BACKGROUND
OnDecember4,2015,FixingAmerica’sSurfaceTransportation(FAST)Act(Pub.L.No.114-94)wassignedintolaw—thefirstfederallawinoveradecadetoprovidelong-termfundingcertaintyforsurfacetransportationinfrastructureplanningandinvestment.TheFASTActauthorizes$305billionoverfiscalyears2016through2020forhighway,highwayandmotorvehiclesafety,publictransportation,motorcarriersafety,hazardousmaterialssafety,rail,andresearch,technology,andstatisticsprograms.WiththeenactmentoftheFASTAct,stateandlocalgovernmentsarenowmovingforwardwithcriticaltransportationprojectswiththeconfidencethattheywillhaveafederalpartneroverthelongterm.
TheFASTActcontinuedtheCongestionMitigationandAirQuality(CMAQ)programtoprovideaflexiblefundingsourcetostateandlocalgovernmentsfortransportationprojectsandprogramstohelpmeettherequirementsoftheCleanAirAct.

GENERAL INFORMATION
TheproceduresandguidelinessetforthinthisannouncementapplytotheawardofCMAQfundsattributedtotheAssociationofCentralOklahomaGovernments(ACOG),theMetropolitanPlanningOrganizationfortheOklahomaCityAreaRegionalTransportationStudy(OCARTS)TransportationManagementArea,forthepurposeofimplementingaPublicFleetConversionGrantsprogramtobeadministeredasacompetitiveprocess.ACOG’sCLEANAIRGrantsforPublicSectorFleetswillallowOCARTSmemberlocalgovernmentsandtheirpublicschooldistrictstoaccessCMAQfundsforfleetconversionstocleanfueltechnologiestoincludelightduty,mediumdutyandheavydutyalternativefuelvehicles,hybridandplug-inhybridvehicles,andalternativefuelvehiclerefuelinginfrastructure.
This is a reimbursement program.Allapplicantsmustdemonstrateanabilitytofundandmanageactivitiesatthetimetheyareundertaken.Applicantsmustbeabletodemonstratetheabilitytoproviderequiredmatchingfundsasapplicable.Theapplicant(s)mustfinancetheentireprojectuntiltheprojectiscompletedandfederalshareisreleasedforreimbursement.Privatesectorgranteeswillreceivereimbursementthroughtheirpublicsponsor.
This is a vehicle replacement program.Vehiclesforwhichawardfundsaremadeavailablemustbereplacementvehiclesandrequiretheremovalofalikedieselorgasolinepoweredvehiclefromthefleet.Fleetsizemustbereducedorremainthesame.(SeeCertifiedVehicleReplacements,page6)

6. Public-PrivatePartnerships(PPP):PrivatesectorentitiesthatcontractservicessuchasrefusehaulingorschooltransportationortheestablishmentofalternativefuelingstationoperationsandmaintenancetoeligibleOCARTSareapublicentitiesareeligibletoapplyforfunding.However,theprojectneedsalocaljurisdictionsponsorwillingtosubmittheapplication.InaPPP,aprivateentity’sresourcesreplaceorsupplementlocalfundsinaselectedproject.PPP’smusthavealegal,writtenagreementinplacebetweenthelocaljurisdictionandtheprivateornon-profitentitybeforeaCMAQ-fundedprojectmaybeimplemented.TheseagreementsshouldbedevelopedunderrelevantStatecontractlawandshouldspecifytheintendeduseforCMAQfunding;therolesandresponsibilitiesoftheparticipatingentities;andhowthedispositionofland,facilities,andequipmentwillbecarriedoutshouldtheoriginaltermsoftheagreementbealtered(e.g.,duetoinsolvency,changeinownership,orotherchangesinthestructureofthePPP).ItremainstheresponsibilityofthelocaljurisdictiontoapplyforfundingandtooverseeandprotecttheinvestmentofCMAQfundsinthe(PPP).
Publicfundsshouldnotbeinvestedwhereastrongpublicbenefitcannotbedemonstrated.Consequently,CMAQfundsmustbedevotedonlytoPPPsthatbenefitthegeneralpublicbyclearlyreducingemissions,notforfinancingmarginalprojects.
Sharingoftotalprojectcosts,bothcapitalandoperating,isacriticalelementofasuccessfulpublic-privateventure,particularlyiftheprivateentityisexpectedtorealizeprofitsaspartofthejointventure.
PROJECT PERIOD
Theestimatedprojectperiodforawardsresultingfromthissolicitationwillbegin in January 2021 withanexpectedprojectcompletion date no later than October 2022.

A.Alternative Fuel Infrastructure

NATIONAL ENVIRONMENTAL POLICY ACT (NEPA) REQUIREMENTS
AllCMAQfundedprojectsmustmeetNationalEnvironmentalPolicyAct(42U.S.C.Sec.4321-4347)requirementsandsatisfythebasiceligibilityrequirementsunderTitle23andTitle49oftheUnitedStatesCode.ProjectsfundedunderthisannouncementaresubjecttoNEPAreview.
Liquid and gaseous fuel infrastructure installations:Thetimeframefortheperformanceofenvironmentalassessmentsforliquidandgaseousfuelinginfrastructurecantakesixmonthsormore.Thereforeinordertoexpeditethestateandfederalreviewprocess,applicants must submit a preliminary environmental assessment with liquid and gaseous fuel infrastructure project applications.
Electric Vehicle Supply Equipment (EVSE) also known as electric vehicle charging infrastructure, and vehicle replacement projects:Ordinarily,EVSEinfrastructureprojectsandvehiclereplacementprojectsqualifyasCategoricalExclusions(CE)undertheNEPAprocess.Forthesetypesofprojects,thetimeframeforcompletionofanenvironmentalreviewpriortofinalrecommendationsforgrantawardsunderthissolicitationisestimatedtobe30days.ACOG will submit projects in the EVSE infrastructure and vehicle replacement categories to the Oklahoma Department of Transportation for a CE ruling.
DESCRIPTION OF ELIGIBLE PROJECTS
A.Alternative Fuel Infrastructure Projects:
Theseprojectswillestablishfuelingfacilitiesandotherinfrastructureneededtofuelorrechargealternativefuelvehicles.Iftheproposalsupportsabillingsystem,itmustbeauniversalcardbillingsystem.
ForthepurposesofthisCMAQ-fundedgrantopportunity,eligiblealternativefuelinfrastructureislimitedtoprojectsthatrelatetothestorageanddispensingof:
1. Compressednaturalgas(CNG)andLiquefiednaturalgas(LNG)
2. Liquefiedpetroleumgas(LPG,propane)
3. Electricity–AlternatingCurrent(AC)orDirectCurrent(DC)ElectricVehicleSupplyEquipment(EVSE)
Important Note:ThiscategoryislimitedtoprojectsinstalledatexistingfuelingfacilitiesorfleetyardsexceptinthecaseofEVSEwhichislimitedtoinstallationatexistingparkingfacilitiessuchasfleetyards,parkinggarages,parkinglots,andon-streetparkinglocations.
AllequipmentpurchasedandinstalledwithACOGCLEANAIRGrantsfundingmustbenew.Usedand/orrefurbishedequipmentisnoteligibleforfunding.

ItisneithertheintentofACOGnorthisCLEANAIRGrantssolicitationtofundalternativefuelinfrastructureprojectstocompetewithprivateenterprise.Therefore,public-privatepartnershipinfrastructureprojectsthatincludeinstallationandoperationbyestablishedprivatesectorentitiesareencouraged.
Allalternativefuelinfrastructureprojectsmustfallintooneofthefollowingthreecategoriesoracombinationthereof,andinthecaseofelectricvehiclerechargingandCNG,mustmeetorbetterthespecifiedcapacities.
1. High Capacity Public and/or Private Access Infrastructure
a.Forprojectsinvolvingelectricvehiclerecharging,requiredminimumcapacity:DCquickchargestationcapableofrechargingabatteryelectricpassengercarfrom20percentemptyto80percentfullinlessthan30minutes,usinghighpoweroutputof96kilowatts(480VoltsDC,200Amps).
b. ForprojectsinvolvingCNG,requiredminimumcapacity:two(2)dispenserswithtwo(2)hoseseach;400scfm(standardcubicfeetperminute)compressor(s)output;30,000scfto60,000scfstoragevolume;5,500poundspersquareingauge(psig)storagecapacityand3,600psigfillcapacity.
2. Medium Capacity Public and/or Private Access Infrastructure
a.Forprojectsinvolvingelectricvehiclerecharging,requiredminimumcapacity:ACLevel2chargestationcapableofrechargingabatteryelectricpassengercarfrom“empty”to“full”insix(6)toseven(7)hoursusingmaximumpoweroutputof3.3kW(240Voutputat32A).
b. ForprojectsinvolvingCNG,requiredminimumcapacity:one(1)dispenserwithtwo(2)hoses;200scfm(standardcubicfeetperminute)compressor(s)output;30,000scfstoragevolume;5,500psigstoragecapacityand3,600psigfillcapacity.
3.Time-Fill Private Access Fleet Facility Infrastructure
a.ForprojectsinvolvingCNG,requiredminimumtime-fillcapacity:25-50scfm(standardcubicfeetperminute)compressor.Optional“quick-fill”storagecapacitiesaslisted:

B. Light Duty and Heavy Duty Dedicated Alternative Fuel Vehicles (AFVs)
Theseprojectswillpurchasepublic-sectorand/orcertainprivate-sectorowned(seePublicPrivatePartnershipsunderEligibleApplicantssection)OriginalEquipmentManufacturer(OEM)dedicatedalternativefuelvehiclesthatrunexclusivelyoncompressednaturalgas(CNG),liquefiedpropanegas(LPG),orelectricity(batteryelectricvehicles–BEV)including

DedicatedOEMalternativefueloff-roadequipmentprojectssuchaspropaneorcompressednaturalgascommercialmowersarealsoallowableunderthissolicitation(seeD.DedicatedAlternativeFuelCommercial/IndustrialMowingEquipmentunderthisSection).
Onlydedicatedalternativefuelvehiclesareeligibleforfunding.Additionally,allvehiclesandequipmentpurchasedwithACOGCLEANAIRGrantsfundingorusedasprojectfundingmatchmustbenew.Usedand/orrefurbishedequipmentorexistingfleetvehiclesarenoteligibleforfunding.

eligibleforCMAQfunding.HybridpassengervehiclesmustmeetlowemissionsandenergyefficiencyrequirementssetbyEPAthatwouldqualifythemtotravelassingle-occupantvehiclesinHighOccupancyVehicle(HOV)lanesinstatesthathaveHOVlanes.TobeeligibleforCMAQfunding,hybridvehiclesmustmeetTier2emissionsstandardsandfallwithinBins5,4,3,2,or1.
AlistofcurrentmodelyearalternativefuelandadvancedtechnologyvehiclesincludingHEVsandPHEVscanbefoundintheU.S.DepartofEnergy’sAlternativeFuelsDataCenter.AdditionalBinclassificationinformationcanbefoundundertheU.S.EnvironmentalProtectionAgencyandU.S.DepartmentofEnergyFuelEconomy.govwebsitebyaccessingtheFindaCarmenu,thenusingtheCompareSide-by-Sideapplication,andthenclickingtheEnergyandEnvironmenttab-EPASmogRatingsforthevehiclesbeingcompared.
1. Projectsinvolvingheavy-duty hybrid vehicles,includingrefusehaulers,streetsweepers,andothertrucksalsomaybeappropriateforprogramsupport.Eligibilitywillbebasedonacomparisonoftheemissionsprojectionsoftheselargercandidatevehiclesandothercomparablemodels.
2. Asusedinthissolicitation,thetermhybrid vehicleincludeshybrid-electric vehicles, and plug-in hybrid vehicles.Hybrid vehicles are not required to have alternative fuel capacity.
D. Dedicated Alternative Fuel Commercial/Industrial Mowing Equipment
DedicatedOEMalternativefuelcommercial/industrialmowingequipmentisallowableunderthissolicitation.
OnlydedicatedOEMmowingequipmentfueledexclusivelybypropane,compressednaturalgas,orbatterypoweredelectricityiseligibleforfundinginthiscategory.Additionally,allequipmentpurchasedwithACOGCLEANAIRGrantsfundingmustbenew.Usedand/orrefurbishedequipmentisnoteligibleforfunding.
CERTIFIED VEHICLE REPLACEMENTS
Light Duty VehiclesdefinedandclassifiedaspassengervehiclesorasClass1andClass2truckswithGrossVehicleWeightRatings(GVWR)of≤10,000lbs.Canonlybereplacedwithlightdutyvehiclesandcannotbereplacedwithheavydutyvehicles.
Lightdutygasolineanddieselvehiclesmaybereplacedwithnew,currentModelYear(MY)orneweralternativefuelvehicles,orhybridsandplug-inhybridsmeetingcurrentapplicableTier2,Bin5throughBin1,EPAemissionslimits.
Heavy Duty Vehicles*definedasClasses3through8truckswithGrossVehicleWeightRatings(GVWR)of≥10,001lbs.–canbereplacedwitheitherlightdutyvehiclesorheavydutyvehicles.
*Important Heavy Duty Vehicle Replacement Note: Theweightclassofaheavydutyreplacementvehiclemaynotbegreaterthantheweightclassofthevehiclebeingreplaced.(Example: A Class 6 truck with a GVWR of 19,501 lbs. – 26,000 lbs. can be replaced with a Class 1 – 6 truck but cannot be replaced with a Class 7 truck because a Class 7 truck has a GVWR of 26,001 – 33,000 lbs.)SeeAPPENDIXBfortrucktypesandweightclassifications.Heavydutygasolineanddieselvehiclesmaybereplacedwithnew,currentMYornewercertifiedalternativefuelvehicles,orhybridandplug-inhybridsmeetingthe2010EPAemissionsstandardsforheavydutyengines.

EPA Emissions Standards Certification Requirement Note:AnEPA-issuedEmissionsStandardsCertificateofConformitymustbeprovidedtoACOGwithprojectinvoicingforgaseousfuelvehicleprojects(CNGandLPG)forvehiclesotherthanOriginalEquipmentManufacturervehiclesorvehiclesoriginallyequippedwithOEMnaturalgasenginessuchastheCumminsISL-Gseriesengines,orvehiclesequippedwithfactory-installed,gaseousenginepreppackagesandpurchasedthroughtheStateofOklahomaStatewideFleetContract.
REMOVAL OF VEHICLES FROM FLEET
Vehicles eligible for replacement include:
•Heavy Duty:gasolineordieselvehicles(GVWR≥10,001lbs.;Class3,4,5,6,7,8trucks)
•Light Duty: gasolineordieselvehicles(GVWR≤10,000lbs.passengervehiclesandClass1,2trucks)
•Commercial/Industrial Mowing Equipment:gasolineordieselcommercial/industrialmowers

BUDGET DOCUMENTATION
Supportingdocumentationforbothinfrastructureprojectbudgetsandvehiclereplacementprojectbudgetswillconsistofcurrentitemizedpricequotesfromvendors/contractorsandanyotherpertinentdocumentsthathelpillustratetheprojectcosts.
Tobeconsideredforfunding,itemizedpricequotesforvehiclesmust make clear the incremental cost forthededicatedalternativefuelvehicleand/orhybridvehicles.Insomecasesthismayneedtobeaccomplishedbyprovidingapricequoteforthealternativefuelvehicleorhybridvehicleanditsidenticallyequippedconventionalfuelcounterpart.Inallcases,theincrementaldifferencemustbedeclaredandsupportedbydocumentation.Statecontractbasepricesforconventionalfuelvehiclesandtheiralternativefuelcounterpartsmaybesubstitutedwhereappropriateforitemizedpricequotes.
