NEW TEACHER I POSITIONS FOR SY 2013-2014"

1. This is to reiterate on the Salient Features of the Regional Memorandum No. 41, s. 2013entitled "Allocation of the New Teacher I Positions for SY 2013-3014", which were based on theUnnumbered DepED Memorandum, for emphasis and considerations:
> Division Offices are now instructed to evaluate and identify qualified applicants for theone half of the Division Allocation to be based on the Old Registry of QualifiedApplicants (RQA).
List of qualified teacher-applicants for the 1st half from the Old RQA shall be madeavailable by January 31,2013.
Recruitment evaluation, and selection process for the 2«* half of the DivisionAllocation shall start as early as January to have new RQA and must be completed bythe end of March 2013.
All of the qualified teacher-applicants for the 2nd half shall be made available forassignment to schools not earlier than April 1,2013 and not later than May 15,2013.
Deployment of the Teacher Items should remain "as is " for both levels. There shall beno changes/realignments to be made.

For the information and guidance of all concerned, enclosed is a copy of thei Amended Implementing Rules and Regulations (IRR) of Republic Act (RA) No. 8190ntitled An Act Granting Priority to Residents of the Barangay, Municipality or City Wherehe School is Located, in the Appointment or Assignment of Classroom Public School'eachers.
Pursuant to Section 9 of this IRR, this Order shall take effect 15 days after itsjmblication in the Official Gazette or in at least one newspaper of general circulation. Assuch, the IRR took effect on January 12, 2013 since it was published on December 28,£012 in the Philippine Daily Inquirer.
All Orders, Memoranda, and other related issuances inconsistent with this IRR isdeemed amended accordingly upon its effectivity.
Immediate dissemination of and strict compliance with this Order is directed.

AMENDED IMPLEMENTING RULES AND REGULATIONS OF R.A. NO. 8190 "An ActGranting Priority to Residents of the Barangay, Municipality, or City Where the
School is Located, in the Appointment or Assignment of Classroom Public SchoolTeachers"
Pursuant to Section 3 of Republic Act No. 8190 otherwise known as "An Act Granting PriorityTo Residents of the Barangay, Municipality or City Where The School Is Located, in theAppointment Or Assignment Of Classroom Public School Teachers", the following amendedrules and regulations are hereby prescribed:
Section 1. Definition of Terms - As used herein, the following terms shall be understoodto mean:
(i») Teacher refers to a person who meets the minimum requirements for the position asrequired by law and the standards set by the Department who does actual teaching inclassrooms and other learning centers.
(l>) Applicant refers to a person who holds a valid certificate of registration/professionalli :ense as a teacher from the Professional Regulation Commission (PRC) seeking to beappointed to a Teacher I Position.
(<:) Qualified applicant refers to a person who meets the evaluation and selection criteriaas prescribed by the Department of Education (DepEd), and who is in the registry of theSchools Division and is a bona fide resident.
(d) Bona fide resident refers to a qualified applicant who is, prior to appointment, residentft* a period of at least six (6) months of a particular barangay, municipality, city or provincewhere the school is located, as evidenced by legal documents to be identified by theDepartment.
(<•) Secretary refers to the Department of Education Secretary
(f) Regional Director refers to the Department of Education Regional Director
(ci) Protest refers to the administrative complaint filed by an aggrieved applicant(Complainant) regarding an appointment or assignment to a Teacher I made by an
pointing or assigning authority (respondent).
) Appointment refers to the issuance of original appointment of teachers.
(i Assignment refers to the posting of a teacher in a public school or other learningnter.
(j) Registry refers to the official list of qualified applicants in the Schools Division.
Section 2. Coverage - These rules and regulations shall apply to appointment orisignment of teachers in all public schools and other learning centers under the
Department of Education.
Section 3. Filling Up of Vacant Positions - In the appointment or assignment ofteachers to public schools and other learning centers with vacant teaching positions, priority
lall be given to bona fide residents of the barangay, municipality, city or province wherethe school is located, in no particular order.

Recruitment and Selection Process - Upon approval of these rules andregulations, applicants who are interested in being appointed or assigned to publicelementary or secondary schools and other learning centers located in the place where theyere bona fide residents may send their written applications together with the necessarydocuments, to the school head concerned who shall verify and certify as to the correctnessnd authenticity of the documents submitted including the proof of place of residence. Thechool head in turn shall forward the applications to the Office of the schools divisionuperintendent. The Division Office shall maintain a registry which shall be valid for a period

he Secretary of Education shall issue guidelines on the hiring of teachers that shall beconsistent with RA 8190 and these implementing rules and regulations.
ection 5. Protest Procedures for Violations of RA 8190
Aggrieved applicants in the registry of the Schools Division may file a protest. The protest,which shall be subscribed and sworn to in the form of a letter-complaint in three (3) copies,
Nail be filed at the Regional Office within ninety (90) days from the issuance of theappointment.
The Regional Director shall, within seventy-two (72) hours upon receipt of the protest,require the Schools Division Superintendent (SDS) to answer the allegations in the protestwithin fifteen (15) days, furnishing the protestant a copy thereof.
The Regional Director's decision may be appealed to the DepEd Secretary within fifteen (15)days upon receipt thereof. Any appeal on the decision of the Secretary shall be filed with theCivil Service Commission.
A protest shall not render an appointment ineffective nor bar the approval thereof by theappointing authority, but the approval shall be subject to the final outcome of the protest.
Section 6. Sanctions - Any person found guilty of violating any of the provisions of RA8190 and these implementing rules and regulations or any part hereof shall be chargedadministratively pursuant to RA 6713 otherwise known as the Code of Conduct and EthicalStandards for Public Officials and Employees and other relevant laws, rules and regulations.Administrative sanctions for any willful violations of RA 8190 and its implementing rules andregulations shall be imposed as follows:
(a) First violation - suspension of one month without pay(b) Second violation - suspension of two months without pay; and(c) Third violation and subsequent violation - suspension of six months without pay
Section 7. Separability Clause - Should any provision of this IRR be subsequentlydeclared invalid or unconstitutional, the same shall not affect the validity and effectivity ofthe other provisions.
sction 8. Repealing Clause - Rules, regulations and issuances which are inconsistentwith these rules are hereby repealed, rescinded or amended accordingly.
Section 9. Effectivity - These rules and regulations shall take effect fifteen (15) days afterit$ publication in the Official Gazette or in at least one (1) newspaper of general circulation.

ALLOCATION OF NEW TEACHER I POSITIONS FORSY 2013-2014
We are pleased to inform you that the Department of Budget and Management (DBM)has granted the authority for the creation of Sixty One Thousand Five Hundred Ten(61,510) new Teacher I positions for kindergarten, elementary and secondary level, SY2013-2014. The effectivity date of the NOSCA shall not be earlier than April 1, 2013.
In this connection, attached are the allocation of Teacher I items for the region b%division and by legislative district. Electronic copies of the deployment report by schoolshall be c-mailed by the Office of Planning Service (OPS) to the Regional Planning Unit(RPU) which shall then be forwarded to the division offices. The same report wasforwarded to DBM Central Office to serve as their basis for the approval of the creationof the items as well the basis of the DBM Regional Offices for the issuance ofSARO/NCA and NOSCA. Kindly note that we have prioritized the creation of items formultigrade schools, elementary schools still offering multigrade classes due to lack ofteacher positions and annexes or newly-opened schools of which the items are deployedto its mother/main school.
It is earnestly requested that the deployment report should remain "as is" for both levels,i.e, no changes/realigments in the deployment report shall be made. Finally, we wouldlike to request for a copy of NOSCA once the cited deployment report has beenapproved by DBM-RO.

As provided in the Revised Flowchart on the Allocation and Deployment of New TeacherItems (DepEd Order No. 9, s. 2011), you are required to inform the relevant stakeholders(legislators and local government officials) of the number of items allocated to (heirspecific areas or districts after the receipt of this memorandum.
