B&E&$* and the Capital %evelopment $uthority )the BC%$* were raised! It was #ontended in

the &etitions that #ertain a#tions and omissions of the &E&$ and the C%$ had adversely affe#ted

the environment of Islamabad!

The administrative boundaries of the #ity and distri#t are established by the Ordinan#e! TheOrdinan#e also assi8ned the mana8ement of the #apital area+ in#ludin8 the nearby #ity of

.awalpindi+ to the C%$! (owever+ subseuent le8islation has seen the #reation of new mana8in8

institutions and as a result of whi#h there are #urrently three )9* main a8en#ies #har8ed withsome aspe#t of development and administration in Islamabad! Ea#h of these is dis#ussed below!

The &E&$ is also mandated an important role in the environmental mana8ement of Islamabad!

)1* Capital %evelopment $uthority

nder the Ordinan#e+ the C%$ has the power to perform all fun#tions reuired to implement the

aster &lan! The C%$ wors under the Cabinet %ivision of the Federal Dovernment and ismainly tased with land mana8ement+ development+ #ontrol and the provision of muni#ipal

servi#es!

)2* Islamabad Capital Territory $dministrationThe Islamabad Capital Territory Order+ 1>=0+ #reated the ICT$ and in 1>=1 #onferred on it all the

powers and duties for the administration of the overall ICT areas in#ludin8 Islamabad! Themana8ement of rural areas was transferred from C%$ to the ICT$! In this way+ ICT$ mana8es

the ma/ority of the rural areas and C%$ #ontinues to mana8e the urban area! (owever+ there is

still substantial /urisdi#tional overlap and as a result+ poli#y implementation and 'onin8enfor#ements have deteriorated and ille8al en#roa#hments and in#ompatible land@uses

proliferated! The ICT$ is mandated to administer matters relatin8 to land+ revenues+ food+ law

and order+ #ivil defen#e+ #o@operatives+ transportation+ population+ housin8+ womenGsdevelopment+ labour+ so#ial se#urity and some infrastru#ture+ mainly in rural areas!

)9* Capital $dministration and %evelopment %ivision

The Constitution )Ei8hteenth $mendment* $#t+ 2010 )the B2010 $mendment $#t* deleted the

Con#urrent ?e8islative ?ist! .esultantly+ several sub/e#ts were transferred to the eH#lusive

#ompeten#e of the provin#es! This led to the abolition of several federal ministries for thetransfer of their fun#tions to the provin#es! To deal with the fun#tions and a#tivities of the

devolved ministries spe#ifi# to Islamabad+ a new division named the Capital $dministration and

%evelopment %ivision )the BC$%%* was #reated in ar#h 2011! The C$%% was vested withthe mandate to eHe#ute+ within the /urisdi#tion of ICT+ all su#h fun#tions handled by the

abolished ministries and divisions and su#h other fun#tions as allo#ated to it from time to time!

$s su#h+ C$%% was #on#eived to be the sole administrative a8en#y for servi#e delivery in

edu#ation+ health and spe#ial edu#ation se#tors within the ICT! (owever+ the FederalDovernment subseuently Brevived some old inistries under a new nomen#lature su#h as the

inistry of Edu#ation and &rofessional Trainin8 and inistry of ational (ealth 3ervi#es! The

inistry of Climate Chan8e was also a result of this de#ision of the Federal Dovernment in areaswhere overall federal #o@ordination is reuired! The Federal Dovernment has re#ently

re#ommended abolishin8 C$%% as the inistry of Edu#ation and &rofessional Trainin8 as well

5! on@Implementation of ?aws and &oli#ies

The Commission found that+ 8enerally+ a satisfa#tory le8al and re8ulatory framewor eHists for

the prote#tion of the environment of Islamabad! It presently provides an adeuate basis to

pro#eed! The #hallen8e has been that these laws and re8ulations are not properly implemented orenfor#ed by the Federal Dovernment+ C%$+ &E&$ and ICT$! Other reasons for the ineffe#tive

implementation in#lude the la# of publi# awareness+ the non@fun#tionin8 of some of the

Environmental Tribunals and Environmental a8istrate+ and a la# of an adeuate and well@trained #apa#ity for environmental 8overnan#e!

The Commission resisted the attempt to propose new le8islation)s* and re8ulations when the

eHistin8 laws and poli#ies are 8enerally not implemented! It re#ommends Bimplementation as itsmost important re#ommendation for the future of Islamabad!

Implementation reuires the #ommitment to developin8 a #apa#ity and the politi#al will! Thiswill need #apa#ity buildin8 and resour#e allo#ation! The ba#bone of an appropriate ar#hite#ture

for environmental prote#tion is the EI$! This basi# environmental tool has not been used

effe#tively! Dovernment pro/e#ts routinely i8nore this reuirement and when #omplian#e is#ontested+ it turns out that the whole eHer#ise of approval did not #omply with the essential

reuirements of transparen#y and publi# parti#ipation! Instead+ as pointed out in a re#ent

/ud8ment of the ?ahore (i8h Court in Imrana Tiwana vs! &rovin#e of &un/ab=+ su#h approvals

are not professionally handled but are an eHtension of 8overnment poli#y di#tated to theapprovin8 E&$!

That the Federal Dovernment and the a8en#ies #ontinually disre8ard the letter and spirit of thelaws and poli#ies with respe#t to Islamabad #an be shown by the followin8 eHamplesA

)1* The aster &lan of Islamabad is a solemn do#ument that should have been respe#ted andfollowed! $lthou8h the aster &lan is and should be a livin8 do#ument+ the Dovernments from

time to time amendedmodifiedbrea#hed it without providin8 a transparent pro#ess for its

Constitution!

The C%$+ in li8ht of the order of the 3upreme Court in in 3uo otu Case o! 10200< $#t empowers &E&$ to issue an E&O to prohibit an a#tual or potentialadverse environmental effe#t+ to prevent the violation of the rules and re8ulations or the violation

of any of the substantive provisions of the 1>>< $#t! 7y issuin8 an E&O+ &E&$ has the power to

prevent+ stop or lessen the harm done to the environment of Islamabad by dire#tin8 thepersonsindustries to stopremovedispose of the effluent+ waste+ air pollutant+ noise+ or ha'ardous

In the rural areas of ICT+ almost siHty );0* water supply s#hemes are bein8 operated by the

To ensure #ontinuous supply of #lean drinin8 water+ the #hlorinators are reuired to be timely

repla#ed! (owever+ due to pau#ity of funds+ timely installation and repla#ement of #hlorinatorssuffers whi#h+ in turn+ affe#ts the supply of #lean drinin8 water to the rural areas!

3imilarly+ water supply in the urban areas of ICT is the responsibility of C%$! Even thou8h C%$has set up a number of water filtration plants in the se#toral areas+ filtration fa#ility is provided

only to some of the areas! Further+ no #hemi#al and biolo8i#al pro#essesreverse pro#essosmosis

pro#ession eH#han8e is bein8 done+ whi#h affe#ts the uality of the drinin8 water!

Further+ .awal ?ae+ whi#h is a sour#e of drinin8 water for .awalpindi+ is re#eivin8 untreated

sewa8e and other wastes from the irre8ularly 8rowin8 population of 7araaho+ 7ari Imam+

3hadara+ 7ani8ala and other ad/oinin8 populations main8 the water hi8hly polluted and toHi#!3imilarly+ 3imli ?ae+ that provides a sour#e of drinin8 water for Islamabad+ is re#eivin8

untreated sewa8e and other waste from urree and newly developed #olonies alon8 the urreeEHpressway whi#h are pollutin8 the water and renderin8 it unfit for human #onsumption!

To over#ome these impediments+ the C%$+ ICT$ and the Cabinet %ivision have /ointly prepared

a pro/e#t envisa8in8 the #onstru#tion of five )5* de#entrali'ed sewera8e treatment plants

upstream of .awal ?ae at the #ost of .s! 2+25= million in the #at#hment area of .awal ?ae)the B&ro/e#t* to ensure the supply of #lean drinin8 water from .awal ?ae! The &ro/e#t was

submitted to the inistry of &lannin8+ %evelopment and .eforms! (owever+ fundin8 is still

awaited! $dditional water resour#in8 from Tarbela may also be #onsidered!

fa#ilitate a maret@based mana8ement of solid waste! This #an be a#hieved by the outsour#in8 of

the solid waste mana8ement in Islamabad+ as has been done in ?ahore! The eHperien#e of ?ahoreprovides an attra#tive basis for Islamabad to move on similar lines! This #an be repli#ated by

formin8 a #ompany under 3e#tion :2 of the Companies Ordinan#e+ 1>=:! The #ompany so

formed should outsour#e the solid waste mana8ement throu8h an open and #ompetitive biddin8by invitin8 both national and international firms! The winner of the bid should be tased to

develop an inte8rated system of solid waste mana8ement to ensure effi#ient #olle#tion+

transportation+ re#overy+ treatment and disposal of the waste 8enerated in Islamabad while theC%$ performs a supervisory role!

)9* (ospital aste ana8ement

The hospitals and other health #are fa#ilities 8enerate various inds of ris and non@ris waste!

The non@ris waste is similar to domesti# waste and a##ounts for more than =0L of the hospital

waste! The remainin8 10@20L is ris waste whi#h+ after se8re8ation+ needs spe#ial treatment!

nfortunately+ there are no satisfa#tory and (ospital .ules@#ompliant arran8ements for hospitalwaste mana8ement in ICT and the waste from hospitals and health #are institutions is miHed up

with the muni#ipal waste! 3ome types of su#h waste+ lie human pla#enta+ is bein8 used inpoultry feed industry!

The -i#e Chan#ellor+ &I3+ %r! "aved $ram+ pointed out durin8 his attendan#e of the thirdmeetin8 of the Commission as a 3pe#ial Invitee that there is a lon8@standin8 reuest of &I3

with the E#onomi# $ffairs %ivision for the pro#urement of an in#inerator for &I3! The Fren#h

Dovernment had indi#ated an interest in this! %urin8 a meetin8 on ; O#tober 2015 at the

inistry of Climate Chan8e reuested by the Chair+ representatives of several hospitals inIslamabad1;/oined to #onfirm that if &I3 8ets the in#inerator+ over 50L of the hospital waste

disposal needs of Islamabad will be met! This #an also be sour#ed throu8h the Dlobal

Environment Fa#ility )DEF* by the 3e#retary+ Climate Chan8e!

To ensure the proper disposal of hospital waste+ the Commission proposes the followin8A

)h* 3everal hospitals in Islamabad are outsour#in8 their waste disposal with spe#ialistor8ani'ations su#h as the ational Cleaner &rodu#tion Center! This trend should be

stren8thened and similar outsour#in8 arran8ements must be developed for the eHtensive

hospital wastes 8enerated by the hospitals+ health#are fa#ilities and laboratories in

Islamabad!

)i* The hospitals in Islamabad should or8ani'e a Islamabad (ospital aste ana8ementCommittee to #o@ordinate #entrali'ed in#inerator fa#ility)ies* for the use of all the

hospitals on a shared@#ost basis!

)/* &E&$ and the inistry of Climate Chan8e are already #oordinatin8 installation of an

inte8rated fa#ility for solid and ha'ardous waste mana8ement in Islamabad by the world

leadin8 Derman waste mana8ement firm $?7$! If this fa#ility is under implementation+

it needs to be #oordinated with the other re#ommendations of the Commission!

):* Industrial aste ana8ement

There is no system or me#hanism in ICT for handlin8 and disposin8 the industrial wastes from

3e#tors I@> and I@10K therefore+ the Commission re#ommendsA

)a* $ detailed waste amount survey of all su#h fa#ilities needs to be #arried out! 7ased on

this survey+ a ha'ardous landfill site and allied fa#ilities #ould be developed!

)b* The wastewater from the industries should be treated and reused in 8reen belts+ ifappropriate!

)#* arble waste handlin8 in ,hyber &ahtunhwa and other provin#es may be looed at for

any 8ood pra#ti#es!

)5* $ir &ollution ana8ement

$mbient air uality of Islamabad reveals that annual avera8e mass #on#entration of parti#ulate

matter )&2!5* ):5 to >5 8 m9* and nitri# oHide )O* ):1 to120 8 m9* eH#eed the

standard set by the E43! The ma/or #ontributors of air pollution in Islamabad are the motor

vehi#les and the emissions from the industries in 3e#tors I@> and I@10!

To #ontrol and mana8e the air pollution+ the Commission re#ommendsA

)a* &E&$ should run a #ity@wide toHi# assessment #ampai8n to monitor the total amount oftoHins+ in#ludin8 mer#ury+ bein8 emitted in the air of Islamabad! 7ased on this survey+ the

ambient air uality standards for the #ity must be revised and #ompulsory emission limitsbe set! The present ambient air uality should also be displayed and shared with the

publi#!

)b* &ermanent onitorin8 units to be set up!

)#* Compulsory emission limits must be set and the Bself@monitorin8 and reportin8 tool

)3$.T* must be reintrodu#ed to the industries of Islamabad! This will monitor the

whi#h+ resultantly+ has led to arbitrary amendments of the aster &lan and the ICT 6onin8.e8ulations+ and weaened the pro#ess of EI$!

In view of this+ the Commission re#ommends the settin8 up of an institutionali'ed permanentpubli# en8a8ement #ommittee )the B&EC* for ea#h 'one of ICT! These &ECs may #omprise of

parliamentarians from Islamabad+ representative)s* of the ele#ted lo#al 8overnment+ urban

planners+ ar#hite#ts+ en8ineers+ media+ #ivil so#iety+ a#ademi#s+ and eH offi#io members from the

lo#al administration! The &ECs should parti#ipate and follow up on EI$s done for differentdevelopment pro/e#ts to be #arried out in their relevant 'ones! $lso+ the &ECs will hold publi#

hearin8s to dis#uss any proposed #han8es or amendments in the aster &lan and the ICT 6onin8
