Umum

General

• P e n g e l o l a K a w a s a n SCBD wajib memberikan p e l a y a n a n d a l a m h a l pengelolaan, perawatan, p e m e l i h a r a a n , d a n p e n i n g k a t a n Fa s i l i t a s Umum di Ruang Umum SCBD kepada Pemilik Lot, Pengguna atau External Provider yang melakukan kegiatan di Kawasan SCBD.

•The SCBD Estate Management shall provide services concerning the management, preservation, maintenance and improvement of Public Facilities in SCBD Public Spaces to the Lot Owners, Users or External Providers carrying out activities in SCBD.

UMUM GENERAL1

•Pengelola Kawasan SCBD berhak dan berwenang menetapkan besaran Iuran Pengelolaan Kawasan (IPK), Uang Jaminan Iuran Pengelolaan Kawasan dan/atau Uang Jaminan Kegiatan kepada Pemilik Lot, Pengguna atau External Provider yang melakukan kegiatan-kegiatan di dalam Kawasan SCBD sesuai dengan ketentuan dalam Peraturan Kawasan SCBD. IPK dapat disesuaikan secara berkala oleh Pengelola Kawasan SCBD.

•Pemilik Lot, Pengguna atau External Provider yang melakukan kegiatan di dalam Kawasan SCBD wajib membayar secara tepat waktu IPK, Uang Jaminan IPK, dan/atau Uang Jaminan Kegiatan sesuai Perjanjian Pengelolaan Kawasan yang ditandatanganinya dengan Pengelola Kawasan SCBD.

•The SCBD Estate Management is entitled and authorized to determine the amount of the Estate Management Fees (IPK), Estate Management Fees Deposit (IPK Deposit) and/or Activity Deposit to the Lot Owners, Users or External Providers carrying out activities in SCBD as stipulated in the provisions of the SCBD Estate Regulations. IPK can be periodically adjusted by the SCBD Estate Management.

•The Lot Owners, Users or External Providers carrying out activities in SCBD must pay the IPK, IPK Deposit, and/or Activity Deposit in a timely manner as stipulated in the Estate Management Agreement that is signed with the SCBD Estate Management.

“Dalam hal Pemilik Lot, Pengguna dan External Provider tidak melakukan pemulihan terhadap ketidaksesuaian/ketidakpatuhan tersebut, maka Pengelola Kawasan SCBD dapat mengenakan sanksi-sanksi.”

•Besaran IPK dan Uang Jaminan IPK ditetapkan berdasarkan total luas lantai masing-masing bangunan yang ada di dalam Lot atau ukuran-ukuran lain yang mencerminkan proporsi penggunaan Fasilitas Umum Kawasan SCBD dalam pelaksanaan kegiatannya, dan “beban” yang dikontribusikan dari Lot atau Ruang Umum Kawasan SCBD akibat pelaksanaan kegiatan.

•Uang Jaminan IPK adalah suatu dana yang wajib diberikan oleh Pemilik Lot atau Pengguna Kawasan SCBD kepada Pengelola Kawasan SCBD sebagai jaminan yang dapat digunakan apabila terjadi hal-hal yang terkait namun tidak terbatas pada cidera janji terhadap Perjanjian Pengelolaan Kawasan SCBD dan/atau ketidaksesuaian/ketidakpatuhan Pemilik Lot atau Pengguna Kawasan SCBD atas ketentuan-ketentuan dalam Peraturan Kawasan SCBD. Uang Jaminan IPK akan digunakan untuk memulihkan setiap cidera janji terhadap Perjanjian Pengelolaan Kawasan SCBD dan/ atau ketidaksesuaian/ketidakpatuhan oleh Pemilik Lot atau Pengguna tersebut di atas, serta apabila ada untuk memperbaiki setiap kerusakan Fasi l i tas Umum Kawasan SCBDakibat kegiatan yang dilaksanakannya.

•Pemilik Lot atau Pengguna wajib melakukan pembayaran atas tambahan Uang Jaminan IPK sekaligus dan seketika sejak diminta oleh Pengelola Kawasan SCBD dalam hal :• Terdapat kenaikan IPK yang berakibat pada kenaikan

uang jaminan; atau • Terdapat perubahan tahapan kegiatan pada Lot; atau

• Uang Jaminan IPK yang ada telah digunakan untuk memulihkan kewajiban Pemilik Lot atau Pengguna yang tidak dipenuhi oleh Pemilik Lot atau Pengguna.

•Uang Jaminan Kegiatan adalah suatu dana yang wajib diberikan oleh Pemilik Lot, Pengguna atau External Provider kepada Pengelola Kawasan SCBD sebagai jaminan atas kegiatan-kegiatan yang dilakukannya di dalam Lotnya atau di Ruang Umum Kawasan SCBD, dan dapat digunakan oleh Pengelola Kawasan SCBD untuk memulihkan setiap cidera janji terhadap Perjanjian Pengelolaan Kawasan SCBD dan/atau ketidaksesuaian/ketidakpatuhan terhadap Peraturan Kawasan SCBD, dan/atau memperbaiki setiap kerusakan Fasilitas Umum Kawasan SCBD yang disebabkan oleh kegiatan-kegiatan tersebut. Uang jaminan ini akan dikembalikan kepada Pemilik Lot, Pengguna atau External

•The amount of the IPK and the IPK Deposit are determined based on the total floor area of each buildings in the SCBD Lots or other calculations that indicate the proportion of the Public Facility of SCBD utilization in the activity, and the “imposed load” from the SCBD Lots or SCBD Public Spaces as a result of the activity.

•Estate Management Fees Deposit or IPK Deposit is a fund that the Lot Owners or Users of SCBD must pay to the SCBD Estate Management as a collateral for any occurrence concerning but not limited to a default on the SCBD Estate Management Agreement and/or non-conformity/non-

compliance by the Lot Owners or Users of SCBD with the provisions of the SCBD Estate Regulations. The IPK Deposit will be used to remedy every default on the SCBD Estate Management Agreement and/or any non-conformity/non-compliance by the Lot Owners or Users referred to above and to repair any damage to the Public Facility of SCBD, if any, resulting from the activity.

•The Lot Owners or Users must settle the additional IPK Deposit immediately and in full upon the request of the SCBD Estate Management in the event of: • An IPK increase resulting in the deposit increase; or

• A change of Activity (Vacant SCBD Lots, Construction/Development Activity, and SCBD Lots Operational Activity) in the SCBD Lot; or

• The existing IPK Deposit has been used to recover any outstanding obligation of the Lot Owners or Users.

•Activity Deposit is a fund that the Lot Owners, Users or External Providers must pay to the SCBD Estate Management as a collateral for the activities carried out in their respective SCBD Lots or in SCBD Public Spaces. The SCBD Estate Management may use the deposit to remedy any default on the SCBD Estate Management Agreement and/or non-conformity/non-compliance with the provisions of the SCBD Estate Regulations and/or to repair any damage to the Public Facility

Provider, tanpa bunga, setelah dikurangi biaya-biaya yang dikeluarkan oleh Pengelola Kawasan SCBD jika ada, untuk memulihkan setiap cidera janji terhadap Perjanjian Pengelolaan Kawasan SCBD dan/atau ketidaksesuaian/ketidakpatuhan terhadap Peraturan Kawasan SCBD, dan/atau memperbaiki setiap kerusakan Fasilitas Umum Kawasan SCBD.

•Besarnya Uang Jaminan Kegiatan yang ditetapkan oleh Pengelola Kawasan SCBD mencerminkan besaran risiko kerusakan Fasilitas Umum di Ruang Umum Kawasan SCBD yang mungkin timbul akibat kegiatan-kegiatan yang dilakukan oleh Pemilik Lot, Pengguna atau External Provider.

•Pengelola Kawasan SCBD sewaktu-waktu dapat mengundang Pemilik Lot, Pengguna dan External Provider, jika terindikasi adanya cidera janji terhadap Perjanjian Pengelolaan Kawasan SCBD dan/atau ketidaksesuaian/ketidakpatuhan atas Peraturan Kawasan SCBD. Dalam hal Pemilik Lot, Pengguna dan External Provider tidak melakukan pemulihan terhadap cidera janji terhadap Perjanjian Pengelolaan Kawasan SCBD dan/atau ketidaksesuaian/ketidakpatuhan atas Peraturan Kawasan SCBD maka Pengelola Kawasan SCBD dapat mengenakan sanksi-sanksi yang diatur dalam Peraturan Kawasan SCBD ini.

•The amount of the Activity Deposit set by the SCBD Estate Management is based on the Risk of damage to the Public Facilities in SCBD Public Spaces as a result of the activities carried out by the Lot Owners, Users or External Providers.

•The SCBD Estate Management at all times may invite the Lot Owners, Users and External Providers, if any default on the SCBD Estate Management Agreement and/or non-conformity/non-compliance with the SCBD Estate Regulations is indicated. The SCBD Estate Management may impose the sanctions as stipulated in this SCBD Estate Regulations for the failure of the Lot Owners, Users and External Providers to remedy a default on the SCBD Estate Management Agreement and/or non-conformity/non-compliance with the SCBD Estate Regulations.

IURAN PENGELOLAAN KAWASAN (IPK) LOTESTATE MANAGEMENT FEES (IPK) FOR THE SCBD LOTS

Berdasarkan Perjanjian Pengelolaan Kawasan dengan Pengelola Kawasan SCBD, Pemilik Lot atau Pengguna wajib membayar IPK-Lot, Uang Jaminan IPK, dan/atau Uang Jaminan Kegiatan.

Based on the Estate Management Agreement with the SCBD Estate Management, the Lot Owners or Users are required to pay IPK-SCBD Lots, IPK Deposit, and/or Activity Deposit.

IPK-Lot akan digunakan oleh Pengelola Kawasan SCBD untuk membiayai pengelolaan, perawatan, pemeliharaan, dan peningkatan Fasilitas Umum di Ruang Umum Kawasan SCBD.

Uang Jaminan IPK, apabila diperlukan, akan digunakan oleh Pengelola Kawasan SCBD untuk memulihkan setiap cidera janji terhadap Perjanjian Pengelolaan Kawasan SCBD dan/atau ketidaksesuaian/ketidakpatuhan terhadap Peraturan Kawasan SCBD oleh Pemilik Lot atau Pengguna.

Uang Jaminan Kegiatan, apabila diperlukan, akan digunakan oleh Pengelola Kawasan SCBD untuk memulihkan setiap cidera janji terhadap Perjanjian Pengelolaan Kawasan SCBD dan/atau ketidaksesuaian/ketidakpatuhan terhadap Peraturan Kawasan SCBD, dan/atau memperbaiki setiap kerusakan Fasilitas Umum Kawasan SCBD yang disebabkan oleh kegiatan-kegiatan tersebut.

Setiap pemasangan media promosi di dalam Lot, Pemilik Lot atau Pengguna, selain memperoleh izin dari instansi pemerintah yang berwenang sesuai dengan Peraturan Perundang-undangan yang berlaku di Indonesia, wajib pula mendapat persetujuan dari Pengelola Kawasan SCBD dan membayar IPK-Media Promosi Lot, yang besarannya ditetapkan oleh Pengelola Kawasan SCBD.

The SCBD Estate Management will allocate the IPK-SCBD Lots for the funding of the management, treatment, maintenance and improvement of the Public Facilities in SCBD Public Spaces.

The IPK Deposit will be allocated by the SCBD Estate Management for the remedy of every default on the SCBD Estate Management Agreement and/or non-conformity/non-compliance with the SCBD Estate Regulations by the Lot Owners or Users, if necessary.

The SCBD Estate Management will allocate the Activity Deposit for the remedy of every default on the SCBD Estate Management Agreement and/or non-conformity/non-compliance with the SCBD Estate Regulations by the Lot Owners or Users and/or repair every damage from the activity, if necessary.

In addition to obtaining permit from the Authorized Government Agency in accordance with the prevailing Laws and Regulations in Indonesia, the Lot Owners or Users must obtain the approval of the SCBD Estate Management and pay the IPK-SCBD Lots Promotional Media for every promotional media installation in the SCBD Lots. The amount of the IPK is determined by the SCBD Estate Management.

b. The amount of IPK Deposit-Construction/Development is determined as follows:

c. The amount of Construction/Development Activity Deposit is determined by the SCBD Estate Management based on the potential damage from the relevant Construction/Development activity.

2.1.4 Media Promosi di dalam Lota. Pemilik Lot atau Pengguna wajib membayar IPK-

Media Promosi Lot kepada Pengelola Kawasan SCBD untuk setiap pemasangan media promosi atau papan informasi yang memuat materi komersial di dalam Lot.

b. Besar IPK-Media Promosi di dalam Lot ditetapkan oleh Pengelola Kawasan SCBD.

2.2 IURAN PENGELOLAAN KAWASAN (IPK) RUANG UMUM KAWASANPemilik Lot, Pengguna atau External Provider wajib membayar IPK-Ruang Umum Kawasan untuk setiap kegiatan yang dilakukan di Ruang Umum Kawasan SCBD kepada Pengelola Kawasan SCBD. Besaran IPK-Ruang Umum Kawasan ditetapkan oleh Pengelola Kawasan SCBD sesuai dengan jenis kegiatannya di Ruang Umum Kawasan SCBD.

2.2.1 EventPemilik Lot, Pengguna atau External Provider wajib membayar IPK untuk setiap event yang dilaksanakan di dalam Ruang Umum Kawasan SCBD berdasarkan Perjanjian Pengelolaan Kawasan SCBD. Besarnya IPK dan Uang Jaminan Kegiatan Event ditetapkan oleh Pengelola Kawasan SCBD sesuai dengan jenis kegiatannya.

2.2.2 Media Promosia. Pemilik Lot atau Pengguna wajib membayar

IPK-Media Promosi Ruang Umum Kawasan kepada Pengelola Kawasan SCBD untuk setiap pemasangan media promosi atau papan informasi yang memuat materi komersial di dalam Ruang Umum Kawasan SCBD.

b. Besar IPK-Media Promosi di Ruang Umum Kawasan SCBD ditetapkan oleh Pengelola Kawasan SCBD.

2.1.4. Promotional Media in the SCBD Lotsa. The Lot Owners or Users must pay the IPK-SCBD

Lots Promotional Media to the SCBD Estate Management for every commercial promotional media or information board installation in the SCBD Lots.

b. Amount of IPK-SCBD Lots Promotional Media is determined by the SCBD Estate Management.

2.2 ESTATE MANAGEMENT FEES (IPK) FOR SCBD PUBLIC SPACES The Lot Owners, Users or External Providers must pay the IPK-SCBD Public Spaces for every activity carried out in SCBD Public Spaces to the SCBD Estate Management. The amount of the IPK-SCBD Public Spaces is determined by the SCBD Estate Management based on the type of activity carried out in SCBD Public Spaces.

2.2.1 EventThe SCBD Estate Management Agreement requires the Lot Owners, Users or External Providers to pay an IPK for every Event organized in SCBD Public Spaces. The SCBD Estate Management determines the amount of the IPK and Event Deposit based on the type of activity.

2.2.2 Promotional Mediaa. The Lot Owners or Users must pay IPK-SCBD

Public Spaces Promotional Media to the SCBD Estate Management for the installation of every promotional media or information board that contains commercial material in SCBD Public Spaces.

b. The amount of the IPK-SCBD Public Spaces Promotional Media is determined by the SCBD Estate Management.
