INTRODUCTION 1. Rapid Alert System for Food and Feed The RASFF is an effective tool to exchange information within EU Member States about measures taken in response to serious risks detected in relation to food or feed. This exchange of information helps Member States to act more rapidly and in a coordinated manner in response to a health threat caused by food or feed. The INC report collects and classifies all 2018 RASFF notifications for nuts and dried fruits intended for food published in the RASFF portal web page, regarding product, country of origin, notifying country and type of notification. The report also includes notifications for peanuts intended for feed, which are not included in the general overview, summary or 2010-2018 comparisons. Some caution is needed when drawing conclusions from this report, for example, it is not because a Member State has a relatively high number of notifications that the situation regarding food safety is disastrous in that country. On the contrary, it could indicate that a greater number of food checks are carried out. The analysis shall consider trade volumes through Member States. The report includes the relation between the 2017 imports of the RASFF member states from the notified countries and its total notifications.

2. The Legal Basis The legal basis of the RASFF is Regulation (EC) Nº 178/2002, published in the European Official Journal L.31 of 1 February 2002. Article 50 of this Regulation establishes the rapid alert system for food and feed as a network involving its members. Whenever a member of the network has any information relating to the existence of a serious direct or indirect risk to human health deriving from food or feed, this information is immediately notified to the Commission under the RASFF. The Commission immediately transmits this information to the members of the network. Article 50.3 of the Regulation lays down additional criteria for when a RASFF notification is required. Member States shall immediately notify the Commission under the rapid alert system of: - Any measure they adopt which is aimed at

restricting the placing on the market or forcing the withdrawal from the market or the recall of food or feed in order to protect human health and requiring rapid action.

- Any recommendation or agreement with professional operators which is aimed, on a voluntary or obligatory basis, at preventing, limiting or imposing specific conditions on the placing on the market or the eventual use of food or feed on account of a serious risk to human health requiring rapid action.

- Any rejection related to a direct or indirect risk to human health, of a batch, container or cargo of food or feed by a competent authority at a border post within the European Union.

Regulation (EC) N° 16/2011 lays down implementing rules for the RASFF. It entered into force on 31 January 2011. The Regulation lays down requirements for members of the network and the procedure for transmission of the different types of notifications. A difference is made between notifications requiring rapid action (alert notifications) and other notifications (information notifications and border rejection notifications). 3. Members The RASFF list of members includes the 28 EU Member States, the European Commission, as member and manager of the system, the European Food Safety Authority (EFSA), Norway, Liechtenstein, Switzerland and Iceland. 4. Notifications The system differentiates between ‘market’ notifications and border rejections. According to the seriousness of the risks identified and the distribution of the product on the market, the market notification is classified as alert notification or information notification.

Alert Notifications - Alert notifications are sent when a food or

feed presenting a serious risk is on the market or when rapid action is required.

- Products subject to an alert notification have been withdrawn or are in the process of being withdrawn from the market. Member States have their own mechanisms to carry out such actions, including the provision of detailed


information through the media if necessary.

- Alerts are triggered by the member of the network that detects the problem and has initiated the relevant measures, such as withdrawal/recall. The notification aims at giving all the members of the network the information to verify whether the concerned product is on their market, so that they can take the necessary measures.

Information Notifications - An information notification concerns a food

or a feed on the market of the notifying country for which a risk has been identified

- that does not require rapid action, because the product has not reached the market or is no longer on their market.

- Products subject to an information notification have not reached the market or all necessary measures have already been taken or are in process of being taken.

Border Rejections - A border rejection notification concerns a

food or a feed that was refused entry into the Community and was rejected at their external borders for reason of a health risk.

The notifications are accompanied by a detailed explanation of the reasons for the action taken by the Member State in which the notification was issued. Notifications are immediately transmitted by the Commission to the members. Border rejections are transmitted to all members’ border posts as well as the third country of origin.

Information is also provided to third countries when a food or feed has been notified and shipped to them.

5. Abstract In 2018, the European Union’s Rapid Alert System for Food and Feed (RASFF) issued a total of 625 notifications including edible nuts (448 not.), dried fruits (127 not.) and peanuts for feed (50 not.). This result means a slight increase of 4% compared with 2017, when a total of 601 notifications were registered. The most notified edible nuts were peanuts, with 191 notifications, followed by pistachios (104 not.) and hazelnuts (60 not.). As in previous years, the main reason for notifying edible nuts were the presence of aflatoxins (88%). By country of origin, the most frequently notified edible nuts were peanuts from Argentina (20%), pistachios from USA (10%) and peanuts from China (8%). Peanuts from Argentina were the most notified product/country (89 not.), tripling the notifications reached in 2017. On the other hand, the notifications for peanuts from China decreased by 58%. Notified almonds and pistachios from USA experienced an increase of approximately 325% and 39%, respectively. As for dried fruits, dried figs (46 not.), dried grapes (42 not.) and dried apricots (35 not.) were the most notified. For the first time, Ochratoxin A was main reasons for notifying (44 not.), followed by aflatoxins (37 not.) and sulphites (34 not.). Dried figs, dried apricots and dried grapes from Turkey were the most notified, representing 29%, 27% and 26%, respectively, of the total dried fruit

notifications. The number of notifications for dried grapes from Turkey increased compared with 2017, whereas in the case of dried figs from Turkey, the number of notifications decreased by from 68 to 37.

INTRODUCTION 1. United States Import Refusal Report To ensure the safety of imported foods and related products, the USA Food, Drug, and Cosmetic Act (the Act) authorizes the Food and Drug Administration FDA to detain a regulated product that appears to be out of compliance with the Act. The FDA district office will then issue a "Notice of FDA Action" specifying the nature of the violation to the owner or consignee. The owner or consignee is entitled to an informal hearing in order to provide testimony regarding the admissibility of the product. If the owner fails to submit evidence that the product is in compliance or fails to submit a plan to bring the product into compliance, FDA will issue another "Notice of FDA Action" refusing admission to the product. The product then has to be exported or destroyed within 90 days. The IRR reports on those products for which a determination was to refuse admission to part or all of the product offered for importation. The IRR is generated from data collected by FDA's Operational and Administrative System for Import Support (OASIS) and is updated monthly. Each month, the IRR is available sorted by country/area and by product based on the industry code which is the first two characters of FDA's product code (e.g., all fishery/seafood products will be coded 16...). FDA has prepared this information in an effort to provide the public with information on

products that have been found to appear in violation of the Act. The cases of violation of Food Sanitation Law that are Found on the Occasion of Import Notification are available on: http://www.accessdata.fda.gov/scripts/importrefusals/ 2. INC Report This report collects and classifies all 2017 United States notifications for nuts and dried fruits published in the Food and Drug Administration (FDA) Home Page regarding product, country of origin and type of notification.

3. Abstract In the United States, notifications for edible nuts remained stable with respect to the last year. As in 2017, the edible nut with the higher number of notifications was the peanut (10 not.). Misbranding (33% of total) was the main reason for notifying edible nuts, followed by aflatoxins (24%) and filthy (13%). On the contrary, the number of notifications for dried fruits decreased by 24%, reaching 79 notifications, a similar value to 2016. Raisin was the dried fruit most notified (36 not.) followed by dates (18 not.) and prunes (13 not). As the last year, filthy (42%), pesticide (20%) and misbranding (15%) were the main reasons for notifying dried fruit.

INTRODUCTION 1. Japanese Import Procedure under Food Sanitation Law

To ensure the safety of imported foods and related products, Article 27 of the Japanese Food Sanitation Law obliges importers to submit import notification. As Article 27 of the Food Sanitation Law states that "Those who wish to import food, food additives, apparatuses, or container/packages for sale or for use in business, shall notify the Minister of Health, Labour, and Welfare (MHLW) on each occasion as prescribed by the Ministerial Ordinance," the imported foods and related products must not be used for sale without import notification.

Notifications are submitted to a Quarantine Station of the Ministry of Health, Labor and Welfare. At the quarantine station, food sanitation inspectors carry out document examination and inspection to see the foods and products comply with the Food Sanitation Law

2. Document Examination of the Notification Form for Importation of Foods, etc. and Inspection at the MHLW Quarantine Station

2.1. After the submission of notification, the food sanitation inspector at the quarantine station inspects the product to examine whether the item meets the regulations under the Food Sanitation Law.

During the document examination, the food sanitation inspector validates the following

items, based on the information reported in the Notification Form. The judgement will be made based on the information, such as the country of export, imported items, manufacturer, the place of manufacture, ingredients and materials, methods of manufacturing and use of additives.

- Whether the imported food, etc. complies with the manufacturing standards regulated under the Food Sanitation Law.

- Whether the use of additives complies with the standards.

-Whether poisonous or hazardous substance is contained.

- Whether the manufacturer or the place of manufacturing has a record of sanitation problem in the past.

2.2. When the document examination judges the cargo needs to be inspected (cargoes with many records of incompliance with the law in the past, imported swellfish, etc.), an inspection order (inspection order system), a public inspection (other inspection systems) and other inspections (Inspections) will be carried out in order to confirm the compliance of the cargo with the law by the inspection.

2.3. When the document examination and cargo inspection have found that the cargo is in compliance with the law (the cargo "passed" the inspection), a "Certificate of Notification" will be returned to the importer from the MHLW quarantine station where the

notification was first submitted. The import procedures, then, will proceed to the next step.

2.4. The cargo that has been judged not to comply with the law (the cargo that "did not pass" the inspection) cannot be imported into Japan. The MHLW quarantine station will notify the importer how the cargo violates the Food Sanitation Law, and the importer will take necessary measures by following the instructions from the station.

2.5. In order to simplify and expedite the import procedures, simplified systems of import notification are also available (“ Simplified and Expedited Systems of Import Procedures”).

This report collects and classifies all 2018 Japanese notifications for nuts and dried fruits published in the MHLW Imported Foods Inspection Services Home Page regarding product, country of origin and type of notification.

4. Abstract In Japan, notifications for edible nuts and dried fruit slightly decreased by 6% with respect to 2017 (from 136 to 128 not.). Almond was the product most notified (46 not.), instead of peanut as in the previous years. Peanuts ranked the second most notified product (33 not.), followed by pistachios (16 not.) and dried figs (14 not.). The main reason for notifying edible nuts and dried fruits is still the presence of aflatoxins (93% of total).

INTRODUCTION 1. Australian Failing Food Reports When food is inspected under the Imported Food Inspection Scheme, it may be subject to analytical testing for particular hazards. For tests applied to surveillance and risk foods, please refer to the relevant Imported Food Notices. The data presented in the failing food reports has been compiled from the results of inspection activity on imported food consignments under the scheme. This data is published and released to the public in monthly failing food reports. The foods listed in these reports have been identified as failing foods under the Imported Food Control Act 1992 (the Act). The Department of Agriculture may publish certain information concerning this failing food under Section 35 of the Act. Future consignments of the food will be inspected at the rate of 100 per cent of consignments until the food demonstrates compliance with Australian food standards. Failing food reports identify foods that have been found to fail analytical testing or do not meet the compositional requirements of the Australia and New Zealand Food Standards Code. The report does not list foods that have failed for non–compliant labels as the responsibility

for the correct labelling of imported food lies with the importer. In these cases, the importer has an opportunity to bring the label into compliance with Australian food labelling standards. From January 2012, the producer of the food will be included in these reports. The producer is defined as the overseas entity that has grown, caught, manufactured or processed the food and is identified using information provided by the importer and the labelling on the foods packaging. 3. Abstract Australia published 45 notifications for nuts and dried fruit in 2018, being double than last year, and the highest number of the last eight years. The most notified product was peanut products, with 20 notifications, followed by peanuts, with 11 notifications. The main reason for notifying edible nuts and dried fruits was the presence aflatoxins (82% of the total).
