Know what stays & what goesWhen a property changes hands,
what goes with it? Unless otherwisestated in the sales contract, you won’tfind a comfy couch and huge flat-screen TV waiting for you when youmove in. But what about curtains, car-pets or mirrors?
The question of what conveys, or isincluded, with a property can be morecomplicated than you think. It’simportant that by the time you,whether a buyer or seller, reach theclosing table, you know exactly whichitems go on the moving truck andwhich ones stay behind. Here aresome guidelines to help you deter-mine what’s included or excluded in asale.
START WITH THE CONTRACTA property includes anything per-
manently attached to the house oranything that would cause significantdamage to remove. That definitionleaves some room for interpretation,so the Texas Real EstateCommission’s One to Four FamilyResidential Contract (Resale), used inmost transactions involving the resaleof residential property, dedicates asection to this topic.
Paragraph 2 of this contract coversthe improvements, attachments andaccessories that stay with the proper-ty. It also deals specifically with exclu-sions—items usually included withthe sale that are excluded from a par-ticular transaction.
DON’T BELIEVE EVERYTHINGYOU SEE ONLINE
Some online listings mention spe-cific improvements like “gorgeouskitchen upgrades with stainless steelappliances.” That doesn’t necessarilymean those stainless steel appliancescome with the house. Certain built-inappliances may convey, but don’tassume anything—and don’t trust theinformation online. The final word onwhat stays or goes is the sales con-tract.
IT’S ALL NEGOTIABLESo what’s attached to the home and
what isn’t? The contract languagesays that the brackets for a wall-mounted flat-screen TV stay with thehouse, but the TV does not. Any per-manently installed or built-in appli-ance stays; that usually includes theoven or stove but may not include the
refrigerator. There’s a long list ofitems in the contract that usually con-vey with the house, but everything isnegotiable—that’s why there’s a sec-tion for exclusions.
FIND OUT BEFORE YOU CLOSEThe best thing to do when you’re
considering making an offer on ahome is to ask what comes with it.Then, if you really like a piece of fur-niture or an appliance—or it’s justmore convenient for you to keepwhat’s there—ask the seller for it inthe contract.
Your Texas Realtor can negotiatefor something to be included in thesale, like the TV in the bedroom or thewasher and dryer, and the worst theseller can say is no. Just be sure you’renot derailing the purchase of your$250,000 dream home over a $500 setof drapes.
