Submitted are the following comments to the Affidavit of Atty. Melchor G.

Magdamo (Magdamo) dated 15 April 2010:

1,. Paragraphs 1 to 3 of the Affidavit - I specifically deny the allegations in these

paragraphs for lack of knowledge or information sufficient to form a belief as

to the truth or falsity thereof;

2. Pars.4 and 5 -These do not refer to the ballot secrecy folder.

3. Par. 6 - This does not refer to the ballot secrecy folder. However, I am

attaching a copy of Resolution No. 8490, dated July 18, 2008, to show that the

allegations in this paragraph are mere rehash of issues previously resolved by

the Commission en banc. lt is submitted further that the Panel of lnvestigators

should be very cautiours about the veracity of the allegations in the Magdamo

Affidavit since Magdamo has once again omitted from said affidavit, in the

same manner he withheld way back in 2008, a public document, namely,

Minute Resolution No. 08-0391-, showing that when the BAC proceeded withthe bidding for VRR binders/filler, Minute Resolution No. 08-0364 which

Magdamo repeatedly cites as having suspended the bidding for said items,

was already set aside;

4. Pars.7 to 10 - These do not refer to the ballot secrecy folder; and

5. Pars. 1-1 to 15 - I specifically deny the allegations in these paragraphs for lack

of knowledge or information sufficient to form a belief as to the truth or falsity

thereof.
