he lifeblood of every libertarian regime is found in the vitality of its

judicial system.”1 Corollarily, the quality of the justice system depends, to

a large extent, on the quality of the people administering it -- which, in turn, hinges on

the process of their selection or appointment.

To ensure merit selection of magistrates and other key officials in government,

the Judicial and Bar Council (JBC) was created under the 1987 Philippine

Constitution. It has the principal mandate of recommending at least three nominees for

every vacant position of Member of the Supreme Court and other appellate courts,

judge of lower courts, Ombudsman, Deputy Ombudsman, Special Prosecutor, and

Chairperson and Regular Members of the Legal Education Board.

Year 2013 saw the continuing efforts of the Council to reengineer its selection

process. Thus, process-mapping workshops were undertaken. Comments or

suggestions regarding its policies and evaluative criteria were solicited from judges,

lawyers, and other stakeholders. At the same time, the JBC was able to complete the

processing of applications for 119 vacancies, including three (3) positions of Associate

Justice of the Court of Appeals; one position of Presiding Justice of the

Sandiganbayan; one position of Associate Justice of the Court of Tax Appeals; one

position of Overall Deputy Ombudsman; and three (3) positions of Regular Member of

the Legal Education Board representing the (a) Philippine Association of Law Schools

(PALS), (b) Philippine Association of Law Professors (PALP), and (c) Law Students’

Sector.

I. REGULAR ACTIVITIES

The principal mandate of the JBC is to nominate appointees for the positions of

Chief Justice and Associate Justices of the Supreme Court; Presiding Justice and

Associate Justices of the Court of Appeals, Sandiganbayan, and Court of Tax Appeals;

judges of first and second level courts; Ombudsman, Deputy Ombudsman, and Special

Prosecutor; and Chairperson and Regular Members of the Legal Education Board.

In line with its Vision and Mission, as well as its goal to build up and implement

systems or programs designed to enhance the quality of nominations for the Bench, the

Council undertakes the following regular activities:

A. Inventory and Assessment of Vacancies

The JBC regularly conducts an inventory of vacancies, with data on the dates the

vacancies occurred, caseload of the vacant courts, number of applicants for each

vacancy, previous actions, and status. This inventory serves as an assessment and

planning tool to keep track of the vacancies.

B. Publication and Dissemination of Announcements of Opening of

Vacancies.

To broaden the base of choices for judgeship positions, the JBC causes wide

dissemination of the announcements of the opening of vacancies through print,

broadcast, and electronic media. Specifically, it causes the publication of these

announcements in two newspapers of general circulation with a deadline set for the

filing of applications. It also asks the assistance of Executive Judges, the Integrated

Bar of the Philippines (IBP) and its Chapters, and publishers of local newspapers for

the dissemination of announcements or for their posting in at least three conspicuous

places in the locality where the position is stationed. Likewise, it posts the

announcements in the JBC Website and in the Supreme Court bulletin boards. Upon

the JBC’s request, the Supreme Court Public Information Office posts the

announcements in the Supreme Court Website; disseminates them through its twitter

account; and gives advisory to the media.

C. Processing of Applications

The JBC Secretariat reviews application documents and ensures the completion

by applicants of all the requirements. It prepares a profile for each applicant; a master-

list of applicants in alphabetical order and by geographic region, as well as

comprehensive applicant profile matrices showing the comparative qualifications of all

applicants for every vacant position, the results of background check, synopsis of

oppositions, complaints, comments, and other relevant information.

D. Preliminary Screening of Applications or Recommendation

During the preliminary screening, the Council meets to determine who are viable

candidates for the vacancies and to weed out those who do not meet the minimum

constitutional and statutory qualifications, as well as the Council’s evaluative criteria.

1. First Preliminary Evaluation

The JBC Executive Committee (Execom) consisting of the JBC Regular

Members, as well the representatives of the Ex Officio Chairperson and Members and

of the OCA (assisted by the Executive Officer, ORSN Chief, and two staff members),

meets to determine whether the applicants possess the qualification requirements and

none of the disqualifications. It then comes up with a long list of applicants for

publication.

For the period January to November 2013, the Execom preliminary evaluated a

total of 4,443 applications for 247 positions, i.e., 193 for 3 vacancies in the Court of

Appeals; 11 for Presiding Justice of the Sandiganbayan; 6 for the position of Overall

Deputy Ombudsman; 9 for the position of Deputy Ombudsman for Mindanao; 6 for the

position of Legal Education Board (LEB) Member representing the Philippine

Association of Law Schools (PALS) and Philippine Association of Law Professors

(PALP); and 4,218 for 239 judgeship positions.

2. Second Preliminary Evaluation

The Council En Banc, which is comprised of the JBC Ex Officio Chairperson

and the Ex Officio and Regular Members (assisted by the JBC Ex Officio Secretary and

her staff and by the Executive Officer), deliberates on the long list of applicants who

survived the first preliminary screening.

In 2013, the Council En Banc had only one preliminary deliberation. It took up

54 applications for 9 judgeship positions.

To streamline the process, the preliminary deliberation by the Council En Banc

has been dispensed with. In its stead, the long list of applicants is submitted to the Ex

Officio Chairperson and Members for their comment or approval before its publication.

E. Publication and Dissemination of Lists of Judicial Applicants

With the assent by the Ex Officio Chairperson and Members, the list of

considered applicants is published in two newspapers of general circulation, with an

invitation to the public to file a sworn complaint, written report, or opposition against

any of the applicants. Those who are eliminated from the list are apprised of such fact

and urged to apply for other vacancies.

In 2013, the JBC caused the publication of 37 announcements of vacancies,

names of applicants for various positions, and schedules of public interview.

Just like announcements of vacancies, copies of the list of applicants are

published in local newspapers (if available), disseminated, announced, or posted in at

least three conspicuous places in the locality where the position exists - - with the

assistance of Executive Judges, the IBP and its chapters, Supreme Court PIO, and

publishers of local newspapers. This list is similarly posted in the JBC website and in

the bulletin boards in the Supreme Court.

In case oppositions are filed, the JBC furnishes the applicants concerned with a

copy thereof for their comment if they so desire and, at its discretion, asks them to

comment thereon during the interview.

F. Background Check

1. Queries on Candidates’ Background or Cases

With the authorization or waiver contained in the applicants’ Personal Data

Sheets, a background check on the candidates in the long list is done with the

assistance of the National Bureau of Investigation (NBI). Requests for information like

pending or decided cases against candidates or any derogatory record are made also

from the following:

1. Office of the President; 6. Office of the Bar Confidant (OBC);

2. Department of Justice (DOJ); 7. Public Attorney’s Office (PAO);

3. Office of the Ombudsman; 8. Integrated Bar of the Philippines

(IBP); and 4. Civil Service Commission (CSC);

5. Office of the Court Administrator

(OCA);

9. Other appropriate agencies.

The information gathered from these sources are compiled and reflected in the

applicant’s profile matrices.

2. Survey on Applicants

To obtain feedback or information from the public as to the reputation of

candidates for appellate courts and key offices in the Office of the Ombudsman and in

the Legal Education Board, questionnaires are sent to persons who have knowledge of

the qualifications or character of applicants. Answers to the questionnaires are held

with strict confidentiality and are tabulated and calculated based on a set criteria and

formula. The results of the survey are then submitted to the Council and serve as a

guide in the evaluation of candidates.

G. Conduct of Psychological/Psychiatric/Psychometric Tests

Apart from the submission of a

sworn medical certificate and the results

of an executive medical examination, the

JBC conducts clinical psychological and

psychiatric tests on applicants. The

Council considers the results of such tests

to ascertain whether the applicants are of

sound physical and mental health to

perform the sacred task of administering

justice.

In 2013, 381 applicants underwent

psychological/psychiatric evaluation administered by JBC psychologists and

psychiatrists in Manila and in the provinces.

Sometime in the last quarter of 2013, following a study and consultations, there

was a shift of orientation from clinical to industrial testing procedures, which

necessitated the acquisition of new sets of psychological tests, as well as training of the

JBC psychologists and psychometrician in the application of the said tests. With such

significant changes the psychologists came up with a different format of reporting the

psychological test results, highlighting each applicant’s strengths and limitations based

on the core qualities of independence, competence, integrity, and probity, which are

being sought for from applicants.

H. Essay-Writing Test

A large part of the time of

magistrates and key officials in the

Office of the Ombudsman and the

Legal Education Board is devoted to

writing orders, decisions, memoranda

or correspondences. It is doubtless

necessary that applicants possess

good writing skill or ability.

An innovation, thus, introduced

by the Chief Justice in 2013 was the

essay-writing test required of

applicants before their interview. Such test is aimed at assessing whether applicants

can express themselves in a clear, concise grammatically-correct, and logical manner.

I. Conduct of Interviews

The Council conducts personal interviews to test their mastery of the law; probe

into their values and philosophies; and observe the candidates' personality demeanor,

and physical condition.

Also, conformably with Rule No. JBC-10 and with its commitment to improve

the transparency and public awareness of its proceedings, the Council conducts public

interviews of candidates for vacant judicial positions in appellate courts, the positions

of Ombudsman, Deputy Ombudsman, Special Prosecutor; and those in the Legal

Education Board. The schedules of the interview are announced in newspapers of

general circulation.

For the year 2013, the JBC conducted on various dates public interviews of 83

candidates, specifically 48 candidates for 3 vacancies in the Court of Appeals; 10

candidates for 1 position in the Sandiganbayan; 10 for 1 positions in the Office of the

Ombudsman; and 5 for 2 positions in the Legal Education Board.

J. Second Execom Deliberation on Candidates

After the psychological and psychiatric evaluation and interview of candidates,

the Execom holds another meeting for purposes of re-evaluating the candidates. It

takes into account the applicants’ educational background; bar examination

performance; professional experience; work performance; awards and distinctions;

other accomplishments, such as authorship of law books and articles and leadership in

organizations; and the results of the background check, survey, psychological and

psychiatric evaluation, and interview.

During its second deliberations in 2013, the Execom tackled 2,223 applications

for 150 positions.

K. Final Evaluation and Selection of Nominees

The Council En Banc meets to deliberate on the list submitted by the Execom

for voting and comes up with a short-list of at least three nominees for each vacancy.

In 2013, it deliberated on 1,481 candidates for 119 positions. It thereafter submitted to

the Office of the President short-lists with 551 nominees for the said 119 positions,

together with pertinent documents concerning the nominees. Before transmittal of the

lists, the nominees were requested to signify their acceptance or non-acceptance of the

nomination. On the other hand, excluded candidates for lower courts were notified and

encouraged to apply for other vacancies.

D. Second Execom Evaluation

After the psychological and psychiatric evaluation and individual or public

interview of candidates, the Execom meets again to further evaluate their

qualifications. Table 6 shows that 150 vacancies with 2,223 applicants were

deliberated upon by the Execom during its second evaluation.

E. Final Evaluation of Candidates and Selection of Nominees

Table 7 indicates the vacant positions, the processing of which was completed by

the Council by coming up with a short-list for submission to the Office of the

President. In 2013, the JBC finalized the lists for 119 positions with a total of 1,481

candidates. It thereafter submitted to the Office of the President short-lists with 551

nominees for the said 119 positions.

IV. SPECIAL PROJECTS AND ACTIVITIES

In connection with its principal mandate and in order to meet the demands of the

times, the JBC undertook in 2013 the following projects or activities:

A. Process-Mapping Workshops

Among the Chief Justice’s thrust is to

professionalize the service. To align itself with

that goal, the JBC undertook to revisit its

plantilla or staffing pattern so as to make the job

title and qualifications match the job description

or actual tasks to be performed. Thus, as a

prelude to the plantilla review, the JBC, upon

the initiative of the Office of the Chief Justice,

had process-mapping workshops, to wit:

B. Dialogue with Various Sectors on JBC Processes

From 2006 to 2008, the JBC

conducted regional dialogues, which

served a three-pronged strategy: as

information drive, search campaign, and

feedback mechanism. They were aimed

at orienting the public on JBC’s search,

screening, and selection processes and, at

the same time, encouraging lawyers to

join the Judiciary. They also afforded the

participants an opportunity to air their

concerns and give recommendations on

how to improve the selection process.

Having been convinced of the gains of the said dialogues, the JBC decided to

resume conducting another round in the Visayas and in Mindanao, particularly, in

1. Cebu City – 23 September 2013; and

2. Davao City – 18 November 2013.

C. Survey on JBC Policies or Reform Initiatives

It behooves the Council to nominate only those who measure up to the standards

or qualities prescribed by the Constitution. Nominees must not only possess these

qualities, but must also appear to, or are perceived by, the public to possess these

qualities.

Thus, in 2008, the Council introduced the Points System, which involves a

mathematical assignment and computation of the points of an applicant based on the

following criteria: (1) educational background; (2) experience; (3) performance; (4)

integrity; (5) personal interview; (6) sound physical and mental condition; and (7)

other related accomplishments like awards and authorship of legal articles or books.

Likewise, a Survey System was adopted in 2008 as part of the background

check insofar as the integrity and reputation of applicants are concerned. This scheme

was patterned after that of the Commission on Judicial Nominees Evaluation in

California, U.S.A. The answers to survey questionnaires are tabulated and calculated

based on a set criteria and formula. To make the survey system work more effectively,

the Council held a dialogue with stakeholders on the said system in 2009 in Manila and

in Cebu City.

Both the Point System and Survey System were pilot-tested and were eventually

approved to serve as guide in the assessment of the qualifications of candidates.

To provide stakeholders in the Visayas and Mindanao with an opportunity to air

their concerns and give their recommendations on how to improve both systems, the

Council conducted a survey thereon concurrent with the dialogues held in September

2013 in Cebu City and in November 2013 in Davao City.

Also included in the survey was the requirement that applicants in government

service should be occupying a position with Salary Grade 27 for them to be considered

for Regional Trial Courts.

D. Pilot-testing of, and Survey on, the JBC Online Application System

The existing JBC online application system in 2013 was very simple:

1. Applications and accomplished Personal Data Sheets (PDS) could be

submitted online through the JBC electronic mail boxes.

2. Since the JBC e-mail boxes lack storage space, applicants were required to

submit flash drives or compact discs containing the electronic file of their

supporting documents.

3. Entries in the PDS in Microsoft Excel format sent through e-mail, as well as

supporting documents in flash drives or CDs, are copied and pasted into the

JBC Integrated Data System.

During the dialogues in Cebu City and Davao City in 2013, pilot-testing of, and

survey on, the JBC online application system were conducted for the following

purposes:

1. To elicit from stakeholders feedback or suggestions on how to enhance the

system; and

2. To assess whether this system would really fast-track the filing and

processing of applications.

The results of the survey and the pilot-test were positive. Hence, negotiations

have been made with the Management Information Systems Office for the

establishment of a bundled enhancement online application system, which would be

linked to the JBC Integrated Data System.

E. Survey on the Proposed Promotion Track and Point System

In line with the Chief Justice’s avowed vision of a robust Judiciary, the JBC has

been trying to enhance its nomination processes for membership or promotion in the

Judiciary. As a preliminary step, it solicited suggestions from judges on the following:

1. Development of a point system that would attempt to scientifically rank the

candidates according to their best fitness for positions that are to be filled;

and

2. Creation of a promotion track for judges.

The suggestions thus far submitted were consolidated and submitted to the

Council En Banc for its consideration.

The selection process is a work in progress. Thus, the JBC will continue to

explore avenues that will lead to the realization of its vision, i.e., a JBC that is

“independent, efficient and a proactive sentinel of judicial service, guided only by the

principles of integrity, excellence and competence; unfettered by the shackles of

friendship, relationship, or other considerations, thus vesting the cloak of Magistracy

on those who will best dispense justice for all.”
