Introduction

I, The Chairman of the Ethics Committee having been authorized by

the Committee to submit the report on their behalf in the matter of Hon’ble

MLA Shri O.P. Sharma allegedly damaging the mike in the House on

30/6/15 present the report to the Hon’ble Speaker, Delhi Vidhan Sabha.

The Committee wishes to place on record its appreciation of the

valuable assistance rendered by the officers and staff of the Assembly

Secretariat during its meetings as also in the preparation of the report.

In the matter of Shri O.P. Sharma, Hon’ble MLA damaging the mike in the

House on June 30, 2015

Report The Charge

On June 30, 2015 at about 2.45 P.M when replies to Starred questions were in progress, Shri O.P. Sharma allegedly damaged the mike installed at his seat by violently shaking it. Many MLAs protested against his behaviour. Shri Somnath Bharti requested the Hon’ble Speaker to deduct the cost of the mike from the salary of Shri O. P. Sharma. The Hon’ble Speaker referred the matter to the Ethics Committee. The Proceedings

The Ethics Committee took cognizance of the matter in its first meeting dated July 20, 2015 in which it was directed, as is required by the principles of natural justice and fair play, that Shri O.P Sharma should be asked to furnish his written reply in this regard.

Shri O.P. Sharma, Hon’ble MLA submitted his written reply dated August 11, 2015 terming the allegation of damaging the mike as completely baseless and politically motivated. He requested that CCTV footage of the House be made available to him so as to enable him to submit a detailed explanation.

The Ethics Committee in its second meeting held on Oct. 15, 2015 considered Shri O.P. Sharma’s reply and unanimously decided that the Hon’ble MLA Shri O.P. Sharma may be provided with the video footage available with the Assembly Secretariat. The Committee also directed that Shri Sharma be asked to present himself before the Committee on Oct. 26, 2015. The Committee also directed that Shri Somnath Bharti, Hon’ble MLA, the complainant be also asked to appear before the Committee on the same date.

The required footage, as web-cast on June 30, 2015 and as available with

the Assembly Secretariat, was sent to Shri O.P. Sharma, Hon’ble MLA in a DVD alongwith the notice asking him to appear before the Committee on Oct., 26, 2015. Shri. O.P. Sharma, Hon’ble MLA responded to the notice and appeared before the Committee on Oct., 26, 2015 but the meeting of the Ethics Committee could not commence on time i.e. at 3.00 P.M. for want of quorum. Shri O.P. Sharma left the committee venue after waiting for over ten minutes. He requested the Committee officers that he be not called for the next meeting of the Committee before Nov. 8, 2015.

In deference to Shri Sharma’s request, the Ethics Committee (the quorum

having been fulfilled at 3.15 P.M.) directed that Shri Sharma and Shri Somnath Bharti Hon’ble MLAs be called to appear before the Committee on Nov.16, 2015.

On Nov. 16, 2015 both Shri O.P. Sharma and Shri Somnath Bharti Hon’ble MLAs appeared before the Committee. In the meeting Shri O.P. Sharma made the following two points: (a) The footage sent to him by the Secretariat does not anywhere capture the incident of he damaging the mike. (b) If the mike was broken, why it did not come off into his hands.

Shri Somnath Bharti the complainant in this case was asked by the Committee to give his account of the incident. Shri Somnath Bharti stated that Shri O.P. Sharma was in completely agitated mood that day. The whole House and the media have witnessed the said incident, Shri Bharti said. By damaging the mike he has insulted the whole House and this is the type of conduct which does not behove even a common man, let alone a MLA, he added. The video clip which was played before the committee today fully establishes damaging of mike by Shri O.P. Sharma on June, 30, 2015, Shri Bharti argued.

The Ethics Committee considered this matter in its entirety. It was pointed out to Shri O.P. Sharma that in the House the focus of the camera is always on the member who is permitted to speak by the Hon’ble Speaker. It does not capture all the activities of the House. As far as the damaged mike is concerned it is available

with the JE (Elect.) posted in Vidhan Sabha. The authorities concerned have also given the estimate for replacing the damaged mike.

Shri O.P. Sharma was confronted with the following four newspaper clippings of July 01, 2015: (a) Dainik Jagran ( Hindi) (b) Nav Bhart Times (Hindi) (c) The Statesman (English) (d) The Hindustan Times (English)

These news reports unambiguously corroborated what was witnessed in the House by the Members and what was told to the Committee by Shri Bharti.

Shri O.P. Sharma was also shown video clips of this incident telecast by two channels viz. India News and V6 News in the TV monitor installed in MLA lounge No.1 where the meeting was held.

When asked by members of the Committee about his act of damaging the

mike, Shri O.P. Sharma called it a ‘natural conduct’. When asked if he recognized himself in the video clips of two TV channels shown to him, he replied in the affirmative. When asked if it was he who was seen violently shaking the mike, he stated that all members do it.

Now the issue before the Ethics Committee is whether Shri O.P. Sharma is guilty of damaging mike or not. The Committee has the following evidence/material before it. (1) The entire House including the members of Ethics Committee present in the House on June 30, 2015 witnessed this incident. (2) Four Newspapers clippings of July 01, 2015 (2 in Hindi and 2 in English) clearly reporting the fact of mike getting damaged by Shri O.P. Sharma. (3) Video clips shown to Shri O.P. Sharma and the members of the Committee on Nov. 16, 2015 where the incident is clearly brought out/shown.

Conclusion and Recommendations

In view of the above, the Committee is fully convinced that Shri O.P Sharma damaged the mike installed at his seat on June 30, 2015. During the entire meeting the Committee tried to reason out with Shri O.P. Sharma to see if he had any regrets about his conduct. The Committee was of the view that, had Mr. O.P. Sharma expressed regret for his misconduct, he could have been let off with a warning. But it was not to be. Shri O.P. Sharma, whose abrasive behavior in the House -- be it running to the Chief Minister’s seat, be it challenging the decision of Hon’ble Speaker from time to time, be it repeated interjections when other members/ministers are speaking in the House -- is very well documented, remained defiant. He categorically told the Committee that he had not done anything for which he has to express regrets. The Committee has noted with deep anguish that Shri O.P. Sharma’s reply betrayed no repentance, let alone apology. Therefore, the Committee is constrained to recommend that the full cost incurred on replacing the mike damaged by Shri O.P. Sharma be recovered from his salary. The Committee further recommends that Shri O.P. Sharma be warned not to resort to such misconduct in future.
