The business of Cincinnati Coin Laundry grew from the first Laundromat in Cincinnati to the installation of coin operated laundry equipment in apartment buildings, institutions and colleges. They service a market within a 150 mile radius of Cincinnati, including Dayton, Lexington, Columbus, Louisville and Indianapolis. Established in 1957 by Edward Mischell and his brother Clarence Mischell, their philosophy has remained unchanged, provide only quality equipment backed by the best service in the industry. Use of Criminal Records when

Screening Applicants

On July 14, 2016 at 10 am, GDAA and the Miami Valley Fair Housing Center will conduct a webinar on HUD’s new guidance, the “Application of Fair Housing Act Standards to the Use of Criminal Records by Providers of Housing and Real Estate-Related Transactions.”

HUD has a long history of urging housing providers to conduct individual assessments of applicants in order to avoid engaging in conduct or developing policies that have a disproportionate adverse effect on protected classes under the Fair Housing Act. Some landlords and property management companies have developed policies and procedures that are a “one size fits all” approach. This has an adverse effect on vulnerable populations like people with disabilities, minorities, immigrants, and citizens coming home from incarceration. These institutions are being encouraged to develop a more flexible approach to screening applicants with a criminal history. A few of the best practices are having a policy that reads, for example: “Management reserves the right to refuse an applicant who poses a health or safety threat to other residents,” rather than having a blanket ban on anyone with a criminal past or a felony. Another best practices could be to implement policy that your “business conducts criminal background checks in order to make informed decisions about applicant’s suitability.”

“Informed Decisions” can use what HUD’s guidance calls “Relevant individualized evidence:” such as:

*the facts or circumstances surrounding the criminal conduct; *the age of the individual at the time of the conduct; *evidence that the individual has maintained a good tenant history before and/or after the

conviction or conduct; and *evidence of rehabilitation efforts *By delaying consideration of criminal history until after an individual’s financial and other

qualifications are verified, a housing provider may be able to minimize any additional costs that such individualized assessment might add to the applicant screening process.

*Policies that exclude persons based on criminal history must be tailored to serve the housing provider’s substantial, legitimate, nondiscriminatory interest and take into consideration such factors as the type of the crime and the length of the time since conviction.
