILL:

Dan watches Wade and his men ride off.

DANLets get the herd rounded up.

    DOWN THE HILL:

They walk down toward the wrecked stagecoaches and startmoving their cattle, working like an efficient team.

EXT. TRAIL TO BISBEE - DAY

Ben and his gang gallop all in a line, like a well-trainedcavalry.

The way they hold their heads, the way they sit straight upin the saddle, tells us everything we need to know: thistrail, this town, this country belongs to them.

EXT. BISBEE MAIN STREET - DUSK

They ride right down the middle of the main street, turningheads all the way.

Bisbee is a nice little town, doing its best to put on agood face. It serves as the county seat to almost a thousand

people living in the basin and trying to make it as farmersor ranchers.

Wade and his men ride by a few MEN who are takingmeasurements and shoving sticks with red tassels tied to theminto the ground. A fancy railroad sign announces it as thefuture site of the BISBEE TRAIN DEPOT.

The gang stops in front of the nicest building in town, wherethe sign says WYMANS.

    INT. WYMANS - DAY

The inside of this place is large, with ten tables and a longbar running down the wall. A painting of a nude woman gracesthe wall behind the bar, and in the corner is a BARBERSCHAIR.

Wade and his men enter and sit at the bar, where they findKATIE, a woman who is about 30 and still beautiful eventhough life has not been easy.

She immediately places shot glasses before the men and startsfilling up glass after glass with a bottle of rot-gut.

    Wade holds up his drink.

    WADEHeres to my outfit.

They all hold up their glasses.

    15.

    17/112

WADE (contd)Were one man stronger and ahelluva lot richer because oftoday.

Katie starts to fill up his drink again as another woman, *MOLLY, shuffles into the bar from a back room. She is *covered in a layer of dirt mixed with sweat and grime. *

She sizes up the men before zeroing in on Wade. *

MOLLY *You the leader here? *

Wade looks at Katie and smiles. *

    WADE *Nope. He is. *

    He points at Darden. *

    MOLLY *(to Darden) *

They got rooms for rent in back.

Darden looks her over, while CRENSHAW rubs a thick scar that *runs from his eye down to his chin.

    CRENSHAWBe careful, Darden. *

DARDEN *(with an Irish lilt) *

You can finish her off when Im *through. *

With that, he winks a thanks to Wade and takes her wrist *leading to a door in back. Wade turns to Katie. *

    WADEWhats your name?

    KATIE

    Katie.WADE

Well Katie, were cattle herderswho just dropped off our lot backin Nueves. I was wondering ifthere was a Marshal in town?

    16.

    18/112

KATIEThere is, but not much happensaround here. I imagine hes havinghis nap.

WADEWhat about you? When do you nap?

    She blushes.

KATIEUsually not until three or four.

    Wade locks eyes with her.

WADEI guess I came too early then.

She smiles, neither of them looking away.

    CUT TO:

    EXT. DANS RANCH - DAY

Dans ranch is humble and small and smells like struggle.Hes built an unflattering house which stands next to asparse, unpainted barn.

In front of the house is a large pen used for cattle, andfrom there a dirt trail runs down the hill, across a dry

creek bed and toward the brown valley.

Dan and his sons lead the cattle up the trail and toward thepen, expertly herding them through the gate.

One skinny steer stumbles into the wooden boards and then *drops on its side, its tongue lolling out of the side of its *mouth. Dan just stares at it, hard, like things cant get *any worse. *

He grabs it by the legs and drags it toward the barn as the *boys rustle the last of the cattle into the pen. *

Dans wife, LORENE, appears in the doorway. Shes pretty, but tired. Running the ranch is a non-stop job.

She immediately can tell something is wrong and meets Danhalfway.

    LORENEWhere are your horses? *

    17.

  • 7/31/2019 310 To Yuma (2004.09.15)

    19/112

Frustrated, Dan gives up on the dead steer and walks toward *the barn. *

DANA stagecoach was held up by the

    west pass. *

    INT. BARN - DAY

There are a few horses in here, and Dan starts to saddle *them up as Lorene walks in. *

    LORENEAre you okay? The boys?

DANWere all fine. They killed some

    railroad men, though.

Lorene is very concerned and William and Matthew come inbehind them, excited...

MATTHEWIt was a shootout, ma! First thelead bandit used our cattle to stopthe coaches and then the driver gotahold of this Mexican and wasusing him as a shield, but thebandit just shoots right throughhis own man, bang! ...so he can get *

a clean shot at the driver.

    LORENE(to Dan)

    My god. Whatd you do?

Dan ignores her and continues to work on the saddle.

William stares at him, then speaks up without taking his eyesoff his father.

    WILLIAM

    Nothing. We did nothing.DAN

(snaps)Thats enough! You and yourbrother tend to the chicken feed.Get on...

William lowers his eyes and walks out of the barn, followedby Matthew.

Dan starts gathering up rope and equipment, stuffing asaddlebag.

    LORENEThats terrible. With the boys

    watching.

    DAN(still hot)

Whats terrible is having nothingbut a dried up creek. Whatsterrible is fifty head of cattleall starving to death.

Dan grabs the packed saddlebags heads outside, Lorenefollowing.

    EXT. DANS RANCH - CONTINUOUS

Dan walks over to the horses, which are busy drinking from atrough. Theres barely enough water in it to just fill thebottom.

DANI went over to Charlie Brettsplace this morning. He said sixmonths water rights costs twohundred dollars.

Lorenes face falls... its written on every crease: they

dont have that kind of money.

Dan puts his fingers in the trough... just the tips get wet.He looks at the wet fingers for a moment, then shakes hishead and climbs back on the horse.

    LORENEDan --

DANIll be back as soon as I can.

He pops the reins on his horse and gallops off, leading thepair of bays in tow.

    EXT. CHICKEN PEN - DAY

William scatters chicken feed across the dirt pen as skinnybirds peck the earth around him.

    BACK TO:

    INT. WYMANS - DAY

Ben, Crenshaw and Wu sit at the bar, drinks in front of them.A MARSHAL, competent and honest looking, leans on the barnext to Wade. Katie watches their exchange from down the *bar. *

MARSHALHow far back ya say it was?

WADEOh, must be bout twenty miles. *

Looked like they were heading forthe mountains to the west.

MARSHALDamn. And why didnt you fellastry an help?

WADELike I said, we didnt see it tilwe were looking back.

The Marshal nods and heads out. Wu leans into Wade. *

    WUYou want us to scatter?

    INSIDE THE COACH:

On the other side sits Nate, carrying a pistol, and Mr.Butterfield.

    IN FRONT OF DANS RANCH:

The trail crosses that dried up creek-bed in front of Dansranch with a makeshift BRIDGE -- really just a few planks ofwood -- spanning the gap.

The stagecoach slows to go over the planks, but suddenly, itskids out and one of the wheels drops down and wedges in therut.

    ON THE HILL:

Wu, Darden, and Crenshaw stop and watch as some of the menjump off their horses to try and lift the coach out of theditch.

Wade grins, waiting for the inevitable as Nate andButterfield climb out.

    IN FRONT OF DANS RANCH:

GERVINDont matter. That water goesunderground a mile down.

    BAM! A gunshot.

Startled, Huacha and Gervin turn to Vargas, whos holding asmoking gun. He just shot a hole in Williams hat below.

    VARGAS(smiling)

    Conseguido lo.

Satisfied, the three head back down to their horses.

As they pass the wall of cactuses, the CAMERA HOLDS on the

    gnarly mass... no way...

...and then we see it, a bloody, wounded face, hiding in theworst possible place, waiting for the men to leave.

    LATER:

A torn-up, bloody hand moves to the cliff ridge, followed byanother, and then William peeks down over the canyon. Hesees the three men that chased him at the bottom where theyare joined by the other men from Wades gang! They are

looking at his hat, pointing at the river, when...Suddenly, a shadow falls over William. He turns, expectingthe worst, only to see...

    ...his horse.

The horse leans down and nuzzles him. Hes still badlyscared and shaken, but he struggles to his feet. Hesliterally been shredded by the cactus.

    OTHER SIDE OF THE GORGE:

The gondola makes it to the other side of the canyon.

As soon as everyone is safe on the other side, McElroy startswalking toward Wade, anger on his face and his pistol drawn.

He gets right up next to him, but points his pistol up at thecable, which is hanging just a few feet above his head.

    BAM!

The cable snaps. With a tremendous clashing of metal, theplatform crashes down the rocky side of the gorge until itdisappears below.

They all look across at Wades outfit, little specs on the

    other side of the gap.

    ON THE OTHER SIDE:

The remaining bandits turn their horses around and gallopback the way they came.

    ON DANS SIDE:

Dan turns to his son, who averts his eyes.

    DANAre you okay?

    WILLIAMI... I couldnt do it.

Dan puts a hand on Williams shoulder. His first gesture ofaffection. William finally looks up at his father.

This seems to get to Wade. He blinks a few times.

    WADE(sincerely)

    Im sorry. I didnt know.

The two men hold eyes for a second. William speaks up...

The woods are starting to thin.

    EXT. MOUNTAINS - DAY

Through a mountain pass we see where a strip of massive pineshas been cut, making way for the rails that are coming. The

trail they are following is nothing but the jagged stumps ofcleared trees.

Dan and his team come across a group of CHINESE GRADERS whoare working the strip. Its backbreaking work, shovelingdirt from the proposed track line and creating an embankment.

Dan, William, Doc and Wade ride past them, arousing nothingbut blank looks from the workers.

    EXT. BLASTING CAMP - DAY

The blasting camp consists of a few Central Pacific buildingssurrounded by smaller dwellings for the workers. Itspopulated entirely by CHINESE, working like ants, each withan unspoken task at hand.

Dan, William, Doc and Wade ride into camp, the mouth of aTUNNEL dead ahead of them at the other end.

William is shocked by what he sees. Outside of the companytents, the rest literally looks like a small Chinese villagehas been dropped in the middle of northern Utah.

The workers wear the hats of the workers in the rice paddies

around the world. Men cook over open fires with woks insteadof kettles. Even the temporary tents have been decoratedwith Chinese silks and characters.

The workers themselves are tiny, skinny, and beat to hell. There are no smiles and very little conversation between theChinese. Its as depressing as anything these men have everseen.

In front of them, the tunnel is blasted into the side of themountain. More Asians stalk in and out of the tunnel, movingexplosives and tools in, buckets of rocks and dust out. Theoccasional rumbling BOOM from inside the mountain is a

reminder of whats going on in there.

Doc is really hurting. Hes pale as a ghost and sweatingprofusely. William notices how bad he looks.

    WILLIAMDoc?

DOC POTTERIm fine. We gotta keep moving.

    GERVINIts the boss!

Between the tents, Gervin has located them and is shoutingout to the rest of Wades outfit.

    DANStay with me. Hya!

    APPROACHING QUICKLY:

Wades gang spurs their horses after them, hell-bent onfreeing their boss.

But they werent counting on the Doc...

He throws himself at Gervins horse, which recoils back, kicking and bucking wildly, knocking him off his horse.

Dan just barely has time to look back as Wu reaches thecommotion, and BAM! BAM! BAM!

...fires point blank into the Doc, killing him instantly! AsGervin re-mounts...

    THROUGH THE CHINESE TENTS:

Dan has the reins for both he and Wades horse and he spursthem on as William stays close behind.

    TOP VIEW LOOKING STRAIGHT DOWN:

Like mice navigating a maze, Dan weaves his threesome aroundtent after tent.

Expert horsemen all, Wades outfit weaves after them, tryingto cut them off.

The Chinese workers dash out of the way as their cooking woksand supplies get scattered under the horse hooves.

    AT THE BLASTING SITE:

Dan and William guide Wades horse out of a row of tents andgallop straight out into the BLASTING AREA -- where theChinese workers are dynamiting enormous sheets of rock.

Just as they ride past a striated rock face, BOOOM! A giantEXPLOSION sends gravel flying right behind them!

Wades gang has to fight to stay on their mounts as they ridethrough the debris in front of them. Like ghosts, they comeout the other side, covered in dull gray soot.

With a little bit of distance now between them...

    MAIN STREET:

...Dan, Wade, and William burst out on to the main street.

    DANHead for the tunnel!

He immediately steers his horse that way. Williams horse

almost stumbles making the quick turn, but rights himself andgallops after the others.

Behind them, Wades outfit tears out on to the street, pistols up, SHOTS CRACKING.

    William smiles.

    BEHIND THEM:

Gervin is the fastest of Wades gang, and he gallops rightthrough the flames without breaking stride. The rest ofWades gang does the same, charging through the fire likedemons from hell.

    UP AHEAD:

The other side of the tunnel is coming up fast... after that,

    who knows?

Now Gervin is right on his heels, and, desperate, Dan leansdown over the side of his horse and scoops up a PICK-AXE likea polo player.

Like a windmill, he makes contact with a wooden support beam,CRACK!

And the roof starts to cave in from above.

Dan barely makes it through the dust and debris that allcomes crashing down at once!

Gervins not so lucky... he takes the brunt of the collapse, three tons of earth right on top of him!

    BEHIND THE WALL OF EARTH:

Wu and the rest of the gang have to pull up their mounts asquickly as they can to avoid crashing into each other.

    OUT THE TUNNEL:

William, Wade, and Dan come barreling out the other end ofthe tunnel, dust and debris chasing them out.

Later, the horses crest a hill and get a look down the tracksinto a valley, where CONTENTION sits, the dark blister of the

city tucked up against the mountains, just below them...

From here, we can see that a SHANTY TOWN spreads out fromContention. And on the other end of town, we can see thehalf-built TRAIN DEPOT.

Also surrounded by the tents and lean-tos are a large CATTLEPEN and an IRONWORKS PLANT.

It is a bleak existence, even from Dans view looking down ashe and the others emerge from the mountains.

    WADE

This the civilization you want sobadly, Dan? Contention City?

Dan looks at him, and we can see the doubt and disappointmentin his face. William picks up on this.

EXT. MAIN STREET - CONTENTION CITY - DAY

Dan and William ride with Wade through the town. The town isfairly new, but it was thrown up so fast its alreadystarting to fall apart. Paint is peeling and buildings leanon their foundations.

The INHABITANTS of this town are not in any better shape. Many are Chinese, but there are a fair share of Irish too.And there are hardly any women.

There are two types of men here: those who work for therailroad and those who live off swindling or stealing fromthose who work for the railroad.

Theyre on the second floor, with a view looking out over all

the filth that is Contention. At the end of town, the half-built train depot is visible, but theres no train yet.

Inside, the room is fairly large. A small stove sits in thecorner, throwing out a little heat. Wade sits down on thebed, hands still bound.

DANI couldnt find the hotel manager,so I left a note and took this key.Sit tight here while I go find theMarshal.

He looks at Chavez and Watts.

WUYou two make sure no one gets onthat train.

They nod and run off toward the depot.

    INSIDE THE ROOM:

Dan picks up his rifle and looks at that logo of the U.S.Army. He hands it to William.

DANWere going to have to work our wayaround to that train. We dontwant to get there too early orwell be sitting ducks. Bepatient. Think your way throughthis.

William examines the rifle and nods.

    WILLIAMYes, sir.

DANThen I guess we better get on withit.

Dan nods at the little stove and starts unbuckling one of hisbullet belts.

    IN THE STREET:

The glass shatters and bullets explode in the street likesomeone in the window has opened fire.

Everyone scrambles for cover not knowing whos shooting atwhom.

    IN THE ROOM:

The bullets in the stove whizz out like someones cranking a

    Gatling gun.

    OUT THE BACK DOOR:

Dan, Wade and William throw open the back door and movequickly along the back balcony. Dan has Wade right up closeto him the whole time, gun in his back.

They get to the end of the balcony and all jump over to theroof of an adjacent building, moving quickly.

    ON A NEARBY ROOFTOP:

Crenshaw climbs on the roof of a building across the street, still looking at the window where all the gunfire is comingfrom.

But something catches his eye on the roof of an adjacentbuilding... Dan and William sneaking away with Wade!

    CRENSHAW(shouts)

    Theyre usin the rooftops!

He turns and aims his rifle at them, but...

...Crenshaw takes a shot to the heart.

He flops straight down, his body slumping over, dying on asooty rooftop in a god-forsaken town, his dead eyes lookingout over the dirty alley.

    IN THE STREET:

But everyone below has been alerted...

    VOICESUp on the rooftops!

They fan out to chase after Dan and William, guns firing

    indiscriminately.

    ON THE ROOF:

William and Dan push Wade across and take a look over theedge.

BAM! Wood splinters by Dans head, but he sees all he needsto see: men climbing every ladder and stairway they cantrying to come up after them.

    WILLIAM

    Over here!

William points at a BELL TOWER that sticks up along the sideof the roof. Dan nods and he and Wade join William next toit.

Without thinking twice, William jumps for the ROPE that runsfrom the ground up to the bell. The bell GONGS as he slidesdown the rope to a platform below.

WADEHow do you plan on getting me to go

    down there?DAN

    Like this...

And with that, Dan gives Wade a shove over the edge towardthe rope! Even though his hands are bound, Wade is able grabon and slide down, the bell RINGING the whole way down.

DANLets get out of the open.

    WILLIAMWhere?

Dan points to the shanty town.

    DANWe can hide in there.

WADEAs long as no one recognizes you asa quick hundred bucks.

DANOpen your mouth in there and itwill be the last thing you ever

    say.

They quickly move down the alley and into the

    SHANTY TOWN

The three move quickly, weaving in and out of the tents, doing their best to make their trail impossible to follow andalso not make eye contact with anyone.

More MEN with guns rush right by them, unaware their targetsare so close.

    IN THE ALLEY:

Two gun-toting IRISH LOCALS watch our three disappear intothe shanty town. They look at each other, smile, and followthem in.

    CUT TO:

    IN THE SHANTY TOWN:

Its just one shitty tent after another. They all look thesame, and they seem to go on forever.

Dan, William and Wade move quickly, just seconds ahead of thetwo Irishmen.

They move through a walkway and then pop out right in frontof a CHINESE KID, no more than 13, holding a pistol! Thethree stop dead in their tracks.

The kid starts jabbering in Chinese with the gun pointed atthem.

    WILLIAMWhats he saying?

WADEHes making a list of things to buywith all that money.

Dan holds his gun out in front of him.

    DAN(to the kid)

Were not going to hurt you. Illput this down...

He starts to bend down and put his gun in the dirt. The

Chinese kid is still talking away.

Just then, the two Irishmen appear behind them!

    IRISHMAN ONEHold it!

Startled, the Chinese kid fires! William and Wade hit theground as Dan spins quickly, putting a bullet in each of theIrishmen.

William swings his rifle, whacking the Chinese kid in theshin and knocking him down. Quickly, William takes the kids

gun as Dan pulls Wade back up.

    DAN(to William)

    Are you hit?

    WILLIAMI dont think so.

    DANCome on.

Dan and William -- with Wade -- hustle farther into theshanty town.

    CONTENTION MANTheyre in the tents!

Wu looks at Riley and Vargas and points toward the shantytown.

    WUFlush them this way.

    Riley and Vargas race off.

    THE TRAIN DEPOT:

The big locomotive is still on the turntable, still turningslowly. Its nearly all the way around, back facing west.

    MATCH CUT TO:

    DANS WATCH:

The minute hand is in the same place as the train on theturntable. Six minutes before the hour.

Dan snaps the watch shut. He looks around, the three of themsurrounded by tents.

DANWe should start toward the depot.

William points off to their right.

    WILLIAMI think its over there.

    Dan looks around, unsure.

    DANI think youre right.

    WADEYou guys sure about that?

    DANWere sure.

We follow them through the shanty town, which in this part ismostly Chinese. The WORKERS here are unaware of the bounty, and go about cooking their meals and smoking their opium.

Our three get to the edge of the tents and find themselves infront of an IRONWORKS FACTORY.

    103.

  • 7/31/2019 310 To Yuma (2004.09.15)

    105/112

Just then, BAM BAM BAM! Riley and Vargas open fire!

Dan pushes Wade and William into the ironworks and Riley andVargas go after them.

    INT. IRONWORKS FACTORY - CONTINUOUS

Inside, WORKERS struggle to pour hot liquid metal into rails.

The equipment is primitive, the conditions shoddy, theatmosphere dangerous and scary. Its noisy too... clankingand hissing and rumbling.

The trio disappear amongst all the machinery.

Riley and Vargas creep through as slowly as they can, tensionin every step, eyes darting around like hawks.

They split up to cover more ground.

    BEHIND A PIPE:

...the CAMERA FINDS Dan, and behind him, William holds hisgun on Wade.

Finally, Riley comes into view, and makes his way next to alarge cauldron full of molten metal...

Dan regulates his breathing, slowly squeezes the trigger, and

the bullet flies out of his rifle...

    THE CAULDRON - DAY:

It slices through the air and clips a huge stabilizing chainthat was holding up the cauldron.

The cauldron snaps down and dumps its load on theunsuspecting Riley. Not a pretty sight.

Dan and William lead Wade toward a door.

    CUT TO:

    THE TRAIN DEPOT:

Now back on the tracks going west, the locomotive backs intoplace with a CLANK at the front of the supply train.

    104.

    106/112

The cars its taking back west are empty, and shudder fromthe chain reaction. The train lets out a WHISTLE.

    BACK TO:

    OUTSIDE THE IRONWORKS:

The WHISTLING TRAIN can be heard all over Contention.

Dan surveys the situation. Outside the ironworks is the mainstreet, which they will have to cross to get to the traindepot.

DANIm sure theyre covering the depotby now.

Just then, Wu, in the street, sees them and opens fire!

    BAM BAM BAM!

Bullets whiz by as they all duck behind a stack of RAILS nextto the CATTLE PEN.

Through the steel, Dan can see Wu moving between somebuildings, closing in on them. He WHISTLES loudly and pointsat the rails.

A group of about 20 LOCALS catch on and see that Wu has themcornered. They all start moving toward the stack of railstoo, ready to put a bullet in someone and collect some money.

Vargas emerges from the ironworks and starts to close in aswell. Even Chavez and Watts come running from the depot, wanting to be in on the final kill.

    Our three are completely surrounded.

    BEHIND THE RAILS:

Dan, William and Wade can see through the stacked rails, andsee everyone closing in on them. Its not looking good.

WADEListen to me. I know this isntabout money anymore. But I dontwant to see you two die. Dan, Illpay you ten thousand dollars to buyyou some common sense. On top ofthat, itll buy you so much ranchland that you wont be able to ridefrom one end to the other.

    105.

    107/112

William and Dan look at each other as everyone closes in.

WADE (contd)All you gotta do is let me walk onoutta here.

William nods at the CATTLE PEN theyre pinned up against.Full of LIVESTOCK. Dan sees it, gets it.

DANThats a generous offer, Mr. Wade. But we got a train to catch.

    JUST OUTSIDE THE IRONWORKS:

Wu, Vargas, Chavez and Watts, along with the locals, waitwith their guns drawn for someone to emerge from behind the

    rails.

    WULet him go!

For a second, there is no answer...

...just the howl of the TRAIN WHISTLE echoing from thedepot...

...then they hear a low RUMBLE, like a thundercloud in thesky...

All of a sudden, a hundred head of cattle come bursting fromthe pen, spilling out into the street and heading in everydirection.

The local men run for their lives as Chavez and Watts try andhold their positions. Its fruitless, and they are eachtrampled to death like rag dolls.

Everyone else has to abandon their positions as the mob ofcattle rumble through everything in their path before turningup the street.

Wu looks hard, but cant see anything but cows and theoccasional glimpse of human legs running with them.

    INSIDE THE STAMPEDE:

In the middle of the ruckus, we find Dan hanging on to Wadeas William whips the livestock into a frenzy, using all ofhis ranching skills to motivate this herd into a stampede!

    106.

  • 7/31/2019 310 To Yuma (2004.09.15)

    108/112

The cattle moves through main street, cows disappearing upand down every alley.

    AT THE TRAIN DEPOT:

The locomotive is puffing and its bell starts RINGING. Steambegins to pour out from the sides of the engine as a fewheads of cattle start to arrive.

The trains WHISTLE blows one last time as William, Dan andWade scramble toward the train.

Through a blast of steam, William finds an open SUPPLY CARand climbs up inside. He turns to reach for his dad to helphim pull Wade in.

But the look on Wades face stops both of them. Wade looks

at Dan with wonderment in his eyes. He is genuinely, sincerely happy for him.

WADEYou made it, you son-of-a-bitch.Idve bet every dollar I had thatyoud be dead by now, but here youare!

For the first time in a long time, Dan grins.

    Then...

    WUStay where you are!

The steam starts to clear, and out from it, Vargas and Wuappear on the platform, guns drawn.

Dan grabs Wade to use him as a shield.

The train wheels start to slowly turn, connecting rodsrising. William looks around, desperate.

    VARGAS

All this way for nothin.Dan is tense, trying to figure out an angle, but he has none.

WUDrop, Ben! Drop and well kill emboth!

But Wade doesnt drop. In fact, he looks confused. He wasso happy for Dan a moment ago.

WU (contd)Go down, Ben! Drop so well have ashot.

Williams rail car is moving away. Its now or never.

Conflicted, Wades eyes dart from the car to Vargas and Wuand back to the car. Then, only for Dan to hear...

    WADELets get out of here.

    DANWhat?

    WADELets jump into the car.

DANHow do I know youll do it?

    WADEYoull have to trust me!

And together, just as another steam burst envelopes them, they turn and jump for the car, William pulling them inside!

    ON THE PLATFORM:

Wu just stares at the train, not moving, emotionless.

Vargas, baffled, instinctively opens fire, spattering the carwith as many bullets as he can let fly. Then he startschasing after it.

    IN THE CAR:

Dan sees Vargas getting closer, leaping for their car... sohe lifts the butt of his rifle up, and just as Vargas latcheson... BAM! Knocks him down face-first onto the platform.

In the car, Wades eyes are electric, like he made the bestdecision of his life.

The locomotive is getting up to speed now. It is a secondmore before Dan can speak, but his eyes never leave Wadesface.

    DANWhyd you do it?

    108.

  • 7/31/2019 310 To Yuma (2004.09.15)

WADEAhh, I dont know. You made itthis far, itd be a shame to seeyou shin out now.

Dan grins, and William smiles, seeing his father smile.

WADE (contd)Besides, I guess Ive grown to likeyour company.

Its a warm moment, which is shattered by a PISTOL SHOT!

    BAM!

    DANAGGGH!

Dan is blasted, right in the shoulder.

William looks up and sees Wu standing in the back door oftheir car, pistol up.

Without a second thought, William lunges at Wu, knocking himoff his feet, sending his pistol skidding across the rail carand out the open door.

William and Wu slide too, almost following the pistol out.

The more experienced fighter, Wu rolls William over andstraddles on top of him. WHAM! He clocks him in the face.

Dan, wounded shoulder and all, makes a move to help, but Wadeputs his bound hands up to hold him back, almost like afather who wants to see what his boy is made of.

William shows he has some grit and gets a couple shots in onWu. At the same time, they both see Dans rifle lying in thestraw.

They both go for it and just when we think Wu has the betterof him, William uses every bit of strength and leverage hehas to spin out of the grasp of Wu and come up with the

rifle!Wu puts his hands up, and it seems to be over, but THE CAMERATRACKS DOWN to see he has a PISTOL tucked into the back ofhis pants, the outlaws hidden spot.

William has him, but Wus hands slowly lower, slowly makingtheir way back toward that weapon.
