4. Statement of .Facts:
4.1 Dr. Bhandari presented an application for a license to practice medicine in the
State of Tennessee to the Tennessee Board of Medical Examiners ("TBME" or the "Board") in
January of 2019. (See attached Exhibit A.)
4.2 By letter dated March 6, 20 I 9, the Board responded to Dr. Bhandari's application
with a request for a personal interview on March 19, 2019. (See attached Exhibit B).
4.3 The letter states that the interview is a prerequisite for licensure because Dr.
Bhandari "has not completed 3 years of a US residency training program in one discipline and is
not currently ABMS Board Cettified". (Id.)

4.4 On March 19, 2019, Dr. Bhandari appeared before the Board for a personal
interview, at which time the Board tabled his application to allow him to file a Petition for
Declaratory Order requesting that the Board find his participation in and completion of three (3)
fellowship programs to be an equivalent to the training required under T.C.A. §63-7-
207(a)(2)(F).
4.5 Dr. Bhandari has applied for a Tennessee medical license under T.C.A. § 63-6-
207(a)(2) and the provisions of TBME Rule 0880-02-.04, which detail the medical licensure
process for international medical school graduates. Dr. Bhandari has provided all infom1ation
required to meet each element of the statute and regulatory rule. In particular, Ruic 0880-02-
,04(5) requires that the applicant "submit evidence satisfactory to the Board of successful
completion of a three (3) year residency program approved by the American Medical
Association or its extant accreditation program for medical education or its successor," to include
"a notarized certificate of completion and a letter attesting to satisfactory completion issued by
the director of the program which shows that the residency was completed in one (I) discipline."
4.6 As demonstrated by the documentation provided in Collective Exhibits C and D,
attached hereto, Dr. Bhandari has met and exceeded this requirement. See Collective Exhibits C
and D, which include: (I) certified copy of a Ce1tificate of Faithful and Satisfactory Completion
of a lwo and a half (2 ½) year fellowship as a Senior Fellow in Hand and Microsurgery from The
University of Louisville School of Medicine, from January 11, 2016 to June 30, 2018 (Collective
Exhibit C); and (2) letters from Sonia Alvarez, M.D., FACS, Associate Professor of the
Depatiment of Plastic Surgery at the University of Tennessee Health Science Center College of
Medicine and from Robe1i D. Wallace, M.D., Professor and Chair of the Department of Plastic
Surgery at the University of Tennessee Health Science Center of Medicine evidencing Dr.
Bhandari's current participation in and anticipated successful completion of a one (I) year

fellowship in Pediatric Craniofacial surgery at the University of Tennessee Health Science
Center College of Medicine in June of 20 l 9 (Collective Exhibit D).
4.7 Rule 0880-02-.04(5) also provides that an applicant who holds a specially board
certification may be deemed to have satisfied the aforementioned residency requirement "if the
specialty board is recognized and is a member of the American Board of Medical Specialties."
There is no specialty board ce1tification available to Dr. Bhandari in his chosen specialty of
plastic surgery, rendering the "deeming" language of Rule 0880-02-.04(5) not applicable to this
Petition. The Board's rules do not require specialty board certification, although Dr. Bhandari
was ce1tificd as a Master of Plastic and Reconstructive Surgery in India, his country of origin, in
July of 2014. See Collective Exhibit C.
4.8 Dr. Bhandari holds a full unrestricted medical license in the state of Ohio (Ohio
license number 35.134122).
4.9 Dr. Bhandari holds a full and restricted medical license in the state of Kentucky
(Kentucky license number 51853).
5. Requested Relief. Dr. Bhandari respectfully requests that the Board grant this Petition,
convene a contested case hearing and, upon presentation of evidence and testimony from Dr.
Bhandari and his witnesses, find that Dr. Ahandari has met the criteria under its Rule 0880-02-
.04 and T.C.A. § 63-6-207(a)(2), and accordingly, issue Dr. Bhandari a license to practice
medicine in the State of Tennessee.
6. Citation to Statute, Rule, or Order That is the Subject of this Petition .
6.1 Board Rule 0880-02- .07( 4) provides: "Any applicant who has successfully
complied with all requirements of the rules governing the licensurc ... process for the type of
licensure .. . applied for shall be issued a license ... to practice medicine in Tennessee," with
certain exceptions.

6.2 The Board has requested more information in support of Dr. Bhandari's
application for a Tennessee medical license because he has "not completed 3 years of a US
residency training program in one discipline." (Exhibit I3).
6.3 The Policies and Procedures of The Accreditation Council for Graduate Medical
Education (ACGME) apply to the broad continuum of education and training programs available
to physicians following undergraduate medical education and embraces residencies and
fellowships . (ACGME Policies and Procedures, February 6, 2016}. The ACGME defines
"graduate medical education" as a "period of didactic and clinical education in a medical
specialty following undergraduate medical education and which prepares physicians for the
independent practice of medicine in that specialty." (ACGME Glossary of Terms, July 1, 2013).
A "Residency" is defined as "a program accredited to provide a structured educational
experience designed to conform to the Program Requirements of a particular specialty." (Id.) A
"Resident" is defined as "any physician in an accredited graduate medical education program,
including interns, residents and fellows." (id.) The ACGME defines "Fellowship"
interchangeably with "Subspecialty Program" and "Fellow" interchangeably with "Subspecialty
Resident." (Id.)
6.4 Since successfully completing medical school, becoming licensed to practice
medicine and obtaining a specialty certification in plastic and rcconstructive surgery in India, Dr.
Bhandari has engaged in a significant course of subspecialty training in plastic surgery in the
Unitt:<l States, including a 30-month fellowship in Hand and Microsurgery from the Christine M.
Kleinert Institute at the University of Louisville, and a 12-month fellowship in Pediatric
Craniofacial Surgery from the Department of Plastic Surgery at the University of Tennessee
I lealth Science Center College of Medicine.

6.5 Dr. Bhandari respectfully submits that his post-graduate education and training in
U.S. ACGME accredited programs meets or exceeds the educational and training criteria under
the statute and the Board's Rules. Dr. Bhandari, therefore, respectfully petitions the Board under
Rule 0880-02-.1 l (7) and Division of Health Related Boards Rule 1200-l 0-01-.11 for a
Declaratory Order finding compliance with all requirements and granting his application for a
Tennessee Medical License.
6.6 As of June 2019, Dr. Bhandari will have completed more than 3 years of post-
graduate training in sub-specialty medical fellowships at the University of Louisville and at the
University of Tennessee Health Science Center College of Medicine in addition to the extensive
experience and training he received in India and the Netherlands before moving to Tennessee.
Dr. Bhandari respectfully submits that having met all requirements for issuance of a medical
license, and absent any contrary finding by the Board, the Board should grant his application and
issue him a medical license fmihwith under Board Rule 0880-02-.07(4).
7. Effect on Dr. Bhandari of Board's Failure to Issue License. Dr. Bhandari is applying
for a Tennessee medical license because he is under "serious consideration" for a position as
Assistant Professor in the Department of Plastic Surgery at the University of Tennessee Health
Science Center College of Medicine, where he will f:ill an important role focusing on hand
surgery per Dr. Robert Wallace, the Chair of UTHSC's Department of Plastic Surgery (Exhibit
D). According to Dr. Wallace, this is an area of the specialty that is "extremely difficult" to fill
at the faculty level and there is a need for a surgeon of his training and skill at UTHSC. Id. Dr.
Bhandari will be unable to fill that position unless and until he is issued a license to practice
medicine in the State of Tennessee.
WHEREFORE, Petitioner Panambur Laxminarayan Bhandari, M.D. respectfully
requests that the Board grant this Pt:tition for Declaratory Order and convene a contested case

hearing at its May 2019 meeting for the purpose of hearing proof from Dr. Bhandari that will
establish his compliance with the requirements for issuance of a medical license in Tennessee.

It is with great interest and enthusiasm that I arn applying for the physician licensure at Tennessee state.
I did my medical school at Kasturba Medical College, Manipal University, India. Manipal university is among the top ten universities in India, recognized as "Institute to Eminence" by Government of India. After rny medical school, I did ten years of postgraduate medical training and I am currently in my 11th year of training.
After completion of intern year at Kasturba medical college, I did three years of General surgery and three years of Plastic surgery residencies in Calicut medical college, India. Calicut medical college is among the largest public hospitals in India and I had the opportunities to perform a large number of cases across the length and breadth of Plastic surgery and Hand surgery.
Following this, I went to Netherlands for a fellowship in Facial Plastic surgery under Dr. van der Meulen, the president of Dutch association of Facial Plastic surgeons. Later I went to Kleinert Institute, University of Louisville, KY for training in Hand and Microsurgery- where I completed two and a half year of high quality training. Kleinert institute is amongst the most sought after fellowship programs, being amongst the largest and the oldest. Trainees come from all over the world to get training here. I received extensive and comprehensive training in hand and upper extremity surgery including hand trauma, occupational injuries, arthritis, neuropathy, replantation and revascularization surgery.
Currently I am in University of Tennessee, department of Plastic Surgery as a fellow in Pediatric Cranlofaclal surgery. All me residencies and fellowships have been in high volume centers giving me wide clinical exposure and rich surgical experience. I have a cumulative experience of over 7000 surgeries and treating over 30,000 patients. I have attached my surgical logs from Plastic surgery residency and Hand surgery fellowship for your reference. I have also attached certificates of my residencies and fellowships.
I humbly request you to consider my application and grant me the waiver. It would be an honor for me to serve the people of the Tennessee at the University of Tennessee, Memphis and associated hospi1als by offering my expertise in Hand Surgery. Currently, there is no Plastic surgery- Hand surgery faculty at UT- Plastic Surgery department and it would be my privilege to establish my practice here.

I am writing this letter regarding T ,axminarayan Bhandari, MD, current fellow in our pediatric craniofacial fellowship program at the University of Tennessee Health Science Center. Dr. Bhandari is applying for licensure as a physician. Dr. Bhandari will complete a one-year fellowship in pediatric craniofacial surgery June 30, 2019 after completing an thirty month fellowship in hand surgery with Kleinert Institute at the University of Louisville , Kentucky and his plastic surgery residency in India. Due to state to state medical license requirements, Dr. Bhandari has accepted a position in Kentucky in July 2019. Should he be granted a Tennessee medical license, he would be under serious consideration for a faculty position in hand surgery with our department. This is an area of our specialty that is extremely difficult to fill at the faculty level. Several attempts have been made to fill this position with no success. There is severe need for a hand surgery faculty in
our department.
Dr. Bhandari has performed in an outstanding manner. I have known Lax for approximately seven months and can state that his professional judgment, knowledge, ethical and moral character are above reproach. Faculty within our department holds him in high regard as well and would welcome him as faculty member in the future.
