19.03.010 Uniform Building Code (UBC) adopted.

For the purpose of regulating the erection, site construction, enlargement, alteration, repair, moving,removal, demolition, conversion, occupancy, equipment, use, height, area and maintenance of all buildings andstructures or portions thereof in the City and Borough, there is adopted by reference, as the building code of the

City and Borough, that certain compilation of rules and regulations prepared by the International Conference ofBuilding Officials, a nationally recognized technical trade organization, which compilation is entitled "UniformBuilding Code, 1997 Edition," (UBC) and five copies each of which have been filed in the office of themunicipal clerk of the City and Borough, or places designated by the municipal clerk for public use, inspectionand examination, and which compilation is made a part of this chapter as if fully set forth in this section, subjectonly to the enumerated additions, deletions and changes in this chapter.(Serial No. 99-19, § 2, 1999)

19.03.100 Administration.

Delete UBC Chapter 1, Administration, except as referred to elsewhere in this code.(Serial No. 99-19, § 2, 1999)

19.03.203 "B" definitions.

In UBC Section 203, Definitions, B, delete the definition of Building, Existing and add the following:

"Building, existing, is a building that:

(A) was erected before December 5, 1956; or

(B) was erected before March 27, 1999 and complies with the building code regulations ineffect at the time of construction."

19.03.214 "M" definitions.

In UBC Section 214, Definitions, M, add the following definitions:

In Section 214, add the following:

"Mechanical ventilation is a system that delivers tempered or controlled supply air to a spaceusing air handling equipment. See AIR, SUPPLY in the Uniform Mechanical Code."

19.03.216 "O" definitions.

In UBC Section 216, Definitions, O, add the following:

"Office is an area used by employees in which services, clerical work, professional duties and such tasksare performed."

In UBC Section 223, Definitions, the definition of "value" or "valuation," delete the reference to Section

19.03.302.5 Heating equipment room occupancy separation.

In UBC Section 302.5, Heating equipment room occupancy separation, delete Group E and add Group Ito the first exception. All references to boiler and central heating systems in the paragraph immediatelypreceding the exception apply only to boilers and central heating systems that are fuel-fired.(Serial No. 99-19, § 2, 1999)

19.03.303.8 Special hazards in Group A occupancies.

In UBC Section 303.8, Special hazards in Group A occupancies, all references to boiler and centralheating systems apply only to boilers and central heating systems that are fuel-fired.(Serial No. 99-19, § 2, 1999)

19.03.305.1 Group E occupancies defined.

In UBC Section 305.1, Group E occupancies defined, delete Division 3 and add the following:

"Division 3. Any building, or portion of a building, used for day care purposes for more than sixpersons, including children under the age of 12 related to the staff."

19.03.305.2.3 Requirements for Group E occupancies.

In UBC Section 305.2.3, Requirements for Group E occupancies, special provisions, add a newparagraph as follows:

"Group E, Division 3 occupancies that are licensed to care for more than six persons between the hoursof 10:00 p.m. and 6:00 a.m. shall be equipped with an approved automatic sprinkler system throughout,designed and installed in accordance with NFPA Standard 13D-1994 or approved equivalent system."

Add the following exceptions:

"4. Family child care homes operating between the hours of 6:00 a.m. and 10:00 p.m. mayaccommodate a total of eight children without conforming to all the requirements of thisregulation except for smoke detectors as specified in Section 310.9; exiting, including operablewindows in napping or sleeping rooms as specified in Section 310.4; and fire extinguisherrequirements."

"5. Day care facilities that are operated in a primary residence between the hours of 6:00 a.m. and10:00 p.m. accommodating a total of 12 children may use the second story of the buildingwithout complying with Section 305.2.3 Exception 2, Table 3-B, Table 5-A and Type V-1 hourrequirements set out in Table 5-B provided all other applicable legal provisions for an E-3occupancy are met."

Add a new third paragraph as follows:

"Rooms used for sleeping or napping purposes within an E-3 occupancy shall be provided with a smokedetector that complies with Section 310.9.1."

19.03.310.4 Requirements for Group R occupancies, access and exit facilities and emergency escapes.

In UBC Section 310.4, Requirements for Group R occupancies, access and exit facilities and emergencyescapes, in the third paragraph after " . . . sleeping room . . . ," add the following:

"or other habitable room over 70 square feet and not used for cooking, eating or living room uses."

At the end of the third paragraph, add the following sentence:

"The building official may accept a recorded deed restriction as an alternative to this requirement whenthe current use of the space will clearly not include sleeping."

19.03.310.9.1.2 Additions, alterations or repairs to Group R occupancies.

In UBC Section 310.9.1.2, Additions, alterations or repairs to Group R occupancies, revise paragraph toread:

"When a plan review is required in an existing Group R occupancy, smoke detectors shall be installed inaccordance with Sections 310.9.1.3, 310.9.1.4 and 310.9.1.5 of this section."

19.03.310.9.1.4 Smoke detector requirements for Group R occupancies.

In UBC Section 310.9.1.4, Requirements for Group R occupancies, smoke detectors, location withindwelling unit, in the first sentence after " . . . sleeping room . . . ," add the following:

"or other habitable room over 70 square feet and not used for cooking, eating or living room uses."

Revise the fourth sentence as follows:

"When sleeping rooms are on an upper level, the detector shall be placed at the ceiling of the upper levelin close proximity to the stairway if there is no door or other obstruction at the top of the stairway toblock the path of smoke and near the ceiling at the bottom of the stairway if there is such an obstructionat the top of the stairway."

At the end of the paragraph, add the following sentence:

"The building official may accept a recorded deed restriction as an alternative to this requirement whenthe current use of the space will clearly not include sleeping."

19.03.310.9.1.5 Smoke detectors and sprinkler systems requirements for Group R occupancies.

In UBC Section 310.9.1.5, Requirements for Group R occupancies, smoke detectors and sprinklersystems, location in efficiency dwelling units, congregate residences and hotels, in the first sentence after " . . .congregate residence sleeping rooms . . . ," add the following:

"or other habitable room over 70 square feet and not used for cooking, eating or living room uses."

At the end of the paragraph, add the following sentence:

19.03.310.11 Heating in Group R occupancies.

Change UBC Section 310.11, Heating in Group R occupancies, to read:

"Every dwelling unit or guest room which is situated on a lot any part of which is within one-quartermile of a public or private road from which the owner may gain legal access to the lot or which issituated on a lot any part of which is within one-quarter mile of a public utility electric powerdistribution line shall be provided with heating facilities capable of maintaining a room temperature of70 degrees F at a point three feet (914 mm) above the floor in all habitable rooms without involving thecombustion of a solid fuel."

19.03.508 Fire resistive substitution.

In UBC Section 508, Fire resistive substitution, add the following exception:

"Exception: In one-story E-1 occupancies, a fire sprinkler may be used in accordance with this sectionfor fire-resistive substitution under the following conditions:

1. The fire sprinkler system must be fully compliant with UBC Standard 9-1.

2. The total square footage of the building must be 20,000 square feet or less, or areaseparation walls or occupancy separations having a fire-resistive rating of not less thantwo hours must be provided to subdivide the building into separate compartments thatcontain an aggregate floor area not greater than 20,000 square feet. When two-hour ratedoccupancy separations are used, they must extend up through the attic to provide acomplete fire break."

19.03.904.1.4 Fire-extinguishing systems; state permit.

In UBC Section 904, Fire-extinguishing systems, add subsection 904.1.4 as follows:

"904.1.4 State permit. No sprinkler systems shall be designed, modified, installed or maintained exceptunder the supervision of an individual or company holding a valid permit issued by the state fire marshalas required in 13 AAC 50.035. The requirement for such a state fire marshal permit is not required inone- and two-family dwellings and mobile homes."

19.03.904.2.2 Fire-extinguishing systems; floor area.

In UBC Section 904.2.2, Fire-extinguishing systems, all occupancies except Group R, Division 3 andGroup U occupancies, in the first sentence, delete the following:

"the floor area exceeds 1,500 square feet (139.4 m2) and".(Serial No. 99-19, § 2, 1999)

19.03.904.2.2 Fire-extinguishing systems; automatic sprinkler system.

Revise UBC Section 904.2.2, Fire-extinguishing systems, all occupancies except Group R, Division 3and Group U occupancies, by deleting the fifth paragraph and exceptions and adding the following paragraph:

"5. In all newly created buildings that have floors used for human occupancy over 35 feet above thelowest level of fire department vehicle access shall be equipped throughout the building with anautomatic sprinkler system that complies with Chapter 9 of the Uniform Building Code andChapter 10 of the Uniform Fire Code. This shall not affect the provisions of UBC Section 505,Allowable Area Increases or UBC Section 508, Fire Resistive Substitution."

Add subsections 6, 7 and 8 as follows:

"6. When new construction, addition or remodeling creates a building where the ground floor area

exceeds 12,000 square feet. For this section only, not less than four-hour area separation wallsmay be used to divide larger buildings into buildings less than 12,000 square feet, however,automatic closing door openings with three-hour fire resistive ratings are allowed at a rate of nomore than one opening in every 50 lineal feet of area separation wall."

"7. When new construction, addition or remodeling creates a building where the total area underroof, regardless of area separation walls, exceeds 24,000 square feet."

"8. In all buildings more than three stories in height."(Serial No. 99-19, § 2, 1999)

19.03.904.2.4.1 Fire-extinguishing systems, Group E occupancies.

In UBC Section 904.2.4.1, Fire-extinguishing systems, Group E occupancies, delete exceptions 1 and 2.(Serial No. 99-19, § 2, 1999)

19.03.904.3.2 Fire-extinguishing systems; alarms.

In UBC Section 904.3.2, Fire-extinguishing systems, alarms, in the second sentence, add "visual strobe"after "audible."(Serial No. 99-19, § 2, 1999)

19.03.904.4 Permissible sprinkler omissions.

In UBC Section 904.4, Permissible sprinkler omissions, a new item as follows:

"6. In elevator mechanical rooms when all of the following criteria are met:"

"6.1. The building is otherwise protected throughout with an approved automatic sprinklersystem and;"

"6.2. Such rooms are separated from the remainder of the building by a two-hour fire resistiveoccupancy separation with all openings in the separation protected by a fire assemblyhaving a 1 1/2 hour fire protection rating and;"

"6.3. Such rooms are used exclusively for such equipment and;"

"6.4. An approved automatic smoke detection system is installed in such rooms and the systemis supervised by an approved central, proprietary or remote service or a local alarm whichwill give an audible signal at constantly attended locations and;"

"6.5. Other approved fire-protection equipment such as portable fire extinguishers or class IIstandpipes are provided adjacent to the entry into the room."

"The above does not apply to elevator shafts. The fire sprinkler head for the top of elevator shafts mayhave a marked globe valve sealed open installed so the single head can be turned off in an emergency."

In UBC Section 1002, Definitions, "Private stairway", add the following to the end of the definition:

"The provisions of this division may not be construed to allow the elimination of fire protection systemsor a reduction in the level of fire safety provided in buildings constructed in conformance withpreviously adopted codes."

Revise Section 3406.2, Existing non-high rise structures, effective date, to read:

"Plans for compliance shall be submitted for approval within 18 months of notification of violation ofthis chapter by the building division and the work required for compliance shall be completed within 18months of permit issuance."

In Section 3413, revise the first paragraph to read:

"These requirements apply to all high-rise buildings constructed before 10/28/90 which have floors usedfor human occupancy which are located more than 75 feet (22,860 mm) above the lowest level ofapproved fire department vehicle access."

Revise Section 3413, by adding the following paragraph:

An existing building, regardless of occupancy, that exceeds the areas andheights allowed by Chapter 5 of this code or that does not conform to the requirements of Section 503,Location on the Property, and in the building official's opinion presents a serious fire threat to adjacentproperty, will, in the building official's discretion, be required to have installed an approved automaticsprinkler system, area separation walls, a combination of both, or other approved means intended toreduce the fire threat."

19.03.Standard_9-1_4-4.1.7.2.5 Elevator hoistways and machine rooms.

UBC Standard 9-1, Section 4-4.1.7 is revised by the addition of a new section 4-4.1.7.2 to read:

"4-4.1.7.2(a) Elevator hoistways and machine rooms. Sidewall spray sprinklers shall be installed at thebottom of each elevator hoistway, not more than two feet (0.61 m) above the floor of the pit."

"Exception: For enclosed, noncombustible elevator shafts that do not contain combustible hydraulicfluids, the sprinklers at the bottom of the shaft are not required. Automatic sprinklers in elevatormachine rooms or at the top of hoistways shall be of ordinary or intermediate temperature rating.Upright or pendent spray sprinklers shall be installed at the top of elevator hoistways."

"Exception: Sprinklers are not required at the tops of noncombustible hoistways of passenger elevatorswhose car enclosure materials meet the requirements of ASME A17.1 Safety Code for Elevators andEscalators."
