M/s. SKM Egg Products is an EOU located at Erode for manufacture and export ofEgg Yolk Dried, Other Egg Dried, Egg Albumen Dried, Pasteurised Egg Liquid, Egg Atbumenand Egg Powder Mix. The Unit has made the following two requests and wants clarificationfrom this office:-

L) Whether they can import duty free goods (feed materials like Soya, Maize,Jowar, Wheat, etc) and other ingredients and materials for the poultry farm in DTA locatedat S.F.No.43312, Thulukkampalayam, Nadanthai, Aravakurichi, Karur from where they buyeggs (captive consumption)?

2) Whether they can set up a layer farm along with Feed Mill in the existing EOU

area located at Erode-Karur Main Road, Cholangapalayam, Erode or in an area nearby tothe EOU and whether they would be eligible for duty-free import and materials requiredfor the farm?

As per para 6.00 of Foreign Trade Policy, the term 'manufacture' of goods includesPoultry. In other words, an EOU can be set up for taking up Poultry as a manufacturingactivity. Since Poultry can be a manufacturing activity for an EOU, it can be inferred thatthe goods required'for the poultry farm, can be imported duty free as in the case of anyother EOU involved in the manufacturing of goods.

The other provisions relating to Poultry are Para 6.01 (g) of Foreign Trade policy and6.22 of Handbook of Procedures.

a. As per para 6.01(9) of FTp, an EoU engaged in poultry may be permitted toremove specified goods in connection with its activities for use outside thepremises of the Unit. However, neither the FTP nor HBP has prescribed theprocedure for such removal of specified goods outside the premises of theUnit.

It4/s.Hexagon Nutrition ( Exports) P\4.Ltd., was issued LOA for manufacture and export of"Micro Nutrient Premixes" vide letter dated 14.10.2004 and subsequently obtained broad bandingpermission for Trading of,Vitamins, Minerals, Food & Feed additives Printed Laminated plasticfilms and Pouches vide letter dated 04.05.2010. The Date of Commencement of production is04.12.2004. The validity of LOA is upto 03.12.2024.

Their LOA was renewed for the 4th Five year block period with effect from 04.12 .2019 to03.12.2024 vide lejtter dated 31.10.2019. The Unit has sought permissiori for Trading for 22items( list attached). The Unit has stated that there is no change in the projections in the Foreign

Exchange Balance sheet submitted for the 4th five year block period, which starts from 04.12.2019.The Unit has further stated that their earning would be Foreign Exchange only for the Tradingactivity.

Ltd., Developer of the sector specific SEZ forHeavy Engineering located at Coimbatore vide letter dated 03.09.2019 has stated that one of theUnits in the SEZ viz. ZF Wind Power Coimbatore Ltd. proposes to install a 22OO KWdc Solar rooftop project within their unit premises for captive consumption. Their vendor, M/s.SKRE SolarPrivate Limited is willing to carry out the installation, commissioning, operation and maintenanceof the said project for a period of 15 years.

In relation to the above mentioned project, it is stated that M/s.SKRE Solar PrivateLimited, being the owner of the proposed installation, wants to avail duty benefits and taxexemptions as available to the installations done within the SEZ and the unit viz. M/s. ZF WindPower Coimbatore Ltd. will execute the lease deed with M/s.SKRE Solar Private Limited, for thesaid purpose. The Developer of the SEZ has conveyed no objection for setting up of the statedSolar Project by M/s. SKRE Solar Private Limited on the roof top of the unit viz. M/s. ZF WindPower Coimbatore Ltd. for leasing of the roof top space to the service provider. In this regard,the Developer has requested for the following:-

1. Permission to M/s. SKRE Solar Private Limited, for installation of 220 KWdc Solar Project onthe roof top of M/s.ZF Wind Power Coimbatore Ltd., a unit in the SEZ;

The unit submitted the details of the key business justification & Advantage are as

follows;

. They stated that when the tool could not identify the problem in the electronic

vehicle due to coding issues, they send the software patch to diagnostic tool tosolve the problem.

o During this situation to rectify the coding issue in the tool, a software patch willbe created by the team, but since the engineers developing the patch is remotelysolving the field problem, many time patch is not delivered with first time right.

o In order to improve the first time right solution, the software patch could be

validated in the vehicle to be imported, so that the quality of patch will be

improved leading to better customer satisfaction.

The unit has also informed that they have obtained relaxation in Policy and Procedure in

terms of Para 2.58 (c ) of FTP, 2OL5-20 for import of used left hand drive car for advance

electronic systems programming through Chennai Sea Port vide DGFT letter dated 3O.O7.2OL9.

The Authorised Officer has informed that if the activity required by the unit is accepted

to be covered under the definition of authorised operations, then the procurement may be

allowed with the condition that the vehicle will not move outside the SEZ.

In this regard, another unit, M/s. Robert Basch Engg. Business Solutions Ltd. located inCHIL SEZ, Coimbatore was issued permission with the following conditions, the same conditionscan be imposed to this unit for the import of the passenger car.

L. The proposed import goods viz. "Cars" would fall within the scope of the definition ofcapital goods given under the scope of the definition of capital goods given under Rule (2X1X

e) of SEZ Rules,2006 which reads as follows :

"any plant, machinery, equipment or accessories required for manufacture or

production, either directly or indirectly, of goods or for rendering services, or fordevelopment of SE2...".

Since the imported cars are intended to be used for testing the software developed by the unit,

it could be treated as capital goods directly connected with the unit's authorised operations

approved under the LOA. Under the Rule 27(Ll of SEZ Rules, a unit may import all types ofgoods, including CG, RM, semi-finished goods, components, consumables, spares and materials

for making goods for their authorised operations.

2. The unit shall submit an Undertaking to the effect that the imported cars would be used

only in connection with the authorised operations of the unit.

3. The imported cars shall be moved out of the SEZ into DTA only with the prior written

permission of the Authorised Officer of the SEZ. A movement register shall be maintained by

the unit for recording the date/period of use of the cars in the DTA along with the purpose of

use. The register will be submitted to the Authorised Officer every fortnight for

cou ntersignature.

4. The unit shall comply with the provisions of Motor Vehicles Act and other relevant Acts

in connection with the usage of the cars in the SEZ and DTA.

5. In the event of any violation of the above conditions, the permission shall be withdrawn

with immediate effect.

1. Flaps:

The unit submit that the tyres manufactured by them are fitted on to rims and on to a

vehicle in case of tube less tyre and in other cases, a tube is inclosed in the tyre before fittingthe same onto the rim. While fitting the tyre on to a rim, flaps are used to protect the bleeding

of the tyre or the tube. The flaps are also used to protects the tube from chafing with the rim.

2. O-Rines:

They are located in a groove between the rim & bead seat ring to create an seal and

hence needs replacement whenever the air seal becomes weak.

3. Valves:

The pneumatic tyres which the unit manufacture needs to be filled in with air before

the vehicle can be operational. The air is pumped into the tube or the tyres where a valve is

provided. The unit inform that the value is also prone to defects and may need replacement

whenever required.

As all the above products are in contact with metal, they have less life than the tyre

but the customers are asking the unit to supply only those products.. As the unit tyres are ofnon-regular size, their customers are finding it difficult to source them in open market. Hence

the above request for Broad banding of trading of goods.

The unit further undertakes to pay necessary applicable duties and taxes and also

abide by any other condition that may be imposed in this regard.

As per the agreement, the unit is required to supply Cement for construction workand the Contractor is required to supply sand and aggregates to produce RMC. For theproduction of the RMC the unit is require to install RMC batching plant in their SEZ premises.

As report by the unit, the plant is very much necessary as bringing of RMC material fromoutside SEZ is not feasible in large quantities and also involvement of transportation cost.

08.03.2013 and surrendered all original documents including Green Card and also submitted

LUT for exit. The unit was asked to submit 'No Due Certificate' from Jurisdictional Authorities

on 24.O4.2OI4. The unit has not submitted 'No Due Certificate' so far. The Assistant

Commissioner of Central Excise, Tirunelveli vide thelr letter dated 21,.7.2016 had informed that

Green Card has been extended upto 24.09.2012" The unit has achieved positive NFEE of

<1213.85 lakh as per the APRs submitted from 2007-08 to 201-2-13.

The unit has applied for exit on 07.05.2012 and surrendered all original documents

including Green Card. They had also submitted LUT for exit.
