The 167th

Meeting of the Eastern Regional Committee (ERC), National Council for Teacher

Education (NCTE) was convened on 9th - 10

th January, 2014 at Conference Hall, ERC, NCTE,

15, Neelakantha Nagar, Nayapalli, Bhubaneswar. The Chairperson, Members and Convener as listed below

were present at the time of the 167th ERC Meeting.

10. At the outset, the Regional Director welcomed all the members of Committee and apprised them

about the provisions of the NCTE Act, Rules, Regulations and Guidelines issued from time to time. With the

permission of Chairperson, Shri Chandrapida Neelap (Convener) presented the Agenda before the

Committee for its due consideration and appropriate decision.

(i) The committee unanimously decided that the institution may reply in

response to the decision of the committee uploaded on the ERC website

without waiting formal letters from the office of ERC. The replies so

received will also be considered by the committee.

(ii) It is to bring to the notice of all concerns that as per the order of Hon’ble

Supreme Court vide WP(Civil) No. 276 of 2012 in the matter of

Maa Vaishno Devi Mahila Mahavidyalaya -Vs- State of U.P. & Ors.

the cut off date of grant of recognition of all teacher training programme for

the session 2014-15 is 3rd

March, 2014. Any recognition granted after the

cut-off date shall only be valid for the academic session 2015-16.

the High Court of Delhi at New Delhi.

After considering the records available in the file, and relevant provisions of the NCTE Act 1993, Rules,

Regulations and guidelines issued by NCTE Hqrs. and the Hon’ble High Courst of Delhi order dated 06.2013, the

Committee discussed the matter in detail and observed as under:

1. The ERC NCTE vide order No. 17502 dated 06.04.2013 had rejected the case under clause 7(1) of NCTE

Regulation 2009.

2. The Appeal Committee also confirmed the order of ERC, NCTE vide Order No. A73135 dated

26.08.2013.

3. The institution preferred writ petition in W.P. No. 5696 of 2013 and the Hon’ble High Court of Delhi vide

Order Dated 13.12.2013 has directed to ERC, NCTE to issue a fresh show cause notice to the petitioner

within a period of three week.

In view of the above, the committee decided as under:

As per the order of the Hon’ble High Court of Delhi, a fresh show cause notice be issued to the institution.

the above points. The Committee therefore, provides an opportunity under section 14(3)(b) of the NCTE Act

1993 to the institution to submit its reply within 30 days from the issue of the letter before the Committee

takes final decision.

2. The institution is required to submit a fresh building plan showing the measurement of rooms as per

NCTE Regulation 2009. The building plan must be approved by any Govt Engineer.

3. The institution vide representation dated 27.12.2013 requested 30 days more time to submit the

faculty list duly approved the Bihar School Examination Board.

4. The committee accepted the request and allowed 30 days more time.

5. As per clasue 7(4) of the NCTE Regulation 2009, inspection shall not be subject to the consent of the

course under section 14(3)(b) of NCTE Act 1993.

many classes or days she was attended in B.Ed. in that institution along with the proof like submission of

A complaint dated 10.08.2013 received from the students and teachers of the institution against the principal

of the Dhubri PGTT college. It is observed that the principal is not having Ph.D in Education.


New principal having Ph.D degree in Education is to be appointed. The institution is required to appoint new

principal and submit the faculty list duly approved by the Registrar of the concerned university.

academic sessions of the existin recognized course prior to grant of recognition of

additional intake in existing D.El.Ed. course run by the Government Teacher

A letter No. 49-34/2013/NCTE/N&S/A79859 dated 2nd

January 2014 received from the NCTE Hqrs., New

Delhi regarding grant of relaxation in Sub-regulation 8(3) of Regulations, 2009 of completion of three

academic sessions of the existing recognized course prior to grant of recognition of additional intake in

existing D.El.Ed. course run by the Government Teacher Education Institutions in Bihar.

The NCTE Hqrs. directed to process the application(s) submitted by the Government Teacher Training

Institutions in Bihar for additional intake in D.El.Ed. course be processed expeditiously without insisting the

condition of completion of three academic sessions of the existing recognized course(s) for the aforementioned 25 institutions.


All 25 files are to be processed as per the direction of NCTE Hqrs.

received from Anant Kumar Srivastava, the Committee discussed the matter in detail and observed as under:

1. The institution submitted an application for grant of recognition to ERC, NCTE on 23.08.2004 and

the recognition was granted on 30.04.2008 with an annual intake of 100 from the academic session

2008-2009.

2. At the time submission of application, the institution possess land 1017.99 sq mts. As per NCTE

Regulation 2002 only the adequate number of classrooms, hall, laboratory space, principal room,

faculty room, office room and a store etc were required. The size of instructional spaces were

required 10 sq.ft. per students. Hence, the land possessed area was not specified. As per inspection

report conducted as per NCTE Regulation 2002 the land and instructional space were sufficient.

Since the first inspection was conducted in 2007 however, the faculty was well qualified as per

NCTE Regulation 2007. However, the recognition to the institution was granted on 30.04.2008 from

the academic session 2008-09.

3. On the basis of complaint, the institution was again inspected on 21.08.2009 and found that the total

area of land and built up area is less, construction work of 1st and 2

nd floor was going on, all labs

were dismantled for construction, teachers for physical and Art/Works experience not appointed, a

school also running in the same campus, principal was appointed but not joined at the time of

inspection and many other deficiencies were found. Hence, the recognition of the institution was

withdrawn on 14.11.2010.

4. As per court direction, the institution was again inspected on 12.09.2011 and found that - (1) As per

the Xerox copy of the sale deed the society possesses 32 decimal of land which is less than the

required 2500 sq.mts. (2) The original sale deed was not produced before the VT members, which is a

breach of para 8 (14) of NCTE Regulations 2009. (3) The management was unable to produce the

Land Mutation / Possession Certificate in Original. (4) The size of Multipurpose hall is 1080 sq.ft,

which is less than the required 2000 sq.ft as per NCTE Norms and Regulations 2009. (5) The identity

of the institution is not clear as the name of the college was not written permanently in any place of

the building, but it is written in a Banner which was placed at the main gate. (6) The Accounts of the

institution was not furnished to Visiting Members at the time of inspection, which is a violation of

para 8 (14) & 8 (15) of NCTE Regulations 2009. (7) As per the VT Report, during the period of visit,

it is observed that there is no co-ordination among the members of the Managing Committee. (8)

There is inadequate open space for outdoor games. (9) The Principal is not qualified as per existing

NCTE norms & standards 2009. As the Principal has no Ph.D in Education and less percentage of

marks in Master’s Degree in School Subject-48.9% whereas the required marks is 50%. (10)

Suggested list of teaching staff submitted by the institution dated on 13.09.2011 is not countersigned

by the Registrar / Competent authority of the affiliating body which is not acceptable as per the

NCTE Norms and Standards 2009. Except three faculty members, other staff including part time

staff are not qualified as per NCTE Regulations 2009. (11) As per the VT report, no record of

attendance of teaching staff of the college is available from 1.6.2010 to till date. (12) The permission

of the competent authority to use the land exclusively for Educational Purposes (CLU) is not

submitted to the VT members. (13) The building plan could not be furnished to V.T. members to

verify the details of infrastructure given by the institution as same as the building plan approved by

the competent authority. (14) The building completion certificate was not furnished to V.T. members

to match with the approved building plan and the land document of the building inspected are same.

(15) Safe guard against the fire hazard has not been provided in the building as per VT report. (16)

The institution’s campus, building, furniture is not disabled friendly

5. As per direction of the appeal committee a 16 numbers of show cause notice was issued to institution

on 17.12.2013. After observation of the reply to the show cause notice the ERC it its 166th meeting

found that only the principal is not qualified who was appointed as per NCTE Regulation 2009.

6. Now, the institution appointed principal as per NCTE Regulation 2009.

Keeping in view the above, the committee decided as under:

As per NCTE Regulation 2002 required land area was not specified and all faculty except principal were

appointed as NCTE regulation 2007. The present NCTE norms & Regulation 2009 is not implemented on the
