Contractors License Board Minutes of the February 20, 2015 Meeting Page 2 Call to Order: There being a quorum present, Chairperson Akasaki called the meeting to

order at 8:30 a.m. Chairperson Akasaki introduced and welcomed Craig S. Takamine as the

Board’s interim member from Hilo, Hawaii. Mr. Takamine stated that he works for Takamine Construction Inc. and is

looking forward to working with the Board. Agenda: The agenda for this meeting was filed with the Office of the Lieutenant

Governor, as required by Hawaii Revised Statutes (“HRS”) section 92-7(b). Minutes: It was moved by Mr. Lee, seconded by Mr. Kamai, and unanimously carried

to approve the Board’s January 23, 2015 meeting and executive session meeting minutes as circulated.

The agenda was taken out of order and continued with “Chapter 91, HRS,

Adjudicatory Matters”. Amendments to Agenda: It was moved by Mr. Lee, seconded by Mr. Kamai, and unanimously carried

Chapter 91, HRS, Adjudicatory Matters: Chairperson Akasaki called for a recess from the Board’s meeting at 8:35

a.m. to discuss and deliberate on the following adjudicatory matters pursuant to HRS chapter 91.

1. Settlement Agreements

None.

2. Board’s Final Orders a. In the Matter of the Application for a Contractor’s License of

Stanley Wayne Mugleston; CLB-LIC-2013-001

Stanley Wayne Mugleston requested a contested case hearing due to the Board’s denial of his application in the C-13 Electrical classification for failure to demonstrate the requisite four years of supervisory experience in this classification at its April 25, 2014 meeting. On August 13, 2014, a hearing was held and the Hearings Officer recommended that the Board affirm the denial of Mr. Mugleston’s application for the C-13 electrical contractor license. b. In the Matter of the Application for a Contractor’s License of

Hadley Enterprises LLC and William W. Hadley, RME; CLB-LIC-2013-002

William Hadley, on behalf of himself and Hadley Enterprises LLC

requested a contested case hearing due to the Board’s denial of their applications for a license and conditional license in the C-44a Gutters classification.

The Board denied Mr. Hadley’s applications at its March 22, 2013

meeting for failure to show a good reputation for honesty, truthfulness, financial integrity and fair dealing.

A hearing was held on November 6, 2014 and the Hearings Officer

recommended that the Board find and conclude that it did not act

improperly by denying Mr. Hadley’s request for a conditional license or their applications for the C-44a license.

After review and discussion, it was moved by Mr. Kamai, seconded by

Mr. Lee, and unanimously carried to adopt the Hearings Officers recommended orders as the Board’s Final Orders for the above two cases.

Following the Board’s review, deliberation and decisions in these matters,

pursuant to HRS chapter 91, Chairperson Akasaki announced that the Board was reconvening to its open meeting at 8:40 a.m.

Executive Session: At 8:41 a.m., it was moved by Mr. Lee, seconded by Mr. Kamai, and

unanimously carried to enter into executive session pursuant to HRS section 92-5(a)(1) to consider and evaluate personal information relating to individuals applying for professional or vocational licenses cited in HRS section 26-9, and to consult with Rodney J. Tam, deputy attorney general, on questions and issues pertaining to the Board’s powers, duties, privileges, immunities, and liabilities pursuant to HRS section 92-5(a)(4).

At 10:05 a.m., it was moved by Mr. Suehiro, seconded by Mr. Lee, and

unanimously carried to move out of executive session and to reconvene to the Board’s regular order of business.

At 10:10 a.m., it was moved by Mr. Suehiro, seconded by Mr. Kamai, and

Scott Oosthuizen, CEO of AVDB Group, appeared for Nathaniel Hall. After discussion, it was moved by Mr. Suehiro, seconded by Mr. Matsuzaki,

and unanimously carried to defer Mr. Hall’s appearance to the Board’s next meeting.

unanimously carried to enter into executive session pursuant to HRS section 92-5(a)(1) to consider and evaluate personal information relating to individuals applying for professional or vocational licenses cited in HRS section 26-9, and to consult with Rodney J. unanimously carried to defer Mr. Ruda’s application for licensure in the C-13 classification pending the submission of a revised project list of four years supervisory experience in electrical work.

Recess: Chairperson Akasaki called for a short recess at 10:30 a.m. The Board reconvened at 10:35 a.m. The agenda continued with the appearances.

At 10:41 a.m., it was moved by Mr. Suehiro, seconded by Mr. Polischeck, and

unanimously carried to defer Mr. Campos’ application for licensure in the C-37 classification pending the submission of a revised project list of on-site field supervisory experience, excluding administrative office work, and using the Board’s project list format.

unanimously carried to enter into executive session pursuant to HRS section 92-5(a)(1) to consider and evaluate personal information relating to individuals applying for professional or vocational licenses cited in HRS section 26-9, and to consult with Rodney J. g. Ronald E. Prescott, RME (Additional classification) Tokunaga Masonry Inc. “B” General Building Executive Session: At 10:58 a.m., it was moved by Mr. Mochida, seconded by Mr. Lee, and

unanimously carried to enter into executive session pursuant to HRS section 92-5(a)(1) to consider and evaluate personal information relating to individuals applying for professional or vocational licenses cited in HRS section 26-9, and to consult with Rodney J. Tam, deputy attorney general, on questions and issues pertaining to the Board’s powers, duties, privileges, immunities, and liabilities pursuant to HRS section 92-5(a)(4).

At 11:05 a.m., it was moved by Mr. Mochida, seconded by Mr. Suehiro, and

unanimously carried to move out of executive session and to reconvene to the Board’s regular order of business.

After discussion, it was moved by Mr. Mochida, seconded by Mr. Lee, and

unanimously carried to defer Mr. Prescott’s application for licensure in the “B” classification pending the submission of a revised project list of three years supervisory experience in “ground-up” projects, and copy of his civil engineering degree and master’s in business, which can be used in lieu of one year of experience.

h. Vanessa M. Lucido, RME ROC Equipment LLC C-35 Pile driving & foundation Executive Session: At 11:09 a.m., it was moved by Mr. Suehiro, seconded by Mr. Kagawa, and

unanimously carried to enter into executive session pursuant to HRS section 92-5(a)(1) to consider and evaluate personal information relating to individuals applying for professional or vocational licenses cited in HRS section 26-9, and to consult with Rodney J. Tam, deputy attorney general, on questions and issues pertaining to the Board’s powers, duties, privileges, immunities, and liabilities pursuant to HRS section 92-5(a)(4).

At 11:27 a.m., it was moved by Mr. Lee, seconded by Mr. Kagawa, and

unanimously carried to move out of executive session and to reconvene to the Board’s regular order of business.

Based upon Ms. Lucido’s description of the work that she performs, the Board determined that a C-31e Concrete cutting, drilling, sawing, coring, and pressure grouting classification is also required.

After discussion, it was moved by Mr. Leong, seconded by Mr. Suehiro, and unanimously carried to defer Ms. Lucido’s application for licensure in the

C-35 and C-31e classifications, pending the submission of four years of projects in each classification, and using the Board’s project list format.

i. Kim Ramsey, RME Ramsey Machine Services Inc. C-48 Structural steel Executive Session: At 11:30 a.m., it was moved by Mr. Konishi, seconded by Mr. Lee, and

unanimously carried to enter into executive session pursuant to HRS section 92-5(a)(1) to consider and evaluate personal information relating to individuals applying for professional or vocational licenses cited in HRS section 26-9, and to consult with Rodney J. Tam, deputy attorney general, on questions and issues pertaining to the Board’s powers, duties, privileges, immunities, and liabilities pursuant to HRS section 92-5(a)(4).

At 11:36 a.m., it was moved by Mr. Suehiro, seconded by Mr. Mochida, and

unanimously carried to move out of executive session and to reconvene to the Board’s regular order of business.

After discussion, it was moved by Mr. Matsuzaki, seconded by

Mr. Polischeck, and unanimously carried to defer Mr. Ramsey’s application for licensure in the C-48 classification pending the submission of a revised project list of broad-based supervisory experience in structural steel work, and using the Board’s project list format.

Mr. Ramsey stated that California requires the structural steel license to do

bridge crane work. Mr. Polischeck stated that if he submits just bridge crane work experience,

then the Board cannot approve him for the C-48 license, as broad-based experience supervising the means and methods of construction in structural steel classification is required.

l. Andrew D. Chekene, RME Andrew Chekene Enterprises Inc. “B” General Building C-33 Painting & decorating Executive Session: At 11:40 a.m., it was moved by Mr. Lee, seconded by Mr. Mochida, and

unanimously carried to enter into executive session pursuant to HRS section 92-5(a)(1) to consider and evaluate personal information relating to individuals applying for professional or vocational licenses cited in HRS section 26-9, and to consult with Rodney J. Tam, deputy attorney general, on questions and issues pertaining to the Board’s powers, duties, privileges, immunities, and liabilities pursuant to HRS section 92-5(a)(4).

At 12:00 p.m., it was moved by Mr. Polischeck, seconded by Mr. Kamai, and

unanimously carried to move out of executive session and to reconvene to the Board’s regular order of business.

unanimously carried to enter into executive session pursuant to HRS section 92-5(a)(1) to consider and evaluate personal information relating to individuals applying for professional or vocational licenses cited in HRS section 26-9, and to consult with Rodney J. Tam, deputy attorney general, on questions and issues pertaining to the Board’s powers, duties, privileges, immunities, and liabilities pursuant to HRS section 92-5(a)(4).

At 12:05 p.m., it was moved by Mr. Polischeck, seconded by Mr. Lee, and

unanimously carried to move out of executive session and to reconvene to the Board’s regular order of business.

unanimously carried to approve Mr. Thompson’s application for licensure in the C-5 classification. Mr. Thompson was reminded to be in Hawaii when the projects are ongoing, and Mr. Thompson replied that he is planning on moving to Hawaii.

unanimously carried to enter into executive session pursuant to HRS section 92-5(a)(1) to consider and evaluate personal information relating to individuals applying for professional or vocational licenses cited in HRS section 26-9, and to consult with Rodney J. Tam, deputy attorney general, on questions and issues pertaining to the Board’s powers, duties, privileges, immunities, and liabilities pursuant to HRS section 92-5(a)(4).

At 12:34 p.m., it was moved by Mr. Kagawa, seconded by Mr. Lee, and

unanimously carried to move out of executive session and to reconvene to the Board’s regular order of business.

unanimously carried to defer Mr. Jamorabon’s application for licensure in the “B” classification pending the submission of additional projects verifying four years of “ground-up” experience, which may include owner-builder projects; and a current criminal abstract for Mr. Napierala.

unanimously carried to enter into executive session pursuant to HRS section 92-5(a)(1) to consider and evaluate personal information relating to individuals applying for professional or vocational licenses cited in HRS section 26-9, and to consult with Rodney J. At 12:45 p.m., it was moved by Mr. Mochida, seconded by Mr. Kamai, and

unanimously carried to move out of executive session and to reconvene to the Board’s regular order of business.

After discussion, it was moved by Mr. Akasaki, seconded by Mr. Polischeck,

and unanimously carried to defer Mr. Raphael’s application for licensure in the C-22 classification pending the submission of a project list verifying four years of broad-based experience in the C-22 classification.

unanimously carried to enter into executive session pursuant to HRS section 92-5(a)(1) to consider and evaluate personal information relating to individuals applying for professional or vocational licenses cited in HRS section 26-9, and to consult with Rodney J. Tam, deputy attorney general, on questions and issues pertaining to the Board’s powers, duties, privileges, immunities, and liabilities pursuant to HRS section 92-5(a)(4).

At 1:05 p.m., it was moved by Mr. Matsuzaki, seconded by Mr. Kamai, and

unanimously carried to move out of executive session and to reconvene to the Board’s regular order of business.

Mr. Mochida left the meeting at 1:00 p.m. After discussion, it was moved by Mr. Kagawa, seconded by Mr. Konishi, and

unanimously carried to defer Mr. Peterson’s application for licensure in the C-37c and C-37f classifications pending the submission of separate project lists verifying four years of on-site supervisory experience in each classification.

Contractors License Board Minutes of the February 20, 2015 Meeting Page 11 Committee Reports: 1. Examination Committee: Aldon Mochida, Chairperson The Contractors Examination Summary for January 2015 was provided in the

Board’s packet for their information.

2. Recovery/Education Fund Committee:

Gary B.K.T. Lee, the Board’s recovery fund attorney, was not present. He provided a report for the Board. 3. Legislation Committee: Peter H. M. Lee, Chairperson Committee Chairperson Lee provided an update to the legislative bills introduced this session. H.B. No. 54 – This bill specifies that general engineering and general

building contractors will require further examination and additional fees prior to issuance of additional specialty classifications. This bill had a triple committee referral, but no hearings have been scheduled.

H.B. No. 103/ H.B. No. 103 H.D. 1 – This bill raises the threshold

under the contractor licensing law’s “handyman exemption” from $1,000 to $5,000.

On February 10, 2015, the House Committee on Economic

Development and Business (“EDB”) held a hearing on H.B. No. 103. The Board submitted testimony in opposition based upon its position on similar bills in the past. EDB passed the bill with amendments to reduce the increase in the exemption threshold from $5,000 to $2,000 and changing the effective date to February 19, 2025. H.B. No. 103 H.D. 1 was referred to the House Committee on Consumer Protection and Commerce (“CPC”) on February 18, 2015. CPC did not schedule a hearing for H.B. No. 103 H.D. 1.

Mr. Lee recommended opposition to H.B. No. 103 H.D. 1 and to keep

the exemption threshold at $1000. H.B. No. 129/S.B. No. 838 – These bills allow the Board to accept in

lieu of a specific experience requirement for licensure, equivalent knowledge, training, or experience including self-employed or unlicensed experience, if the Board investigates and makes a detailed written finding available for public inspection.

A hearing has not been scheduled for both bills. The Board voted to

oppose H.B. No. 129 at last month’s meeting. Mr. Lee recommended opposing its companion bill, S.B. No. 838.

H.B. No. 130/S.B. No. 839 – These bills prohibit the general

Hearings have not been scheduled for these bills. The Board voted to

oppose H.B. No. 130 at last month’s meeting. Mr. Lee recommended opposing its companion bill, S.B. No. 839.

H.B. No. 131/S.B. No. 840 – These bills clarify that records that show

a licensee’s relevant experience, trade examination results, and adequate bonding are subject to disclosure.

On February 4, 2015, the CPC held a hearing on H.B. No. 131. The Board did not submit testimony on this bill, but the Professional and Vocational Licensing Division did submit testimony in opposition. The CPC deferred this bill.

A hearing was not scheduled for S.B. No. 840. H.B. No. 307/H.B. No. 307, H.D. 1 – These bills amend the

membership and composition requirements of the Board, and declares that protection of the public shall be of the highest priority for the Board in the exercise of its licensing, regulatory, and disciplinary functions.

On February 6, 2015, the LAB held a hearing on H.B. No. 307. The

Board submitted testimony in opposition. The LAB amended this measure by:

(1) Removing the proposed character, residency, and domiciliary

qualifications for board members; (2) Clarifying that of the ten contractors in the Board, three shall

be general engineering contractors and two shall be building contractors;

(3) Specifying that the non-contractor members shall not: (a) Hold a valid or expired license to operate as a

contractor; (b) Have a close family member who is a licensee; or (c) Hold any financial interest in the business or any

licensee of the Board; and (4) Changing the effective date to July 1, 2115, to encourage

further discussion. On February 10, 2015, H.B. No. 307 H.D. 1 was referred to CPC. CPC did not schedule a hearing for this bill.

H.B. No. 713, H.D. 1/S.B. No. 168 – Allows the Department of Labor and Industrial Relations (“DLIR”) to train and deputize volunteer investigators investigating public works projects. H.B. No. 713, H.D. 1 requires the DLIR to submit reports and appropriate monies.

On February 3, 2015, the LAB held a hearing on H.B. No. 713. The Board submitted testimony in opposition. The LAB amended this measure by:

(1) Authorizing the DLIR, and not the Board, to train and deputize

volunteer investigators for public works projects; (2) Requiring the DLIR to submit status reports to the Legislature;

and (3) Appropriating funds from the general fund instead of the

Compliance Resolution Fund and changing the expending agency to the DLIR.

On February 11, 2015, the CPC held a hearing on H.B. No. 713, H.D. 1. The Board did not submit testimony. This bill just passed earlier this week, and the CPC amended this measure by mandating DLIR to make rules for specialized investigators (H.B. No. 713, H.D. 2). Mr. Lee recommended that the Board monitor H.B. No. 713, H.D. 2) as it no longer amends HRS chapter 444. A hearing has not been held for S.B. No. 168. H.B. No. 714/S.B. No. 164 – These bills prohibit general engineering and general building contractors from performing incidental or supplemental work. It requires general engineering and general building contractors to engage an appropriate specialty contractor to perform incidental work, and it also defines “incidental work”. On February 11, 2015, the CPC held a hearing on H.B. No. 714. The Board submitted testimony in opposition. The CPC deferred this measure. A hearing has not been scheduled for S.B. No. 164. The Board voted to oppose S.B. No. 164 at last month’s meeting. Mr. Lee recommended opposing its companion bill, H.B. No. 714. H.B. No. 1232 – This bill requires a contractor to pay a subcontractor within ten days after receipt of an invoice by the subcontractor that includes any supporting documents pursuant to the subcontract terms. On February 11, 2015, the CPC held a hearing on this bill, and the Board submitted testimony. The CPC deferred this measure. Arnold Wong of the Ironworkers stated that when the bill was first written and introduced, the wrong chapter was cited (HRS Chapter 444). The statute for public works should have been cited. S.B. No. 466 – This bill amends the number of members and membership requirements and restrictions for the Board. No hearings have been scheduled.

Mr. Lee recommended opposition to S.B. No. 466. S.B. No. 548 – This bill requires a general building contractor on construction projects involving more than four, rather than two, unrelated building trades or crafts. Allows a specialty contractor to take and execute a construction contract involving two or more crafts or trades without requiring the performance of the work to be incidental and supplemental. Mr. Lee asked for any comments from the audience, in particular the history of the bill. Mr. Wong stated that the Ironworkers Stabilization Fund rushed to introduce this bill. It proposes to require a general building contractor’s license if the project involves more than four unrelated trades. It also proposes to allow a specialty contractor to enter into a contract involving two or more trades even if the work is not incidental and supplemental to the primary work of the project. Gregg Serikaku of PAMCA asked if a job requires two or more unrelated trades, who can take the contract? Mr. Lee related that currently a general building contractor’s license is required for construction requiring three or more unrelated trades. Mr. Lee recommended opposition to S.B. No. 548. S.B. No. 1055 – This bill regulates ironworkers in the State by: establishing a board of ironworkers; requiring licensure for master ironworkers and journeyman ironworkers in Hawaii; and setting minimum qualification and continued competency requirements for licensure of ironworkers. Mr. Wong stated that instead of S.B. 1055, they are requesting the Legislature to introduce a resolution for a sunrise study on a structural board.

It was moved by Mr. Kamai, seconded by Mr. Polischeck, and unanimously carried to approve Mr. Lee’s recommendations as stated above.

4. Rules Committee: Tyrus Kagawa, Chairperson Rules Committee Chairperson Kagawa stated that the Board will take PAMCA’s submittal on their responses to GCA’s concerns (submitted on February 19, 2015) under advisement and for review. Messrs. Masatsugu and Arelliano of the Glaziers Union asked if PAMCA’s submittal to the Board will be made available to the public. Executive Officer Ito responded that it will be available to the public.

5. Investigation Committee: Kent Matsuzaki, Chairperson None. 6. Scope of Activity Committee: Nathan T. Konishi, Chairperson County of Kauai Department of Public Works – The County of Kauai is working on a design-build RFP for a chiller replacement project. The work will include C-2 Mechanical insulation, C-13 Electrical, C-15 Electronic systems, C-48 Structural steel, and C-52 Ventilating and air conditioning work. The primary work will be by the C-52 contractor and the balance could be considered incidental to their work. Douglas Haigh, Chief of the Building Division of the County of Kauai, is inquiring whether he is correct in recommending either a “B” General Building or the C-52 contractor to bid on the contract. After discussion, the Board recommended that this matter be deferred pending the receipt of additional information on the project; specifically, more detailed information on the structural supports for the chiller, concrete work, the percentages and dollar amounts of each of the different types of work involved on the project, what is entailed in the 90% chiller replacement work, and whether new power is being brought in for the new chiller. Department of Education (“DOE”) – The DOE requests clarification regarding the specialty license required to perform the work for Specification Section 027490 – Cured in Place (“CIPP”) Liner as specified. There is a bid inquiry from other bidders that the low bidder did not list the specialty license to perform the subject work. Recommendation: The “A” General Engineering, C-43 Sewer, sewage disposal, drain, and pipe laying, or C-43a Reconditioning and repairing pipeline contractor’s license may be required to install the CIPP Liner. Shawn A. James Leavey – Mr. Leavey is the project manager for the Waimea Village, LLC project. In order to clear the way for new construction at the Waimea Village site, Japanese-built structures from the 1940s era are to be removed. Residential carpenters and heavy machinery men who are capable of deconstructing these old buildings are interested in salvaging the structures (cabin, furo house and front shack). They are bonded and insured, but are not licensed contractors. The County of Hawaii Building Division has deferred to the Board on the question of requirements for commercial property demolition permit applicants. Mr. Leavey is inquiring if a licensed contractor must apply for his demolition permit, or can the owner of the property be the signatory, because these heritage buildings will not be certified for occupancy after they are deconstructed and removed, and will not be occupied by the public (hand-deconstructed with materials removed).

Recommendation: Only the “A” General Engineering, “B” General Building, or C-24 Building, moving and wrecking contractor should be allowed to pull a demolition permit. County of Maui – The County of Maui is requesting a determination on whether the “B” General Building contractor can bid on a project where the only scope of work is a chain link fence. The only subcontractor listed is a company who has a license to do fencing work. Recommendation: No, the “B” General Building contractor cannot bid a project where the scope of work is only a fence. The “A” General Engineering or the C-32 Ornamental, guardrail, and fencing contractor’s license may be required to install the chain link fence. Mr. Serikaku of PAMCA asked if the Board feels the “A” General Engineering contractor can bid on the project because the C-32 automatically comes with the “A” General Engineering contractor’s license. The Board responded “yes” and affirmed that the “B” General Building contractor can only bid on a contract if there are two or more unrelated trades, and the “B” General Building contractor does not automatically hold the C-32 classification. Hawaii Public Housing Authority (“HPHA”) – HPHA is requesting determination on which licenses (and/or combination of licenses) are required to perform the following work: to replace/repair existing solar hot water system to include replacement of solar storage tank, panels, controllers, time clock, valves, pipes, pumps, breakers, and insulation.

Mr. Wong of the Ironworkers Stabilization Fund Local Union 625 stated that

anything to do with structural steel should be done by the C-48 Structural steel contractor.

The Board did not receive the additional information it requested at its January 23, 2015 meeting.

Welding Technologies (“WT”) – WT is requesting an exemption from HRS chapter 444 to perform pressure boundary repairs within HPOWER’s boiler furnace. WT believes they meet the exemption under HRS section 444-2(9) because there are less than ten persons in the State of Hawaii qualified to perform these special repairs utilizing automated weld overlay machines that are designed and built by WT.

Mr. Wong asked if there were any safety issues to consider. Recommendation: The exemptions in HRS section 444-2(9) do not apply to

boiler furnace pressure boundary repairs; and a C-4 Boiler, hot-water heating, hot water supply, and steam fitting contractor is required to perform the boiler furnace pressure boundary repairs utilizing automated MIG welding which applies pressure boundary restoration and/or corrosion resistance to boilers and vessels.

Mr. Wong of the Ironworkers Stabilization Fund Local Union 625 brought a

sample fiberglass rod (rebar), which is now being used because of the sea salt water which causes rust. It is strong enough to hold his weight and it has

to be bent at the shop or pre-made. Ties have to be plastic or stainless steel and cannot be made of metal. He asked that this be added to the C-41 Reinforcing steel classification scope when amending the rules.

Executive Officer Tamanaha asked Mr. Wong to submit the brochure on the

fiberglass rebar and to provide the Board with proposed language amendments for the C-41 classification.

After discussion, it was moved by Mr. Lee, seconded by Mr. Polischeck, and

unanimously carried to approve the above scope recommendations.
