TCEQ Regulations Definitions, Abbreviations, and Acronyms

• Drinking water All water distributed by any agency or individual, public or private, for the purpose of human consumption, or which may be used in the preparation of foods or beverages or for the cleaning of any utensil or article used in the course of preparation or consumption of food or beverages for human beings. The term “drinking water” also includes all water supplied for human consumption or used by any institution catering to the public. In this document, the terms “drinking water,” “potable water,” and “finished water” are used to mean the same thing: water that has been treated in accordance with TCEQ standards and which is delivered to customers for human consumption by public water systems.

• §290.44(h)(2) No water connection from any public drinking water supply system shall be connected to any condensing, cooling, or industrial process or any other system of nonpotable usage over which the public water supply system officials do not have sanitary control, unless the said connection is made in accordance with the requirements of paragraph (1) of this subsection. Water from such systems cannot be returned to the potable water supply.

• §290.46(j)(4) A customer service inspection is an examination of the private water distribution facilities for the purpose of providing or denying water service. This inspection is limited to the identification and prevention of cross-connections, potential contaminant hazards, and illegal lead materials. The customer service inspector has no authority or obligation beyond the scope of the commission's regulations. A customer service inspection is not a plumbing inspection as defined and regulated by the TSBPE. A customer service inspector is not permitted to perform plumbing inspections. State statutes and TSBPE adopted rules require that TSBPE licensed plumbing inspectors perform plumbing inspections of all new plumbing and alterations or additions to existing plumbing within the municipal limits of all cities, towns, and villages which have passed an ordinance adopting one of the plumbing codes recognized by TSBPE. Such entities may stipulate that the customer service inspection be performed by the plumbing inspector as a part of the more comprehensive plumbing inspection. Where such entities permit customer service inspectors to perform customer service inspections, the customer service inspector shall report any violations immediately to the local entity's plumbing inspection department.

Uniform Plumbing Code

• 603.4.13 Portable Water Supply to Carbonators “shall be protected by either an air gap or a vented backflow preventer for carbonated beverage dispensers installed within the carbonated beverage dispenser. The carbonated beverage dispenser shall bear the label of an approved testing agency, certifying and attesting that such equipment has been tested and inspected, and meets the requirements of the approved applicable standard. Carbonated beverage dispensers without an approved internal air gap or vented backflow preventer for carbonated beverage dispensers and carbonated beverage dispensing systems shall have the water supply protected with a vented backflow preventer for carbonated beverage dispensers.”

International Plumbing Code Yr. 2012

• 608.3 Devices, appurtenances, appliances and apparatus.

– All devices, appurtenances, appliances and apparatus intended to serve some special function, such as sterilization, distillation, processing, cooling, or storage of ice or foods, and that connect to the water supply system, shall be provided with protection against back flow and contamination of the water supply system. Water pumps, filters, softeners, tanks and all other appliances and devices that handle or treat potable water shall be protected against contamination.

American Beverage Association (ABA)

• National Soft Drink Association (NSDA) now called American Beverage Association issued a statement stating that “…. Under the new code language, the soft drink industry will meet the code requirements by installing the new backflow preventer meeting the ASSE Standard 1022 during the dispenser manufacturing process. This change will eliminate the need to install backflow prevention devices on the permanent dispenser water line after the dispenser is installed in the establishment. Fountain dispensers that currently use an internal non‐vented dual check valve (ASSE 1032), the industry standard for decades, will be required to have an ASSE 1022 device installed on the dispenser water line.”

Determining Applicability

ASSE 1022 Dual Check Valves. Any dual check valve device with atmospheric vent that meets ASSE 1022 standards are approved for carbonated beverage systems. These non-testable devices are typically installed directly to the carbonator at the water inlet connection. These devices also have a relief port and a drain line shall be routed from these ports to an approved receptacle, such as a floor sink. These units are non-testable, so if these devices are used, the business operator shall have the device(s) inspected annually and provide an inspection report from a commercial beverage system installer, licensed plumber, or certified backflow tester, stating the backflow preventer is operable or that it is not malfunctioning, or replace the double check valve(s) annually. Annual inspection records of service maintenance shall be kept onsite for verification by a Department representative.

Summary and Conclusion• Should the water selection tap on carbonator beverage

units be isolated and tied in up stream of approved backflow prevention assembly?

• Local water purveyor may have additional, more stringent rules.
