UAE-based energy firm Dana Gas reported flat second-quarter profit as low oil and gas prices were partly offset by a gain on the buy-back of an Islamic bond. Dana made a net profit of $7 million in the three months to June

30, the same as the previous year. In a statement, Dana said the fall

in oil and gas prices was offset by reversals in provisions and the $6 million gain on the Islamic bond, or sukuk.

Abu Dhabi Terminals (ADT) has launched its new training program for UAE Nationals with a high school diploma, part of its ongoing Emiratisation strategy. The Al Khayyal program, which means horse rider in Arabic, prepares young Emiratis for operational roles at Khalifa Port, the flagship container terminal of ADT and one of just two semi-automated container terminals in the region. ADT’s new Emiratisation program recruits and develops UAE National employees through a dedicated in-house training program that equips new joiners with the skills and expertise needed to work in the UAE ports sector.

A drop in global oil prices led to a day of declines on stock markets in Abu Dhabi and Dubai. Brent crude prices slipped for a third successive day, declining by 0.3 per cent to US$43.89 per barrel by the time the two main UAE bourses closed.

The fortunes of Middle Eastern stocks have largely followed the performance of oil prices since global oil prices started to plummet in 2014. For the week, Dubai was up 1.5 per cent and Abu Dhabi was 0.01 per cent higher

Abu Dhabi Ports and Abu Dhabi Ship Building (ADSB) signed a long term contract that, when fully realized, will see a fully operational ship repair facility that will also include a “Floating Dock” capability within Zayed Port.

Dr. Khaled Al Mazrouei, Chief Executive Officer of ADSB said: “We are proud to sign this agreement with Abu Dhabi Ports that aims to strengthen our long-term partnership between the two companies and cement the joint relationship.”

Established to support the UAE Navy, ADSB specializes in the construction, repair and refit of naval,

military and commercial vessels. The company is widely recognized for carrying out its projects in steel,

aluminum alloy and high tech composite materials to international standards.

Gulf Petrochem Group, the UAE based global bunker supplier, has announced that it is now officially offering physical bunker supply in the port of Rotterdam, out of its new office based in Dordrecht.

The launch of physical supply operations in Rotterdam will compliment Gulf Petrochem Group’s growing global footprint in bunker supply which to date includes all ports in the UAE, Gulf of Kutch, Indian ports of Kandla, Sikka and Vadinar as well as the expansion of the Singapore and London offices.

Emirates National Oil Company (ENOC) is set to award the contract for a major expansion of its Jebel Ali plant, part of a broader downstream growth strategy that it expects will create hundreds of new jobs.

The plans for the refinery expansion and the addition of more than 80 new

retail outlets in the UAE and Saudi Arabia are part of Enoc’s efforts to develop into a "middleweight" inte¬grated oil player, following the doubling of its upstream output last year when it purchased the 46 per cent of Dragon Oil it did not already own.

DP World announced its first half net profit surged by 50 per cent to $608 million, from $405 million for the same period in 2015, and said it retains the flexibility to bring on extra capacity in line with demand.The company said its revenue grew 10.2 per cent to $2.094 billion, supported by the acquisitions of Jebel Ali Free Zone (UAE) and Prince Rupert (Canada). Cash from operating activities amounted to $905 million from $857 million in the first

half of 2015.DP World Group chairman and

CEO Sultan Ahmed bin Sulayem said the modest first-half earnings growth is a reflection of the challenging trade environment. “Looking ahead to the second half of the year, we expect throughput performance to improve. Overall, the strong financial performance of the first six months leaves us well-placed to meet full-year market expectations,”

The new prices were agreed after an “exhaustive study,” and are in line with average rates in Gulf Cooperation Council countries, the government said. The plunge in oil prices has prompted members of the six-nation GCC to revise the generous

benefits their citizens traditionally enjoyed, and forced them to tap the international bond market to plug their deficits.

The National Shipping Company of Saudi Arabia (Bahri) has signed an agreement for a USD 133.2 million loan facility to finance the purchase of five chemical tankers, the company said in a stock exchange filing.

Namely, the company’s subsidiary, National Chemical Carriers, is set to receive the funds from Saudi Arabia’s Arab Petroleum investments Corporation (APICORP) and BNP Paribas.

Bahri added that the loan would be provided in the form of a murabaha facility for a 10-year period. Bahri earlier said that the fund would be realized in three phases with the total investments composed of debt and equity.

Qatar-based shipping group Milaha has reported that its overall revenues declined 7% in the first six months of this year compared with the first half of 2015, despite an increase in container volumes. Its Port Services division was adversely affected by lower demand for ancillary services and reduced shipments of non-containerized general cargo and ro-ro traffic. In addition, pricing pressures faced by

the container shipping unit dampened this unit’s results.

Milaha’s Gas & Petrochem division’s revenue grew by 56% despite a global slowdown in the shipping market. The investment in two LNG carriers made in the second half of 2015, and the mid to long-term nature of the majority of charter contracts, largely insulated this segment from market pressures during the first half of 2016.

Egypt’s government has approved five oil and gas drilling and exploration agreements with foreign companies ahead of parliament’s final approval, Petroleum Minister Tareq

Al Molla said. Four of the deals are gas exploration and drilling agreements between Egypt’s state gas board EGAS and BP, Eni, Total, and Edison. The fifth deal,

which is an oil and gas exploration and drilling deal, is between state petroleum board EGPC and a local company.

The Chairman of the Libyan National Oil Corporation (NOC), Mustafa Sanalla, is optimistic that the country’s exports could reach 900,000 b/d by the end of 2016 if all oil terminals were opened and the blockade militias honor the agreement to resume operations, the Tripoli Post

reported.The majority of the initial increase

in production will likely come from NOC’s largest subsidiary, Arabian Gulf Oil Company (Agoco).

In a statement on the NOC’s website, Sanalla said that the corporation is working with the Unity government

to restart exports from the ports that were closed and from the fields that supply them. “We need to be clear, there are still big military, political, and legal obstacles that must be resolved. NOC will immediately start technical works, and we will mobilize workers as quickly as possible,” he added.

The MENA region is forecasted to become the world’s second-largest gas-importing area by 2040, as the countries invest around $10.3b in LNG-importing facilities, Hellenic Shipping News reported. The move comes in light of boosting consumption of natural gas in the Middle East, which is expected to rise from 480 bcm in 2015 to over 700 bcm in 2040.

According to Oil & Gas Journal, MENA has extensive LNG developments in the pipeline. The UAE plans for a chartered FSRU at Ruwais, Abu Dhabi. Kuwait, the Gulf ’s first LNG importer, plans a permanent terminal at Mina Al-Ahmadi with a capacity of 15 bcm/y, and the possibility of doubling its output. Bahrain plans for an LNG

terminal with a capacity of 4.1 bcm/y, expandable to 8.2 bcm/y.

Saudi Arabia has indicated it might use LNG to supplement its gas supply. The kingdom wants to raise the gas share of power-generation fuel to 70% by 2030, up from 50% at present, in

order to replace oil.Egypt imported 1.67 bcm of gas in

the first quarter of 2016. The country’s demand is expected to exceed supply by 2 bcm/y by 2021, despite predicted outputs from the offshore Zohr natural gas discovery.

Maersk could sell APM Terminals and Damco Danish shipping Major Maersk

Line’s container shipping related units, APM Terminals (APMT) and Damco, could be spun-off or divested entirely, following the company’s strategic and structural review, according to Alphaliner.

The move could be made as the company faces “tough divestment choices” after posting an operating loss of USD 111 million and a net loss of USD 151 million for its container shipping business in the second quarter of 2016. The ocean carrier’s losses have dragged down overall net profits of the A.P. Møller-Maersk Group to only USD 118 million for the quarter, compared to USD 1.1 million in the same quarter last year.

Alphaliner added that the appointment of Søren Skou as the group CEO in June, and his concurrent

role as CEO of Maersk Line, suggested that container shipping would remain central to the group’s new strategy.

The Port of Los Angeles has released an initial Study of Preparation, the first step in the Environmental Impact Report (EIR) process for the Marine Oil Terminal Wharf Improvements Project at the Valero Terminal on Mormon Island in Los Angeles Harbor.

The primary goal of the proposed project is to comply with the Marine Oil Terminal Engineering and

Maintenance Standards (MOTEMS) in the interests of protect public health, safety, and the environment. The project will involve the demolition of an existing 19,000-square-foot timber wharf at Berth 164 and the construction and operation of a new, MOTEMS-compliant wharf. The plans also include minor infrastructure improvements to connect the new loading platform to

the existing landside pipelines and utilities.

The new structure would be capable of handling vessels of up to 85,000 dwt.

The proposed project would also include a new, 30-year lease between Los Angeles Harbor Department and Valero which would run through 2047.

Bureau Veritas has classed the first LNG-fuelled newbuilding oil/chemical tanker, the 15,000 dwt Ternsund, built under BV class at China’s shipbuilder Avic Dingheng and delivered to Danish Terntank

Rederi at the end of June 2016. “This is the first installation of such

engine and it was done under BV class. In early August 2016, the vessel became the first ever ship to take on LNG as

bunker fuel in the port of Rotterdam, qualifying for an LNG bunkering premium equal to a ten per cent reduction in port dues,” said Philippe Donche-Gay, President of BV.

The first of three Royal Navy warships being built on the River Clyde has been unveiled at BAE's Scotstoun yard, where it will be finished and tested. “HMS Forth” is part of a £348m contract to build vessels to support counter-terrorism, counter-piracy and anti-smuggling

operations.It is the first complex warship to

be fully assembled at Glasgow since Type 45 destroyer HMS Duncan in 2010. The ships are being built at

the company's yards at Scotstoun and Govan. "HMS Forth" will be ready in 2017, with the other ships to be named HMS Medway and HMS Trent.

New Zealand’s Ports of Auckland Limited (POAL) and Napier Port plan to enter into a strategic alliance in an effort to optimize freight services and achieve further improvements in the supply chain.

The partnership is expected to prompt

greater competitive contestability and resilience in New Zealand’s supply chain to help lower costs to exporters and importers, according to Ports of Auckland.

In addition, the alliance builds on Napier Port and Ports of Auckland’s

existing joint venture in Palmerston North’s Longburn regional freight hub. According to POAL, the alliance would support its regional freight hub network strategy to manage the growing freight market.

What are your priorities and plans for the current stage?

Tell us about your expansion plans and upcoming projects?

We witnessed an excellent performance this year, as we entered many international markets with new leading projects. Our subsidiary India’s NMDC was awarded with a $316million contract (AED1.16billion). As for our project for deepening and widening Khalifa Port, we signed a contract with Abu Dhabi Ports

to start preparations for dredging the port’s main canal and dock, in addition to building a 1,000m quay wall with a significant foundation of 21m and the adjacent yard. This contract represents a vital opportunity for cooperation among all parties involved in maritime services and marine dredging. Around 250 workers will be deployed on this project, which we are aiming to have completed by 2018.

What are your main strengths, and how do they contribute to your ability to better serve your clients? At NMDC, we have a clear action plan in place. This plan is mainly based on analyzing the capabilities of our company and developing them, as well as studying market opportunities and requirements. Once completed, we implement this plan by prioritizing the actions, on the leaders, second management line, and all junior levels. Employees’ performance is then linked to key performance indicators (KPI) in order to realize the objectives of the plan. All employees are engaged in the plan, and unlike other organizations, we start with the junior employees and move up to the first line management. As a specialized company in dredging and marine construction, we spare no effort in developing our employees’ KPIs and enhancing their experiences by expanding our training courses in dredging and marine construction at our training center.

How do you see the importance of developing national competencies in the maritime sector? And what are the efforts NMDC is exerting with this regard?

Attracting national talent is a top priority within NMDC’s strategy, given the current transformation in dredging industry on an international level. In order to address the increasing demand on expanding ports and international waterways, we have to invest heavily in human capital for various specializations. It is no secret that technological experience in marine dredging and digging is rare and greatly sought after.

Consequently, it was logical for us to attract the Emirati expertise and improve their experiences which guarantee sustainable returns on our investment in human capital. Emirati employees are known for their loyalty, dedication, and efficiency, in addition to the fact that they will not need to return to another country after some time. A stable and loyal staff helps us increase our projects portfolio and exposure through new ventures, and it also represents one of the main pillars for

effective implementation of future plans.On the other hand, our company

sponsors excellent Emirati students by granting them scholarships at the most prestigious universities. We also offer training opportunities for students to provide them with access to the marine dredging and reclamation, which is a highly sought after specialization due to its high income potential.

There is an increasing interest in safety and security on a global level. Tell us about your HSE standards and measures?

Environment, health and safety (HSE) policies are among our top priorities in all projects. As our human capital is most important for us, we have to pay extra attention for their safety and health, even if it is against our financial margins of employees’ KPIs. We also attracted expertise and specialist professionals to implement the comprehensive standards of the Abu Dhabi Occupational Safety and Health Center (OSHAD) in HSE in order to achieve a safe work environment.

What role does technology play in your processes?

We implement cutting-edge technologies in our dredging projects, and use next generation automated machines that enable us to control dredging level precisely up to 0.5 meters, which prevents the need for any additional dredging. This was the case with the Suez Canal Project where the dredging depth was specified to 24 meters and we had no chance to increase it due to the time limitations. Our advanced technologies helped in ensuring full commitment and highest standards in outcomes.

NMDC has repeatedly expressed its belief in collaborative work and partnerships. Tell us about your strategic partnerships with government and private entities, and with different stakeholders in the sector?

We have a firm believe in the importance of partnerships for its benefits in exchanging experiences, diversifying business resources, and reducing risks. By entering partnerships with important organizations and discussing projects with them, we create new horizons for development, in addition to the important potential international opportunities represented by the partners and their clients. There has been a noticeable vacuum in the UAE’s maritime finance industry, due to the lack of enthusiasm expressed by local banks towards the sector. In the past, this attracted support from foreign banks for UAE ship owners and operators but most have now withdrawn from financing new transactions.

In an interview with Marasi News Magazine, Marcus Machin, CEO of Tufton Oceanic, Dubai, says that local banks recognized the growing need for ship financing in the GCC but have been extremely cautious in their support for what is a complex international industry. He gives us the highlights of the industry’s financial performance.

international standards” commented Mr. MarcusThe Maritime Advisory Council is composed of well-

known personalities operating within the maritime sector, including senior executives from prominent marine companies. Members include DP World, Dry docks and the Emirates Classification Society, Tasneef, which is one of the few who made several landmark achievements in a short time.

Mr. Marcus emphasized that Tasneef has done a great job in order to ensure the adherence of international standards in terms of the operational quality of ships. The standards of operations in the region and internationally have improved remarkably over the past twenty years and the emergence of a local UAE classification society is a key part in that progress

Offshore marine companies facing financial problemsSignificant technical progress has been made over the

past three years, with the deployment of more sophisticated but, ultimately, more costly vessels in the region. As the oil markets entered a more difficult phase of their cycle, offshore marine companies, with previously steady cash flows and easy access to credit, have been forced to look for alternative financing options.

Tufton Oceanic investments and businessTufton Oceanic is divided into two main businesses, The

Hedge Fund division and the Asset Backed Investments group (ABI). The firm offers full service institutional investment management services to international pension funds, endowments, and private equity investors willing to invest in the shipping and oil services industries. In aggregate, Tufton Oceanic has approximately US$2.0bn assets under management in a series of investment vehicles,

each with specific investment parameters. For ship owners and operators, Tufton Oceanic provides a

potential source of finance, either for projects or for specific vessel acquisitions. Each possible transaction is assessed based upon in-house research and technical assessment.

Mr. Marcus emphasized that Tufton Oceanic has also established two successful investment funds with Kuwait Finance House (KFH) and are in process of launching a third investment vehicle with KFH that will give regional Islamic investors the opportunity to invest in internationally trading vessels. They also manage investments for APICORP, working on the establishment of the Apicorp Petroleum Shipping Fund in 2012.

In these projects, the investment strategy is based on the acquisition of marine vessels employed through a long term Ijarah bareboat lease structure that avoids market volatility and provides a steady yield to investors. The Ijarah based lease investment structure is relevant for both finance leases and operating leases, and has been proven to be a secure contractual structure which offers flexibility in its exposure to the cycles inherent in the international shipping market.

Emirates Classification Society “TASNEEF” completed its 3rd year with significant achievements in classification services that are tailored to the needs of the Arab world. This comes as a result of TASNEEF’s success in directing the world’s

attention to the UAE’s added values in the marine industry. Commenting on Tasneef ’s achievements, Eng. Rashed Al Hebsi, CEO of Tasneef said, “We are blessed to have achieved a wide acceptance in the Arab maritime community as the first Arab classification society, and we are considered the accredited society for issuing compliance certificates in accordance with GCC standards.”

Landmark Achievements “TASNEEF” has successfully signed a contract with

Kleindienst Group under which Tasneef will provide classification standards, design assessment and surveillance during construction for the floating villas, also called “Floating Seahorses” being constructed by Kleindienst Group. This is a significant step towards supporting floating marine facilities in the country, the first of its kind industry in the world, while ensuring the highest safety standards.

In less than six months from signing the partnership contract between the two parties, the first prototype of the

“Seahorse Villa” is now floating offshore from St Petersburg and the main Europe island of Dubai’s World Islands. This comes as a result of Tasneef ’s successful assessment of design and surveillance during construction.

Commenting on this achievement, Al Hebsi said: “This project was an exceptionally outstanding achievement for us. It shows our commitment to being leaders in classification for both traditional and new and innovative products. We hope that this will encourage more new concepts to come to the UAE and expand our maritime economy.”

Furthermore, Oman’s Ministry of Transport and Communications “MOTC” has appointed “TASNEEF” to inspect the small ships that are not abiding by the international conventions in GCC countries. The society will be authorized to conduct technical surveys for ships that carry the Omani flag, and issue international certificates and accreditation for ship safety, anti-pollution compliance, collision prevention, cargo thresholds and more.

Al Hebsi pointed out “We are proud to stand alongside international classification societies as it highlights our capabilities and resources in the maritime field, especially when it comes to GCC specifications. We will also establish our Oman branch by the end of this year and will therefore be handling the required inspections and certifications.”

Enhance Maritime Education "Tasneef" has also graduated 10 engineers after completion

of an advanced training course in the engineering field from Genoa University. This accomplishment represents an important step towards the framework of Tasneef ’s vision that aims to transfer advanced knowledge and technology in the maritime field to the young national calibers.

AlHebsi emphasized “The UAE leadership is fully aware that continued prosperity and development in the UAE is based on the ability to build sustainable economic elements that are capable to provide the same level of development and affluence for next generations in the post-oil era.”

Concrete steps towards Emiratization TASNEEF launched “the Maritime Emiratization Index”,

one of the main initiatives contained in the declaration of the Abu Dhabi Maritime Youth Summit for Empowering Emirati Youth Leaders in the Maritime Domain, which was organized by TASNEEF Academy in January 2016.

Al Hebsi clarified: "Our aim is to motivate all our youth to take part, as of today, in the preparation for the celebration called for by His Highness Sheikh Mohammed bin Zayed Al Nahyan, Deputy Supreme Commander of the Armed Forces, Crown Prince of Abu Dhabi, fifty years later, when

the last barrel of oil is shipped from the UAE. The maritime sector is in great need of national talents to ensure the continuity of the UAE’s international standing in the field of international shipping and trade."

TASNEEF’s achievements during the last three years are represented in preparing and developing new standards and specifications such as Sahara, the UAE Yacht Code and GCC Code for ships not covered by international conventions; and obtaining more accreditations by signing agreements with other Arab countries and authorities. It also strengthened its international relations by signing a partnership agreement with the Italian classification society “RINA Services” enabling Tasneef to deliver its services based on RINA’s extensive infrastructure reducing the lead-time. Furthermore, the launch of Tasneef ’s maritime academy aims to be an excellent academic reference in building expertise and specialized national and Arab caliber in maritime classification.

Tasneef has also strengthened its initiatives to promote interactive discussions among international leaders within the global maritime industry through its partnership agreement with the Mare Forum International Committee to host the “the Abu Dhabi Summit of Global Marine and Maritime Leaders” on 20 January 2016.

خطوات بناءة نحو توطين القطاع البحريعل��ى �شعي��د اآخ��ر، قام��ت ت�شني��ف برعاي��ة "موؤ�ش��ر الإم��ارات لتوط��ين القط��اع الماح��ي" ال��ذي اأطلقت��ه مجل��ة مرا�ش��ي، اأح��د اأه��م المبادرات الت��ي ت�شمنها اإع��ان "قمة اأبوظبي لتمك��ين القيادات الإماراتية ال�ش��ابة في القطاع البحري"، والتي نظمتها "اأكاديمية ت�شنيف" الذراع التعليمي لهيئة الإمارات للت�شنيف "ت�شنيف" في �شهر يناير 2016 الما�شي. حيث يهدف الموؤ�شر ليكون ذو تاأثر

حقيقي في تحفيز الموؤ�ش�ش��ات الوطنية وال�ش��ركات على توطين القطاع الماحي. ال�ش��باب جميع��ا "نه��دف دائم��ا اإلى تحفي��ز اأهمي��ة الموؤ�ش��ر قائ��ا وعل��ق الحب�ش��ي عل��ى لي�ش��اهموا منذ اليوم للتح�شر لاحتفال الذي دعى اإليه �شاحب ال�ش��مو ال�ش��يخ محمد بن زايد اآل نهيان، نائب القائد الأعلى للقوات الم�شلحة ولي عهد اأبوظبي، بعد خم�شين عاما، عندما يتم �ش��حن اآخ��ر برمي��ل نف��ط م��ن دول��ة الإم��ارات. حيث يحتاج القط��اع الماحي اإلى الكف��اءات الوطنية بدرجة كبرة من اأجل �شمان ا�شتمرارية ال�شدارة الدولية التي حققتها الدولة في مجال الماحة

والتج��ارة ع��بر الحدود".كم��ا تمثل��ت الأنج��ازات الأخ��رى ل�"ت�شني��ف" خ��ال الأع��وام الثاث��ة الما�شي��ة في اإع��داد المعاي��ر

اإنجازات نوعية كواح��دة م��ن اأب��رز اإنجازاته��ا في ع��ام 2016، وقع��ت "ت�شني��ف" ومجموع��ة "كايندين�ش��ت" المط��ورة لم�ش��روع "فر���س البح��ر العائ��م" عق��دا للتع��اون الم�ش��رك فيم��ا بينهم��ا، تق��وم "ت�شني��ف" بموجب��ه بو�ش��ع المعاي��ر الخا�ش��ة بالفل��ل العائم��ة، وتقييم مخطط��ات الت�شامي��م، بالإ�شافة اإلى الإ�شراف المبا�شر على عملية البناء؛ في خطوة تهدف اإلى دعم قطاع ت�شنيف المن�شئات البحرية العائمة في الدولة، وتقديم الدعم لها لتحقيق اأعلى معدلت ال�ش��امة والأمان في تلك المن�ش��ئات، والت��ي تعت��بر النم��وذج الأول م��ن نوع��ه في الع��الم. كم��ا ا�ش��تطاعت "ت�شني��ف" النته��اء م��ن و�ش��ع

في دول مجل���س التع��اون ل��دول الخلي��ج العربية والتي �شادقت عليها ال�ش��لطنة.وق��ال الحب�ش��ي: "اإن اعتم��اد �ش��لطنة عم��ان لخدم��ات "ت�شني��ف" يع��د �ش��هادة م��ن ال�ش��لطنة بكفاءة كوادرنا وقدراتنا في مجال الت�شنيف البحري، ل�شيما في ما يتعلق بالموا�شفات الخليجية في ه��ذه المنطق��ة الت��ي نعت��بر الأك��ثر خ��برة بطبيعته��ا وم��ا يائمه��ا م��ن موا�شف��ات لبن��اء وت�ش��غيل ال�شفن، وهذا يوؤكد على اأهمية وجود هيئات ت�شنيف اإقليمية تماأ الفراغ الذي تحتاجه �شناعة الت�شني��ف البح��ري. و�ش��يتولى ف��رع هيئ��ة الم��ارات للت�شني��ف ال��ذي م��ن المتوق��ع اأن يت��م افتتاح��ه

تعزيز التعليم والتدريب البحري �شم��ن خطته��ا ال�ش��راتيجية لتمك��ين �ش��باب الإم��ارات من الخبرات المتط��ورة في مجال العلوم الماحي��ة والبحري��ة، قام��ت "ت�شني��ف" بتخري��ج ع�ش��رة م��ن طابه��ا الذي��ن ق��د اأنه��وا دورة تدريبي��ة متقدمة في مجال الهند�شة في بجامعة جنوة الإيطالية. ويعد هذا الإنجاز الذي تولت "ت�شنيف" تنظيمه بالكامل خطوة هامة �شمن روؤيتها لنقل المعرفة والتقنية المتطورة في المجال البحري اإلى

Damen Shipyards Sharjah (DSS) in the United Arab Emirates has won a contract to build a shallow draught, self-propelled Jack-up Pontoon 3526 for the UAE-based contractor Aqua Diving Services Ltd. Once delivered, it will be used primarily to deliver offshore support services, including the provision of

accommodation facilities for personnel as well as operating as a work platform with crane facilities.

Aqua Diving Services (ADS) has specifically designed the Jack-up for Middle East operations and is closely cooperating with Damen Shipyards Sharjah for the construction of the unit. The jack-up, which will be named the Aqua Rise III, will provide accommodation for up to 128 personnel, 350m² of deck space and two cranes, rated at 75 and 15 tonnes respectively. The vessel will also be fitted with a helideck and life boats.

Aqua Diving Services was established in the United Arab Emirates in 1975 and, today, delivers a wide range of sub-

sea services as well as other support to offshore oil and gas operators in the region. The company already owns and operates a fleet of two Jack up pontoons. Aqua Rise III is due for delivery in early 2018 and promises to be a state of the art vessel offering services to a long list of clients in the Arabian Gulf.

Mr. Clive Frost, Managing Director of Aqua Diving Services, commented that building the vessel at a high quality shipyard like Damen Shipyards Sharjah was a win-win for both parties and that he is very much looking forward to the delivery of Aqua Rise III.

Pascal Slingerland, Sales Manager Middle East for Damen Shipyards Group, commented that this order is fitting in with Damen’s strategy to become more active in the lift-boat market and to build vessels outside the standard Damen portfolio. This is a further sign that local clients value Damen’s strong track record and reputation as a shipbuilder, delivering superior quality at the right price.

The new management of GulfNav have been and are working intensively to clear all historical liabilities and backlog in order to give the

Company a new leash of life whereby new horizons of maritime and shipping business can be explored on a more positive footing. This settlement and clearing of liability with NAT marks a beginning of the end of the troubled past of the Company. It is expected that this news will improve investor confidence and widen market interest for the Company. GulfNav is also in negotiations with its other major creditors and is hopeful of reaching fair settlements soon.

Gulf Navigation Holding PJSC (GulfNav) and Nordic American Tankers (NAT) have signed a new settlement agreement and the long standing debt that GulfNav owed to NAT has now been settled fully and finally pursuant to the terms.

لبنود الاتفاقية.

S ince 2009, the IMO Marine Environmental Protection Committee (MEPC) discussed the eutrophication process of

semi-closed and closed sea areas of the world on the basis of studies demonstrating that the sensitivity of these areas is not sufficiently protected against nutrient emissions from international shipping.

In July 2011, such discussion lead to the adoption of the amendments to MARPOL Annex IV, prohibiting the discharge of sewage from passenger ships within special areas (at the moment, just the Baltic Sea) on or after:• 1st of January 2016, for new passenger

ships (i.e. for which the building contract is placed, or in the absence of it, the keel of which is laid on or after 1st of January 2016 or the delivery of which is on or after 1st of January 2018)

• 1st of January 2018, for existing passenger shipsPassenger ships can be exempted from

the application of such requirements if they have, in operation, a sewage treatment plant approved by the Administration, in accordance with the Guidelines in Resolution MEPC.227(64), and the effluent does not produce visible floating solids or discoloration of the surrounding water.

The application of this requirement was conditional on the availability of adequate port reception facilities in the Baltic Sea Special Area and the related receipt of coastal Parties notifications (Regulation

13.2 of MARPOL Annex IV). Moreover, some industry parties complained about the lack of type-approved sewage treatment plants meeting the industry needs.

Due to all these outstanding issues, it became clear that the earliest effective date, i.e. 1 January 2016, would be impossible to meet for the Baltic Sea Special Area. At the end of an intensive discussion in April 2016, the MEPC reached a final agreement on the following effective dates of the sewage discharge requirements within the Baltic Sea Special Area:1. 1st of June 2019 for new passenger ships

The UAE has been proven a fruitful location for various industries throughout the years. As a hub for world trade and a beacon for the

oil and gas industry, ship and rig recycling has great potential here.

With the oil prices going down and higher rig availability than needed, companies are heading towards fleet upgrades and vessels replacements. Some of the older units are converted into accommodation for oil fields and some are converted into Mobile Offshore Production Units MOPU. If conversion proves unfeasible, a decision is usually made to recycle or scrap them.

Since the beginning of 2014, 66 units have been removed from the fleet for various reasons, either to be converted or scrapped. Of these 66, 25 were removed in 2014, and the rest in 2015. With many oil analysts in agreement that the crude price has not yet reached bottom, it is likely that more rigs will be removed.

Transocean downsized it’s fleet by about 14%, from 86 in 2014 to 74 by the end of 2015. Diamond Offshore slimmed down by nearly 20% from 2014. Of the other top 10 managers, the only one not to downsize was Shelf Drilling, who stayed at 39 units.

A drilling rig is mostly constructed of steel, however, there are liquids and other hazardous materials that needs to be disposed of. The UAE’s environmental regulations are very strict when it comes to recycling operations, making green

scrapping quite a complex process. For this reason, many international contractors opt to send their units to be scrapped in India, Turkey or China.

It’s not only drilling rigs that need to be recycled. With the decline in ultra-deep-water drilling and global trade in general, there are semi-submersibles, drilling ships, freighters and other equipment that may also be decommissioned. In many cases, recycling is a more attractive financial proposition that paying the high cost of storage. Certain industries in the UAE, such as steel, could benefit greatly from a local recycling operation of this nature.

Ali and Sons Offshore and marine have been studying the possibility of green recycling. As the facility is located in a sheltered location with inland basin that can take the largest drilling rig operating in the area, the potential of green scrapping is high. ASMEF is in continuous improvement and upgrade mode in order to ensure the facility is able to serve various markets and industries. With the recent expansion and talent acquisition, the facility is expected to grow quickly and become a leading authority in the marine and offshore business.

The unique location and the close proximity to the Abu Dhabi Oil fields, along with the neighboring countries’ fields, makes it the perfect destination for various types of marine and offshore businesses, including ship and rig recycling.

The STCW Manila Amendments entered into force on 1st January 2012 and had a 5 year grace period until 1st January 2017. The comprehensive review of the STCW 78, as amended 95 had made major revisions identified in the Manila Amendments which come into effect on 1st January 2017.

The amendments identify the crucial role human factors play in high-stress, high-risk environments and encompasses team training, as well as simulation, interactive group debriefings and improvement of crew performance. With greater technical reliability, automation and quality control of component systems, we no longer have an alibi for normal human fallibility, now the human element has been identified as being the weakest link in the chain.

Amongst the amendments adopted,

there are a number of important changes to each chapter of the Convention and Code, including: • Improved measures to prevent fraudulent

practices associated with certificates of competency and strengthen the evaluation process (monitoring of Parties' compliance with the Convention)

• Revised requirements on hours of work and rest and new requirements for the prevention of drug and alcohol abuse, as well as updated standards relating to medical fitness standards for seafarers

• New certification requirements for able seafarers

• New requirements relating to training in modern technology such as electronic charts and information systems (ECDIS)

• New requirements for marine environment awareness training and

training in leadership and teamwork• New training and certification

requirements for electro-technical officers

• Updating of competence requirements for personnel serving on board all types of tankers, including new requirements for personnel serving on liquefied gas tankers

• New requirements for security training, as well as provisions to ensure that seafarers are properly trained to cope if their ship comes under attack by pirates

• Introduction of modern training methodology including distance learning and web-based learning

• New training guidance for personnel serving on board ships operating in polar waters

• New training guidance for personnel operating Dynamic Positioning Systems

New amendments to the STCW rulesNew wide-ranging amendments to the

STCW rules, agreed by governments in Manila in 2010, are intended to ensure that STCW standards stay relevant, so that seafarers can continue to develop and maintain their professional skills.

The competence of seafarers is one of the most critical factors in the human element to ensure safe and efficient ship operations. It is directly related with safety of life at sea and the protection of the marine environment as well. The STCW 78 as amended, constitutes a comprehensive set

of regulations intended to maintain the highest standards of competence globally. Hence, the International Convention on Standards of Training, Certification and Watch-keeping for Seafarers (STCW) is placed as an important international convention that will affect the human element in the maritime industry.

It is important to highlight here that even though the United Arab Emirates has not ratified the STCW convention, it has as part of the countries representation in IMO, shown keen compliance to the specific convention.

In those regions of the world where the vast majority of maritime trade takes place, it is now extremely difficult for

sub-standard ships to operate without detection and sanctions. This is viewed by the shipping industry as a positive development: any tolerance of sub-standard operators provides unfair commercial advantages and damages the industry’s reputation.

Training and upgradation requirements for all seafarers till 1st January 2017 will need to be inline with the new requirements. Flag States will be required to ensure compliance with the new requirements, which in turn would mean more inspections. Therefore, it is imperative, that crew onboard has the mandatory upgradation and training to meet requirements as training requirements and compliance will be legally binding.

A recent judgment of the English court in SBT Star Bulk & Tankers (Germany) GmbH & Co KG v. Cosmotrade SA (The Wehr Trave) [2016] EWHC 583 (Comm) highlights the need to exercise care in using the word “trip” in the charterparties. This is an English law case but this word can also result in a dispute in the UAE courts as addressed below.

In The Wehr Trave, the vessel was chartered on an amended NYPE 1946 form for “one Time Charter trip via good and safe ports and/or berths via East Mediterranean/Black Sea to Red Sea/Persian Gulf/India/Far East always via Gulf of Aden...” The vessel loaded

at Sevastopol/Avitla, Novorossiysk and Constantza/Agigea before proceeding to discharge its cargo at Jeddah, Sohar, Hamriyah, Jebel Ali and Dammam.

The owners considered that the vessel had performed the one trip that it was chartered for and could now proceed to the redelivery place. However, the charterers issued fresh orders for the vessel to proceed for loading at Sohar with subsequent discharge in India. The owners claimed that the charterers’ orders are not legitimate.

It was the owners’ principal case that the words “one time charter trip” mean a journey from one load port to one

discharge port. The Court found in favour of the

charterers. The Court held that time charters can be divided into two main categories: term time charters (where the charter period is agreed in advance) and trip time charters (where the charter period is defined by a trip within a geographical range). Importantly, in both cases, the defining characteristic of the time charter is that the vessel is under the directions and orders of the charterers as regards her employment for a period of time / the charter period.

What constitutes a one-time charter trip? The Court further found that there is

no single definition as to what constitutes a “trip”. A trip could be a single voyage carrying cargo from one port to another or any number of possible permutations of this, such as multiple loading ports with discharge at one singular port, or perhaps a series of consecutive loading and discharging operations, all at different ports along a given route. The fact that this charter referred to “one trip” does not change the position.

Therefore, unless the charterers' entitlement to give orders is restricted by clear words in the charter itself in relation to period, trading limits, geographical route etc., the charterers are entitled to order the vessel to load and discharge at multiple ports. As a matter of construction, the charter in The Wehr Trave did not contain any such restrictions. The Court found that the port of Sohar was within the agreed trading limits and was consistent with the

contractual route.The Court also commented that if the

owners were correct in their position that the trip should have ended at the final discharge port of Dammam, this would have been commercially unattractive to the charterers, who would have been forced to ballast the vessel to the redelivery area and pay hire to the owners without the possibility of earning freight.

This decision confirms that use of the word “trip” in connection with a charter is misleading and is a “red herring”. What is meant by the word “trip” very much depends upon the specific wording of the charterparty? To avoid any arguments about what constitutes the “trip”, it is therefore prudent to use precise wording in the charterparty to describe loading and discharge ranges, the route, and expressly provide what ports or areas are to be excluded. In the absence of clear contractual restrictions, an English Court may, as it did in this case, construe such

provisions in favour of the charterers by finding that the charterers are entitled to order the vessel to load cargo from any port or place within a range that is not expressly excluded.

Whilst there is no case law on this point, in our opinion a charterparty for “one time charter trip” which is subject to UAE law, may further give rise to a dispute between the parties as to whether this is a genuine time charter or a voyage charter. Whilst the UAE Maritime Code (Federal Law No. 26 of 1981) distinguishes between time charters and voyage charters, it does not specifically address the concept of a trip time charter. In our experience, when dealing with “one time charter trip” charters, the UAE courts would consider the fact that the vessel is under directions and orders of the charterer as a defining characteristic of a time charter. Clear drafting is, therefore, of paramount importance under both UAE law and English law.

A vessel arrest is the manner in which a claimant obtains security for a claim which may possibly lead to the judicial sale of the vessel, should that become necessary. Vessel arrests arise as potential remedies for an assortment of creditors; for example, a ship owner that needs to repossess the vessel under the charterparty, or a mortgagee who has terminated a loan facility due to default, etc.

In the UAE, Courts permit vessel arrests for genuine claims; however, procedural errors occurring after the arrest order has been granted are tending to invalidate the arrest as a whole, causing losses for claimants.

As many readers will note, UAE Federal Law No. 26 of 1981Concerning the

Commercial Maritime Law, as amended (“CML”) is the primary statute governing maritime law in the UAE. The CML regulates, inter alia, the arrest of vessels. Vessel arrests in the UAE are accomplished through ex parte proceedings (i.e. without the vessel owners’ notification). A vessel can only be arrested to obtain litigation or arbitration security in respect of a ‘maritime debt’. A ‘maritime debt’ is defined under CML Article 115(2) to mean a claim in respect of a right arising out of fifteen potential heads (including collision, GA, crew wages, mortgage, etc.).

In order to arrest a vessel, a claimant (or his/her lawyers) must file an arrest petition in the UAE Court that has jurisdiction over the port in which the vessel is located. The

arrest petition must include all supporting evidentiary documents (in Arabic). The arrest petition will be reviewed by an urgent matters judge who has the discretion to accept or refuse the petition, as well as requesting further information from the claimant. The judge may require the claimant to lodge countersecurity in case the vessel is damaged during the period of the vessel arrest.

Once completely satisfied, the judge will grant the arrest and issue the order to arrest the vessel. Almost simultaneously, the Court will issue two letters: the first, to the UAE Coast Guard, and the second to the port authority where the vessel is located. The letters inform the Coast Guard and the port authority of the vessel arrest and that the

vessel is not permitted to leave its current location. Within eight days of the arrest order, the claimant must file substantive proceedings on the merits of the claim (i.e. the Statement of Claim).

Article 119(1) of the CML states “[c]opies of the Notice of Arrest shall be delivered to the master of the vessel or his deputy thereon, a second copy to the relevant maritime authority in the port in which the arrest is effected to prevent the vessel from sailing, and a third copy to the Registration Bureau in the said port”.

Furthermore, Article 120 states “1. [t]he Notice of Arrest shall contain a Summons to attend before the relevant civil Court in the area of which the arrest is effected to adjudicate the validity of the debt, of

whatever amount. 2. [a] date shall be f ixed for the hearing not more than thirty days from the date of the Notice of Arrest. The Court shall promptly enquire into the claim, and the time shall not be further extended”.

Requirements to board the arrested vesselIn effect, the Court Bailiff is required

to board the arrested vessel and serve the vessel’s master or chief engineer with the Notice of Arrest which must contain a date for the first hearing not more than thirty days from the date of the Notice of Arrest. A copy of the Notice of Arrest must also be served on the port authority where the vessel is located, as well as another copy to the Registration Bureau. It is only after the above has been completed by the Court Bailiff that the claimant should file their

Statement of Claim (i.e. the substantive proceedings that gave rise to the claim), i.e. up to eight days later.

Several UAE Court decisions have invalidated arrests (and thereby security of the claim) because the above procedures were not correctly followed. The Court has clarified that the exceptional procedures provided in the CML demonstrate that the legislator insists that vessel arrests are handled in an expedited manner. Although it is the Court Bailiff that is required to officially serve the Notice of Arrest, it is ultimately the claimant’s responsibility to ensure that the Notice of Arrest contains all the correct information and is served in the manner prescribed for in the CML; otherwise, the arrest will be invalidated for procedural errors.

The traditional means for transportation of natural gas have, so far, been pipelines and LNG ships. An important innovation in the natural gas market is the transportation by sea without undergoing liquefaction, but simply compression.

Indeed, in limited gas fields, relatively close to end-users, Compressed Natural Gas (CNG) transportation can be competitive, as it avoids the challenges of the pipeline construction and the costs of methane liquefaction and subsequent regassification.

For such reasons, the Oil & Gas industry is showing increasing interest in this new concept. With CNG carriers, the so-called marginal and stranded fields can be recovered and enhanced, monetizing those small amounts of gas that would otherwise be wasted. Collectively, these small amounts are significant but, up until now, it has been unfeasible collect due to the cost of implementation.

No regulations exist specifically for CNG so carriers must make do with existing rules and practicesFrom a general regulatory perspective, ships are to comply with a set of international regulations (e.g. SOLAS and MARPOL)

and national rules according to flag of the country of registration, service type, navigation and characteristics. For CNG carriers, no internationally recognized regulation exists yet. RINA has developed ad-hoc rules to cover the safety issues related to CNG transportation, with the aid of the Approval in Principle and Technology Qualification process to cover the most important aspects, relevant to the fitness of service, since the design solutions may not be fully predictable for the time being.The main reference in the safety rules development was the “International Convention for the Safety of Life at Sea” (SOLAS Convention) integrated by the “International Code for the Construction and Equipment of Ships Carrying Liquefied Gases in Bulk (IGC Code)”. Although not strictly applicable to CNG ships, which do not carry liquefied gas, this Code was deemed adequate to provide the general safety criteria valid also for these types of ships. As a starting point of the RINA rule development, the ship was assumed to be arranged with dry spaces which contain the CNG vessels, but other solutions could be proposed as the technology progresses.As an example, considerations were also given to the possibility of

using the pusher-barge concept, where a set of barge transporting CNG vessels are driven by interchangeable pushers in order to increase the use flexibility and reduce the dead times imposed by the gas loading on board.On the basis of the IGC Code, stability and arrangement criteria, like intact and damage stability and the required space to guarantee the inspectability of CNG vessels, were drawn up. The general philosophy of fire & gas detection, overpressure protection, fire protection and extinction etc. was also derived from the IGC Code, with the proper adjustments made due to the presence of a large amount of high pressure gas. In fact, critical aspects are the safety management of gas overpressure and possible leakages.However, novel solutions applicable to a CNG carrier might not yet be included in Class Rules. Novel technologies are generally not adequately covered by established codes and procedures since they, for their very nature, explore new challenges on a continuous basis, and move much faster than the reviews of the normative bodies. Novel technologies not envisaged in Class Rules may therefore be required to be qualified through an ad-hoc, rational approach. This approach should be flexible and reliable enough as to address:• safety of operation• reliability of the novel technology equipment• maintainability of the system

• high performance standard• demonstration that new technology is fit for purpose.

Where there’s a will, there’s a wayA framework to achieve this result is the Technology

Qualification. RINA has developed a specific “Guide for Technology Qualification Processes” and has already successfully applied this process to innovative solutions.

This consists of a process of verification that the novel technology meets the specified requirements for its intended service, i.e. is ‘fit for service’, i.e. fulfills all the requirements of functionality, safety, reliability, availability and maintainability defined in the qualification basis.

It is important to highlight that the fitness of service covers not only the safety aspects normally addressed by normative bodies, but also the performance aspects.

This characteristic enables the certification of fitness of service to be particularly appealing to novel technology providers, and to the sponsors that are involved in financing the development of such technology.

In the case of CNG carriers for which no internationally accepted regulation exists, a design dossier has, inevitably, to be produced and accepted by the Flag. It would be a natural course of action to include the safety-related TQ activities (prominently the risk assessment) in the design process, which would be thus streamlined.

INFRARED THERMOGRAPHY COULD SAVE TIME AND MONEY WHILE REDUCING THE RISK OF A CATASTROPHOC FAILURE

Infrared (IR) thermography has become a powerful tool for basic and applied scientific research, along with practical applications in various fields such as industrial, environmental, and maritime. Infrared thermography is applied in the marine field to identify and target equipment and systems which need attention, as well as to eliminate unnecessary work on board. Thermographic inspections with an infrared camera will instantly show the condition of electrical circuits, electronic systems and other installations on board, which helps to avoid costly and catastrophic failures.

In 2004, Lloyd’s Register, the world’s most important ship classification and certification body, made the following prediction: “In the near future, mechanical machinery onboard vessels will also benefit from thermal imaging, especially as a pre-docking strategy to identify and target equipment and systems which need attention, as well as to eliminate unnecessary work.”

PRINCIPLES OF INFRARED THERMOGRAPHYEvery object whose surface temperature is above zero (-2730c)

radiates energy at wave length corresponding to its surface temperature. Utilizing the highly sensitive infrared cameras, the radiated energy in a thermal image of the objects being surveyed is captured and fed into the software installed in a PC, laptop or a mobile device. The digital thermal images can be captured directly from the camera and fed into highly user friendly software.

ADVANTAGESInfrared Thermography is a completely non-destructive

testing method. It provides the ability to monitor large areas, thus achieving complete thermal map of the hull. More detailed investigations can then be carried out on the suspected areas. It is the only condition monitoring tool that allows temperature measurements of objects across their entire surface area quickly and safely. The infrared camera shows exactly what’s going wrong and where. Onboard inspections on commercial ships are carried out on engines, compressors, boilers, pumps, piping insulation systems and electrical switchboards; everything that can heat up and break down, from the bridge to the caboose. Thermography offers the advantage of not interfering with the vessel’s operation. For good inspection conditions, the engines must be working at their normal loads and temperatures.
