Agenda: The agenda for this meeting was filed with the Office of the Lieutenant Governor, as required by Hawaii Revised Statutes (“HRS”) section 92-7(b).

The agenda was taken out of order and continued with “Chapter 91, HRS,

Adjudicatory Matters”. Chapter 91, HRS, Adjudicatory Matters: Chairperson Akasaki called for a recess from the Board’s meeting at 8:35

a.m. to discuss and deliberate on the following adjudicatory matters pursuant to HRS chapter 91.

1. Settlement Agreements

a. In the Matter of the Contractors Licenses of Solarcity

Corporation; James H. Cahill, Jr.; CLB 2011-315-L & CLB 2014-243-L

RICO alleges that Responsible Managing Employee James Cahill (“Respondent Cahill”) of Solarcity Corporation (“Respondent Solarcity”) was not in residence in the State during the entire period that Respondent Solarcity was installing a solar power system at the Maui Arts and Cultural Center and was not regularly in residence in the State while residential photovoltaic systems were being installed by Respondent Solarcity. The allegations would constitute violations of HAR section 16-77-71(a)(4) (RME shall be in residence in the State while a project is under construction). Respondents do not admit to violating any law or rule, but agree to pay a settlement in the amount of $50,000.00 The Board noted that there is a typographical error in the Settlement Agreement: the license number for Solarcity is missing a digit and the correct license number should be C-29770. After discussion, it was moved by Mr. Kamai, seconded by Mr. Leong, and unanimously carried to approve the above Settlement Agreement Prior to Filing of Petition for Disciplinary Action and Board’s Final Order in the above case.

2. Board’s Final Orders a. In the Matter of the Contractors’ Licenses of Christopher J.

Terry, Terry Construction & Development, Inc., and CT Construction, Inc. dba Premier Consulting; CLB 2008-254-L; CLB 2008-316-L; CLB 2009-209-L; CLB 2010-76-L

Christopher J. Terry, Terry Construction & Development, Inc., and CT Construction, Inc. dba Premier Consulting (“Respondents”) failed to disclose various liens and disclosures, failed to comply with

contract requirements, improperly listed a plumbing contractor on a permit, among other things. At the beginning of a hearing on May 29, 2014, Respondents orally moved to dismiss the proceedings against them on the grounds that Respondent Christopher Terry had voluntarily surrendered his contractor’s license effective at the close of business on May 28, 2014. The Hearings Officer denied Respondents’ motion and decided not to dismiss the case because the acts were committed while Respondents were licensed. The hearing was recessed while the parties discussed a settlement. When the hearing reconvened, the parties announced they had reached a settlement on all issues, with the following settlement terms:

(1) Respondents agree to the revocation of their contractors’ licenses for a period of five years;

(2) Respondent Christopher J. Terry will not reapply for a contractor’s license for himself, and will not apply as an RME on behalf of the other two respondents, or on behalf of any other company; and

(3) Respondents will not be required to pay any fines or restitution.

Respondents were charged with violating the following provisions of

the HRS:

(1) 436B-16 (Failure to provide written notice of judgment);

(2) 436B-19(1) (Failure to meet or maintain conditions and requirements);

(3) 436B-19(2) (Untruthful or improbable statements); (4) 436B-19(8) (Failure to maintain a record or history of

competency, trustworthiness, fair dealing, and financial integrity);

(5) 436B-19(16) (Employing/utilizing unlicensed person); (6) 436B-19(17) (Violation of chapter and rules); (7) 444-9 (Unlicensed activity) (8) 444-14 (Business address/change of address); (9) 444-17(1) Dishonest, fraudulent, or deceitful acts); (10) 444-17(2) (Unfair and deceptive acts or practices); (11) 444-17(3) (Abandonment); (12) 444-17(6) (Violation of state or county law); (13) 444-17(10) (Misrepresentation on application); (14) 444-17(11) (Failure to complete project); and (15) 444-25.5 (Failure to explain rights and include rights).

After discussion, it was moved by Mr. Konishi, seconded by

Mr. Mochida, and unanimously carried to approve the above Board’s Final Order in the above case.

Following the Board’s review, deliberation and decisions in these matters, pursuant to HRS chapter 91, Chairperson Akasaki announced that the Board was reconvening to its open meeting at 8:45 a.m.

Executive Session: At 8:46 a.m., it was moved by Mr. Polischeck, seconded by Mr. Kagawa,

and unanimously carried to enter into executive session to consult with Rodney J. Tam, deputy attorney general, on questions and issues pertaining to the Board’s powers, duties, privileges, immunities, and liabilities pursuant to HRS section 92-5(a)(4).

At 9:16 a.m., it was moved by Mr. Kagawa, seconded by Mr. Konishi, and

unanimously carried to move out of executive session and to reconvene to the Board’s regular order of business.

Minutes: It was moved by Mr. Suehiro, seconded by Mr. Kagawa, and unanimously

carried to approve the August 22, 2014 meeting and executive session meeting minutes as circulated.

Amendments to Agenda: It was moved by Mr. Kamai, seconded by Mr. Mochida, and unanimously

and unanimously carried to deny Mr. Zuckerman’s application for licensure in the C-57 classification because he did not meet the experience requirement. Mr. Zuckerman was advised that he could have an employee who will be providing the onsite field supervision in Hawaii while the project is ongoing to apply for the license.

and carried (Mr. Suehiro recused himself) to defer Mr. Kajihiro’s application for licensure in the C-63 classification pending the submission of a revised project list, copy of his apprenticeship certificate (if applicable), and an experience certificate from his C-63 supervisor.

Mr. Suehiro returned to the meeting at 10:37 a.m. The agenda was taken out of order and continued with “Committee Reports,

and unanimously carried to approve Mr. Joseph for a conditional license in the C-42 classification, subject to quarterly updates from his attorney on the status of his debts, and the requirement that he pay all debts and settle all matters within one year.

Recess: Chairperson Akasaki called for a short recess at 12:45 p.m. The Board reconvened at 12:50 p.m. The agenda continued with the rest of the Committee Reports. Committee Reports: 1. Examination Committee:

Aldon Mochida, Chairperson The Contractors Examination Summary report for August 2014 was

distributed with the agenda packet for the Board’s information.

3. Legislation Committee: Peter H. M. Lee, Chairperson

Arnold Wong of the Ironworkers Stabilization Fund Local Union 625 informed the Board that they will be submitting bills similar to this past

session’s bills on “incidental and supplemental” and changing the composition of the Board by adding more specialty licensed members. 4. Rules Committee:

Tyrus Kagawa, Chairperson

Proposed Amendments – HAR chapter 16-77 – Rules Committee Chairperson Kagawa stated that the Board would like to continue moving forward in amending its administrative rules. In 2013, the Board established an Investigative Committee under HRS section 92-2.5 to investigate and respond to SCR 84, S.D.1, review all of the contractor classifications for possible amendments, and draft a report to the legislature in November 2013. The Board would like to continue reviewing amendments to its rules, and needs to appoint new members to the Investigative Committee since some of the original Investigative Committee members are no longer on the Board. The following members expressed interest in serving on an Investigative Committee to continue investigating and reviewing amendments to the Board’s rules: Messrs. Nathan Konishi, Chairperson Terra Posts PV LLC – Terra Posts PV LLC requests a determination on the license required to install support posts for the racking that supports solar panels in large commercial and utility scale ground mounted solar installations. Specialty machines (compact pile driving units) are used to install the support posts. Arnold Wong of the Ironworkers Stabilization Fund Local Union 625 stated that anything dealing with structural portions of the systems, such as mounting should be performed by the C-48 Structural steel contractors. Recommendation: Either an “A” General Engineering or C-35 Pile driving, pile and caisson drilling, and foundation contractor may install the support posts. A C-48 Structural steel license is required to erect any structural steel components; and a C-13 Electrical license is required for the mounting of panels and jumpers, and to perform grounding and bonding work.
