2017 Thunderbird Lake Biggest Fish Competition Rules and Agreements

Reel a Million Tournament Objective and Restrictions In order to encourage the increased use and enjoyment of Lake Thunderbird for recreational purposes, Calypso Cove Marina, LLC (“Sponsor”) is sponsoring a Reel a Million Fishing Tournament (the “Tournament”) and a separate Biggest Fish Competition (the “Competition”) (where both referenced together, the “Event”) at 6:00 am on Saturday June 24th, 2017, located at Calypso Cove Marina on Lake Thunderbird. The Reel a Million Tournament will require Participants to use their individual angling skills in an attempt to catch a certain largemouth bass that will be tagged and released prior to the start of the Event. Prior to the day of the Event, the Tag and Release Team (individuals selected by the Sponsor and the Tournament Advisor, including at least one member of law enforcement) will tag a total of 25 largemouth bass and release the tagged fish at random locations across Lake Thunderbird. Only one of these 25 tagged fish will be the potential Grand Prize Winner. The potential Grand Prize Winner will be randomly selected and identified by a third-party expert that specializes in similar promotions (the “Tournament Advisor”) prior to release of the fish. The Tournament Advisor will provide the tag number associated with the potential Grand Prize winning fish to the Sponsor prior to the release of the 25-tagged fish. Each of the 25-tagged fish are intended to be readily identifiable by Participants as the potential Grand Prize winner. In order to receive the Reel a Million Tournament prize money, the winning fish MUST be among the first three tagged fish caught and presented to the Sponsor, between 6:00AM and 6:00PM on June 24, 2017, by a registered Participant using approved fishing methods as described below. The process of verifying whether the Grand Prize Winning fish is one of the first three tagged fish presented will be done by the Tournament Advisor and the Sponsor at the Weigh In desk using proprietary software technology owned by the Tournament Advisor. As a condition of payment, the Sponsor and Tournament Advisor require that compliance with Tournament rules be verified by polygraph examination as described more fully below. The Biggest Fish Competition will also conclude at 6PM on June 24, 2017. The Biggest Fish Competition prize list is attached. Grand Prize The Grand Prize is US$1,000,000.00. The Tournament Advisor and the Sponsor will verify the integrity of the Promotion and fund the payout of the Grand Prize, which will be paid out in equal installments over a fifty-year annuity period in the event that the Grand Prize winning fish is among the first three fish presented in accordance with the rules contained herein.

Consolation Prize Each of the 25 Reel A Million tagged fish (with the exception of the Grand Prize Winner) caught at any time after the start of the Event and prior to September 30, 2017, is eligible for a consolation prize of a 65 Quart Yeti cooler valued at $400.00. Eligibility Participation in the Event is voluntary. Registration must be completed and all fees paid prior to the start of the tournament. Early bird registration fees are $100.00 if paid on or before June 1, 2017. Any time on or after June 15 the registration fees due are $150. Participants will be eligible to complete registration up to 12:01PM on the of the Event.

Registration and Weigh In will be located at the entrance to Calypso Cove Marina.

PARTICIPANTS must comply with all laws, rules and regulations of the State of Oklahoma and its Department of Wildlife Conservation governing the recreational harvest of fish.

NO MEMBERS OF THE TAG AND RELEASE TEAM shall be eligible to participate in the Event. In addition, employees, agents, successors and assignees of Sponsor or the Tournament Advisor, their respective advertising agencies and promotional companies involved in this Event, as well as family and household members of same, shall be ineligible to participate in the Event and shall be ineligible to receive any prize. PROFESSIONAL guides and professional fisherman will be allowed to fish. MINORS: Any minor (under 18 years of age) Participant in the Event must be accompanied by their parent, legal guardian, or an adult with written parental consent. The accompanying adult must also pay a registration fee for the Event. If a minor Participant is awarded a prize, his or her parent, legal guardian, or accompanying adult will accept the prize on minor Participant’s behalf. USE OF LIKENESS: Participants grant full permission to Sponsor to use, reuse, reproduce, publish, or republish any photographs, motion pictures, recordings, or any other record of my participation in this event, in any medium now know or hereafter developed, alone or in conjunction with other material, without restriction as to changes alterations, as well as to use my name, voice, likeness, and/or other indicia of identity, for editorial, educational, promotional, advertising, and commercial purposes, including without limitation in connection with the solicitation of contributions and furtherance of the corporate objectives of Sponsor. SAFETY AND SPORTSMANSHIP: Safe boating and fishing practices must be observed at all times. Life jacket must be fully zipped and snapped at all times when the big motor is running above an idle speed. All boats will have available Coast Guard approved life jackets for all of their occupants’ use. Each Participant is expected to follow the highest

standard of fairness, courtesy, safety and conservation. Each Participant and/or boat operator is expected to operate their boat in a manner that does not jeopardize the safety of its occupants and public. POLYGRAPH: As a condition of entry, all persons, including minors (and the minor’s accompanying adult), claiming a prize, must agree to submit to a polygraph examination, which will be used to confirm the winner used permitted fishing methods during the time of the event and truthfully caught the winning fish. The Sponsor and the Tournament Advisor reserve the right to select polygraphists to administer polygraph examinations. All polygraph examinations shall be taken at the time, place and by the polygraphists designated by the Event. By signing the official Event entry form, or by clicking the “accept the rules” box for online entrants, Each Participant agrees to submit to a polygraph examination and abide by its conclusion. All travel expenses are to be paid by Participant. Failure to submit to or pass the required polygraph examination shall result in disqualification from eligibility to win prize money and from participation in future fishing promotions of the Sponsor. Event Date and Time

DATE/TIME: The Tournament and the Competition will begin at 6:00 am, Saturday, June 24, 2017, and end at 6:00PM on the same day. Only fish caught the day of the Event and tendered at the official weigh station prior to 6:00PM on June 24, 2017, will be eligible for Event prize consideration. Permitted Fishing Locations: Anywhere on Lake Thunderbird except as prohibited by law. Also off limits is fishing within 50 feet of another Participant’s anchored boat, the take-off cove, any area marked off limits by the Corps of Engineers or the Department of Conservation and any area designated by the Sponsor as off limits. Permissible Fishing Methods

FISHING METHOD: Winning fish must have been caught and landed by a registered Participant on a conventional rod, hook and line exclusively. Trolling, drifting or still fishing, are allowed. While trolling, drifting or still fishing a rod secured in a rod holder may hook a fish; however, the Participant who initially retrieves the rod from the holder must thereafter must solely and continuously fight and land the fish without assistance from any other person. Allowed assistance is limited solely to, netting the fish caught by the Participant. Disabling or subduing a fish in any way before it is landed is strictly prohibited. Eligible Fish: Only fish taken from Lake Thunderbird will be eligible. All fish to be entered for consideration into the Event must have been caught by a registered and eligible Participant during the designated Event listed above and must be weighed, and must be presented at the designated Tournament Weigh In station at Calypso Cove Marina, as soon as practicable after landing and in no event later than 6 pm on Saturday, June 24, 2017.

Participants submitting a tagged fish shall complete and sign the official Tournament weigh form. The Participant shall present proof of identity (driver’s license or identification card), a valid Oklahoma fishing license or proof of exemption. No fish will be weighed or entered without the Participant signing the official weigh form. Tagged fish Division: Only a large mouth bass that is tagged with an official numbered and verified 2017 Reel-A-Million Tournament tag and presented by the registered /qualified participant who caught the tagged fish will be eligible for prize consideration.

NO TRANSFER of fish among Tournament participants shall be allowed. Participants shall only submit fish to be weighed which were caught by that particular Participant. Prize Winners PRIZE WINNERS are solely responsible for payment of any applicable taxes, fees and costs associated with said prize. There are over one million dollars in possible prizes all or part of which may be paid out to participants/entrants. Prizes awarded/paid out will depend on compliance with all rules and regulations of the Reel-A-Million Tournament.

Participants are SOLELY RESPONSIBLE for the validity, accuracy and correctness of the information provided on their entry form. All decisions of the Tournament committee are final and not subject to appeal. Event Decisions and Disputes Protests must be submitted in writing, and postmarked by 5:00 pm on July 15, 2017 to the Sponsor at Calypso Cove Marina, PO Box 721200 Norman, OK 73070. Decisions of the Event Committee, in its sole discretion, shall be final on any and all matters.

Concerning any dispute between a Participant and the Sponsor arising out of any aspect of the Event, the non-prevailing party in said litigation shall be bound to pay reasonable attorney’s fees, expenses of litigation, court costs and other costs incurred by both parties. Hold Harmless and Indemnity In consideration of being allowed to enter the Event, each person agrees and contracts to indemnify and hold harmless the Event and its Sponsor, its agents, sponsors, members, managers, employees, owners, directors, representatives, or any of the not for profit organizations that receive funds thru the event (the “Indemnified Parties”) from any and all loss, liability, claims, or damages arising out of or in any manner whatsoever connected with the planning, operation or conduct of the Event, including but not limited to claims for personal injury, wrongful death, survival damages, property damage, and claims relating in any way to the awarding of prizes in the Event. The parent, legal guardian, or accompanying adult of a minor Participant in the Event further agrees to indemnify and hold harmless the indemnified parties from all loss on account of any claims

presented against them by or on behalf of their child or ward. Winners will be required to execute an additional release, indemnity and hold harmless agreement upon receipt of prize. Any controversy, claim or dispute arising out of or in any way relating to the Event shall be settled by binding arbitration conducted in the city of Norman, Oklahoma, in accordance with the commercial arbitration rules of the American Arbitration Association. Judgment on the award rendered by the arbitrator may be entered by any court of competent jurisdiction in accordance with law. Should litigation and/or arbitration result between a Participant and the Event and/or its Sponsor, it is agreed that the prevailing party in such litigation and/or arbitration, shall be entitled to recover reasonable attorney’s fees and all costs incurred in the arbitration and/or litigation from the other party to said arbitration and/or litigation. Any arbitration and/or litigation will be governed by the law of the State of Oklahoma and any suit/complaint/petition must be filed in Cleveland County Oklahoma. By registering for the Event Participant acknowledges and specifically agrees to this Oklahoma jurisdictional and venue provision. Severability Clause: If any provision, rule, or regulation of the Event is deemed illegal or unenforceable, it will not affect the validity of the remaining provisions, rules, regulations of the Event. Knowledge of These Rules Is Your Responsibility: Failure to read these rules or ignorance of these rules is no excuse. Any extreme violation of rules will be grounds for disqualification. Any announcement made by the Sponsor at the Event site takes precedence over these written rules.
