Demand Pardon for John White

Time is of the essence and the Appellate Division, Second Department may drop the shoe onJohn White before Gov. David Paterson makes an accurate assessment of his own plight; that

is, no legal basis exists for his leaving officebefore 2011. In fact, no legal reason exists forGov. Paterson to bow out of the 2010gubernatorial campaign.

If he is unsuccessful in the white primary inSeptember 2010, he may run on a third-partyticket in November 2010; preferably, theFreedom Party. History could record him as

"The Great Emancipator" for pardoningthousands of Blacks in the prison-industrialcomplex who have been deprived of theirconstitutional rights and wrongfully convicted.He can also be remembered as the founder ofthe Freedom Party.

One of the outcomes of Saturday's meeting at the Cotton Club is to pressure Gov. Paterson toact immediately on a request for a pardon for White. Over this weekend, organizations of everystripe should sign up with UAM to demand this pardon.

We need you to personally and immediately contact an organization or an elected official for

support and you should e-mail any positive responses to me. A letter to Gov. Paterson for thisrequest for a pardon will be signed, sealed and delivered this Tuesday, March 9. Supportingorganizations will be listed.

Today is the 153rd anniversary of the infamous Dred Scott decision. Yesterday, was theanniversary of the assassination of Crispus Attucks in 1770 for leading the struggle forrepresentation. On March 16, 1827, Freedom's Journal was established in New York City asthe nation's first Black newspaper.

We can secure this pardon for John White with a small amount of effort. The power is in ourhands. If Gov. Paterson awards a gambling contract to Rev. Floyd Flake's AqueductEntertainment Group after Rev. Flake promises to endorse him over state Attorney General

Andrew Cuomo, he should be definitely moved to pardon John White after he receives arequest from a potential list of supporters. He needs our support

John White Shooting Case

Lawyers for John White, a black man,whowas convicted of killing Daniel Cicciaro, awhite teenager in a racially chargedshooting on Long Island, has been wagingthe fight of his life to get his convictionoverturned on Friday. The hearing onFriday was to determine whether or not hereceived a fair trial for the murder of theteen in 2006. White is out on $200,000 bailwhile his appeal is heard. On Friday, he

was flanked by dozens of members of theNAACP, the Nation of Islam and others onthe courthouse steps to proclaim theinjustice of the jury's decision. He wasconvicted of manslaughter and othercharges in the August 9, 2006, shooting.

An all-white group, including Daniel Cicciaro, followed White's then-20-year-

old son Aaron to his home because they wrongly thought he made sexualthreats to a woman. Mr. White confronted the teens with a gun as they

threatened to enter his house. He later told jurors the gun went offaccidently when Cicciaro jumped him. Prosecutors said White was guilty of

reckless homicide for bringing out the handgun instead of calling 911, and ajury found him guilty, three days before Christmas 2007. On Friday, White's

lawyer, Richard Mischel, argued to a four-judge panel that jurors werecoerced by a judge pressing them to decide. He also argued that his defensewas unfairly kept from putting a psychologist on the stand or to talk aboutracial incidents before the shooting.

A decision from the four-panel judges won't be made for at least a month.

This is a tragedy on all fronts, but what I would love the boy's mother toanswer, is why her son was chasing this young man and had the nerve to

confront the young man's father? Having lived in New York City for many

years, I recall several incidents in which white kids accosted and/or beatblack kids, most notably Yusef Hawkins, who was shot to death after being

taunted by a mob of bat-wielding white youths in Bensonhurst, Brooklyn. Mr.White's actions may be considered by some as excessive, but given the

isolated racially motivated beatings that have occurred in New York and NewJersey, he had every right to protect himself and his home. No parent should

have to bury their child, but Daniel Cicciaro was clearly up to no good whenhe accosted this man. Mr. White had a right to defend his home and the

prosecutor should have taken this into consideration. Sorry, but I don't thinkthis man should have ever been charged with a felony.

If they can free the four thugs in upstate New York that beat an immigrant

to death and found them guilty on lesser charges, then surely Mr. White,who has never run afoul of the law and was only protecting his home and his

family, should have his conviction overturned.
