County Bar Association Co-sponsorship of CLE

2020 Opportunities for Live Broadcast The Ohio State Bar Association will be hosting several live seminars through the end of the year. The

county bar association may elect to host a streaming simulcast of any live OSBA program in your area, for your members on the date indicated. What does co-sponsorship mean for your County Bar Association?

• The County Bar will host the seminar as a “live” broadcast CLE in your area on the designated date.

• The County Bar will secure a facility with Hi Speed internet connection, Sound to the room, Projection or Television for viewing the broadcast, and arrange for any refreshments, if desired.

• The OSBA will provide the county bar with a marketing e-mail for the program and a link for attendees to register.

• The OSBA will handle the online attorney registrations and provide a weekly update with the number of registrations.

• There is no cost for county bar to purchase the CLE program. However, all expenses incurred the day of the program are the responsibility of the County Bar Association.

• The OSBA will obtain all CLE credit through the Supreme Court of Ohio and process the attorney CLE credit following the program.

• The OSBA will share 40% of the registration fees from your attendees at your location.

BANKING, COMMERCIAL AND BANKRUPTCY 19-115 | Debt Collection 6.0 total | 1.0 This program explores various issues relating to the collection of debts. The morning portion of the program will discuss more basic topics—execution on judgment, statute of limitations, and bankruptcy issues. The afternoon portion will discuss foreclosure, ethical considerations and the Fair Debt Collection Practices Act.

CORPORATE \ BUSINESS 19-004 | Business Law Conference 6.0 total Lawyers who advise business clients may be asked for advice regarding a broad range of issues. This seminar will help prepare attorneys to assist business owners in dealing with many issues while contributing to the success of the business. 19-067 | Corporate Counsel Institute 6.0 total | 1.25 The morning will focus on the US Mexico Canada Agreement (aka new NAFTA) and labor law updates concerning the new overtime rules and recent worker’s compensation changes impacted by the medical marijuana law. The afternoon is packed with two distinguished panel discussions with nationally recognized speakers, specialists and academics who will address how corporate governance is impacted by the Business Roundtable Statement and the latest ethics and practices concerning social media including its impact on privacy, marketing and branding. 19-010 | Ohio Insurance & Negligence Law Conference 6.0 total CLE hours | 4.0 Planned in conjunction with the OSBA Insurance Law, Negligence Law and Construction Law Committees, this program will provide an engaging and interesting look into emerging issues in insurance coverage litigation and negligence law. Topics will address common pitfalls and hurdles from both policyholder and insurance defense perspectives.

CRIMINAL 19-144 | Marsy’s Law: Implementation and Upcoming Changes 3.0 total The passage of the Equal Rights for Crime Victims amendment or Marsy’s Law has made a significant impact on Ohio’s criminal justice system. Developments are ongoing as legislation is passed to implement the amendment and attorneys see the changes brought by Marsy’s Law in court and their practice. Planned in conjunction with the OSBA Criminal Justice Committee, this program will cover the practical implications of Marsy’s Law, constitutional issues and upcoming rule changes and legislation from both a state and national perspective. 19-091 | OVI Defense Update 6.0 total | Meets OPD Requirements This seminar is designed to keep OVI practitioners up to date on new developments in this fast-changing area of the law. In addition, in-depth treatment of recurring issues is spotlighted along with new and innovative techniques. The seminar has a statewide focus and features practitioners from all over Ohio. 19-221 | Booze, Bullets and Bingo 6.0 total | 1.0 One of OSBA’s most popular programs will help attendees learn more regarding some of the more interesting and quickly developing areas of Ohio law. This unique CLE will cover hot topics such as liquor, gaming, marijuana law and firearm laws.

ESTATE PLANNING 19-003 | Basics of Estate Administration 6.0 total | 6.0 | 1.5 This CLE provides attendees with a broad overview of estate administration, from opening to wrapping up an estate, and many of the issues to consider in between. 19-070 | Nuts and Bolts of Wills and Trusts 6.0 total | 6.0 This is a revised program, offering practical approaches to planning with trusts and related documents. Expert practitioners guide you through the rationales for using trusts, and, at the end of the day, you will be an estate planner. 19-039 | The Medicaid/Medicare Forum 6.0 total | 6.0 This two-part CLE provides attendees with an overview of Medicare and Medicaid topics. Each session includes a presentation on the basics, as well as detailed discussions of specific matters faced by practitioners in each area. 19-346 | Ohio Special Needs and Elder Law 4.25 total | 4.25 This Ohio Special Needs and Elder Law Planning program will provide in-depth information on how to navigate developmental disability waivers, special needs planning, and Social Security claiming strategies. The program concludes with a session on attorney professional conduct from a practitioner’s viewpoint. 19-347 | New Child Support Guidelines are Here! 3.0 total | 1.0 House Bill 366 modernizes Ohio’s Child Support Guidelines for the first time in 26 years! This seminar will provide important information on the updates and changes to the Guidelines that will affect you and your clients.

If you're in the field, this is one program you don't want to miss! 19-093 | Supreme Court Year in Review 6.0 total | 1.5 | 6.0 | Meets OPD Requirements This course analyzes the important decisions of the U.S. Supreme Court and the Supreme Court of Ohio, and discusses their implications for the Ohio practitioner. Attendees will better understand these cases and, where possible, our expert faculty will explore where the Courts are heading in various areas of the law. 19-352 | Ohio Cannabis Law Conference 6.0 total | Cannabis law is a quickly growing area in Ohio especially due to new regulations and legal changes that impact nearly every practice area. Attend the Ohio State Bar Association’s first ever full day Cannabis Law Conference CLE program to get the latest updates in this important and fast moving area of the law.

Health Care 19-137 | Health Care Law Institute 6.5 total | 1.0 This year’s Health Care Law Institute will include a wide range of topics including updates in telemedicine; medical marijuana from the hospital, physician, and dispensary perspectives; a legal and valuation perspective of fair market value and acquisitions of physician practices; updates to the State Medical Board of Ohio’s “one bite rule”; updates in health care legislation; and an explanation of the proposed Madeline’s law (insurance coverage for hearing aids for children) by Representative Allison Russo from Ohio House District 24.

LABOR & EMPLOYMENT 19-060 | Advanced Employment Law Update 6.75 total | 6.7 This advanced-level seminar will address current employment issues, including religious accommodation; the use of biometric data in the workplace; criminal background and credit checks; workplace bullying; the importance of diversity and inclusion; and more. 19-073 | Basics of Employment Law 6.0 total | 6.0 1.0 This basic- to intermediate-level seminar will provide information on workers’ compensation; workplace privacy issues and investigations; workplace protections and accommodations; e-discovery; and wage and hour updates.

LAW OFFICE MANAGEMENT 18-323| Data and Digital Evidence and eDiscovery: Oh My! 3.0 total l 1.0 Recent changes to the Ohio Rules of Professional Conduct mandate that attorneys become knowledgeable of current technology. Perhaps the biggest challenge to attorneys with regard to data and digital evidence is a failure to remain competent in an electronic environment. LITIGATION 19-353 | Introduction to Alternative Dispute Resolution 3.0 total l 3.0 Most cases never go to trial and alternative dispute resolution can often be the best option. Learn strategies for gaining the best outcome for your client earlier in the process. This program will discuss both mediation and arbitration. 19-035 | Taking and Defending Effective Depositions 6.0 total l 6.0 Providing a broad overview and in-depth discussion of depositions, course topics include: case investigation and deposition preparation; preparation to conduct or defend a deposition; interaction with the obstreperous adversary; conducting the deposition; and special issues with depositions, including objections and waivers, depositions outside of the U.S., and telephonic depositions. 19-127 | Trial Evidence for the Ohio Practitioner 6.0 total | 6.0 Our expert faculty will examine the essential elements of the effective use of evidence in trial, including the use of witnesses, demonstrative evidence, understanding hearsay, expert testimony, and admissibility. 19-344 | The Importance of the Ohio Constitution: How to Litigate State Constitutional Claims 3.5 total This CLE program will build on the foundation of the October 2018 program sponsored by the OSBA. That program, influenced by Judge Jeffrey S. Sutton’s 2018 book, 51 Imperfect Solutions: States and the Making of American Constitutional Law , focused on the importance of state constitutions, but it only brought us to the starting line. Lawyers generally understand that state constitutions may be useful to their clients, and the goal of this program will be to provide lawyers and judges with tools that will help them analyze and argue state constitutional issues.

19-296 | Winning at Trial 6.75 total | 2.0 Learn from leading trial lawyers their approach to winning at trial. This one-day trial advocacy seminar features some of Ohio’s leading trial lawyers. These accomplished lawyers will take you through the trial process, sharing their tactics and strategies leading up to and during trial. Learn their approach to pre-trial discovery, preparing for trial, jury selection, opening statement, direct and cross examinations, and closing argument. This seminar will also cover the ethics and professionalism practiced by trial lawyers through video-taped scenarios prepared by the American College of Trial Lawyers. Attendees will gain a “view from the bench” from our panel of judges. This is a unique trial advocacy seminar that covers the art of the trial lawyer with an emphasis on real courtroom situations and a look into the thought processes of this very experienced faculty.

PROFESSIONAL CONDUCT 19-324 | Attorney Succession Planning Workshop 3.0 total | 2.5 This seminar will help prepare attorneys and firms in the event of unexpected disability, death, disappearance, discipline or deportation. All attorneys and firms should have a succession plan. Is your office prepared if you or a colleague was suddenly unavailable? The resource for this course is the Ohio Ethics Guide: Succession Planning issued in March 2017 by the Ohio Board of Professional Conduct. 19-099 | Discipline Problems 3.5 total | 2.5 This CLE program will provide guidance for attorneys within the State of Ohio relative to the ethical obligations placed upon them by the Ohio Rules of Professional Conduct. We will first explore examples and information about conduct committed by attorneys which has often been the subject of disciplinary proceedings. Next, Mr. Koblentz will describe IOLTA Accounts and the rules which govern their use along with what to look for and include in attorney fee agreements. Finally, the program wraps up with a discussion of the substance abuse and mental health issues that attorneys face.

19-065 | Legal Ethics and Professional Conduct Seminar 2.75 total | 2.75 Improperly managed stress is behind many of the problems the legal profession experiences, including ethical violations and malpractice, depression and substance abuse, which leads to unprofessional behavior. While stress is unavoidable in the practice of law, it can be effectively managed in ways that significantly reduce its negative effect. This seminar will outline several stress management techniques that help prevent and treat the ethical and substance abuse problems that are caused by high levels of stress. Specific illustrations of ethically and professionally challenging dilemmas will be used throughout the program to help the attendees practice the stress management techniques that are presented. 19-355 | Recognition and Alternatives for Substance Abuse Issues for Legal professionals 3.0 total | 2.5 Join us for a comprehensive review of substance abuse issues in the legal profession, the history of chemical dependency, and society’s response. Learn how alternative drugs affect the brain’s chemistry and the signs of chemical dependency. Lastly, we will explore the Code of Professional Responsibility requirements impacting yourself and others. 19-273 | Year-End Wrap Up 2.5 total | 2.5 Gretchen Koehler Mote, Esq., Director of Loss Prevention for the Ohio Bar Liability Insurance Company, will discuss new developments in Ohio ethics and professionalism. Beverly Perfect-Endslow, CDCA, Clinical Assistant for the Ohio Lawyers Assistance Program, will provide perspectives on dealing with stress and depression in the legal profession.
