    PENNIES FOR CHARITY ANNUAL REPORT ON TELEMARKETING CAMPAIGNS IN NEW YORK 

    Last year, for‐profit telemarketers registered in New York reported raising more than 

    $302 million for charity, a 20 percent increase over the previous year and the most ever 

    reported in the history of  the New York Attorney General’s annual report, Pennies  for  

    Charity . Of  those funds donated in 2013, $146 million went to organizations’ charitable 

    missions, or about 48 percent of  the total money raised. This is an increase from 2012, 

    when 37 percent of  the funds raised went to the charitable missions to which donors 

    intended 

    to 

    contribute. 

    It 

    is 

    also 

    the 

    highest 

    percentage 

    of  

    total 

    funds 

    raised 

    by 

    telemarketers that went to charity in the last twelve years. Nevertheless, donors should 

    know that less than half  of  the money they contribute through telemarketers is going to 

    the charitable causes they seek to support. 

    Despite improvements in the share of  funds going to charitable purposes, telemarketing 

    remains an expensive method of  raising funds for charity and suffers from significant 

    limitations compared to other forms of  fundraising: 

     

    Telemarketing encourages “me‐too” charities, which sound like respected and 

    effective charities, but are much less effective. For example: the well‐known 

    “Make‐a‐Wish Foundations” and the me‐too “Kids Wish Network,” which pays 

    out more than two thirds of  its telemarketing revenue to fundraisers. 

      The typically anonymous telephone interaction between telemarketer staff, 

    often located

     at

     a remote

     call

     center,

     and

     the

     donor

     facilitates

     fraud

     and

     

    misrepresentation by a telemarketer. 

      Many charities need to monitor the fundraisers they engage and hold them 

    accountable. The Attorney General has found a number of  fundraisers with 

    significant histories of  violations that continue to secure fundraising contracts. 

    For example, InfoCision, Inc., which has compliance agreements with multiple 

    states arising

     out

     of 

     its

     improper

     conduct

     and

     recently

     settled

     a class

     action

     misrepresentation suit, filed with the Charities Bureau reports related to 41 

    campaigns conducted in 2013 for individual charities.  In 31 of  the 41 reports, 

    InfoCision retained over 50 percent of  the receipts.  InfoCision is among the 

    biggest players in the for‐profit telemarketing industry.

    As New Yorkers, we benefit from this robust giving. We have the highest total number 

    and the second‐highest work force percentage of  not‐for‐profit employees in the 

    country. They work in the nation’s leading hospitals; universities and colleges; 

    foundations; 

    social 

    service 

    and 

    advocacy 

    organizations; 

    churches 

    and 

    religious 

    charities; 

    nonprofit housing groups; arts, history, and cultural institutions; and world‐renowned 

    museums.  New Yorkers also donate their money and time to thousands of  religious and 

    community groups (over 3,000 in the Bronx alone) that provide help for their neighbors 

    through after‐school programs,  job training and placement, food banks, meals to 

    homebound adults, and arts and music programs. 

    New York’s nonprofit sector is recognized as a national and international leader, 

    attracting tens

     of 

     thousands

     of 

     students

     and

     adults

     from

     around

     the

     nation

     and

     the

     

    world who are interested in learning not only what New York charities do, but how they 

    do it.  Some take what they have learned and apply it when they return home; others 

    spend their careers here, or bring nonprofit innovations to government and for‐profit 

    entities. New York is the Silicon Valley of  not‐for‐profits—a source of   job opportunities 

    for New Yorkers, and innovation and positive social change worldwide. 

     

    As of 

     2010,

     over

     18

     percent

     of 

     New

     York

     private

     sector

     employment

     was

     in

     not

    for‐profits, which employed more than 1.25 million workers and paid out more 

    than $57 billion in wages.1 

      In New York, the  job count at nonprofits grew by 17 percent from 2000 to 2010. 

    By contrast, the state’s for‐profit sector lost 6 percent of  its  jobs over the same 

    decade. 

    As the chief  law enforcement officer and regulator overseeing charitable fundraising in 

    New York State, Attorney General Eric T. Schneiderman has made it a priority to protect 

    donors and the charities they support, strengthen public confidence in these 

    organizations, and ensure that contributions assist those in need of  support. 

    One way that Attorney General Schneiderman achieves these goals is by promoting 

    transparency and shining a spotlight on how charitable contributions are spent. For 

    example, in

     July

     2013,

     the

     Attorney

     General’s

     office

     published

     a report,

     Charitable

     

    Response to Hurricane Sandy , which provides the public with detailed information on 

    how Hurricane Sandy relief  funds were spent. This was followed by another report, on 

    the second anniversary of  the hurricane in October 2014, identifying leading charities 

    involved in the Hurricane Sandy response, and amounts spent on their relief  efforts.

    Pennies  for  Charity  is another important tool for transparency because it informs the 

    donating public which portion of  their charitable contributions made through 

    telemarketers went to the outside fundraisers’ fees and expenses, and how much was 

    left to support charitable programs and their administration.  This report focuses 

    specifically 

    on 

    charities 

    that 

    engage 

    for‐

    profit 

    fundraisers 

    and 

    solicitors 

    to 

    contact 

    members of  the public through telemarketing, and the for‐profit organizations that 

    provide telemarketing services.  The report finds that 48 percent of  funds contributed 

    through telemarketers went to charitable purposes. Some charities did much worse. 

    Regulation of  Telemarketing Solicitation  – Rules Donors Should Know 

    The constitutional rules governing charities solicitation, as interpreted by the Supreme 

    Court, are

     clear.2

     

    1) 

    Charitable solicitation is protected by the First Amendment.  States cannot 

    prohibit charitable solicitation, and cannot impose limitations inconsistent with 

    First Amendment protections. 

    2) 

    Charitable organizations and their for‐profit fundraisers cannot make false, 

    misleading or

     deceptive

     statements

     to

     individuals

     or

     households

     in

     connection

     with fundraising activities, and the Attorney General can investigate and 

    prosecute false, deceptive, or misleading statements in connection with 

    fundraising. 

    3)  “Do Not Call” regulations are subject to constitutional limitations. Putting your 

    name on the Federal Communications Commission’s “Do Not Call” list will not 

    bar calls “on behalf  of  tax‐exempt non‐profit organizations.” Charities that are 

    calling on their own behalf  to solicit charitable contributions are not covered by 

    the requirements of  the national “Do Not Call” registry. However, if  a third‐party 

    telemarketer is calling on behalf  of  a charity, a consumer may ask not to receive 

    any more calls from or on behalf  of  that specific charity. If  a third‐party 

    telemarketer calls again on behalf  of  that charity, the telemarketer may be 

    subject to a fine of  up to $16,000.3 

    4) 

    As New

     York

     has

     done,

     states

     can

     also

     require

     telemarketers

     to

     disclose

     to

     those

     

    called (a) the name of  the individual telemarketer, (b) that the solicitation is 

    being conducted by a professional fundraising company, (c) the name of  that 

    company, and (d) that the telemarketer is being paid to make the call.4

    5)  States cannot require disclosures by charities’ fundraisers of  the percentage of  

    funds they keep as part of  the solicitation to individuals or households that are 

    being solicited.5 

    6)  States cannot ban or sanction charitable solicitation based upon the percentage 

    of  funds kept by the charitable solicitors.6 

    7)  States can require disclosure in regulatory reporting to the Attorney General 

    about sources and uses of  funds raised by charities, and the identity of  

    individuals and for‐profit entities engaged in fundraising.  New York is a leader in 

    requiring such disclosure. Attorney General Schneiderman publishes this Pennies 

     for  Charity  report every year from those disclosures.  The report is based upon 

    the information

     self 

    ‐reported

     by

     charities

     and

     fundraisers.

     

    Highlights of  Enforcement Actions by the Attorney General 

    1)  During 2013 and 2014, the Attorney General has investigated and obtained 

    settlement agreements with organizations engaged in false, misleading, and 

    deceptive solicitations, including an agreement with Quadriga Arts and related 

    companies in

     the

     nation’s

     largest

     ever

     settlement

     with

     a fundraiser.

    2)  In February 2014, the office reached a $500,000 settlement that included 

    permanently shuttering three Long Island‐based charities: the Bi‐County Helpline 

    for Abuse Against Women and Children, Long Island Responds, and Breast 

    Cancer Funds for Research. The settlement also mandated closure of  

    professional fundraiser Mure Associates, and bars accounting firm Portfolio 

    Planners from providing services to New York‐registered nonprofits. 

    3)  In April 2014, the office reached a $50,000 settlement with Mark Gelvan, a 

    telemarketer whose New Jersey‐based companies solicit charitable donations, 

    for violating a 2004 order that barred him from raising money for charity in New 

    York State. 

    The Attorney General needs the help of  citizens and organizations to identify individuals 

    and organizations

     that

     fail

     to

     fulfill

     their

     legal

     responsibilities,

     or

     that

     take

     advantage

     of 

     

    vulnerable or unsuspecting donors.  This office asks that members of  the public and 

    organizations who become aware of  false, misleading, or deceptive solicitations report 

    them to the Charities Bureau, which works with consumer protection organizations to 

    identify and investigate allegations of  false or misleading solicitations. The Attorney

    General also works with other states to enforce laws against solicitors and charities who 

    operate illegally in multiple states.

    FINDINGS 

    This report includes data from 573 campaigns conducted in 2013 by 

    telemarketers registered to solicit charitable contributions in New York.  All of  the 

    figures 

    reported 

    were 

    taken 

    directly 

    from 

    reports 

    filed 

    by 

    the 

    telemarketers 

    and 

    signed 

    by representatives of  both the telemarketers and the charities. The campaigns raised 

    over $302 million.  Key findings include: 

      $156.1 million, or 51.6 percent, of  

    the funds raised by telemarketers 

    in 2013 were paid to fundraisers 

    for fees and/or used to cover the 

    costs of 

     conducting

     the

     campaigns.

     

    Charities retained $146.5 million, 

    or 48.4 percent, of  the total funds 

    raised in the campaigns. 

     

    In 435 of  the 573 campaigns, or 75.9 percent, the charities retained less 

    than 50 percent of  the funds raised, or expenses exceeded contributions 

    (meaning the

     charities

     actually

     lost

     money).

     

      In 282 of  the 573 campaigns, or 49.2 percent, the charities retained less 

    than 30 percent of  the funds raised, or expenses exceeded contributions. 

     

    In 101 of  the 573 campaigns, or 17.6 percent, expenses exceeded 

    contributions. 

      Of  the 573 campaigns, 316 were conducted on behalf  of  organizations 

    located outside of  New York. 

     

    The top five campaigns by gross receipts account for $84.2 million, or 27.8 

    percent, of  all funds raised.

    TIPS BEFORE GIVING 

    In addition to annually issuing the Pennies  for  Charity  report, the Attorney General's 

    staff  works year‐round to ensure that donors are protected, charitable assets are preserved, 

    and 

    those 

    who 

    depend 

    on 

    charity 

    receive 

    what 

    generous 

    New 

    Yorkers 

    and 

    others 

    have 

    donated.  Information about the Attorney General's enforcement actions, as well as 

    guidance for charities and tips for consumers, is posted on the Internet at:

    The website also includes an online registry where you can find the annual financial 

    reports of  registered charities, links to "watchdog" organizations that evaluate charities, and 

    online tutorials. 

    If  you receive a call from a telemarketer, do not feel pressured to give over the phone. You 

    can  just say no!  If  you choose not to hang up, you should ask the caller: 

      What programs are conducted by the charity? 

      How much of  your donation will be used for charitable programs? 

      Is the caller a paid telemarketer?  (By law, you should be told the name of  the 

    professional fundraiser

     conducting

     the

     campaign,

     and

     that

     the

     caller

     is

     being

     paid

     for

     

    making the call.) 

     

    How much is the telemarketer being paid and how much is the charity guaranteed? 

    Also remember: 

      Only give to charities with which you are familiar. 

     

    Do not

     give

     a credit

     card

     number

     to

     an

     unknown

     caller.

     

      Be wary of  callers who pressure you to give or say they will send someone to your house 

    to pick up a contribution.  Worthy charities should give you time to make up your mind. 

      Screen calls if  you wish to avoid answering calls from telemarketers. 

      If  you receive a call from a telemarketer or directly from a charity, you may ask to be 

    placed on a do‐not‐call list of  a specific charity. 

      If  you are suspicious that a charity or a telemarketer is abusive, send a complaint to the

    A REMINDER FOR CHARITIES 

    One of  a charitable organization's most valuable assets is its name.  A charity should 

    not  jeopardize its reputation by permitting a telemarketer to speak on its behalf  without 

    carefully 

    reviewing 

    how 

    the 

    campaign 

    will 

    be 

    conducted 

    and 

    what 

    will 

    be 

    said 

    about 

    the 

    charity and its programs, and then monitoring the telemarketer’s activities.  In addition, 

    before engaging a telemarketer, a charitable organization should: 

      Review this report and previous Pennies  for  Charities reports. 

      Obtain bids from several telemarketers to maximize funds for charitable programs. 

      Talk with other charities that have used the fundraiser to find out about their 

    experiences. 

     

    Explore other means of  raising funds that may be more lucrative. 

      Ensure that the agreement with the telemarketer is in the charity's best interest. It is the 

    responsibility of  the charity's officers and directors to make sure that its contracts are 

    fair and reasonable, and that the charity receives all funds due to it. 

     

    Always review the content of  any material using the charity's name, especially scripts 

    used by the telemarketer. 

      Monitor the campaign to make sure that the telemarketers are properly describing the 

    organization and

     its

     programs.

     

      Get periodic financial reports from the fundraiser. 

      Find out if  any legal action has been taken against the telemarketer due to its 

    fundraising activities. 

      Review the fundraiser’s financial report (Form CHAR037), which must be signed by both 

    the charity and the fundraiser before it is filed with the Charities Bureau.

    HOW THIS REPORT WAS PREPARED 

    The data in this report were obtained solely from financial reports filed with the 

    Attorney General’s Charities Bureau by professional fundraisers registered in New York to 

    conduct 

    telemarketing 

    campaigns 

    on 

    behalf  

    of  

    charitable 

    organizations 

    during 

    2013.

    Those reports are either closing financial statements submitted after completion of  a 

    telemarketing campaign, or interim financial statements submitted annually for campaigns 

    conducted for a period longer than one year.10

      Each filed report must be signed by both the 

    professional fundraiser and the charitable organization it represents.  All of  the charities 

    listed in the report conducted telemarketing fundraising campaigns in New York State.11

     

    However, the amounts reported reflect the total amount of  money raised and not  just what 

    was raised in New York. 

    The report includes seven tables: 

      Table 1 lists the charitable organizations in alphabetical order, the professional 

    fundraisers that conducted each organization’s telemarketing campaign, the 

    geographical location of  each charity, whether the filing submitted was an interim 

    or closing statement, the total amount raised in each campaign, the amount each 

    charity retained,

     the

     amount

     of 

     any

     uncollected

     pledges,

     and

     the

     percentage

     of 

     

    the total raised that each charity retained.  If  a charity engaged more than one 

    telemarketer, each campaign is listed separately. 

      Table 2 is similar to Table 1 and organized alphabetically by professional 

    fundraiser name first.
