100 concrete steps. Modern state for all. I. ESTABLISHMENT OF APROFESSIONAL STATE APPARATUS 1. MODERNIZATION OF THE PROCEDURE OF ADMISSION TO THE CIVIL SERVICE Admission to the civil service must start FROM SUBORDINATE POSITIONS. 2. Selection of candidates for subordinate positions and their further career promotion must be implemented through a COMPETENCY-BASED APPROACH 3. CENTRALIZATION OF THE SELECTION PROCEDURE for the first-employed for the civil service through STRENGTHENING THE ROLE OF THE AGENCY OF THE REPUBLIC OF KAZAKHSTAN FOR CIVIL SERVICE AFFAIRS AND FIGHTING CORRUPTION. Implementation of a three-stage system of selection. 4. MANDATORY PROBATIONARY PERIOD for the first-employed for the civil service through 3 + 3 FORMULA (midterm

control of compliance after three months and after six months respectively). 5. INCREASE of salary for civil servants depending on the results of work. 6. TRANSITION TO THE RESULTS-BASED SALARY. For civil servants – implementation of individual annual plans; for state agencies – implementation of strategic plans; for ministers and akims – special indicators for quality of public services, standard of living, attracting investments; for members of the Government – integral macroeconomic indicators. 7. Implementation of REGIONAL ADJUSTMENT FACTORS TO OFFICIAL SALARIES of civil servants. 8.MANDATORY PROVISION OF DUTY HOUSING for rotated civil servants for the period of duty WITHOUT THE RIGHT OF PRIVATIZATION. 9. INTRODUCTION OF LEGISLATION ON THE SYSTEM OF REGULAR TRAINING FOR CIVIL SERVANTS, professional development courses at least once in three years. 10. TRANSITION TO THE COMPETITIVE SELECTION FOR CAREER PROMOTION OF CIVIL SERVANTS. Strengthening the principle of meritocracy by appointing for higher positions of ‘ә’ corps only through competition among civil servants of lower positions. 11. Admission to civil service of FOREIGN MANAGERS, CERTAIN EXPERTS FROM PRIVATE SECTOR AND CITIZENS OF THE REPUBLIC OF KAZAKHSTAN – STAFF OF INTERNATIONAL ORGANIZATIONS. Their appointment can be made on the basis of special requirements and separate list of positions. This step makes civil service an open and competitive system.

12. IMPLEMENTATION OF NEW ETHICS RULES. Development of a new Ethics code of civil service. Introduction of a Commissioner on ethics position. 13. STRENGTHENING THE FIGHT AGAINST CORRUPTION, including development of the new legislation. Establishment of under the Agency for Civil Service Affairs and Fighting Corruption a special unit for systemic prevention and proactive measures against offences related to corruption. 14. Adoption of a NEW LAW ON CIVIL SERVICE, applicable to servants of all state agencies, including law enforcement. 15. Conduction of COMPREHENSIVE PERFORMANCE APPRAISAL OF CURRENT CIVIL SERVANTS after the adoption of a new law on civil service, strengthening of qualification requirements and introducing a new system of payment. II. ENSURING THE RULE OF LAW 16. OPTIMIZATION OF INSTANCES OF THE JUSTICE SYSTEM TO FACILITATE ACCESS OF CITIZENS TO JUSTICE. Transition FROM THE FIVE-LEVEL JUSTICE SYSTEM (first instance, appellate, cassational, supervisory and second supervisory) TO THE THREE-LEVEL (first, appellate, cassational). 17. MAKING QUALIFICATIONAL REQUIREMENTS AND CANDIDATES SELECTION MECHANISMS for judicial posts more strict. Mandatory norm - 5 year experience of participating in judicial processes. Implementation of the case study system tests to assess professional skills and capacities. Candidates for judicial posts will have an ANNUAL INTERNSHIP IN COURTS with granted scholarships. After the completion of an annual internship judges will have a ONE-YEAR PROBATIONARY PERIOD. 18. Separating the INSTITUTE OF JUSTICE FROM THE STRUCTURE OF THE ACADEMY OF PUBLIC

ADMINISTRATION IN ORDER TO strengthen links between learning and judicial practice. This Institute will function under the Supreme Court and ensure professional development of judges on a regular basis. 19. STRENGTHENING ACCOUNTABILITY OF JUDGES. Development of a NEW CODE OF ETHICS FOR JUDGES, on which basis citizens can appeal against actions of judges in a specially established JUDICIAL BOARD under the Supreme Court of the country. 20. Mandatory IMPLEMENTATION OF AUDIO AND VIDEO RECORDING OF ALL JUDICIAL PROCESSES. A judge must not have a possibility to stop recording and edit materials of audio and video recording. 21. Extension of the scope of jury trials application. Legal definition of the category of criminal cases, according to which a JURY TRIAL MUST BE MANDATORY. 22. ENSURING BALANCE BETWEEN THE PROSECUTION AND THE DEFENSE IN COURTS through the stage-by-stage transfer of mandate on THE AUTHORIZATION OF ALL INVESTIGATION ACTS WHICH LIMIT CONSTITUTIONAL RIGHTS OF A PERSON AND A CITIZEN to the investigating judge. 23. Establishment of separate INVESTMENT JUDICIAL PROCEEDINGS. Organization in the Supreme Court an INVESTMENT BOARD to examine disputes where major investors take part in. 24. Establishing in Astana an INTERNATIONAL ARBITRATION CENTRE AIFC based on the experience in Dubai. 25. Establishing an International council under the Supreme Court of the Republic of Kazakhstan for implementing BEST INTERNATIONAL STANDARDS WITH PARTICIPATION OF PROMINENT FOREIGN JUDGES AND LAWYERS. The Council

IMPROVEMENT OF THE SELECTION SYSTEM of police officers on the basis of a COMPETENCY-BASED APPROACH. Implementation of a special testing system for candidate police officers and police officers in service to assess personal qualities and professional skills. 29. Ensuring transparency of police through establishment of the SYSTEM OF PUBLIC COUNCILS ON EXAMINING CITIZENS APPEALS against police officers acts, which violate norms of ethics. THE STATUS AND MANDATE OF PUBLIC COUNCILS WILL BE ENSHRINED IN THE LEGISLATION. 32. INTRODUCING AGRICULTURAL LAND TO THE MARKET in order to use it effectively. Introducing amendments to the LAND CODE AND OTHER LEGAL ACTS. 36. Facilitating the Procedure of CHANGING THE PURPOSE FOR WHICH THE LAND IS TO BE USED. Regular monitoring of agricultural land use. Transfer of all unused lands to the STATE FUND FOR FURTHER PRIVATIZATION. 37. Optimization of tax and customs policies and procedures. V. ESTABLISHING AN ACCOUNTABLE STATE 91. TRANSITION OF STATE GOVERNANCE TO RESULT-ORIENTED STATE GOVERNANCE within standardized and minimal procedures of monitoring, assessment and control. A disciplinary over sight system should be based only on control of achieving target indicators. ALL PROCEDURAL TASKS AND INTERIM OVERSIGHT SHOULD BE ABOLISHED. State agencies will have independence in their activities aimed at achieving the set target indicators. 92. ESTABLISHING COMPACT STATE PLANNING SYSTEM, REDUCING STATE PROGRAMS, ABOLISHING SECTORIAL PROGRAMS based on integration of certain sectorial programs into state programs as well as into STRATEGIC PLANS of state agencies. REDESIGNING STRATEGIC PLANS and territorial development programs in terms of key target indicators. 93. Introduction of a new system for auditing and assessing state apparatus work. 96. Ensuring ONLINE access to STATISTICAL DATA BASES OF CENTRAL STATE AGENCIES. All budget and consolidated financial reports, results of external assessment of state service quality, reports on implementation of republican and local budgets WILL BE PUBLISHED. 97. EMPOWERMENT OF CITIZENS FOR PARTICIPATING IN THE DECISION-MAKING PROCESS through development of self-regulation and local self-governance. TRANSFER OF FUNCTIONS NOT TYPICAL OF STATE TO COMPETITIVE ENVIRONMENT and self-regulated organizations. The government will be compact due to reducing functions that are not typical of state and excessive. 98. At the level of a rural area, auyl, village, township, city of district subordination, INDEPENDENT BUDGET OF LOCAL GOVERNMENT will be introduced. Legal establishment of the status and POWERS OF PUBLIC COUNCILS will enhance transparency of state decision-making. 100. Establishment of a state CORPORATION “GOVERNMENT FOR CITIZENS” THAT WILL BECOME A SINGLE PROVIDER OF STATE SERVICES based on the example of Canada Service in Canada and Centre link in Australia. The state corporation integrates all public service centers into a single system. Citizens of Kazakhstan will receive ALL STATE SERVICES IN ONE PLACE. International certification of state services according to ISO 9000 QUALITY MANAGEMENT STANDARDS.

IMPLEMENTATION MECHANISMS - The NATIONAL COMMISSION on Modernization under the President of state is promptly established, it has FIVE WORKING GROUPS including national and foreign experts. - National commission should implement COHERENT GOVERNANCE OF STEP-BY-STEP IMPLEMENTATION OF FIVE INSTITUTIONAL REFORMS. It will provide for effective interaction of state agencies, business sector and civil society. - National Commission should adopt conceptual decisions and define concrete action plans, its proposals will be approved by the President of the state. In order to implement the approved decisions the Parliament will promptly adopt laws and the Government – decisions. - Efficiency of implementing key initiatives by ministers and akims will be thoroughly MONITORED BY THE NATIONAL COMMISSION. - It is necessary to establish an INTERNATIONAL CONSULTATIVE COUNCIL WITH RESPECTED FOREIGN EXPERTS under the National Commission. This council will develop recommendations and implement INDEPENDENT SYSTEM MONITORING OF RESULTS of reforms implementation. - THE OFFICE OFTHE PRIME MINISTER OF THE REPUBLIC OF KAZAKHSTAN should be defined as the working body of the National Commission.
