came into clearer focus with the release of the October 2009 memorandum to U.S. attorneys. It stated: As a general matter, pursuit of (illegal drug manufacturing and trafficking networks) should not focus federal resources in your States on individuals whose actions are in clear and unambiguous compliance with existing state laws providing for the medical use of marijuana. According to both a representative for the U.S. Department of Justice and the ACLU attorney representing WAMM, this memorandum set the stage for the settlement. It was pretty clear to everyone, including the judge, that the change in policy meant it was time to talk about settling the case, says ACLU lawyer Allen Hopper.

The settlement says, in essence, that the government agrees to leave WAMM alone as long as it abides by state laws. It also agrees that should the feds renege on their promise, the lawsuit can pop right back up in

Judge Fogels courtroom and proceed. Although Uelmen acknowledges that the settlement does not establish precedent, the decision is an important milestone. Its a level of commitment, he says. Hopper adds, All these decisions have been reviewed at the highest level in the Justice Department.

The WAMM members themselves were less effusive in their reactions. Valerie Corral called it a wink from the government. This isnt a huge personal victory for Michael and I, she said in the hallway outside the courtroom. Medical marijuana is most definitely mainstream these days. Fourteen states now have medical marijuana legalization laws, and a dozen more are heading in that direction. California is ahead of the pack, of course, and District 13 Assemblymember Tom Ammiano has taken it a step further by getting

a marijuana legalization bill, A.B. 390, through committee for the first time in U.S. history. Although time ran out before it could make it on to the Assembly floor, the San Francisco representative plans to reintroduce A.B. 390 in early February.

The bill is of interest to District 27 Assemblymember Bill Monning, though not of course without some caveats. I favor decriminalization, but with strict controls. My concern on legalization is that it perhaps sends the wrong message to young people and families, he says. Nevertheless, he does take into consideration the potential boost to state coffers that marijuana taxation could provide. If you remove it from the criminal justice system, you also save money on prosecutions, in courts, jails, prisons. I think one of the strong arguments in favor of the Ammiano bill is if you remove it from the criminal underground, the related violence and felony activity goes along with it. Thats a savings that needs to be better understood.

As for the WAMM decision itself, the lawyers involved concede that its a commitment from Obama and Holder, thats allnothing enforceable. But when asked whether a change in administration could yank that commitment, Hopper says he doubts it. By then well have had these years where states have set up these procedures, the sky didnt fall [and] there will have been additional tax revenue to local governments. Its going to be very difficult for a future administration to say, Whoa, stop. Its kind of hard to put the genie back in the bottle.

Mylls has spent the better part of 33 years competing in bike races and triathlons. Built like a cross between an Olympic squat lifter and a teddy bear, his tree-trunk legs say die-hard cyclist, while his upper body physique and gregarious personality say awesome drinking buddy. Eventually Mylls wants to open a downtown storefront with stationary bikes and a place to meet before rides. But for now, his cluttered Santa Cruz garagepacked with colorful

road bikes, cruisers, BMXs, tandems and track bikes, along with barrels of seats, pedals, sprockets, spokes, helmets and race jerseysis the Dojos nerve center.

Basically, I love cycling, I think everyone should cycle, but there is a learning curve, and people want to learn it quickly, says Mylls. Thats where we come in.

acolytes get unlimited rides and a full-time cyclist to teach them proper form and humiliate them when they miss a workout. Part fitness training regimen, part social club, Mylls operation caters to everyone from seasoned cycling veterans to basic fitness seekers.

So where does a relatively athletic but notoriously lazy reporter fit in? I entered the Dojo to find the answer.

I always have someone to go with and someone to check up on me and make sure I ride.

Jose Maldonado, a chatty 29-year-old from Oaxaca, came to cycling for the practicality of it but stayed for the competitive satisfaction. When I got laid off from my job in Las Vegas I gave up my car and moved back to Santa Cruz, says the ever-smiling Maldonado, who rides, rain or shine, to his jobs at Stagnaro Brothers and Toadal Fitness. I was saving up for a car, but I loved riding bikes so much that I spent the money on a new race bike instead. Now I ride with Rob and Delfina all the time to train. My goal someday is to do an Iron Man.

Having cavalierly ignored Mylls advice that I bring a pair of padded bike shorts, I ride bareback with the group of about 10 cyclists from Mission Street to Santa Cruz Harbor along West Cliff and East Cliff and through several side routes back to our starting point. Hours later, the error of my equipment choice is made clear to me, and I spend the weekend hobbling around like a Texas gunslinger.

On my second ride with the Dojo, I correct my rookie trouser mistake and armor the Cartier jewels in a pair of padded bike shorts from The Spokesman Bicycles. Upping the difficulty in light of my upgrade, we take advantage of the gorgeous January weather and ride up Highway 9 to Felton. As stunning as the twists and turns are, however, I admit they would look that much more attractive with a quaint little bicycle lane tacked on to either side of the asphalt. But safety notwithstanding, the 15-mile ride proves both challenging and enjoyable, with sunlight-f lecked redwoods whizzing by amid the calls of passing birds and the shouts of passing drivers f lipping birds. Conversation rarely ceases around Mylls and Co., with the preferred formula being ruthless but good-humored ridicule mixed in with movie quotes and the occasional hip-hop rendition of 80s hits.

By the time we reach the bottom (after a photo-op-turned-two-bike-pileup that leaves Mylls and friend Jennifer Nebo with bumps and bruises to both their elbows and their egos) we are 15 miles stronger and about 2.4 cheeseburgers lighter.

pep-talking on my partmainly because I bike, I dont cycle. The sweatless, one-mile-smile I spend biking to work most days bears little relation to the quad-pumping, taint-bruising cycling done by folks looking for a proper means of exercise. So as I arrive at Santa Cruz News Cafe on Mission Street on the brisk winter morning of my first ride, Im pleasantly surprised to see that, despite some scattered spandex, the crew of cyclists looks more ragtag than hardcore.

I only had a stationary bike, and even if I had had a bike I wouldnt have known where to ride it, says Cassandra Christine, a lithe-looking redhead sucking down coffee before the ride. Then I met Rob and Delfina, and they taught me all the best places to go. Now

burned, I begin thinking about folks who arent necessarily into cycling but rather just looking to get fit. Eric Hand is a clinical exercise physiologist with Dominican Hospitals Center for Lifestyle Management. He works with people of all ages, some of them diabetic or obese and in desperate medical need of better fitness. According to him, there are few better methods of burning calories than jumping on a bicycle.

From a cardiovascular perspective, cycling is great for the heart and lungs. Its a good way to increase the overall fitness level and is also great for weight loss, he says. The key to losing weight is expending more energy than you put into your body. And cycling is especially good because you can accumulate your time while you commute to the store or to work or whatever. It comes down to whats convenient and what works, and for a lot of people, cycling is both

convenient and enjoyable.The data backs up Hands claims.

The Presidents Council on Physical Fitness and Sports lists vigorous cycling as burning 612 calories per hour. Thats more than basketball, football, aerobic dancing, tennis and even swimming. And as my jellolike shoulders attest since the Felton ride, its not just the legs that get worked riding a road bike. Leaning forward and steering works the upper body, too.

So what did I learn during my brief schooling in Mylls Dojo? I suppose its that bike riding isnt for everyone. There will always be those who prefer toiling, hamsterlike, on a stationary machine in the dank warrens of a gym. But there are also those who would rather tone the ticker while watching the waves of Monterey Bay splash against West Cliff Drive. For them, cycling is the way to go, and the Bike Dojo is a great means to get there. 0

Since 1993 the Sri Chaitanya Saraswat Seva Ashram has been a center for Bhakti yoga, which does incorporate asanas (poses) but goes beyond physical practice to include chanting, prayer, the reading of ancient texts and the practice of prasadam, or mercy (food, in this case; anyone can come and eat for free, and the ashram distributes food to the homeless). This downtown studio specializes in Iyengar, a school of yoga named after the living Indian yoga master, and boasts a senior instructor, Kofi Busia, who was taught and certified by the guru himself. Yoga Center owner and director Maya Lev describes the discipline as concentrating on proper alignment, with an equal emphasis on strength and f lexibility. We hold poses longer, she says. When you sit in a pose or stand in a pose and you focus your mind intensely on doing this, youre training your mind how to meditate. Thats a really valuable skill. To Brown neophytes, however, the compilation provides a serviceable introduction to the recent work of a man with 27 albums under his belt. And at this point, Brown has more than earned a valedictory lap.

If history is any indication, however, the artistically restless Brown wont rest on his laurels for long.

affair: in 2002 he married Iris DeMent, an accomplished songwriter in her own right, and his daughter Pieta Browns own musical career is a growing concern. On recordings, Brown is often joined by the family. While onstage, he continues to be supported by players such as intrepid sidekick Bo Ramsey, who has played beside Brown for so long that he could nearly be considered family.

Browns latest release, Dream City: Essential Recordings Vol. 2, is a two-disc compilation of his work from 19972006 that collects fan favorites from previous albums, as well as a handful of unreleased tracks and live recordings. For Browns legion of die-hard fans, such a compilation might be redundant, as

apt description of a songwriter whose dry wit and capacious warmth is self-evident. Through his grizzled baritone, Brown portrays affecting miniatures of American life with a literary bent that at times recalls Raymond Carver. Theres not a whole lot of glit or f lash to a Greg Brown composition, nor does there need to be: this is music that is as intrinsically down-home as Iowa cornfields and rusted-out carburetors. Which isnt to tar Brown with some reactionary association that doesnt fit him. Browns politics are avowedly progressive, but he has no place for a simple Red State-Blue State divide in his work, even when he is explicitly critical of contemporary politics and culture. Instead, Brown seems intent on rendering a picture of American life that opts for honesty and

ONE OF the highlights of the new film Crazy Heart is the washed-up country singer Bad Blakes performance of Greg Browns Brand New Angel. In a recent interview with Under the Radar magazine, actor Jeff Bridges fingered Brown as an inspiration for the character of Blake. Considering the disheveled state of Bridges character in the movie, this might appear to be a backhanded insult, but the inspiration Bridges speaks of has nothing to do with Browns lifestyle choices; rather it points to his musicologists grasp of American music, from country to folk to jazz.

Unlike Bridges country singer on the skids, Greg Browns career is going stronger than ever, but its been a long road. Browns career seems to have been defined by his penchant for confounding folk music cliches: a preachers son who escaped the Midwest for the fertile 60s coffeehouse folk scene, Brown quit music and returned to his native Iowa just as he was gaining attention in the early 70s. After lying low for a number of years, Brown returned to the music business, but on his own idiosyncratic terms, building a following through appearances on Garrison Keillors Prairie Home Companion and on the strength of unexpected endeavors such as 1986s Songs of Innocence and of Experience, a song cycle based on William Blakes poetry.

while, its obvious that his heart belongs to the mountains. I miss the work, tracking the warblers, Moore says. Its really quiet work and one of the best jobs Ive ever had. He says he and Tacular are in the midst of building a cabin together in North Carolina.

The structure is finished with a roof and everything, but there are still holes and all the interior needs to be done, Moore says. When we finish our cabin, Beth can do her art and I can eventually write some music; Im not really eager to write more songs or tour, I kinda just want to live right now.

PHIL MOORE says hed rather spend time studying birds in the isolated forests of North Carolina than do just about anything else. The singer/songwriter of the folk outfit Bowerbirdsplaying the Brookdale Lodge on Friday with Canadian folkie Julie Doironderives most of his songwriting inspiration from the days he spent tracking a species of small bird named the plaintive warbler for the North Carolina Museum of Sciences while living alone in a remote cabin.

I was a biology major, he says from his North Carolina apartment. Nature really affects me when Im in it. I guess its what Im passionate about, so it naturally comes up in songs.

Moore says his other muse is his girlfriend and band mate, Beth Tacular. And while the nature-love-folk formula is a tad clich, the Bowerbirds music isnt. There arent any lines about Taculars hair blowing in a distant wind, nor is there any trace of in-your-face, environmentalist proselytizing.

You could be angry and write some punk rock songs, but the other way is just to write and make people aware about whats going on, Moore says. Its more helpful and it works. Well, I dont know if it works, but hopefully it works better.

On In Our Talons, from the Bowerbirds debut Hymns for a Dark Horserated fourth of the 15 best albums of 2007 by daytrotter.comMoore sings,

Moore says he witnessed this scene every day when he lived in the woods. Taculars accordion meanders along throughout the songsparrowlike, you might say.

Moore admits that some of the songs about Tacular were initially hard to play in a concert setting with her standing beside him onstage. There were a couple songs that were tough to perform live with Beth at first, Moore says. But overall, its really rewarding.

Silver Cloud was one of those songs.

You could move like a secret and slip past my life But you cant seem to quit moving words around to show who was right.

The song resounds with a quietness that cuts through a thicket of acoustic guitar and mandolin; Moores voice strains with a naivet similar to Bonnie Prince Billy or Little Wings.

For dessert we showed some restraint and shared a single order of crme brle ($6.95), whose burnt sugar topping was classic, but whose creamy interior was almost cold. A luxurious Kahlua and coffee ($7) offered a very warming way to end a meal, as did a tumbler of Fernet Branca ($6.50),

Susans entree of panko-encrusted sashimi grade ahi was nicely done, if tamely f lavored ($24.95). The ahi itself was exceptional, and the bed of sticky sushi-style rice was a great foil for plum sauce and slender baby carrots. I actually preferred Angies huge appetizer portion of ahi, sliced along a bed of outrageous Napa cabbage slaw slathered with wasabi vinaigrette.
