WI IEBC History

• Replaces S&B Existing Building Guidelines, Wisconsin Historic Code (Comm ch. 70) and IBC ch. 34, which share similarities with IEBC.

• Provides a more predictable alternative than one or more petitions for variance

• Note that there is no distinction between buildings originally approved under ICC suite or pre-ICC Wisconsin codes

• Note that per s. 101.121, WI Stats, local ordinances may not be anymore restrictive for historic building projects approved per this code

• Change of Occupancy to a Public Building Occupancy from non-commercial use – comply with new construction requirements per IBC, rather than IEBC, except that archaic materials may continue to be used

• Revised Comm 66.0101(2)(b)2. to allow qualified historic buildings including 1&2 family dwellings to use the IEBC

s. Comm 61.30 Plan Submittal

• Required for new buildings, additions and alterations• Change of Use - There is NO requirement that a plan

has to be submitted to gain an approval for a change in use. Submittal requirements exist only for the plans of the alteration work that is often desired or required with a change a use.

• 61.30(4) Minor Alterations - If the code official can understand the proposed project and agree that compliance can be achieved without having plans to work from, no submittal of plans is necessary - Document the decision!

Fair Housing LawRemodeling Scenarios

1. > 50% of the interior square footage of the housing is remodeled, the entire housing shall conform to the standards

2. If 25% to 50% is remodeled, that part of the housing that is remodeled shall conform to the standards

3. If < 25% is remodeled, the remodeling is not subject to the standards unless the alteration involves work on doors, entrances, exits or toilet rooms, in which case those elements shall conform to the standards
