The Islamic Sharee`ah forbids adultery and considers it amongst the most indecent acts. It imposes severe punishments for committing it or for wrongly accusing others of committing it without providing clear evidence. The Islamic Sharee`ah also puts obstacles to prevent adultery and closes all the paths that lead to it.

The researcher wishes to discuss the Islamic position on the issue of khulwah; when is it considered a crime punishable by the Islamic Law; what is its punishment; and what is the standpoint of the judicial law and the Committee for Enjoining the Good and Forbidding Evil. These points constitute the topic of the thesis. Importance of the Research

The importance of the topic of the research lies in the fact that khulwah was not fundamentally and practically studied in the centers of the Committee for Enjoining the Good and Forbidding Evil and in the legal courts in the city of Riyadh. The reason could be that it was not considered a crime that deserved to be studied since it was hidden and rare. However, since it has become noticeable by the Committee and has worried security, the researcher hopes that his thesis can contribute to clarifying this crime and its causes and effects, its legal punishment, its prevention, and its handling by the specialized sectors in the Kingdom of Saudi Arabia. It is worth noting that the researcher worked for the Committee for Enjoining the Good and Forbidding Evil for some years, so his research is based on experience and practice. Goals of the Research

How can it be prevented ? 5. What is the legal proof to incriminate it? What is the punishment? 6. Did the Committee for Enjoining the Good and Forbidding Evil deal with

khulwah ? 7. Are there any cases of khulwah in the Saudi courts? How are they dealt with?

Methodology of the Research The research has two aspects: First: The Theoretical Aspect The researcher followed the comparative analytical methodology in studying the khulwah and its punishment from a jurisprudential perspective. Second: The Practical Aspect: The researcher presented the rulings of both the Committee and the judicial law on khulwah based on ten cases dealt with by the Committee and ten cases by the courts between 1419 and 1424H. Results

1. In the legal terminology, khulwah refers to the situation where a man and a woman whom he can legally marry are secluded in a place where no one can see them.

2. A man being alone with a beautiful boy who is not a relative is just as criminalized.

3. khulwah has many causes. The researcher mentioned twelve main causes. 4. Khulwah has bad effects on both the man and the woman and destructive effects

on the society. 5. Khulwah leads to adultery. 6. The Islamic Sharee`ah has established all the preventive measures to prevent

khulwah and its causes and effects. 7. It is possible to restraint khulwah if both individuals and institutions work

together. 8. The Committee for Enjoining the Good and Forbidding Evil is doing a good job

in this regard. 9. The legal courts deal with many cases of khulwah and determine their own

punishment for it.
