PENNSYLVANIACopyright 2001 LWVPA-CEFThe League of Women Voters publishes thisinformation neither to endorse nor to reject theviews of any candidate quoted and does notassume responsibility for the content of acandidate’s reply.Candidates were asked: Because of somepublic concern about the amount of moneybeing spent in statewide judicial elections, would you support an amendment to thePennsylvania Constitution changing themethod of selecting statewide judges to amerit selection process? Why or why not?

JUDGE OF THE SUPERIORCOURT

Job DescriptionThe Superior Court is one of Pennsylvania’stwo statewide intermediate appellate courts. This court, which was established in 1895,reviews most of the civil and criminal casesthat are appealed from the Courts of Com-mon Pleas in the Commonwealth’s 67 coun-ties. The Superior Court consists of 15 judgeswho serve 10-year terms. The president judgeof Superior Court is elected to a five-yearterm by his or her colleagues. A huge volumeof appeals flow to Superior Court from thetrial courts. Generally, appeals are heard bypanels of three judges sitting in Philadelphia,Harrisburg or Pittsburgh. The court often isthe final arbiter of legal disputes. Althoughthe Supreme Court may grant a petition forreview of a Superior Court decision, mostsuch petitions are denied and the ruling of theSuperior Court stands.Term: 10 yearsSalary: $178,914

Endorsed by Pennsylvania DemocraticParty, Allegheny and Philadelphia LaborCouncils, FOP Lodge 91, Professional Fire-fighters Local 1. Register of Wills, AlleghenyCounty 1998-2003.RESPONSE: Reasonable people disagree. Onthe one hand, appointment of judges wouldeliminate problems posed by campaignfundraising, especially large corporate contri-butions now permitted by the U.S. SupremeCourt. On the other hand, our Constitutionshould not lightly be amended, particularlywhere amendment would disenfranchisePennsylvanians. Those who would alter ourConstitution carry a heavy burden. While I amnot yet persuaded, I have an open mind andbelieve the issue merits candid and thought-ful discussion.

JUDGE OF THECOMMONWEALTH COURT

Job DescriptionThe Commonwealth Court is one of Penn-sylvania’s two statewide intermediate appel-late courts. This court, which was establishedin 1968, is unlike any other state court in thenation. Its jurisdiction generally is limited tolegal matters involving state and local govern-ment and regulatory agencies. Litigationtypically focuses on such subjects as banking, insurance and utility regulation and lawsaffecting taxation, land use, elections, laborpractices and workers’ compensation. Com-monwealth Court also acts as a court oforiginal jurisdication, or a trial court, whenlawsuits are filed by or against the Common-wealth. The Commonwealth Court is madeup of nine judges who serve 10-year terms. The president judge is chosen by his or hercolleagues for a five-year term. The courtgenerally decides cases in three-judge panelsand sits in Philadelphia, Harrisburg and Pitts-burgh.Term: 10 yearsSalary: $178,914

I have fullconfidence in the Pennsylvania voters tocarefully consider each candidate’s qualifica-tions and make the best judgment. PENNSYLVANIA JUDICIALRETENTION ELECTIONS

Judicial retention is a system of retainingjudges for additional terms after they havebeen elected on a partisan, contested ballot.Previously elected incumbent candidates forjustice or judge appear unopposed on theballot. The only question confronting thevoter is whether or not the judge should beretained. All judicial retention candidateswere asked to list their education, occupationand qualifications for this office as well as thesame question on the Judicial Conduct Board.

They are billed quarterly at a set ratefor 8,000 gallons whether they use thatamount or not. However, owners of apart-ment buildings are billed only one set rate notmultiplied per apartment. I fought foreach of these goals in my first term whilevoting against every tax increase.
