Road Maintenance Agreement Privately Maintained Portion of Pine Tree Lane
1. The terms and conditions of this agreement shall be applicable to the
privately maintained portion of Pine Tree Lane, commencing at the end of
County Road at the bottom of the hill near the mailboxes to the end of White
Tail Hills property line. Situated within, White Tail Subdivision, Trout Creek, Sanders County, Montana.
2. Owners of Plat J 528 T24 R31 COS 1609 and lots 3, 4 &5 on Pine Tree Lane.
3. Owners ofparcels Lot 1 528 T24 R31 COS 3334 and Lots 1-4 527 T27 T24 R 31

~Road at the subdivision property line as described above shall pay
their share of costs beginning at the property line where they egress onto said
road known as Pine Tree Lane
4. Any additional parcels gaining access to the Pine Tree Privately Maintained
road will be bound by all terms and conditions of this agreement.
5. AU parcels shaU share equally, using a pro-rata basis between the parcel
owners sharing access to the above mentioned Road, in the maintenance1
improvements and snow removal of the portion of the road they use.
6. Maintenance and snow removal shall be performed, and a lien attached to
any tot for payment for work done when a simple majority of tot owners
agree to have maintenance or improvements done. For these purposes, each
lot has one vote. Major improvements would require complete agreement of all owners.
7. tn the event a parcel owner or his agent or business or professional invitee
causes damages to the road other than ordinary wear and tear, said Parcel
owner shalt be required to repair such damage & bear the cost exclusively.
8. This agreement shall be perpetual and shall encumber and run with the land
as long as the road remains privately maintained and shall be binding upon
the parties, their respective heirs, executors, administrators and assigns. 9. This Agreement may be amended only by a two-thirds majority consent of an
parcel owners. Each parcel has one vote.
