Settlement & Clerking:Please make settlement immediately following the auction. 100% of the purchase price is due at the end of the auction unless specifically noted otherwise in this catalog. By bidding in this sale you are entering into a legal contract whether you are bidding for yourself or another party. All bidding disputed will be handled by the auctioneer. If you are not at the auction, please promptly send payment to American Chianina Assoc. P.O. Box 890 Platte City, MO 64079. The location of the embryos will be made known either in the sale catalog or on the supplement sheet. It’s the buyers responsibility to coordinate shipping of their purchased lot(s). Sale management will make an attempt to see that each lot is made available in an accept-able amount of time.

Sale Terms:

The Right to Flush – All lots described as “The Right to Flush” will carry the following guarantee unless otherwise stated in this catalog. In all cases, a minimum of six (6) transferable embryos is guaranteed to the buyer. In the event of the cow failing to produce the minimum amount of embryos, the buyer will have the option of flushing the cow again until the minimum, and only the minimum number of embryos has been fulfilled or the buyer may elect to have their money returned to them based on a prorated price determined by the auction price of the flush. In all cases the buyer will assume all expenses of the flush. The location of and the technician used will be the choice of the seller and will be made known in the catalog or on the supplement sheet. The buyer will have the right to flush the female as soon as she is available or according to the terms of the specific lot. 50% of the auction price is due sale day and the balance being paid upon completion of the flush and before the buyer receives their embryos.

Embryo Packages – All embryos are grade one unless otherwise stated and are fully guaranteed to consist of their respective mating. Due to the nature of this event and the wide range of geographical locations of the buyers and the sellers involved, no guarantee can be made as to conception rate realized when using these embryos. However, if the buyer uses an embryo technician that is agreed upon by the buyer and the seller then one 90 day pregnancy is guaranteed per 3 eggs unless otherwise stated in this catalog. In all cases the buyer is responsible for shipping arrangements and expenses involved.

Pregnant recipients – In the case of already realized pregnancies (i.e. embryos that have already been implanted and confirmed pregnant) the buyer will pay 100% of the auction price immediately following the sale. Each of these recip-ient females have been examined for pregnancy by a qualified technician and are fully guaranteed to be carrying the mating described in that lot. These cattle will sell without further guarantee. All sexed pregnancies are guaranteed to be carrying the calf sex as determined in the catalog or selected by the buyer. No guarantee, expressed or implied, is made as to a live calf, calf quality or recipient value. In all cases transportation will be the responsibility and at the expense of the buyer in cooperation with the seller.

Semen – All semen is guaranteed to be of acceptable quality but no guarantee is made as to conception rate. The buyer is responsible for shipping arrange-ments and all expenses involved with shipping.
