Welcome and opening
1 The meeting on the development of a prototype electronic form (“meeting”) was opened and chaired by Mr. Peter Button, Vice Secretary-General of the International Union for the Protection of New Varieties of Plants (UPOV), who welcomed the participants in Geneva and those who participated in the meeting by means of electronic conference.
2 The list of participants is reproduced in Annex I to this report.
Approval of the agenda
3 The meeting adopted the revised draft agenda (document EAF/2/1 Rev.), as circulated to the participants in advance of the meeting.
Developments concerning the Community Plant Variety Office of the European Union (CPVO) online application system
4 Mr. Jean Maison and Mr. Marc Rouillard, Community Plant Variety Office of the European Union (CPVO), made a presentation on developments concerning the CPVO online application system, a copy of which is attached as Annex II to this report.
Developments concerning the prototype electronic form
5 The meeting considered document EAF/2/2 “Developments concerning the prototype electronic form”.
6 It was recalled that the key aspects of the prototype from the perspective of members of the Union are as follows (see document CAJ/68/8 “Electronic application systems”):
Form Content: The UPOV electronic form would contain all items required by the participating members of the Union, i.e. it would contain all items in the UPOV Model Application Form and, in addition, items required for an application in the participating member of the Union concerned. Applicants would select the members of the Union in which they wish to make an application and all relevant items for the selected members of the Union would be presented for completion.

Status: Participating members of the Union would decide the status of any data provided via the UPOV electronic form for their own situation.
Data format: The UPOV electronic form would enable data to be transferred to participating members of the Union in Word, Excel, PDF or XML format. The participating members of the Union would decide in which format(s) to accept data. In the case of XML format, a standard format would be developed, based on WIPO standard ST.96.
Languages: The UPOV electronic form would present all items (questions) in English, French, German and Spanish. Translations for all items (questions) in other languages would be provided by the participating members of the Union, with a suitable disclaimer.
Crops/species: Crops/species for the prototype would be:
Lettuce (Lactuca sativa L.);Potato (Solanum tuberosum L.); Rose (Rosa L.)Apple (Malus domestica Borkh.).
Partners: The partners in the development of the prototype would be the participating members of the Union (including the continued participation of the Community Plant Variety Office of the European Union (CPVO)), Office of the Union, WIPO Internet Services Section, WIPO Standards Section, WIPO Global Database Service, ISF and CIOPORA.
7 It was noted that Argentina, Japan and Switzerland had requested to participate in the development of the prototype since the previous meeting. The participating members of the Union were confirmed as Argentina, Australia, Brazil, Canada, Colombia, Dominican Republic, European Union, Japan, Mexico, New Zealand, Paraguay, Republic of Korea, Switzerland, United States of America and Viet Nam.
8 It was noted that the application forms received from participating members of the Union had been compiled in the Annexes of document EAF/2/2. Annex I to document EAF/2/2 provided a summary of the “core” questions, comprising the questions from the UPOV Model Application Form, and additional questions provided by the participating members of the Union. As an illustration, Annex II to document EAF/2/2 provided a summary of the “core” technical questions, comprising the questions from the TQ UPOV Test Guidelines for Lettuce (Lactuca sativa L.) (TG/13/10 Rev.), and additional questions provided by the participating members of the Union.
9 It was agreed that the information provided in Annexes I and II to document EAF/2/2 should be checked by the participating members of the Union concerned. It was further agreed that application forms from the other participating members of the Union should be provided by December 27, 2013, in order to be incorporated in the second phase of the “mock-up” to be presented at the subsequent meeting.
10 A first “mock-up” of the prototype electronic form was presented at the meeting by the Office of the Union and by the WIPO Internet Services Section, a copy of which is available under http://upov.appls.org.
Matters for consideration for the prototype electronic application form
a) Form content
11 It was agreed to review whether the UPOV Model Application Form questions should all be considered to be “core” questions. It was noted that such an approach might, potentially, create several additional questions for applications and should be investigated further.
12 It was confirmed that the system would be designed to allow additional documents to be uploaded with the application form.
13 It was noted that the design of the system would incorporate validation steps for “mandatory” information and for appropriate data. The details of the validation steps would be developed at a subsequent stage.

14 It was agreed that the form should be designed to allow for multiple applicants for a single application.
b) Status:
15 It was agreed that the type of authentication that would be required to enter and transmit information (e.g. user name and password, digital certificate, electronic signature, etc.); and payment method for fees (e.g. electronic payment) should be considered at the next meeting. In that regard, Mr. Michael Jung, Head, Internet Service Section, WIPO, would review the suitability of the WIPO Identity Management (IDM) system for authentication of users. It was also recalled that, the Administrative and Legal Committee (CAJ), at its sixty eighth session, held in Geneva on October 21, 2013, had agreed to conduct a survey of participating members of the Union in order to assess their use of electronic application systems where information on existing authentication systems used would be sought (see document CAJ/68/10: “Report on the Conclusions”, paragraph 28 and document CAJ/68/6, Annex III).
c) Data format:
16 Mr. Yun Young-Woo, Senior Industrial Property Information Officer, WIPO Standards Section, provided the following written summary of the latest developments with regard to WIPO Standard ST.96, in his absence:
Since the progress report on WIPO Standard ST.96 at the UPOV meeting in March 2013, the XML4IP Task Force has been continually working on improving ST.96 and finalizing the remaining parts of ST.96, i.e., Annexes V and VI, which are respectively ‘Implementation Rules and Guideline’ and ‘Transformation Rules and Guideline’.
Some new schema components have been added in ST.96 and also existing schemas have been updated. In addition, the Task Force has carried out the discussion on the revision of ST.96 Main body, Annex I (XML Design Rules and Conventions) and Annex II (Data Dictionary).
With regard to the XML schema components regarding plant variety, the members of UPOV were invited to comment on them. The XML4IP Task Force received some comments from CPVO via UPOV/IB. According to the subsequent discussions by email among UPOV/IB, CPVO and WIPO/IB, it was concluded that no change is needed for the Plant Name component in ST.96. The Task Force members recently completed the discussion on ST.96 Schema, version 1.0 draft 5 (called D5). WIPO/IB and USPTO is preparing the next draft version of schema, D6, which is likely a last draft before the new official version, 2.0 of ST.96.
Based on their implementation of ST.96, USPTO (US), KIPO (KR), UKIPO (UK), Rospatent (RU) and CIPO (CA), actively participates in the discussion on the revision of ST.96. Moreover, JPO (JP), EPO, OHIM and IP Australia contribute to the improvement of ST.96. DPMA (DE) recently expressed its interest in ST.96.
In order to complete ongoing discussions on ST.96 and prepare next version of ST.96, the XML4IP Task Force meeting will take place in USPTO from November 4 to 9, 2013.
d) Languages: 17 It was recalled that, as a first step, the questions of the application form and technical questionnaire for the participating members of the Union, would be provided by the participating members of the Union in English plus the language of the participating member of the Union concerned. The participating members of the Union would also provide translations of all questions in their own language.
Future actions and program
18 It was agreed, that a final “mock-up” should be presented at the subsequent meeting, which would be the basis to develop a fully working prototype. The “mock-up” and prototype would be in English only and the Technical Questionnaire would be for Lettuce (Lactuca sativa L.).
