Background

• In July 2011 Commission issued a proposal to amend Council Regulation (EEC) No 3821/85 on recording equipment in road transport

• ‘Roadmap for Future Activities’

• In November 2011 proposal issued to amend Directive 2006/126 (third driving licence Directive)

• Article 27 - Integration of driver cards with driving licences

Driver cards issued in accordance with the tachograph Regulations until 18 January 2018. With effect from 19 January 2018, driver cards shall be incorporated into driving licences and issued, renewed, exchanged and replaced in accordance with the provisions of Directive 2006/126/EC.

The EU Commission held a consultation from 23 December 2009 to 1 March 2010 .

EReg TOPIC Group on smart card Driving Licence held in 2008.

Recommended adopting the ISO WG10 standard - allows modular growth.

Potential for a smart card licence to support several applications.

EU Working groups agreed a chip specification for the Driving Licence – adopted at Driving Licence Committee and soon to be published.

Objective & Timescales

• Objective of merger – to reduce fraud and administrative burden

• Partial General Approach reached in December 2011

• General approach still to be agreed in Council and European Parliament (likely in June 2012)

• Vote in EP Committee anticipated in May 2012 – vote in EP Plenary anticipated in June / July 2012.

• Adoption of new Regulation expected end of 2012/early 2013

• Cost - development cost for UK estimated to be Eur 14 million

• European Data Protection Supervisor expressed need for privacy and security impact assessment

• Questions around compatibility of chip specifications for tachograph card and driving licence.

• Compatibility of data - Driver number on current tachograph card but not proposed for merged card, vehicle unit will expect it.

• Proposal to enable deactivation of tachograph application by enforcement officer – how would this be done?

• Propose to phase out TACHOnet and replace with RESPER – TACHOnet used by non-EU/AETR countries.

• Merging of records – technical and practical challenges, particularly where different issuing authorities in some Member States.

• Challenges around synchronisation of validity periods.

Next Steps

• Joint Research Centre carrying out study – report to Commission by end of June

• Possible proposal for optional’ merger

• Possible discussions on merging with alternative card type e.g. driver qualification card, ADR

• Negotiations will continue at Council and European Parliament.
