    ABOUT THE COLLEGE

    Legal education and legal profession have been held in high esteem

    throughout the world since time memorial. Undisputedly legal education has a

    cardinal role to play in the matter of ensuring legal justice to the citizens. Herein

    lays the pivotal role of law colleges and law schools. The last few decades have

    witnessed the due importance being given to legal education in India. An element of

    professionalism is writ large in the contemporary legal education in India.

    Rashtrasant Tukadoji Maharaj Nagpur Universitys Dr. Babasaheb Ambedkar

    College of Law, a premier legal institution of Central India is a name familiar to the

    legal fraternity all over India and needs no introduction. Yet as a matter of sheer

    delight a few words about the college will not be unwarranted.

    Rashtrasant Tukadoji Maharaj Nagpur Universitys Dr. Babasaheb

    Ambedkar College of Law (BACL), formerly known as University Law College,

    established in the year 1925 is the conducted college of the University. The college

    has the glorious beginning as Sir Vivian Bose who went on to become the Judge of

    Supreme Court of India was the first Principal of this college. The college, over the

    years, has attracted talent from all over India. Even today when the college is facing

    competition from the private law colleges, it is attracting young and talented

    students not only from the area within the jurisdiction of the University but even

    beyond. Large number of students from the adjoining areas of Chhattisgarh and

    Madhya Pradesh States and also from the far flung areas of Delhi and North

    Eastern states have been taking admissions in the college. This is testimony of the

    reputation and rock solid standing of the college in central India.

    The popularity, standing, credibility and reputation of the college has

    been built over the years through the dedicated and selfless service of the

    successive Vice-Chancellors of the University, Principals and teaching and non-

    teaching staff of the college. The contribution of the students of the college in

    building the edifice of its reputation is no less significant. The alumni of the college

    is awesome and star studded one. It includes the stalwarts in almost all important

    walks of public life. The spectrum is as broad as it could be. If on one hand it

    includes the most notable politicians like former Prime-Minister of India late Shri.

    Narsimha Rao, Shri. Devendra Fadnavis (Chief Minister, Maharashtra) and Shri.

    hand it includes legal luminaries like, Honble Shri Justice S.A. Bobde (Judge,

    At BACL, the emphasis is on overall development of personalities of the

    law students. The emphasis is also on value education. With the motto of producing

    lawyers who are socially sensitive and citizens of high moral values, the college has

    been organizing various events including the most prestigious and popular

    JUSTA-CAUSA which will be entering its 14th year. Students from the

    prestigious law schools and colleges from all corners of India eagerly await this

    event and make it a point to participate in it.

    EVENTS OF JUSTA CAUSA

    1. NATIONAL MOOT COURT COMPETITION

    To moot means to bring something to a discussion. In a figurative sense,

    Moot Court means Hypothetical case or hearing/ trial. The aim of Moot Court

    activity is to groom the budding lawyers. It trains the students of law to create

    links between theory and practice. Moot court competition provides a platform to

    the law students to show case their mooting talent. It also is a way for the students

    to learn from their peer group. Taking into consideration this significance of moot

    court competition, we include this competition in the Law Festival. The judges for

    the preliminary and semi-final rounds of the competitions are eminent practicing

    lawyers. The final round of the moot court competition will be judged by sitting

    Honble Judges of the Bombay High Court, Nagpur Bench, Nagpur.

    2. NATIONAL SEMINAR

    Seminars have unique characteristics of bringing several people to share

    their knowledge and experiences and views on a chosen topic. It inspires the

    delegates to view the topics from various angles and give their observations based

    on their scientific study. Since the seminar provides an opportunity to the students

    also to express their views on the selected topic before the elite and educated

    audience it helps them to develop the confidence for public speaking.

    In view of the above mentioned significance of the seminar, our JUSTA

    CAUSA festival has national seminar as an integral event for last several years.

    This year since we have chosen the topic of Health Laws as a theme of the JUSTA

    CAUSA festival, the choice of Health Laws in India-Issues and Challenges as

    the theme of National Seminar, was the natural and obvious choice.

    3. NATIONAL LEGAL DRAFTING COMPETITION

    The legal drafting competition provides an opportunity to the students to

    develop their drafting skill which is hallmark of a successful lawyer. In this

    competition, a legal problem will be given to the participants along with the

    research material. The participants will have to draft the case within the stipulated

    time. These written submissions will then be judged by a panel of judges. The

    National Drafting Competition shall be conducted by Moot Court Association.

    4. NATIONAL LAW QUIZ COMPETITION

    A quiz is a form of game or mind sport in which the participants attempt

    to answer the questions correctly. Quiz competitions are very beneficial for the

    students to improve and expand their breadth of knowledge. Such competitions

    also aid in team building process and provoke discussion and healthy debate

    amongst the participants. Therefore, for the aspiring and inquiring minds of the

    law students, the college has organized a national level quiz competition called

    Justa Quizza. It shall be a brain storming session where workable questions

    shall be asked to test the in depth knowledge of the participants.

    5. NATIONAL DEBATE COMPETITION

    Every law student must be a good communicator. Good communication

    requires critical thinking and creativity. These skills are enhanced by social

    interaction and personal expression. Therefore, for the very first time, the college

    is providing a platform of a National Level Debate Competition to the budding

    lawyers to develop their skills of communication and public speaking.

    6. THE LATE SHRI RATANLAL HIRASAV DONGAONKAR MEMORIAL NATIONAL LEGAL ESSAY WRITING COMPETITION

    Essay writing is aimed to test and enhance writing skills of the students.

    It also serves as a tool to test their knowledge and imagination. It involves critical

    thinking and research skills as well as the ability to develop and logically express

    and defend his view point. The National Legal Essay Writing Competition is

    aimed to provide a Nation-Wide platform to the law students to demonstrate their

    skills of research, language and presentation of their ideas on a particular topic.

    7. JUSTA CAUSA GUEST LECTURE

    One of the hallmarks of the Justa Causa National Law Festival is the

    guest lecture delivered by the eminent legal eagles of India. In the earlier episodes

    of our festival, the Honble Judges of the Supreme Court of India, like Honble

    Shri J. D. D. Sinha, Honble Shri J .Markandeya Katju, Honble Smt J. Ruma Pal,

    Honble Shri J. V.S. Sirpurkar, Honble Shri J.A.M. Ahmadi and Honble Shri J

    .J.S Verma, among others, have delivered their intellectually stimulating and

    academically enriching lectures on various themes of contemporary significance.

    Generally, the lecture is followed by an interactive session between the speakers

    and the audience, mostly the law students. Following this rich tradition, this year,

    Honble Shri. Justice Sharad A. Bobde, Judge, Supreme Court of India, has kindly

    consented to deliver this years Justa Causa Lecture.

    8. MUSICAL PROGRAMME.

    The college appreciates the hard work and toil put in by the

    participating teams who come from all over the country to exhibit their talents.

    And therefore, amidst the tight schedule of the gruesome academic activities, the

    college has also given due recognition to the recreational need of the participating

    teams.

    RULES FOR THE NATIONAL MOOT COURT

    COMPETITION

    1. Number of teams:

    Maximum of 32 teams will be accommodated for the competition.

    Selection of the teams will be done on first come first serve basis.

    2. Team Composition: Each team shall have not more than 3 members i.e. 2 speakers and 1

    researcher.

    3. Rounds: a. The Moot Court Competition shall comprise of the following three

    rounds:

    i. Preliminary Round divided into I-A & I-B on 22nd January 2016.

    ii. Semi-Final Round on 23rd January 2016.

    iii. Final Round on 23rd January, 2016.

    b. All the rounds are knockout rounds. For the Preliminary Round i.e.

    Round I, the teams will be divided into two leagues by a draw of lots.

    c. Each team will have to argue from both sides in the Preliminary Round

    (Comprising of I-A & I-B). This order will be decided by draw of lots at

    the time of orientation on 20th January, 2016.

    d. The teams which have won both their Preliminary Rounds, shall be

    eligible for qualification in the Semi-final Round which shall consist of

    4 teams. In case there are 5 or more teams who have won both their

    preliminary rounds, the aggregate marks shall be considered and the top

    4 teams who have won both their rounds and have highest aggregate

    marks shall qualify for the Semi-Final Round. In case there are 3 teams

    who have won both their preliminary rounds, the fourth place in the

    Semi-Final shall go to the team, which has won one round in the

    preliminaries and also has the highest aggregate marks in both the

    preliminary rounds. In case there are 2 teams who have won both their

    preliminary rounds, the third and fourth place in the Semi-Final shall go

    to the teams which have won one round in the preliminaries and also

    have the highest aggregate marks in both the preliminary rounds. In

    case there is only one team which has won both its rounds, similar

    procedure as mentioned above shall be followed. In case of a tie in the

    above procedure, the marks scored for the memorials shall be the

    deciding factor. In case of any doubt decision of the Coordinator will be

    final.

    e. The sides for the Semi-Final round will be decided by draw of lots

    immediately after the results of Round I. This round will be held on 23rd

    January, 2016.

    f. The top 2 teams shall then argue the case in the Final Round on 23rd

    January, 2016.

    4. Memorials:

    a) The memorial shall necessarily consist of the following:

    (a) Cover Page

    (b) Table of Contents

    (c) List of Abbreviations

    (d) Index of Authorities

    (e) Statement of Jurisdiction

    (f) Statement of Facts (not more than two pages)

    (g) Issues Raised

    (h) Summary of Arguments

    (i) Body of Pleadings (not more than fifteen pages)

    (j) Prayer

    b) All the teams shall submit twelve (12) copies of the memorials of each

    side that is to say 12 copies from petitioners side and 12 copies from

    the respondents side, Thus, a total of 24 memorials are to be

    submitted, at the time of orientation on 20th January, 2016. The copies

    are not to be sent in advance.

    c) The memorials shall not exceed 35 Pages.

    d) The memorials, should not bear any mark capable of identifying

    the team. Putting any such mark on the memorial shall invite

    disqualification of the team.

    e) The Petitioner memorials MUST have light Blue paper covers while

    the Respondent MUST have light Red. Use of plastic binding is

    prohibited. Memorials should be stapled or stitched by cotton thread.

    Teams are advised not to use spiral or comb binding.

    f) All memorials submitted must conform to the following general rules:

    1. It must be printed on white A4 size paper with black ink

    only.

    2. The font used must be Times New Roman, size 12.

    3. The Harvard Blue Book style of footnoting must be followed

    as far as practicable.

    4. The font of footnotes must be Times New Roman, Size 10,

    single line spacing.

    5. Each page of the memorial must have a margin of one inch

    on all sides, excluding its page number. Page numbers must

    be given on the top right hand corner.

    6. The Body of Pleadings must not exceed fifteen (15) pages in

    all.

    5. Oral Submissions:

    a) Each team should have two speakers who shall divide the oral

    submissions between them. Rebuttals are permitted. Sur-rebuttals are

    at the discretion of the judges.

    b) For the preliminary round each team shall have a maximum of 15

    minutes to present their oral submissions. In the semi-final round each

    team shall have a maximum of 30 minutes to present their oral

    submissions. For the final round, a maximum time of 45 minutes shall

    be given to each team. However, granting more time will be at the

    discretion of the judges and no complaints/appeals regarding the same

    shall be entertained. The division of time between the two mooters

    shall be at their discretion. The aforesaid time would include the time

    that each team may want to reserve for their rebuttals.

    c) No speaker shall be permitted to address the court for more than 10

    minutes in the preliminary round, for more than 20 minutes in the

    semi-final round and for more than 30 minutes in the final rounds.

    6. Marking Criterion:

    Following shall be the marking criteria and the marks allotted per mooter.

    Each mooter shall be marked out of 100. Thus, the total team marks, per

    judge, will be 200. Each round shall be before a two judges bench,

    making the team marks out of aggregate 400 marks. Therefore team

    marks in the Preliminary Round (including I-A and I-B round) would be

    out of 800.

    Whichever team secures more marks as against its opponent, shall be

    considered as having won its round. The decision of the judges shall be

    final and binding. In order to ensure uniformity in the marking system all

    I. ABOUT THE SEMINAR:

    Health and well being are deeply personal matters but being on the receiving end of it is what gives us new awareness on various aspects related to health. Every human has a right to highest attainable standard of physical and mental health. This right to health has thus evolved a whole system for protection of health. It ensures that every human has equal access to good quality of services for maintenance of sound health. Indian judiciary has recognized right to health as an indispensable part of right to life under article 21. Right to Life does not connote merely animal existence rather it has a much wider meaning which includes right to health and medical care being essential for making the life of every person meaningful and purposeful with dignity of person. It is a basic human and fundamental right, as recognized in landmark cases like State Of Punjab Vs. Mohinder Singh Chawla; Parmanand Katara Vs. Union Of India, etc. Thus right to health was held as an as integral part of right to life and government has constitutional obligations to provide health facilities and medical services. At the same time, implementation of right to health has its own highest challenges. Access to healthcare is compromised with poor services, deficient resources, lack of effective policies and legislations and similar hurdles. The role of local authorities thus arises to ensure creation and maintenance of appropriate conditions for protection and promotion of health of citizens. Being a mediatory between government and society as a whole, the local bodies, municipal corporations, health departments, etc play a vital role in safeguarding right to health of public. Science and technology being synonymous to progress, also have an important role to play in promoting and protecting health of people. Recent trends like organ transplantation, medical research, patenting, etc have raised many issues of ethics, morality quality, affordability and accessibility. Intellectual Property Rights acts as an incentive to innovators whereas on the other hand, the beneficiaries of technologies feel economically exploited. The IPR laws, therefore, must strike a balance between these conflicting and competing values. Apart from this, there is a need to have other legislations also to address the ethical, moral and social issues arising out of technological advances and thus we have legislations like The Transplantation of Human Organs Act, 1994; Biomedical Waste Management and Handling Rules, 1998; Drugs And Cosmetics Act, 1940, etc. Being directly related to the well being of an individual,

    1. Maximum word limit for the paper is 3000 words (excluding footnotes).

    2. An Abstract of the paper (max 300 words) should be sent to the organizers

    on or before 30th September, 2015.

    3. Selection of papers for presentation& Publication is at the exclusive

    discretion of the editorial board constituted for this purpose, on the basis of

    the abstract of the paper and the results of the same shall be conveyed to

    the participants.

    4. Page: A4, Margins: 1 all sides, Font: Times New Roman size 14 for

    Headings, Times New Roman Size 12 for the main body and Times New

    Roman size 10 for the footnotes. The main body must be typed in 1.5 line

    spacing and the footnotes shall be in single line spacing.

    5. All pages are to be numbered serially and the page number shall be placed

    in the footer section of the page.

    6. All articles shall conform to the rules of research paper and shall reach the

    organizer on or before 15th December, 2015.

    COMPETITION Primarily drafting is a very important aspect of the legal profession. This

    competition will test the participants use of legal language in drafting of legal

    document.

    TOPIC:

    CONSUMER COMPLAINT REGARDING HEALTH SERVICES

    TEAM COMPOSITION:

    Only one team member shall participate in this competition.

    THE ROUND:

    a. The drafting competition shall consist of only one round.

    b. The participants shall be given one common problem on the said topic.

    c. The participant will be given one hour to draft the document.

    d. On basis of the drafting skill as judged by the judges the winner and

    runner up, will be declared.

    e. The participants will be judged on the following parameters.

    i. Language. (30 Marks)

    ii. Brevity of the document. (40 Marks)

    iii. Formatting. (30 Marks)

    Total 100 marks

    f. Laptops are not permitted.

    g. The participants are free to add certain clauses in their legal documents as

    Topic: The theme of the JUSTA QUIZZA quiz competition is HEALTH LAWS IN INDIA

    Note: The topic includes Constitutional Law, Indian Penal Code, The Drugs and

    Cosmetics Act, 1940; The Medical Termination of Pregnancy Act, 1971; Transplantation

    of Human Organs Act, 1994; Drugs and Magic Remedies Act, 1954; Prenatal Diagnostic

    Techniques Act, 1994; The Mental Health Act, 1987, The Indian Patent Act, 1970, and

    any other Act having bearing on the subject.

    .

    TEAM COMPOSITION AND RULES FOR THE COMPETITION:

    1. Maximum 32 teams shall be accommodated in the competition. Preference

    shall be given to the outside students.

    2. Each team shall comprise 2 members.

    3. The QUIZ Competition shall comprise the following two rounds:

    a. Preliminary Round

    b. Final Round

    4. The top 6 teams will be selected for the final round.

    5. The reporting time for the participants shall be 8.00 A.M.

    6. All the team members shall be given a unique Team Code Number, which

    TOPIC: IN THE OPINION OF THIS HOUSE THE PRODUCT PATENT REGIME IN PHARMACEUTICAL SECTOR IS INJURIOUS TO THE INTEREST OF A COMMON MAN

    RULES:

    1. Maximum 20 teams shall be accommodated in the competition. Preference shall be given to the outside students.

    2. There shall be a team of two debaters. One speaker shall speak for the motion and the other shall speak against it.

    3. The teams shall be given a team code number which shall be their identity during the competition. They shall not disclose their names or the names of their college/institution during the competition.

    4. Each speaker shall speak for maximum 4 minutes. There shall be a warning bell after completion of 3 minutes.

    5. From the participants, one best speaker (who may belong to any side) and one best team shall be chosen

    It should be noted that the best speaker need not belong to the best team.

    6. The participants shall be judged on the following criteria:
