2019 Legislative Session Activity Week 8
Certificate of Need Reform
SB 1712 – Senate Passed a Strike All Amendment. Removed language that would have rescinded the ban on Specialty Hospitals.
HB 21 - Previously Passed the House – 77 Yes, 33 No
Outlook: This is part of the health care deal reached by the House and Senate Leadership. Still looks likely to pass.
Surgery Center/Recovery Care
SB 434 has been stalled HOWEVER 24-Hour Length of Stay in an ASC has been added now to
HB 843 HB 25 Passed the House 78 Yes -38 No
Outlook: HB 843 is a “train” that has a lot of other issues
including: Non-Compete Clauses Step Therapy Relief Hospital disclosure of patient status change (observation status) and
discharge instructions Direct Health Care Agreements
Telehealth
SB 1526 – Senate adopted and amended House Bill 23. Amended to remove Payment Parity….but establish that carriers and
physicians can negotiate rates for telehealth services. Allows use of out of state physicians registered in Florida
Concern is the registration fee is less than getting a full Florida license.
HB 23 – Previously Passed the House, 102-Yes, 14-No Outlook: This is part of the health care agreement
between the two chambers. Very likely to pass.
Needle Exchange Program
SB 366 – Passed the full Senate HB 171 – House Passed the Senate version of the bill. Includes the ability for Counties to fund the program
Outlook: Passed both chambers. It is in the Senate Returning Messages so should be addressed this week.
Office Surgery
SB 732 Passed Senate as amended and sent back to the House Financial Responsibility Language same as physician coverage
currently mandated. Inspected annually Designated physician & notification requirements
HB 933 Passed last committee. Outlook: very likely to pass. It is a white hat patient
protection issue with focus on victims of botched surgery vs. corporate owners.
Electronic Prescribing
SB 1192 On the Calendar for 4/30 HB 831 Passed previously by the House. Outlook: The two bills are very different. Will see if
Senate is willing to accept the House version or will send their version back to the House. We support the Senate version.
Shared Savings
HB 1113 – Previously passed the House unanimously. 114-Yes to 0- No.
SB 524 on Special Order Calendar for 4/30. Outlook: Likely to be Passed by Senate this week. It is an optional plan. State has precedent already in the State Health Plan. Could have some positive impact for lower cost providers of
shoppable services.
Non-Opioid Directives
SB 630 – On Special Order Calendar for 4/29 HB 451 – Passed the House – 113-Yes, 1-No
Outlook: Very likely to pass Senate this week.
Previously amended to provide educational materials and informed consent prior to prescribing opioids.
Prescription Formulary Consumer Protection
SB 1180 by Mayfield – Passed Senate 39-Y, 1-No HB 1363 by Williamson – passed one committee
Bill mandates 60 day notice to patient and physician if change in formulary. Insurance carriers must report to the state how often then
change formularies during plan year.
Outlook: Will see if House wants to take up the amended Senate version.
