Plaintiffs United States Fidelity and Guaranty Company and St. Paul Fire and

Marine Insurance Company (together, “USF&G”) annex hereto as Exhibit A a list of exhibits

that it may seek to introduce in its case in chief to which Defendants have not objected. In

addition, USF&G annexes hereto as Exhibit B a list of exhibits that it may seek to introduce in

its case in chief to which Defendants have objected.

USF&G reserves the right to use any document included on the exhibit list of any

Defendant.

USF&G reserves the right to introduce as exhibits at trial any pleadings, briefs,

affidavits/affirmations and discovery responses served or filed in this action.

USF&G reserves the right to offer an enlarged or highlighted version of any

Furthermore, defendants reserve all rights based upon the position that introduction of evidence by USF&G on certain matter such as,

for example, asbestos values and counts or communications with the reinsurers, will open the door to other evidence on such subjects

at the behest of the reinsurers.

In the event the that the trial proceeds without one or more of the current defendants, the remaining defendant(s) reserve the right to

assert hearsay objections with respect to documents created or produced by the absent defendant(s), except to the extent that all of the

remaining parties have reached a contrary agreement in connection with the dismissal of the absent defendant(s).

debtors’ contributions included their ‘valuable rights of action for bad faith . . . against their insurers’” “would

be admissible against it,” USF&G v. American Re, 20 N.Y.3d 407, 425 (2013), Defendants reserve the right to

introduce pertinent portions of these exhibits as against USF&G.

NOTE #3: Defendants understand that the business record status and/or authenticity of certain documents related to

ECRA is the subject of a separate discussion.

evidence as an exhibit.

REINS: Contains evidence concerning notice to reinsurers, and is thus barred by the Court pursuant to its June 3, 2015

Orders on the parties’ in limine motions. If USF&G is permitted to offer evidence pertaining to notice to

reinsurers, then defendants may offer evidence regarding USF&G’s failure to inform reinsurers.
