There are facts; and thenthere are urban mythssome of which through

sheer repetition over a long peri-od of time attain the status offacts. And they become sodeeply ingrained in our psychethat we simply assume them tobe true. One such myth is play-ing out right now in sections ofthe Indian media, especially ontelevision channels, in relation tothe Indrani Mukerjea-SheenaBora case. As much as there isshock and horror over the inci-dent, there appears to be evenmore shock that such a thingcould have happened in “highsociety”.

Commentators appear to bestruggling to comprehend how“normal” people like themselves— educated, successful, urbaneand rational — could be capableof doing something so horrid.The debate is marked by a toneof incredulity. Bharatiya JanataParty (BJP)’s Shaina NC,appearing on a talk show,likened the descent of such aclass of society into criminalityto kalyug. Note the emphasis onadjectives — “respectable”;“society’s upper crust”; and“glamorous” — that have beenused to describe the Mukerjea-Bora clan, and it is not hard tosee where these commentatorsare coming from.

The sting lies in the unspokensubtext. For, what they are reallysaying is that such conductwould have been perfectlyunderstandable if the dramatispersonae had been from “lowersociety” (they are like that afterall) but “these guys” are expect-ed to behave differently. There isa hint of cultural racism, and itflows from our deep-seated elit-ist assumptions about how class-es behave or should behave.

In this imagined understandingof class behaviour, the well-heeled and the clever — the sup-posedly “respectable” faces ofsociety — are credited with san-

ity, civility, and rational thoughtwhile the “great unwashed” areseen as unruly, irrational, dys-functional and primitive. Theyare the “plebs”, you see, andoften they know not what theyare doing. “But how come peo-ple from our own circle — ourgolf partners, club mates, cock-tail circuit buddies — havestooped to their level?” is thequestion that has pundits strug-gling to get their head around.

TV channels have sought todefend their wall-to-wall cover-age of the case on the groundthat the intent is to expose the“criminality” creeping into eventhe upper class of society imply-ing, that it wouldn’t have beensuch a big deal if this had hap-pened in a poor ghetto as downthere they are used to this sort ofthings.

The fact is that the notion ofupper class “respectability”, asagainst the “licentiousness” ofthe hoi polloi is an urban myth

akin to the idea of racial superi-ority. Outside the realm of popsociology and half-baked theo-ries there is no empirical evi-dence to show that particularclasses — posh or otherwise —behave in a particular way. Thereis no such thing as a “typical”behaviour of either the upperclasses or those at the other endof social and economic hierar-chy. The belief in

“herd”mentality, whereby certainbehaviour patterns are assignedto people depending on how thedominant class sees them, is anartificial construct designed todistinguish “us” from “them”.

It is true that different socialgroups, especially those linkedby religious or cultural affinity,share a range of specific charac-teristics in terms of their lifestyle— the way they live, the clothesthey wear and the food they eat.And consumer research hasfound links between consump-tion habits and socio-economicbackground of customers.

But, there’s no definitive datawhich shows that criminal

behaviour is inherent in any spe-cific strata. Mark Twain, speak-ing about crime in America, saidthere was “no distinctlyAmerican criminal class, exceptCongress”; and [minusCongress] that’s true of othersocieties as well.

Poverty, indeed, is regarded asa factor in crime (Aristotledescribed poverty as “the parent

of revolution and

crime”) but it isnot the same thing as identifyingthe entire class of poor people aspotentially criminal-minded.

Or, conversely, declaring thatthe rich are immune to it.Individuals, not classes, commitcrime. And they do it for a vari-ety of reasons — greed, jealousy,sexual deviance, anger, frustra-tion, psychological factors —which have nothing to do withtheir place in society’s arbitraryfood chain; or whether they areaffluent or poor. There are twomyths at play in the way thewhole Mukerjea-Bora saga isbeing debated. The first is that“respectability” — itself a dubi-ous Victorian conceit — is theexclusive preserve of the rich

metropolitan elite; and second,that once you achieve“respectable” status, you auto-matically develop an immunityto any wrongdoing.

Such fiction persists, or rather,has been allowed to persist,despite increasing evidence tothe contrary. Many deviantsbeing unmasked around theworld — among them pae-dophiles , fraudsters, rapists,marital cheats and even murder-ers — belong to the class of the

rich and the famous. Who canbe presumed to be more

“respectable” thanpriests, teachers and

doctors? And,yet, Europe and

the U.S. haveb e e ns w a m p e dwith scan-d a l s ,involvings u c hgrandees.

In Indiatoo, there is no

dearth of high-society figures

who have ended up injail for criminal offences;

and their tribe is growing.Some of Delhi’s most high-pro-file crimes in recent years haveinvolved some so-calledrespectable people. Rememberthe Jessica Lal murder? Or thekilling of Nitish Katara? AndArushi?

Yet, every time such an inci-dent happens, the media (and notjust the media) feigns surprise:how could this have happened?The simple answer is: becausecriminality doesn’t recogniseclass barriers; and the idea thatthere’s such a thing as a ‘class-specific crime gene’ againstwhich the upper classes havebeen inoculated is simply racist.As H.G. Wells wrote, “All crimein the end is the crime of thecommunity.”

For decades, politi-cal parties, the media and soci-ety at large have avoided seri-ous debate on the promotion ofequal opportunity in an iniqui-tous, caste-ridden society prac-tising discrimination by birthfor centuries.

All societies face seriouschallenges on account of dis-crimination and institution-alised inequality. The UnitedStates has its African-Americans and IndianAmericans, Europe has itsGypsies, Australia has itsAborigines, and China has itsnon-Han minorities. Butnowhere in the world areinequality by birth and moralneutrality to such discrimina-tion so institutionalised as inIndian society. Centuries ofartificial division of societyinto hundreds of castes, thedenial of education for all but afew “upper” castes, anunbreakable linkage betweencaste and occupation, institu-tionalised untouchability andabsurd notions of “impurity”,the long-entrenched tradition ofendogamous marriages withina sub-caste, and serious preju-dice against mixed marriagesare all that have made theIndian caste system the mostheinous, oppressive andintractable form of discrimina-tion and inequality by birth.

Styming opportunity

Even a cursory understandingof our society exposes the linkbetween caste and poverty, and

the denial of opportunity basedentirely on circumstances ofbirth. The future of a vastmajority of children born in oursociety can be reasonably pre-dicted at the time of birth mere-ly by assessing the family’seconomic status, parental edu-cation and caste. The child’sinnate ability, ambition andhard work, in most cases, areirrelevant to her future. Notonly is this an unjust, oppres-sive monstrosity in this day andage, but also a large majority ofthe nation’s gene pool is alsowasted by this denial of oppor-tunity, and the nation’s state ofpoverty and backwardness areperpetuated. Given these cir-cumstances, caste will have tobe an important factor in deter-mining eligibility for affirma-tive action policies. However,the unimaginative way inwhich reservations have beenimplemented has led to several,undesirable consequences.

Most of the benefits of reser-vations have gone only to afew, better educated, well-offelites among the communitieseligible for reservations. Whenyou see the background ofyoungsters recruited to the civilservices, or those admitted tomedical schools, the IndianInstitutes of Technology, theIndian Institutes ofManagement, national lawschools or other courses thatgive real opportunities of verti-cal mobility, we see a patternemerging. Though reservationis applicable to the poor and therich, or the illiterate and theeducated in caste groups equal-ly, in reality, most benefitsaccrue to the children of thosewho already have the advan-tages of education, career andwealth. In most selections to/inpremier institutions in highereducation or recruitment to

high-end jobs, it is the childrenof Indian AdministrativeService, Indian Police Serviceofficers and other senior offi-cials, the progeny of Membersof Legislative Assemblies(MLA), Members ofParliament (MP) and the otherpolitical elite, and the offspringof successful professionals andbusinessmen who dominate thescene in communities eligiblefor reservations.

Polarisation and politics

This skewed benefit has para-doxical consequences. Thepoor, disadvantaged ScheduledCastes (SC) and ScheduledTribes (ST) and OBCs aremostly on the fringes and con-tinue to remain mired in pover-ty and backwardness, as theycannot compete with childrenfrom more advantaged back-grounds in their own communi-ties. Therefore, there is enor-mous pain, suffering and angstoften resulting in despair andwhich triggers violence. Mostof the poor in disadvantagedsections are sullen and angry astheir lot does not seem toimprove irrespective of abilityand hard work. At the sametime, the communities exclud-ed from reservations harbouranimosity and prejudice againstthe castes included in the reser-vation category. There are alsoseveral poor and semi-literatefamilies among castes not cate-gorised as SCs or OBCs. Whena child in such a family is over-taken by an obviously wealthychild enjoying caste reserva-tion, the resentment created hasa snowballing effect. This castepolarisation is accentuated bythe political mobilisation ofcaste groups for voting. Giventhis complex process, short-sighted politicians and caste-based leaders can easily pro-

voke primordial loyalties andarouse animosities based oncaste. We have seen manyinstances of caste mobilisationfor and against reservations. Inrecent years, the Jat-Gujjar-Meena agitations in Rajasthanare too well known to bear rep-etition. Now, the agitation ofPatels, the largely successfuland entrepreneurial communityin Gujarat, one of India’s mostvibrant States, only illustratesthe need for rationalising reser-vations.

It is clear that at present mostof the benefits of reservationsflow to a few well-educatedfamilies in the upper strata.Real poor families among SCs,STs and OBCs are largely onthe margins. The poor amongOther Categories (OC) areresentful and frustrated, andtend to blame reservations forall their problems. The currentform of reservations and zero-sum approach have deepenedcaste divisions without helpingthe truly poor, deserving chil-dren to advance in life. MostIndians — from castes includedin reservation or excluded —feel betrayed. We need anurgent, earnest, honest, nationaldebate, and a creative sensible,pragmatic response.Opportunities for all disadvan-taged children, equity, fairnessand common sense should bethe guiding principles in evolv-ing a more rational model ofreservations.

Case for dis-reservation

First, while caste will contin-ue to be the mainstay of reser-vation policies, the benefitsshould flow to the vast majori-ty of underprivileged childrenfrom deprived castes; not to afew privileged children with acaste tag. Families of public

officials of a certain rank —IAS, IPS, other Central andState civil services, present orformer MLAs, MPs, other sen-ior politicians — certain highincome professionals likephysicians, chartered account-ants, managers above a certainrank in the private sector, andbusinessmen and others abovea certain income should be dis-reserved. In other words, oncethey have received a significantadvantage of reservations, theyshould be able to ensure oppor-tunities for their children andvacate the space for the trulydisadvantaged children in theirown caste groups. The argu-ment that financial or profes-sional success does not end dis-crimination, and therefore theyshould forever enjoy reserva-tions is fallacious and self-serv-ing. The logic of reservations isthat educational and employ-ment opportunities will reducediscrimination in a moderneconomy. The state has only thepower to give these opportuni-ties. If education, job andincome do not mitigate dis-crimination, then the rationalefor reservation collapses. Ifreservations do help in upwardmobility, then what more canwe expect in life other than anIAS, IPS officer, MLA, MP or acardiac surgeon? It is easy toidentify families which havesubstantially benefited fromreservation by virtue of posi-tion, rank, profession, educa-tion, children’s school andincome. Once these familiesare dis-reserved, the truly poorand disadvantaged sectionsamong reserved communitieswill get a helping hand in bothhigher education and jobs.

Affirmative steps

Second, we have to addressthe anger and aspirations of

poor families among unre-served communities. Jats,Patels and other obviously suc-cessful communities who arepoor are easily angered by whatthey see as an unjust system.With the Supreme Court rulingof 50 per cent ceiling on reser-vation quotas, no further reser-vation is possible. But intelli-gent, creative, fair and practicalways of giving the poorer chil-dren among OCs a helpinghand are possible and neces-sary. For instance, parental edu-cation and the school the childattended are two sure indicatorsof poverty and the backward-ness of a family. If parents havenot had education beyondschool, and if the child goes toa government school or a low-end, ramshackle private school,it is a sure sign of a lack of ade-quate opportunity. Such a child,however bright, cannot com-pete with the privileged son ofa high official or wealthy doc-tor going to an expensive pri-vate school. And yet, our so-called “merit” system treats a90 per cent score of the privi-leged child as better than the 80per cent score of a poor girl in arural school. If reasonableweightage is given in marks tosuch underprivileged childrenin the category of OC — anaddition of marks decided by agroup of experts — it will giveadded opportunity to poor OCswithout raising reservationquotas. At the same time, truemerit is not compromised andthere is always an aspirationallevel they have to meet. Third,no child with ability and desireshould ever be denied opportu-nities for higher education onaccount of poverty or birth.Scholarships, free tuition, softloans and other mechanismsmust be strengthened, so that abright child can reach for thestars irrespective of his or her

family’s social or economic sta-tus.

Once these three steps are inplace, most of the distortions inthe reservation policy will van-ish. There will be far greaterharmony and little incentive topolarise society or provoke pri-mordial loyalties. Most of all,the really disadvantaged willhave a genuine opportunity torise to their potential.Unfulfilled potential is thegreatest sin in our society. Oncewe eliminate much of thisscourge, we can reduce reser-vations by one or two per centeach year. Within a generation,discrimination by birth will bea thing of the past, and reserva-tions will not be necessary.Simultaneously, the state canencourage market mechanismsfor equal opportunity in the pri-vate sector.

These efforts should be cou-pled with a vigorous nationaleffort to improve school educa-tion outcomes. The Right ofChildren to Free andCompulsory Education (RTE)Act is mostly a failure inenabling a real opportunity forall children. Guaranteed out-comes in schools and access toreal quality school education toevery child irrespective of birthand poverty are at the heart of asociety promoting equity,opportunity and egalitarianism.It is time we address the chal-lenge of reservations honestly,openly, fairly and innovatively.We cannot bury our heads inthe sand forever like an ostrich.

Sunday’s murder in Dharwad of the outspokenKannada scholar, M.M. Kalburgi, is tragic andalarming. It is the first such instance in

Karnataka, which has a tradition of free speech and arecord of outspoken scholars and writers. Kalburgi, aSahitya Akademi award winner and an authority onVachana literature, was known for his sharp criticismand questioning of superstitious beliefs, and received adeath threat from the leader of a fringe right-wing grouplast year. Since June 2014 he was given police protec-tion but some months ago he requested that it be with-drawn. While the identity of the two assailants, andtheir motive, are yet to be conclusively established, thenature of the threats against him has led investigatorsand the intelligentsia to suspect the role of fringegroups. This, especially given the backdrop of the mur-der of rationalist writer Narendra Dabholkar in 2013,and of CPI activist Govind Pansare in 2015, both inMaharashtra. In all the three cases the assailants weremotorcycle-borne, and shot from point-blank range.While hasty conclusions on the latest murder would beimprudent, there is no denying that fringe right-winggroups have created an atmosphere of intolerance tooutspoken writers and academics who question reli-gious practices and myths, thereby putting pressure onfreedom of speech and expression. Soon afterKalburgi’s murder, a case was filed by the police inMangaluru against a Bajrang Dal activist who tweetedthat the “next” victim would be the Kannada writer K.S.Bhagwan, and the activist was arrested. The socialmedia have amplified such threats, which are acerbicand abusive in nature and typically target writers or aca-demics who question ideologies and religious beliefs.There is enough evidence of the use of brute force bythese fringe groups to enforce their points of view.There is a need to crack down on these groups whichprofess violence. It is important to use for some of theseoutfits the same yardstick as is used for other religion-and ideology-based extremist groups. Unfortunately, amajority of the cases filed against them or their leadersfor inflammatory and abusive remarks and even violentacts do not result in convictions, and that emboldensthem further. It is also crucial to monitor and promptlycurb threats made through social media. These actionsare needed to ensure that daring, fierce and temperedacademic and literary opinion continues to be freelyexpressed without fear of any retribution. Whether ornot fringe groups were involved in Kalburgi’s murder isimmaterial here.

The sting lies in the unspokensubtext. For, what they are really saying is

that such conduct would have been perfectly under-standable if the dramatis personae had been from “lowersociety” (they are like that after all) but “these guys” areexpected to behave differently. There is a hint of cultural

racism, and it flows from our deep-seated elitistassumptions about how classes behave or

should behave.

Grand Alliance...must have realised that senior leaders

"The mammoth rally of Prime MinisterNarendra Modi at Bhagalpur was an eye-opener for Yadav. He must have understoodthat the grand alliance has no chance to winin Bihar and a defeat will adversely affect hisparty's chances in UP Assembly elections,"Mr Hussain added.

The grand alliance, comprising six JanataParivar parties including JD(U), RJD, SP,was cobbled up at the behest of Bihar ChiefMinister and JD(U) leader Nitish Kumar tothrow a challenge to BJP-led NationalDemocratic Alliance (NDA) in stateAssembly polls scheduled in October-November this year.

Mr Yadav was unanimously accepted as itsPresident. Mr Hussain referred to RJD vice-president Raghunath Jha quitting the partyand said that it was just the beginning of theend of grand alliance. He added that manymore desertions would follow in the comingdays.

"The opposition should stop calling it'grand alliance.' There is nothing grand aboutit. Modi's Bhagalpur rally was a politicaltsunami and the alliance has realised that itwill obliterate JD(U) and RJD from thestate," he added.

Hitting out at Kumar, the senior BJP leadersaid he was still being egoistic while talkingto the people of Bihar and the recent examplewas the way he spoke to statistical workersduring his programme at Samastipur.

"The workers were raising their demands atwhich Kumar scolded them and threatenedthat their file was with him, and if they madenoise, his one signing (by Kumar) will dumpthem on street. I want to ask him whether it ishis habit to insult the people of Bihar," MrHussain said.

"There are over 50,000 statistical workersin the state and they are also a part of the pub-lic in the state. They will press button andpull down Kumar's government," he added.

Mr Hussain went on to criticize MrKumar's recently released vision documentfor development of the state as "election man-ifesto".

The BJP leader also suggested that theBihar Chief Minister should stop braggingabout being a son of a freedom fighterbecause those whose father or grandfather arenot freedom fighters are also patriots andequal citizen of the country.

Tariq Anwar said in Patna.Mr Anwar, who is Lok Sabha member from

Katihar, said that with Mulayam Singh Yadavwalking out of the alliance "the efforts tobring back splinter parties into Janata Parivarhave virtually come to an end."

After NCP walked out of the alliance, their3 seats were given to SP along with two oth-ers from RJD quota totaling five, which theyrefused.

The NCP leader said his party would loveto enter into a tie-up with the SP after today'sdevelopment.

"Earlier I had talks with SP Bihar chief andhe had expressed agreement to be together.But, after today's development I do not knowwhat will be their approach, but we'll wel-come if they come with us," he said.

Mr Anwar said his party was waiting for aresponse from the Left Front to fight theBihar elections together. He said NCP wasalso in talks with smaller parties like SamrasSamaj Party of former Union ministerNagmani and Bahujan Samaj Mukti Partywhich has spintered from the BSP ofMayawati.

The NCP General Secretary, however, dis-missed any chance of tie-up either withJanadhikar Party of Madhepura MP RajeshRanjan alias Pappu Yadav and AIMIM ofHyderabad MP Asaduddin Owaisi as hisparty did not agree with their ideology.

He said NCP was waiting for reply of Leftand others "but if they do not come we'll fightalone in Bihar."

The NCP leader slammed Prime MinisterNarendra Modi and Bihar Chief MinisterNitish Kumar for competing with each otherin "speaking lies" in the name of economicpackage for the state to lure voters.

The BJP and its three allies in state are notprojecting a presumptive Chief Minister andhave decided that the PM - who has held fourpublic meetings in Bihar, drawing huge audi-ences - will ask for votes directly for him.

This has pitched Mr Kumar and Mr Modiinto a full-blown confrontation. The two lead-ers for years, and through a lengthy allianceof their parties, made no secret of their disre-gard for each other.

When the BJP decided in 2013 to pick MrModi as its candidate for PM, Mr Kumarended their parties' 18-year-long alliance.

reporters that while they were not sure if MrBhalerao has supplied sugarcane to the min-ister's factory, it would honour 50 per cent ofits pending payments in the next one or twomonths.

2000 Villages..."As of now, 13,78,540 people have been hit

due to floods in 2,199 villages," an ASDMAofficial said.

Along with Ms Mukerjea, her driver andher former husband, Sanjeev Khanna, aKolkata businessman, have been arrested.The men, the police says, have confessed tothe crime.

The court allowed the pleas filed by morethan 200 serving and retired officers of theparamilitary forces seeking the court's direc-tion for grant of NFU to them alleging thedeprivation of the financial benefit is "affect-ing the morale and efficiency of the officers".

They had sought direction for central gov-ernment to treat them as "organised cadre"and grant them the NFU benefits.

"NFU is given to all other group cadre 'A'organised services but these officers weredenied saying they have not been accordedorganised service status," said the plea.
