Daring thieves smashed their way into a store just yards from West Bay police station - stripping the business of about $15,000 in cash and goods.

An employee who turned up to open Vidette’s Grocery at 6am yesterday discovered the break-in.

The burglars entered the West Bay business through a garage located at the back. They broke down the store’s door, and destroyed all the security cameras before cleaning it out.

During their raid, the thieves took $1,000 dollars from the cash register, ripped open the Digicel “Top Up” vending machine, taking another $1,000, took $6,000 worth of cigarettes, as well as around $7,000 worth of cell phones, SIM cards, groceries and other items, says the owner.

And they covered their tracks by pouring bleach on the floor to mask their prints.

It was nearly three years ago that Sarah Bush, then age five, first donated her hair to Locks of Love, a charity which provides hairpieces to children in the US and Canada who have lost their hair due to a medical condition.

Now at age seven, the Red Bay Primary School student was ready to do it all over again. “I feel good about it,” she said, as she approached the Spa-to-Go, Avec Moi hair salon at Grand Harbour with her mother Karen Bush.

“It was Sarah’s idea to do this and we are very proud of her initiative,”Ms Bush said. “We hope it will raise awareness and inspire other children – and adults – to do the same, or to make a financial contribution to the group.”

“This is the second time we did it. She has decided to do it again because her cousin just did it,” Ms Bush said.

“It all started when a friend of ours, Jackie Farrington, who used to run the Mesa restaurant held a charity event at a restaurant where she raised quite a bit of money. We said ‘OK, we are going to do it, too.’”

“Of course, it does grow back – but it’s not the sort of thing you can do every single day. For Sarah to grow the ten inches back again –you need

at least ten inches of hair– it probably took about two years.

“I just recently donated 11 inches of hair myself,” Ms Bush added.

The Locks of Love website, www. Locksoflove.org, describes itself as a public non-profit organisation, that “provides hairpieces to financially disadvantaged children in the United States and Canada who are suffering from long term medical hair loss.”

The hair loss can come from any diagnosed medical condition, although most of the children Locks of Love helps have lost their hair due to a medical condition called alopecia areata, which has no known cause or cure. The wigs and hairpieces they produce are intended to help restore children’s self-confidence, the website says.

Police concerned theft was so close to station

The store’s owner, Mr. Glenroy Bodden, says he is both angry and frustrated at the high rate of robberies on the Island. He said: “Look at where the police station is, it seems like people are just robbing you at will, and wherever they want to rob they just rob.

“This is a very heavy loss, something needs to be done.

“Just two years ago they, (burglars) came in through the top of the grocery store by cutting a hole through the zinc.

“It seem as if these people can rob just about anybody they want to rob at anytime they feel like.

“The robbers destroyed our CCTV security cameras, they walked through the garage and entered through the back of the shop.

“In addition to the cash they stole, they took cellular phones, phone cards, SIM cards, and groceries.

“They poured a chemical which looks like bleach on the personal security camera boxes.

“They also poured the chemical on the floor and all over their tracks.

“The burglars also tried to

open a security safe inside the supermarket.”

Mr. Bodden says he now advises all other business owners and operators to be very cautious in their operations They took $1,000 from the “Top Up” vending machine.

He added: “I would advise other businesses to have an additional storing devise for their security cameras, and pay close attention to their surroundings.”

Detective Superintendent Marlon Bodden confirmed they were investigating. He said: “We have not had any specific amount in terms of valuables taken from the establishment.

“One would be concerned that with the proximity of the police station any individual would take that chance just within striking distance of the station.

“But we should also remember that this burglary took place in complete darkness under which circumstance anything could happen.

“I would encourage business people to have a watchman if not proper security to enhance the security of their business.”

Hacker group draws increased scrutiny from feds

SAN FRANCISCO (AP) - Anonymous is not so anonymous anymore.The computer hackers, chat

room denizens and young people who comprise the loosely affiliated Internet collective have increasingly turned to questionable tactics, drawing the attention of the FBI, the Department of Homeland Security and other federal investigators.

What was once a small group of pranksters has become a potential national security threat, federal officials say.The FBI has carried out more

than 75 raids and arrested 16 people this year in connection with illegal hacking jobs claimed by Anonymous.Since June, the Department of

Homeland Security has issued three “bulletins” warning cyber-security professionals of hacking successes and future threats by Anonymous and related groups, including a call to physically occupy Manhattan’s Wall Street on Sept. 17 in protest of various U.S. government policies.San Francisco police arrested

more than 40 protesters last month during a rowdy demonstration organized by Anonymous that disrupted the evening commute. The group called for the demonstration after the Bay Area Rapid Transit system shut off it cell service in San Francisco stations to quell a planned protest over police shooting on a subway platform.“Anonymous’ activities increased

throughout 2011 with a number of high-profile attacks targeting both public and private sector entities,” one of the bulletins issued last month said.

Police yet to move on alleged tax fugitive

Neither the Director of Public Prosecutions nor local police have received a request from US authorities to help find alleged tax fugitive and Grand Cayman resident William Millard, said to owe more than $100 million.

According to US news reports, Mr Millard, 79, founder of California-based ComputerLand retail chain, valued at more than $1 billion in the 1970s and 1980s, has been tracked to Grand Cayman after private investigators, hired by New York law firm Kobre & Kim, found him initially in Orlando, Florida.

“The Financial Crimes Unit has not received any requests for assistance in this matter at all,” FCU chief Detective Superintendent Brian Donley said.

“We have not been approached, but any request would first come through the Director of Public Prosecutions,” he said.

The multi-millionaire was last seen in Saipan, a US possession in the Pacific, part

of the Commonwealth of the Northern Mariana Islands, where tax authorities handed down a deficiency notice to Mr Millard in 1991, followed by a $36 million tax judgement in 1994 from the US District Court.

The Millards, however, left, Saipan in 1990 under pressure from local residents and officials, angered by his unorthodox approach and accusations of corruption. Abandoning a partially built hilltop castle, the Millards vanished, leaving a loose trail through Singapore, Hong Kong, Brussels and Ireland and have been linked to 50 shell companies, trusts and bank accounts.

ComputerLand, with more than 800 stores, was among the largest retail chains in the US, and enabled its founder to acquire a Tudor mansion in Oakland, California, a fleet of private jets, including a Learjet and a Falcon 50.

Investigators for New York’s Kobre & Kim, hired by Northern Mariana’s officials, finally tracked Mr Millard last year to the Orlando, Florida, home of his daughter

Barbara, and from there to Grand Cayman.

Kobre and Kim partner and lead attorney on the case, Michael Kim, and head of the firm’s public relations department Melissa Seitter, told iNews yesterday they were not prepared to answer questions. Mr Kim earlier told the Wall Street Journal, however, that “this is one of the most sophisticated and complicated cases of asset structuring that I have ever seen.

“I hope he will do the right thing and pay his debts,” he said noting they had ballooned from the original judgement after the 20-year accrual of interest payments, “, “But most people do not let go of $100 million easily.”

Yesterday at the Millard family home in Britannia Estates, Mr Millard’s wife Patricia refused to comment.

She said: “In no way, shape of form will I be interviewed.”

Mrs Milliard then directed our reporter to their attorney in the US.

Tropical Storm Maria has moved away from the northeastern Caribbean thanks to a low-pressure trough now located over the eastern United States. This trough will track eastward and cause Maria to turn to the north today. A much stronger trough of low pressure will track into the northeastern United States by Thursday and Friday and will cause Maria to turn to the northeast and speed up in forward speed.

According to Rob Lightbown, “Based on this track, Maria is expected to bring tropical storm force winds and heavy rainfall to Bermuda from about Wednesday afternoon through Wednesday night. After that, Newfoundland may receive tropical storm conditions and very heavy rainfall on Friday.”

Rob continues, “The western Caribbean will be an area to really

watch over the next 10 to 14 days. The entire pattern that will be setting up which consists of a large high pressure system over New England are notorious for leading to falling barometric pressures over the western Caribbean and thus leading to tropical cyclone genesis. The GFS and European model guidance continue

to forecast that tropical cyclone development will occur in the western Caribbean next week. The GFS model is forecasting lowering barometric pressures in the western Caribbean by this weekend, which leads to tropical development there sometime next week. The European model forecasts the same type of scenario with a tropical cyclone developing in the far northwest Caribbean in 10 days from now or right around September 21 or 22.”

There are currently no systems that pose any threat to the Cayman Islands. However, since we live in the western Caribbean, I would suggest keeping an eye on weather reports from local media. A massive quantity of stolen items, valued at $ 90.000 C.I dollars, three guns and 12 rounds of ammunition have been recovered by the RCIPS in separate operations.

The multiple successes of the RCIPS occurred in separate operations all in less than the space of a week and only eight days after the end of the gun amnesty.

The loot recovered by the police includes television sets, power tools, electricity generators, video games, and various items of jewellery.

The massive confiscation comes on the heels of a stern warning by RCIPS Detective Superintendents, Marlon Bodden and Kurt Walton at a press briefing to mark the end of the gun amnesty.

The detectives warned that they would not relent in their efforts to apprehend criminals and would show no leniency to those unwilling to capitalise on the gun amnesty.

Last Thursday in Prospect the

police recovered a .45 caliber pistol and arrested two men, one remains in custody.

On Friday, after 2pm, on Bodden Road in George Town, a quick response by the police lead to the recovery of a 9mm pistol with three live rounds.

On Saturday the police recovered a 9mm semi-automatic pistol with three live rounds, and, in a separate incident, arrested a 32-year-old man for possession of, with intent to supply marijuana.

Mr. Bodden said: “We continue to advise the public to hand over illegal firearms to avoid this trouble.

“We have many strategies in place, and we also carry out vehicle checks, it is not just the vehicle’s coupons that are being examined.

“The road checks do make an impact, and they have been imperative.”

One of the major concerns expressed by Mr Bodden is the large amount of criminals who reoffend after they have been released from custody.

He said: “We always have to be

concerned about recidivism and what influences this rate.

“The more someone does something then the more comfortable they become. But we, the police, are looking to see how competent they are. They will make a mistake.”

Mr Bodden added: “Some people use robbery as an opportunity to blame the economy. A lot of it is senseless.”

The senior detectives also revealed that the enormous quantity and value of the loot recovered, forced them to make unusual arrangements for its security and accommodation.

Police also revealed they will be utilising the new mobile x-ray scanning machines that will be installed by Customs next year.

Detective Superintendent Kurt Walton said: “We looked at the mobile x-ray scanner so the police can also use it to x-ray vehicles passing through.

“There will be occasions when the scanners will be used to support police operations.”

Hurricane Katia’s severe winds batter parts of UKStrong winds from the tail-end of Hurricane Katia are battering much of the UK, the Met Office has severe weather warnings in place for many areas.

Southern and central parts of Scotland, Northern Ireland, Northern England and Wales have been experiencing winds of up to 80mph (129km/h).

Flood alerts have been issued, with road, rail and ferry travel disrupted.

A driver was killed after a tree fell in high winds on a car, Durham Police have said.

Also in the north east, more than a dozen cars were crushed when the roof of a building on Littleburn Industrial Estate at

Langley Moor collapsed due to strong winds.

In Scotland, a lorry hit a tree on the A811 near Arnprior causing the telegraph pole to collapse. Power has been restored.

With cruise ship arrivals down for July (in a decade) and hotel occupancy rates

not improving over last year’s dismal figures, the Cayman Island Government is celebrating the improvements in stay over tourism and air arrivals. Any crumbs that fall from the table to a waiting dog are indeed lapped up with a smile. The air figures are a little suspect as to whether these arrivals are actually tourists and not permanent residents, as the hotel occupancy rates do not match the 7.5% increase. Dept. of Tourism is suggesting the extra visitors ‘are staying with friends and family.’ Our own investigations (see the article on P.12, “Air arrivals are still up”) actually paint a better picture with the occupancy figures of the hotels we contacted.

Our ‘friendly’ bloggers put the whole blame squarely on the shoulders of the Government and in particular our premier, Hon. McKeeva Bush. There is no mention of the downturn in the World economy, especially the USA where the bulk of the cruise ship passengers and stay over visitors come from. The cruise ships are almost ‘giving’ their cruises away and their passengers have little money to spend and prefer to stay on board where

their food is included in the price of the ticket.We have no cruise ship terminal and no word even

when a start is going to be made to implement one. We are almost the only Caribbean destination with no such facility, and more cruise ships are not calling in here now for that very reason.

We cannot boast anymore that we have very little felony and we are almost gun crime free.

We have plenty of talk and precious little action. We can point the blame but not provide the solution.

Government can put forward plans to improve our tourist attractions but we howl our protests when it means change, even when it only indirectly affects us.

When we stagnate, and the tourists we do have leave, whom do we blame? Ourselves? Certainly not! We can organise and join protest marches against any proposed development including signing petitions furiously. “Not in my backdoor” even if the backdoor is 25 miles away. Do we ever stop and consider that tourism is our lifeblood?

No tourists and we may not even have the crumbs left upon the table to fall and we are the scowling, waiting dogs. But its not our fault. Blame someone else.

Pink Ladies volunteer as trolley dolliesSeveral students took time out of their school and university holidays this summer to volunteer with the Pink Ladies Trolley Service at the Cayman Islands Hospital. Eilidh Bridgeman, Ann Kinch, Courtenay Moon, Kia Macfee and Amy Whicker all took their turn at operating the trolley service which sells hot & cold drinks, snacks, patties, cakes, fruit etc to the Staff, Patients and Visitors at the Hospital.

The Trolley Service is entirely volunteer run and Pink Ladies are most grateful to these students and to all the volunteers who help to keep the trolley service in operation. The Pink Ladies trolley service is well supported and warmly

welcomed around the hospital wards and offices and volunteers are always needed to help with the service which operates

Government hopes to sign a comprehensive late-autumn agreement with infrastructure giant China Harbour Engineering Company (CHEC) to develop cruse-ship berths in George Town, Spotts Landing and the Cayman Turtle Farm.

Answering a question in the Legislative Assembly from the opposition People’s Progressive Movement (PPM), Premier McKeeva Bush said in May he had signed an MOU with the Beijing-based company, and now looked forward to a final pact in two months.

PPM leader Alden McLaughlin, stated “The Premier,” signed an MOU with CHEC, indicating an arrangement to build cruise-ship berths, and something in West Bay and Spotts.” He then asked “Is the MOU still operational or have we moved on yet again?”

Mr Bush had initially said reconstruction of the single Spotts Landing jetty, used by cruise ships when inclement weather disrupts the George Town anchorage, would start at the end of July.

The company advanced $3 million to the government for the project, which was, however, delayed until at least November. Little explanation was

offered for the delay, however, although Planning Department officials said they had not seen, much less approved, any blueprints for the redevelopment.

“Things have moved on since 2004,” Mr Bush answered, referring to a series of companies scheduled, at various times, to build the berths.

“We signed with Meisner to build the dock,” he said, naming Florida’s Meisner Marine, which ultimately helped build George Town’s Royal Watler Cruise Terminal.

“Then there was Atlantic Star,” he said, a local construction company operated by Saudi-Caymanian Farhad al Rashid, who agreed in 2009 with PPM Tourism Minister Charles Clifford to build two cruse berths on the Royal Watler site.

“And still we have no dock, and still we are trying,” Mr Bush said, indicating blame for the delays lay with

the previous PPM administration. “Meanwhile the cruise ships went to Honduras, Jamaica and other places.

“Now we have an MOU in place until November,” he said.

“What happened was that we looked at Spotts, which is an atrocious facility, and the cruise industry pulled out because of Spotts, where, for example, the elderly have to move up and down,” the Premier said.

“The new one will be an improved facility, and is projected to cost $6 million or $7 million or $8 million. CHEC said it would advance some of that and build out to $3 million. If we reach agreement, we will pay back what was spent – up to $3 million,” he said.

The money spent was likely to generate a local economic impact of $12 million in goods, services and other activity, “a multiplier effect that is about four times greater than the expense,” Mr Bush told the House.

He denounced critics who had asked about the multi-million- dollar advance.

“The opposition complained and the Auditor General asked if there were $3 million in the account,” he said. “I am sick and tired of this, and I told CHEC not to move forward [on anything] until the definitive agreement was signed. – which should be signed by November.”

Stay-over visitor arrivals in the Cayman Islands are up for the tenth month in a row.

July figures show a significant increase of 7.5% over July 2010.

Latest figures from the Department of Tourism (DOT) shows air passenger arrivals at 31,407, which is the third strongest July over the past 10 years.

Ms. Nadia Hardie of Sunshine Suites hotel says, “June and July have been really good. We had a drop off in August which is pretty standard for the island but in relation to the previous years our numbers have been very positive.”

Mr. Fernando Soler of The Grand Cayman Marriott Hotel said, “We have done very well this year compared to previous years this month is slow but that’s expected.”

Referencing the results at the Tourism Awareness forum on Cayman Brac on Saturday, 3 September, Hon. McKeeva Bush, Premier and Minister of Tourism noted that “these results are even more significant when you consider that figures for December 2010 were the highest for any December since the year 2000 and January registered an increase of 5.8 per cent (January over January), which was the highest figure we had seen in any January since 2001.

The Premier explained that “from February through May our tourism statistics have continued to improve and for the month of June, air arrivals were up by 7.6 per cent, over June 2010. This represented the third strongest June arrival figure in 10 years. Furthermore, for the month of July, arrivals from the US are up 7.4 per cent over last July, and there is a dramatic 72.1 per cent increase in arrivals from Canada this July, over what we were seeing in July 2010.”

Shomari Scott, Acting Director of Tourism commented: “The growth in arrival figures, particularly during these tough economic times, is extremely gratifying and highlights that the proactive steps that have been taken -- such as working more closely with industry partners, realigning CAL and introducing new routes to boost capacity – are paying dividends. Additionally, by working with CITA and other industry partners, the Department has launched a number of new initiatives and promotions that are designed to drive visitation and support local businesses and service providers. Clearly, these are delivering the desired results, as the latest tourism figures demonstrate that the Cayman Islands remains a sought after destination for

families, divers, weddings and honeymoons and those simply seeking sun, sea and sand.

One of the new initiatives in place is the Cruise Conversion & Welcome Back Programme. CITA has recently added the cruise sector to its Board of Directors.

One point of focus has been to improve the visitor experience of cruise ship passengers and create an incentive programme to attract them to return to the Cayman Islands.

CITA has been working closely with the Department of Tourism to accomplish this along with the creation of a welcome centre at the Royal Watler Cruise Terminal.

“As we move into the fall season” continued the Director, “a series of new promotions - including the Visiting Friends and Relatives, Dive Madness and Pirates Week deal -- will be on offer to travelers to maintain the positive trend. James Lyman Hill of New Hampshire is believed to be now hiding in the Cayman Islands after a 1997 incident where he allegedly torched his girlfriend’s house after she broke up with him.

He is wanted by the New Hampshire Joint Fugitive Taskforce due to an arrest warrant being issued by the Belknap County Sherriff’s Office for Arson of a Residence.

The public is asked to “Approach with Caution, Do not attempt to apprehend this person yourself. He should be considered armed and dangerous.”

It has also been reported that Hill has faked his own death at least twice in the late 1990s. Once by running a stolen boat aground and another in a car crash.

U.S. Marshall Jeffery White said, “The last confirmed sighting was in Florida but he was known to vacation in the Cayman Islands and we think that’s where he could be now.”

Hill is white, six-feet tall, 200 pounds with hazel eyes and brown hair, also he is known to work as a carpenter or handyman.

UK’s Cameron meets Medvedev, Putin in rare visitMOSCOW (AP) — British Prime Minister David Cameron insisted Monday that Russia and Britain can overcome the sharp differences in their relations — even the 2006 poisoning death of a Kremlin critic in London — to seal new trading ties and help promote world stability in the wake of the Arab uprisings.

Cameron was in Moscow for the first visit to Russia’s capital by a British leader in six years, meeting with President Dmitry Medvedev, and holding the first talks by any British official with Prime Minister Vladimir Putin in more than four years.

Ties between Britain and Russia soured over the 2006 poisoning death of dissident ex-Russian

security agent Alexander Litvinenko in London. Litvinenko made a deathbed statement accusing Putin of authorizing his killing.

Russia has refused British requests for the extradition of the chief suspect in the case, ex-KGB agent Andrei Lugovoi, who denies involvement.

Following talks at the Kremlin, Medvedev told Cameron there was no prospect of Lugovoi facing a British court because the Russian constitution prohibits the extradition of a Russian citizen.

“This will never happen, no matter what the circumstances,” Medvedev said during a news conference with Cameron. “We all have to learn to respect our legal frameworks.”

Charlie Sheen smiles through Comedy Central roastCULVER CITY, Calif. (AP) — Charlie Sheen smiled through a Comedy Central roast as Mike Tyson, William Shatner, actress Kate Walsh and half a dozen comedians riffed on his high-profile year.

Sheen was famously fired from his sitcom “Two and a Half Men” in March after a very public meltdown during which he claimed to be a “rock star from Mars” who has “tiger blood” and “Adonis DNA.”

At least 61 Kenyans dead after pipeline explosionNAIROBI, Kenya (AP) — A leaking gasoline pipeline in Kenya’s capital exploded on Monday, turning part of a slum into an inferno in which at least 61 people were killed and more than 100 hurt.

Flames leapt out from the pipeline in a radius of some 300 yards (275 metres), setting shacks ablaze and incinerating scores of people, leaving charred bodies and blacked bones in the charred homes. Some burned bodies floated in a nearby river filled with sewage. Homes had been built right up to the pipeline, the residents said.

“I’ve lost count of the number of

bodies,” said Wilfred Mbithi, the policeman in charge of operations in Nairobi as he stood at the scene. “Many had dived into the river trying to put out their flames.”

Provincial Commissioner Njoroge Ndirangu said at least 61 bodies have been recovered so far, but said the death toll from the blast will rise.

Nearby, a young woman clawed through smoldering timbers, screaming in grief. Others wandered by the remains of the inferno, frantically dialing phone numbers that didn’t go through or staring around in disbelief.

twisted wreckage of corrugated iron sheets and scattered possessions. Visibility was poor because of rain and smoke.

On the 31st August 2011, after a trial lasting 15 days, Mr. Justice Cooke delivered a reserved judgment consisting of 35 pages in which he found Devon Anglin not guilty of the murder of your year old Jeremiah Barnes on the 15th February 2010.

Following the delivery of the judgment and speaking on the Courthouse steps, the Commissioner of Police is reported as saying - “it was a sad day for the Barnes family and a desperate day for justice in the Cayman Islands.”

I am assuming that this statement has been correctly reported since it has not been refuted by the Commissioner of Police. For the reasons, which follow, I consider that the statement that the judge’s decision was “a desperate day for justice in the Cayman Islands” was an unwarranted and inappropriate comment.

I think it appropriate for me to refer to certain important sections of Mr. Justice Cooke’s judgment, which are contained in his careful and analytical judgment. He applauded the two leading Counsel who appeared for the Prosecution and the Defence who he said had provided the Court with every assistance. He also noted that the investigating process was as comprehensive as could be. The investigation team was commended by the Judge for their thoroughness and professionalism.

Mr. Justice Cooke then reviewed in detail the five offences with which Devon Anglin had been charged and said this: -

“In arriving at a verdict on each count it is incumbent on me to demonstrate that I am fully aware of the legal principles which touch and concern the relevant issues and that I have applied those principles in a manner that does not have to be construed I will also bear in mind always that the burden of proof is on the Crown, on the prosecution, and I am only entitled to convict if I am satisfied that I feel sure.”

In dealing with the counts of murder, attempted murder and possession of an unlicensed firearm he began by saying as follows:-

“There is no issue that Jeremiah Barnes was murdered. From the circumstances, the uncontested inference is that the fatal bullet was meant or aimed for Andy Barnes. It passed through the headrest of Barnes’ seat in which he was seated in the car and into the head of his son. The shooting was a deliberate act with the intention to kill or cause serious bodily harm. The gunman did not achieve his objective but by reason of transferred malice he would be as guilty as if he had. There is no issue that the evidence grounds attempted murder. And, finally, at this juncture I say that there is further no issue that the gunman was in possession of an unlicensed firearm.”

So the legal requirements were all there, all there save for the critical issue as to the identity of the gunman: was it Devon Anglin, the defendant?

There can be no doubt that when Mr. Justice Cooke’s judgment is reviewed and analysed that he properly understood the issues; applied the proper principles that a judge sitting alone in a criminal trial had to apply and that he realised that the critical issue in this case was the identity of the gunman who fired the shots.

He then carefully analysed the evidence pertaining to visual identification and correctly stated that the relevant evidence on this issue came from Andy Barnes, Dorlisa Ebanks and Carlos Ebanks. He then analysed this evidence and his analysis was critical, thorough and fair. He referred to the evidence that Andy Barnes gave in chief and to his cross-examination by Mr. Ryder, leading Counsel for the defence.

He next carefully analysed the evidence of Carlos Ebanks, who he accepted as a witness of truth. He then referred to the evidence

of Dorlisa Ebanks. She said under cross-examination that the gunman had the gun in his right hand. She did not recall seeing the left hand doing anything to obstruct his face.

The Judge found that there were disturbing and unexplained inconsistencies in the evidence of Andy Barnes. The Judge said of him that at the preliminary inquiry, he told the Magistrate he saw Anglin’s face in the car. In evidence he saw shadows. And he, on oath told the Magistrate “this well knowing that this damning evidence was not true”. Then the Judge found that there was irrefutable and contradictory evidence: he said “it is clear from the CCTV footage that the gunman held the gun in his left hand. He (Barnes) says that the gunman held the gun in his right hand.”

Cooke found as a fact that at all material times the gunman was masked.

The judge found and demonstrated in his judgment that the evidence of Andy Barnes was unreliable.

It is significant to note that during his closing submission the judge posed the following question to Mr. Radcliffe QC (leading counsel for the Prosecution):

“What would be the position if the visual identification is regarded as worthless?”

Mr Radcliffe answered this question with commendable frankness. He said: “that the consequence of such a finding would be as if Barnes and Dorlisa had not given evidence and an acquittal would be inevitable.”

The judge found that the evidence of Andy Barnes is of no value and that it was worthless.

As to the evidence of Dorlisa, the judge found that in respect of the critical issue of visual identification “I put absolutely no weight on her evidence. It has no value.” He says that her evidence is flatly contradicted by the evidence of Carlos Ebanks who he found to be a witness of truth.

The judge summed up that in respect of Andy Barnes and Dorlisa Ebanks the Crown had not adduced any evidence of any probative value and he therefore acquitted Devon Anglin on Counts one, two and three of the Indictment.

As a result of the Judge’s findings in respect of identification, it is absolutely clear he was obliged as a matter of law and in accordance with his oath of office to acquit the Defendant of the charges set out in Counts one, two and three. If he had done otherwise and convicted Devon Anglin his decision to do so would have been perverse, dishonest and completely unsupportable and indeed “a desperate day for justice in the Cayman Islands.”

Whilst we all sympathise with the parents of Jeramiah Barnes, an acquittal in the light of the judge’s careful decision was not a desperate day for justice in Cayman

and for it to be so described by the Commissioner of Police was entirely inappropriate and regrettable.

In my view, desperate days for justice in Cayman, can arise in one of two ways:

(1) If a judge disregards cogent evidence in a case and reaches what is clearly a perverse and dishonest verdict, or

(2) If a judge blatantly disregards well settled and well established legal principles which must have been known to him and reaches a decision without taking such principles into account.

The judgment of Justice Howard Cooke does not fall within these two categories and the Commissioner of Police was completely out of order in describing his decision in the way that he did.

He is entitled to ask the DPP and leading Counsel for the Prosecution to conduct an urgent review of the

judgment to determine whether there were grounds for appeal against the decision of Mr Justice Cooke. That is a right that he has exercised but he has no right to be offensive and make insulting and inflammatory statements about a judgment delivered by a Judge of our Grand court and particularly about this careful and analytical judgment of Mr Justice Cooke. It is not a decision, which could in any sense be described as giving rise “to a desperate day for justice in Cayman.”

In my view Mr Justice Cooke is entitled to an apology from the Commissioner of Police for this intemperate and unwarranted observation and it is my hope that he will receive such an apology.

The event of the summer, the comet of that season’s sky, was an invitation to a small party in the town, where it was understood that young Pronando, with five or six of his companions, would be present. Miss Haws accepted occasional invitations for her pupils, marshalling them in a bevy, herself robed in pea-green silk, like an ancient mermaid: she said that it gave them dignity. It did. The stern dignity and silence almost solemn displayed by Rast’s three worshippers when they found themselves actually in the same room with him were something preternatural. They moved stiffly, as if their elbows and ankles were out of joint; they spoke to each other cautiously in the lowest whispers, with their under jaws rigid, and a difficulty with their labials; they moved their eyes carefully everywhere save toward the point where he was standing, yet knew exactly where he was every moment of the time. When he approached the quadrille, which was formed in one corner by Miss Haws’s young ladies, dancing virginally by

Themselves, they squeezed each other’s hands convulsively when they passed in “ladies’ chain,” in token of the great fact that he was looking on. When, after the dance, they walked up and down in the hall, arm in arm, they trod upon each other’s slippers as sympathetic perception of the intensity of his presence on the stairs. What an evening! How crowded full of emotions! Yet the outward appearance was simply that of three shy, awkward girls in white muslin, keeping close together, and as far as possible from a handsome, gay-hearted, fast-talking youth who never once noticed them. O the imaginative, happy, shy fancies of foolish schoolgirls! It is a question whether the real love which comes later ever yields that wild, fairy-like romance, which these early attachments exhale; the very element of reality weights it down,

and makes it less heavenly fair.At the end of the summer Rast had

acquired a deep experience in life (so he thought), a downy little golden mustache, and a better opinion of himself than ever. The world is very kind to a handsome boy of frank and spirited bearing, one who looks as though he intended to mount and ride to victory. The proud vigor of such a youth is pleasant to tired eyes; he is so sure he will succeed! And most persons older, although knowing the world better and not so sure, give him as he passes a smile and friendly word, and wish him Godspeed. It is not quite fair, perhaps, to other youths of equal merit but another bearing, yet Nature orders it so. The handsome, strong, confident boy who looks her in the face with daring courage wins from her always a fine starting-place in the race of life, which seems to advance him far beyond his companions. Seems; but the end is far away.

East did not return to the island during the summer vacation; Dr. Gaston wished him to continue his studies with a tutor, and as the little college town was now radiant with a mild summer gayety, the young man was willing to remain. He wrote to Anne frequently, giving abstracts of his life, lists of little events like statistics in a report. He did this regularly, and omitted nothing, for the letters were his conscience. When they were once written and sent, however, off he went to new pleasures. It must be added as well that he always sought the post-

office eagerly for Anne’s replies, and placed them in his pocket with satisfaction. They were sometimes unread, or half read, for days, waiting a convenient season, but they were there.

Anne’s letters were long, they were pleasant, they were never exciting—the very kind to keep; like friends who last a lifetime, but who never give us one quickened pulse. Alone in his room, or stretched on the grass under a tree, reading them, Rast felt himself strongly carried back to his old life on the island, and he did not resist the feeling. His plans for the future were as yet vague, but Anne was always a part of his dream.

But this youth lived so vigorously and fully and happily in the present that there was not much time for the future and for dreams. He seldom thought. What other people thought, he felt.

Early in September William Douglas failed suddenly. From taciturnity he sank into silence, from quiet into lethargy. He rose in the morning, but after that effort he became like a breathing statue, and sat all day in his armchair without stirring or noticing anything. If they brought him food he ate it, but he did not speak or answer their questions by motion or gesture. The fort surgeon was puzzled; it was evidently not paralysis. He was a newcomer on the island, and he asked many questions as to the past. Anne sincerely, Miss Lois resolutely, denied that there had ever been any trouble with the brain.

A scrapbook is simply a decorated photo album that also preserves the stories behind the photos (called journaling). It can also hold memorabilia (tickets, certificates, letters, etc.).

Not only does a well-made scrapbook protect and preserve your photos, it also makes the photos themselves more fun to look at. Most people would much rather thumb through a scrapbook with its extra fun touches than a plain photo album. By using acid-free and lignin-free papers and adhesives, photos can be preserved beautifully and safely. The papers and accessories available now give us lots of creative options for doing more than just filing photos in an album—scrapbooking is a creative hobby!

When I was a lot younger it was the norm for kids to keep a scrapbook. It was encouraged at school and it was with pride we would bring our scrapbooks to be shared with our classmates.

Sadly it seems to be a thing of the past but maybe this article might stir up a little interest in the subject. It’s

easy to do. No experience or expertise is required—it’s as simple as cutting and gluing.

You must still have some photographs lying around. You know. The ones actually printed in gloss on stiff paper. Ones your parents and grand parents gave you. Your wedding photographs. Ones when you were a baby – a young child. So get those photos out of shoeboxes and attics and into albums where they can be seen and shared. Where to start? It’s best to begin with your most recent photos. It’s not a monumental task.

Scrapbooks also make great gifts for loved ones on a special day, e.g. weddings, anniversaries, milestone birthdays, graduations, retirement parties, etc. They show you have put a lot of time and thought into your gift and therefore a wonderful keepsake for the receiver.

Scrapbooking is a creative outlet with its colours, themes, cutting and pasting, writing, and arranging. It is so enjoyable and so much fun! If you think you’re not creative – you’re wrong. Even the most un-artistic person can copy a page layout that they found somewhere and really liked. Besides, it’s hard not to be inspired when you have some great photos and some fun scrapbooking materials in front of you. After a while you’ll be adding your own personal touches to your pages, and soon you’ll be creating your own completely unique layouts that you

can be proud of. I promise.Nothing will help you make new

friends faster than sharing a hobby with someone! Scrapbooking is an especially great hobby for sharing with friends. If you don’t believe me - go on-line. Here are just a few websites:

You might even find someone near you who scrapbooks and then start your own scrapbook club. If you don’t have some other scrapbookers in your life, you’re missing out.

Scrapbooking captures precious moments and memories and this is the most wonderful thing about scrapbooking. When I first started scrapbooking, my grandma was the person in my family most interested in my layouts. Every time she came over we would look through them together and she would point out the things she liked the most. She was so interested that I finally decided to make a scrapbook with her. We put in photos of us together along with mementos of all the special times we could think of. It took a few weeks to finish, but we had a great time. Two short months later she was diagnosed with pancreatic cancer and quickly slipped away. I’m so thankful that we were able to make that scrapbook together. Because now, whenever I miss her, I can just look through that scrapbook and smile at all the precious memories.

APPLY SUNSCREEN PROPERLY.

Apply a thick, even coat to all exposed areas 20 - 30 minutes before your child goes out in the sun. Choose a sunscreen with SPF (Sun Protection Factor) 15 or higher. Make sure it's labeled "broad spectrum," which means it blocks both UVA and UVB sunlight. For your little ones, sunscreen that contains zinc oxide or titanium dioxide should be selected as these compounds are less irritating than others. Sunscreen sticks are best for the face because they are sweat proof and less likely to drip. Don't forget nose, ears, hands, feet, shoulders, and behind the neck; lips can also burn, so apply a lip balm with SPF protection. Reapply sunscreen every 2 to 3 hours, or after sweating or swimming.

COVER FROM HEAD TO TOE.

Wearing protective clothing and hats is one of the primary ways of warding off UV damage. When wet, light coloured clothing transmits just as much sunlight as bare skin. Keep your kids covered with dark colours, long sleeves, and pants whenever possible. And don't forget the accessories: sunglasses with UV protection to guard against burned corneas, and hats to prevent sunburned scalps and faces. Protective clothing, hats with wide brims, and sunglasses are just as important for babies. At the beach, bring along a large umbrella.

Parents, you are the best teacher by practicing sun safety yourself. If your child

sees you following sun safety rules, he'll take them for granted and follow suit. Teach every member of the family how to protect

their skin and eyes. With proper supervision, children can learn to protect themselves

and enjoy summer fun without sacrificing the health of their skin.

The end of the school year is here and savvy moms and dads by now have made all the arrangements for summer. Summer camps and leisurely days at the pool or beach are just a few of the summer rituals for many families. However if you're tempted to let your child play outdoors for even a few minutes without proper sun protection, you might want to think twice. Adolescence and childhood are critical periods during which exposure to UV radiation is more likely to contribute to skin cancer in later life. Children with fair skin, blond or red hair and blue or green eyes are at the highest risk of sunburn. But darker-skinned children also need sun protection. With this in mind, it’s important that parents teach their children how to enjoy fun in the sun safely.

LIMIT OUTDOOR PLAYTIME BETWEEN 10A.M. AND 4P.M.

Avoid unnecessary exposure when the sun's rays are at their strongest. Even on cloudy or cooler days, ultraviolet (UV) rays remain strong. Shady spots can be just as tricky because of reflected light. If your child is playingoutdoors during these hours, make sure to apply ample sunscreen.

Some medications increase the skin's sensitivity to the sun, so make sure to ask your doctor whether your child may be at risk. Prescription antibiotics and acne medications are the most notorious culprits, but when in doubt, ask.

Manchester dominate the Premier League

The city of Manchester continued it’s early Premier League domination with weekend wins for both City and United.

Sir Alex Ferguson’s side continued it’s impressive opening to the campaign by destroying North West rivals Bolton 5-0 at the Reebok Stadium.

Striker Wayne Rooney continued his blistering form scoring another hat-trick – his second in as many games. Javier Hernandez completed the route with a brace.

Fergie praised his three-goal hero after the match. He said: “When players get to their mid-20s, there is

more thought in their game. Their timing is better. Wayne’s presence is good and he is looking fantastic.”

Title rivals City put three past Wigan with their new forward Sergio Aguero netted all three goals.

Liverpool suffered a set-back losing to Stoke City in a match they totally dominated. Jon Walters scored the only goal of the game from the spot after a controversial penalty in the first half.

Boss Kenny Dalglish was unhappy with a number of decisions during the game, including denying his side two clear penalties in the second half.

Dalglish said: “If I feel Liverpool are suffering then maybe I need to go down the same route as some other people

go and see if we can get some benefit from that.

“I’ll speak to the owners first and see what they say because the last thing I want is for my behavior to infringe on the club’s success in any way.”

Chelsea beat Sunderland 2-1 but misfit striker Fernando Torres again failed to score for the Blues.

Arsenal got back to winning ways narrowing beating Swansea at home by a single goal while Tottenham put two past Wolves without reply.

In Saturday’s other match Everton and Aston Villa fought out a 2-2 draw.

On Sunday Fulham and Blackburn tied 1-1 while new boys Norwich went down 1-0 at home to West Brom.

Only player to survive Russian plane crash dies

MOSCOW (AP) — The only member of a top Russian hockey team to survive a plane crash that killed 44 people died Monday of his injuries in a Moscow hospital.The Vishnevsky hospital said 26-year-old Alexander Galimov died of the severe burns that covered about 90 percent of his body, despite the best efforts of doctors in its burn unit, considered one of the best in Russia.

The crash Wednesday of a chartered Yak-42 jet outside the western city of Yaroslavl took the lives of 37 players, coaches and staff of the local Lokomotiv Yaroslavl ice hockey club. The only other person to survive, flight crew member Alexander Sizov, remained in intensive care at Moscow’s Sklifosovsky hospital.Unlike many other members of Lokomotiv who were European Union citizens and once played in the NHL, Galimov was a native of Yaroslavl and a product of its youth program.His death is certain to be deeply mourned in the city, where the team’s consistently strong performance was a source of great pride.At rallies following the crash, fans chanted “Galimov, live for the whole team!” and other slogans dedicated to him.“All of Yaroslavl, all of the country, all of the world followed the doctors’ words, believing, hoping, praying that he would defeat death and remain with us,” Yaroslavl Gov. Sergei Vakhrukov said.

Yani Tseng wins NW Arkansas Championship

ROGERS, Ark. (AP) — Top-ranked Yani Tseng successfully defended her title in the LPGA Tour’s NW Arkansas Championship on Sunday, beating Amy Yang with a 4-foot birdie putt on the first hole of a playoff.

Yang missed a 6-foot birdie try before Tseng holed the winning putt on the par-5 18th.“I almost cry because today,

like in the middle of the round, I felt like, ‘Oh, I’m going to lose today.” Because in my mind, I don’t feel excitement. GLENDALE, Ariz. (AP) — All that was missing in Cam Newton’s spectacular NFL debut was a victory.

For all of his big passing plays and Arizona’s many miscues, the Cardinals beat Newton’s Panthers 28-21 on Sunday. Newton threw for 422 yards and two touchdowns, setting the record for yards passing by a rookie in his NFL debut and tying Matthew Stafford’s mark for most yards by a rookie in any game.

Newton earned the respect of his opponents in the process.

“He’s a big, athletic, strong quarterback,” Arizona inside linebacker Paris Lenon said. “The guy can run the ball and throw the ball well. He’s definitely going to be a major force in this league.”

Newton’s big numbers came even though the play book he’s using remains limited.

“We really had to pare it back an awful lot and it’s going to grow each week,” first-year Panthers coach Ron Rivera said.

Newton completed 24 of 37 passes with one interception.

“He was everything everybody didn’t expect him to be,” said Steve Smith, who caught eight of those passes for 178 yards, including TDs of 77 and 26 yards. “He was on point, he made some great runs, he made some great reads, made some fantastic throws. He made some throws out there that honestly as a receiver it made it easy to catch them.”

The statistics seemed to mean little to the big, young quarterback, who was unbeaten in his BCS championship season at Auburn.

“The last time I lost a game was Navarro Junior College,” Newton said. “What do you want me to say, it feels great? It is not a comfortable feeling for me.”

The Panthers had first down at the Arizona 11 late in the game, and even got an extra down on an offside call, but failed to score.

“There’s going to be a lot more things I can look back on tomorrow after I watch the film,” Newton said. “One thing I know is you have to capitalise. When you’re in the red zone, you can’t take the sack, you can’t digress.”

Newton overshadowed a nice Arizona debut for Kevin Kolb, who was 18 for 27 for 309 yards, including touchdown passes of 48 and 70 yards. Kolb talked about the negatives, most significantly Arizona getting inside the Carolina 6 twice in the second quarter and coming up empty.

“You look at what could have been,” he said. “When you go back and analyze it I think you are going to see that besides five plays, we dominated them. Even on defense, they could probably say the same thing. That’s a big deal for us.”

Arizona trailed 21-14 going into the final quarter before Kolb connected with Early Doucet for the 70-yard score.

Then rookie Patrick Peterson, the No. 5 overall pick in the draft who had trouble with Smith much of the day, took a punt back 89 yards for what proved to be the game-winning score.

“With me being a defensive back, I barely have a chance to get my hands on the ball,” Peterson said. “That’s why I love punt returns so much.”
